1.1 Summary

The United States Environmental Protection Agency, National Emission Standards for Hazardous Air

Pollutants (US EPA NESHAP), 40 CFR Part 61 - Nov. 20, 1990, requires an owner or operator of a demolition or renovation project to thoroughly inspect the affected facility or part of the facility where the demolition or renovation operation will occur for the presence of asbestos-containing materials

(ACM) prior to the commencement of that project.

This inspection report was requested by Mr. Richard McPhee with Spees Designs Build.

The purpose of the inspection was to comply with US EPA NESHAP requirements and the San

Joaquin Valley Air Pollution Control District (SJVAPCD) which has jurisdiction for this project site to determine if asbestos containing materials or lead-based paint are present which may be impacted during the upcoming Elevator Replacement Project at Building 32 of the Fresno Veterans Affairs

Medical Center (FVAMC) located at 2615 E. Clinton Ave in Fresno, California.

Materials are classified as regulated asbestos containing material (RACM), Category I (CAT-I) or

Category II (CAT-II) ACM, or asbestos containing construction material (ACCM).

LBP, as defined by the USEPA, is paint with a lead concentration of greater than or equal to 0.5% lead by weight.

This is a summary of the report. The report must be read in its entirety, and the reader must review all the detailed information provided in the body of the report prior to making any interpretations, or conclusions pertaining to the information. Any conclusions made by the reader about the information provided in the body of this report which are contradictory or not included in this report are the responsibility of the reader

1.2 Introduction

The survey was conducted in accordance with ATC Group Services LLC (ATC) proposal for a Pre-

Renovation Limited Asbestos and Lead Paint Survey.

The inspection was conducted by Mr. Pablo Platon on March 24, 2021. Mr. Platon is Division of

Occupational Safety and Health (DOSH) Certified Site Surveillance Technician (CSST) and State of

California Department of Public Health (CDPH) certified lead sampling technician under the direction of Mr. Matt Reilly who is a (DOSH) Certified Asbestos Consultant and CDPH certified Lead Inspector/

Assessor.

The purpose of this pre-renovation survey was to locate, inspect, assess, and sample building materials that are expected to be impacted by the renovation activities and determine if they were asbestos-containing materials (ACM), asbestos-containing construction materials (ACCM), or coated with lead-based paint (LBP) or lead-containing paint (LCP). ATC focused sampling efforts on the specific building materials anticipated to be impacted by the Elevator Replacement Project as communicated by Mr. Ryan Gardner General Engineer with FVAMC. This was not a comprehensive survey and did not include any other areas of the building that were not anticipated to be impacted by the planned Elevator Replacement Project in Building 32.

1.2.1 Building Description

Building 32 at the FVAMC is located at 2615 E. Clinton Ave in Fresno, California and has 4 levels that are serviced by the warehouse freight elevator. The building is framed with brick and mortar walls and has metal corrugated ceilings with a concrete foundation. The building components of the elevator

April 2, 2021 ATC Group Services LLC 2 lobby’s on the 4 levels scheduled to be impacted by the renovation consists of drywall and joint compound walls, stucco walls, vinyl base cove, brick and mortar walls, concrete flooring, floor levelling compound, corrugated metal ceilings with fireproofing and fiberglass insulation.

1.3 Survey Methodology

The areas of the Elevator Replacement Project were visually inspected for the presence of building materials that were suspected to contain asbestos or coated with lead-based paint. Bulk samples of suspect ACMs were collected for areas affected by the planned renovation activities and placed into individual containers for transport to a NVLAP-accredited laboratory for analysis. Materials typically known as non-asbestos items (i.e. unpainted glass, metal or wood) were not sampled. Paint chip samples were collected from each unique painted surface and placed into individual containers for transport to an AIHA-accredited laboratory for analysis. Access to the identified renovation functional areas of the building was not limited and all areas that were visually and physically assessable were evaluated as part of this survey.

Prior to collecting any samples, homogenous areas (HAs) were identified. A homogeneous sampling area can be described as one or more areas of material that are similar in appearance and texture and that have the same apparent installation date, appearance and function. Actual number of samples collected from each homogeneous sampling area may vary, based on the type of material and professional opinion of the inspector.

From the list of suspect homogenous materials, a condition assessment was performed for each material on the list. A condition assessment includes evaluating the condition and determining the friability of each material. By definition, “friable” materials are those that can be crumbled or reduced to powder by hand pressure when dry. Each material was then classified as surfacing, thermal system insulation or miscellaneous materials in accordance with USEPA regulations. The materials were then assessed by their condition as good, fair or poor (damaged). Material with localized significant damage was assessed as poor when observed.

ATC did not use any demolition methods to look within enclosed wall or ceiling cavities during this investigation. ATC did include all suspect materials observed in, on, or associated with the areas expected to be impacted by the Elevator Renovation Project included in this report.

1.3.1 Asbestos-Containing Materials Survey

The survey was conducted in general accordance with the US EPA AHERA regulations using a minimum number of 2 samples collected from each HA, which also meets the sampling requirements found in the Occupational Safety and Health Administration (OSHA) Construction regulations, 29 CFR

1926.1101. Bulk samples of the identified materials were collected by physically removing a small portion of the material and placing it in an individual container, such as a zip lock bag. The container is then uniquely labelled and sealed for transport to the analytical laboratory. Samples were handled according to accepted procedures for the collection, packaging, chain-of-custody documentation and transport of bulk samples to the analytical laboratory for analysis using approved methodology.

Actual number of presumed asbestos samples collected from each homogeneous sampling area may vary, based on the type and amount of material, the sampling protocol used listed in Title II of the

“Federal Toxic Substances Control Act” found in 40 CFR Part 763.86, and the professional opinion of the inspector. A site sketch identifying sampling locations and general building details is included as

Appendix A.

1.3.2 Lead-Based Paint Survey

A Limited LBP survey was conducted by ATC of readily accessible building areas potentially impacted by the planned Elevator Replacement Project. The LBP survey was completed and included physical

April 2, 2021 ATC Group Services LLC 3 sampling of paint coatings that were deemed representative of the predominant paint coatings observed within the building. LBP, as defined by the USEPA, is paint with a lead concentration of greater than or equal to 0.5% lead by weight.

Pursuant to American Society for Testing and Materials (ASTM) E 1729-05 sub-section 7.4.2: Using the appropriate cutting tool, paint was scraped down to the substrate within the marked area and collected for analysis. For brick or concrete substrates, the minimum amount needed to completely remove the paint from the substrate was collected. On wood substrates, scraping in the direction of the wood grain was conducted in order to minimize inclusion of the substrate in the collected sample.

Pursuant to ASTM E 1729-05 sub-section 9.2.4: Field data was collected to include a unique sample identifier, the sample location, the sample description, sample component, condition of the paint, color, and estimated square footage of paint coverage. One paint chip sample was collected from each identified unique painted surface. Paint chip sample locations are located on the sample location map in Appendix A.

2 Survey Information and Results

2.1 Asbestos Sampling and Analytical Results

A total of 25 representative bulk samples of suspect ACMs were collected from the survey site on

March 24, 2021. A total of 29 layers were analyzed by the analytical laboratory based on the number of distinct layers (materials) associated with each bulk sample. For example, floor tile and associated mastic may be collected as one bulk sample but are analyzed as two distinct materials by the asbestos laboratory as required by NVLAP accreditation guidelines.

EMSL Analytical Inc. (EMSL) located in San Leandro, California, analyzed the samples by PLM in accordance with the USEPA “Method for Determination of Asbestos in Bulk Building Materials”

(EPA/600/R93/116, July 1993). None of the materials sampled during this survey were submitted for additional analysis. EMSL is accredited to perform PLM analysis through the AIHA Laboratory

Accreditation Program (AIHA LAP) and NVLAP (200945-0).

Current USEPA regulations designate a result of greater than 1% asbestos as ACM, and DOSH regulations designate a result greater than 0.1% asbestos as ACCM. The results of testing for asbestos during this survey indicate no asbestos is present in any of the building materials tested.

Any building materials which are considered “suspect” for containing asbestos which have not been identified in this report must be assumed to contain asbestos in amounts >1% until properly investigated and/or tested.

For a list of materials found not to contain asbestos please see Appendix B of this report.

The US EPA NESHAP uses the term regulated asbestos-containing materials (RACM), Non-Friable

Category I (CAT I) or Non-friable Cat II (CAT II). Please note, in California, materials containing greater than one-tenth of one percent (>0.1%) asbestos are defined as asbestos-containing construction material (ACCM) and are regulated by the California DOSH. Copies of the asbestos sample laboratory analytical report and corresponding chain-of-custody forms are included in

Appendix B. Inspector accreditations are provided in Appendix C.

3 Conclusions and Recommendations

3.1 Asbestos-Containing Materials

The results of laboratory testing during the pre-renovation asbestos survey conducted in the project areas expected to be impacted by the Elevator Replacement Project in Building 32 of the FVAMC were all found to not contain asbestos.

In the event additional suspect material is discovered during demolition activities, this material should be treated as presumed asbestos-containing material (PACM) in accordance with regulations 29 CFR

1926.1101 and other applicable state and local regulations and either sampled to confirm or nullify asbestos content or be treated as ACM and handled accordingly.

3.2 Lead-Based Paint

The white/cream paint located on the metal elevator door framing, metal I beams and metal elevator doors was found to contain lead in the amount of 1.3% by weight and is considered LBP.

Any work designated by California Occupational Safety and Health Administration (Cal/OSHA) as trigger task which will impact this paint must be done by properly trained personnel, in compliance with all lead related Cal/OSHA regulations and requirements.

Table 2-1 LBP Sampling Results

B.

Samples identified as LBP are bolded in the Table. The full analytical report is included in Appendix special training or work practices related to lead when impacted.

for the analysis method used. As a result, any paints shown not to contain lead will not require any samples which when analyzed did not indicate lead to be present at or above the limit of detection detection limit. Paints determined not to contain lead for the purposes of this report are those million (ppm) of lead. All other paints sampled were determined to be below the laboratory’s levels of the project area exceeded the US EPA LBP criteria of greater than 0.5% or 5,000 parts per on the metal elevator door framing, metal I beams and metal elevator doors associated with all 4

All other paints/coatings/materials sampled did not contain lead above the analysis method detection limit. Lead related construction work practices will not be required for any work impacting these materials.

Any project which may result in the disturbance of lead containing products or surfaces, but is not intended to remediate a lead hazard or specifically designed to remove LBP to reduce or eliminate a known hazard, would be considered “lead related construction work.”

3.3 Asbestos Regulatory Information

US EPA

The property included in this survey report is located in Fresno County. SJVAPCD has been given authority for enforcement of the NESHAP regulations by means of their own rules.

A demolition is the wrecking, taking out, or burning of any load supporting structural member. A renovation is everything else. 10 day written notification to the US EPA Region IX, and the SJVAPCD is required prior to the performance of any demolition project regardless of asbestos being present or not. This notification would also apply to any renovation project which involves the wrecking, taking out, or burning of any load bearing structural member during a renovation as well.

Since no asbestos was detected in any of the samples taken, 10 day notification to the US EPA

Region IX, and the SJVPCD is not required prior to starting work for asbestos purposes.

Cal/OSHA

Disturbance of any ACM or ACCM could generate airborne asbestos fibers and would be regulated by Cal/OSHA. Cal/OSHA worker health and safety regulations apply during any disturbance of ACM or ACCM by a person while in the employ of another. This is true regardless of friability or quantity disturbed.

Since no asbestos was detected in any of the samples, a licensed asbestos contractor, certified by the State of California, and registered with Cal/OSHA will not be required.

3.4 Lead Regulatory Information

Any upcoming project which may result in the disturbance of lead containing products or surfaces, but is not intended to remediate a lead hazard or specifically designed to remove LBP to reduce or eliminate a known hazard, would be considered “lead related construction work”.

Lead related construction work does not fit the classification of a “lead abatement project under CDPH

Title 17 regulations. “Abatement” is defined in 17 CCR, Division 1, Chapter 8, Article 1 as “any set of measures designed to reduce or eliminate lead hazards or LBP for public and residential buildings, but does not include containment or cleaning.” A lead hazard is defined in 17 CCR, Division 1, Chapter

8, Article 1 as “deteriorated LBP, lead contaminated dust, lead contaminated soil, disturbing LBP or presumed LBP without containment, or any other nuisance which may result in persistent and quantifiable lead exposure.”

Lead related construction work means any “construction, alteration, painting, demolition, salvage, renovation, repair, or maintenance of any residential or public building, including preparation and clean up that, by using or disturbing lead-containing material or soil, may result in significant exposure of adults or children to lead”. (17 CCR, Division 1, Chapter 8, Article 1). Currently, Cal/OSHA has not established a definition for LBP, nor have they established minimum concentrations where their regulations do not apply. Cal/OSHA regulates all construction activities involving materials containing lead, including LBP. These regulations are found in 8 CCR, Part 1532.1, Lead in Construction.

April 2, 2021 ATC Group Services LLC 6

Since Cal/OSHA has not established a concentration of lead in a product where their regulations do not apply, any disturbance to products containing lead come under the jurisdiction of Cal/OSHA and their regulations. Disturbance of paints/coatings or materials determined to be LBP may trigger a pre-work notification to Cal/OSHA if “trigger tasks” disturb 100 square feet or more of those paints/coatings or materials. Trigger tasks are described in 8 CCR Part 1532.1 and include: manual demolition, power tool cleaning without dust collection systems, abrasive blasting, welding, cutting, and torch burning.

4 Assumptions and Limitations

The results, findings, conclusions, and recommendations expressed in this report are based only on conditions that were noted during ATC’s survey on March 24, 2021, of the project areas expected to be impacted by the Elevator Replacement Project in Building 32 of the FVAMC located at 2615 E.

Clinton Ave in Fresno, California.

The selection of sample locations and frequency of sampling was based on specific building materials anticipated to be impacted by the Elevator Replacement Project as communicated by Mr. Ryan

Gardner General Engineer with FVAMC. Concealed ACMs may exist in areas not accessible during the inspection. Reasonable efforts have been made by ATC personnel to locate and sample all suspect ACM and painted areas located within the building’s planned renovation areas. If any additional suspect ACM or painted surfaces, not listed in the Survey, will be impacted during future demolition and/or renovation activities, ATC recommends additional sampling of any suspect building materials.

The report is designed to aid the client in understanding the extent of ACM and/or LBP issues as they pertain to the planned renovation of the building. ATC does not warrant, guarantee or profess to have the ability to locate or identify all ACM in a facility. The intent of this report is to be used in planning for the specific renovation project only, and is based on the scope of work provided to ATC by Spees

Design Build and Mr. Ryan Gardner General Engineer with FVAMC. Should the scope of the renovation project change, ATC recommends that an additional investigation, including but not limited to, a review of the revised scope of work be performed to determine if ACM or suspect ACM will be impacted.

This Survey Report is intended for the sole use of Spees Design Build. The scope of services performed in execution of the survey may not be appropriate to satisfy the needs of other users, and use or re-use of this survey report, the findings, conclusions, or recommendations is at the risk of said user.

As with all such surveys, the results of the sampling represent conditions found on the date of the survey and may not represent conditions found at other times. Additionally, the survey was limited with respect to the specific parameters indicated above and should not be construed to be a comprehensive evaluation or a definitive representation of conditions within the site.

The Client recognizes that all testing and remediation methods have reliability limitations; no method or number of sampling locations can guarantee that a condition will be discovered within the performance of the services authorized by the Client. Additionally, the passage of time may result in a change in the environmental characteristics at the site. This survey report does not warrant against future operations or conditions that could affect the recommendations made herein. The results, findings, conclusions, and recommendations expressed in this survey report are based only on conditions that were observed during the Survey on March 24, 2021.

EMSL maintains liability limited to cost of analysis . Interpretation and use of test results are the responsibility of the client. This report relates only to the samples reported above, and may not be reproduced, except in full, without written approval by EMSL. EMSL bears no responsibility for sample collection activities or analytical method limitations . The report reflects the samples as received.

Results are generated from the field sampling data (sampling volumes and areas, locations, etc.) provided by the client on the Chain of Custody. Samples are within quality control criteria and met method specifications unless otherwise noted. The above analyses were performed in general compliance with Appendix E to Subpart E of 40 CFR (previously EPA 600/M4-82-020 “Interim Method”) but augmented with procedures outlined in the 1993 (”final”) version of the method. This report must not be used by the client to claim product certification, approval, or endorsement by NVLAP, NIST or any agency of the federal government. Non- friable organically bound materials present a problem matrix and therefore EMSL recommends gravimetric reduction prior to analysis . Unless requested by the client, building materials manufactured with multiple layers (i.e. linoleum, wallboard, etc.) are reported as a single sample. Estimation of uncertainty is available on request.
