A.1 SOLICITATION 36C26027Q0003 QUESTIONS AND ANSWERED
1) Question: Are vendors required to have an Authority to Operate (ATO)?
Answer: Scheduling software must be a Federal or Department of Veterans Affairs approved IT solution
2) Question: When we contacted AMiON and similar software provider QGenda, they said they usually work directly with the customer and not through resellers. Since this is a federal solicitation, I wanted to kindly ask how a small business should proceed in this situation.
Answer: In accordance with the Government’s market research, solicitation 36C26027Q0003 is set aside exclusively for small businesses. Prospective vendors must be either the Original Equipment Manufacturer (OEM), an authorized dealer, authorized distributor, or authorized reseller of the proposed equipment/system. This status must be validated through an authorization letter or other documentation from the OEM, submitted with the offer. All software licensing, warranties, and services associated with the equipment/system must comply with the OEM’s terms and conditions, as required by VAAR 852.212‑72.
If a small business vendor is not an OEM or does not provide an authorization letter for their proposed system at the time of offer, their offer may be considered non‑compliant with the solicitation requirements and may be removed from evaluation.
Please note that FAR 52.219-14, Limitations on Subcontracting (Nov 2025), applies to all small business set-asides.
3) Question: If the OEM Authorization Letter remains a mandatory pass/fail requirement for the brand-name solution, will the Government explicitly clarify that alternative "or equal" software platforms will be evaluated equally, provided they map to the salient characteristics in the Statement of Work ?
Answer: Please see Solicitation, Section E.5 on page 24 and Section E.6 on pages 24 – 27.
