About this file
This justification and approval document supports a brand-name-only procurement for medical gas equipment as part of an upgrade mechanical systems project at three Department of Veterans Affairs Gulf Coast Veterans Health Care System clinics. Key equipment to be procured on a brand-name basis includes Powerex medical air and instrument air compressor systems, RamVac oral evacuator pumps, and related dryers, filters, and controls. Justification is provided for restricting competition due to the need for standardized equipment brands across GCVHCS clinics to facilitate maintenance and spare parts interchangeability. The anticipated award will be competed as a 100% set-aside for Service-Disabled Veteran-Owned Small Businesses, with fair and reasonable pricing to be determined from competitive proposals. Market research found over 1,700 qualified SDVOSB/VOSB contractors in the relevant NAICS code.

DEPARTMENT OF VETERANS AFFAIRS
Justification and Approval
For Brand Name Items Project 520-22-169
1. Contracting Activity:
Department of Veterans Affairs, VISN 16, Biloxi VAMC. Network Contracting Office 16.
The proposed procurement is for the Upgrade Mechanical Systems, JACC, Eglin, and Panama City project number 520-22-169 at the Gulf Coast Veterans Health Care System (GCVHCS), Joint Ambulatory Care Clinic (JACC) in Pensacola, Florida.
2. Nature and/or Description of the Action Being Processed:
This justification is to support the Upgrade Mechanical Systems project that includes replacement of end-of-life medical air systems that will be awarded as a firm-fixed price contract. This justification is for other than full and open competition for the procurement of certain construction materials and installation. The use of a particular brand name for the items listed below accommodates standardization of these items throughout the Gulf Coast Veterans Healthcare System (GCVHCS).
The medical equipment at all GCVHCS clinics is maintained by both in-house maintenance in partnership with HMS, Inc. Currently, HMS is contracted to provide services to the medical gas equipment. To not impact patient care, we strive to keep uniform medical gas brands at each of our sites, improving our access to on-had spare parts that can be rapidly sourced and installed between facilities. Our in-house staff and HMS have been trained in these manufacturer brands, increasing their ability to make timely adjustments or repairs in restoring medical gas services to each of our clinics. For this reason, we request the equipment below to be standardized by brand as follows:

3. Statutory Authority Permitting Other than Full and Open Competition:
(X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; 41 USC §253(c)(1) ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2;
( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3;
( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5;
( ) (6) National Security per FAR 6.302-6;
( ) (7) Public Interest per FAR 6.302-7;
4. Demonstration that the Contractor’s Unique Qualifications or Nature of the
Acquisition Requires the Use of the Authority Cited Above (applicability of authority):
Operational medical gas equipment used at each of the GCVHCS facilities is made by Powerex and RamVac. Using a different manufacturer would reduce the available spare parts and equipment on-hand to borrow from in the event of a failure. Supply chain interruptions have decreased the reliability of express ordered parts being delivered in a timely manner. Maintenance increasingly relies on similar facility equipment (chiller sensors, chiller comm cards, compressor sensors, etc) at other locations that can provide temporary parts, while the express order parts are delivered days or weeks later. This applies to motors, pulleys, communication cards, power supplies, etc.
5. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:
In accordance with the Competition in Contracting Act (CICA), the components listed above are identified as brand name; however, the overall procurement will be competed as a Service-Disabled Veteran-Owned Small-Business (SDVOSB) Set-Aside. This Justification for Other Than Full and Open Competition will be posted to Federal Business Opportunities with the solicitation.
6. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable:
The anticipated price to the Government for the items requested to be brand name is approximately
The items for which brand name approval is being requested are subsequent components to the overall construction project. This procurement will be competed and based on competition; the Contracting Officer will make a determination of fair and reasonable pricing prior to award.
7. Description of the Market Research Conducted and the Results, or a Statement of the
Reasons Market Research Was Not Conducted:
Multiple (SDVOSB) companies are listed in SBA VetCert and SAM, as general construction companies capable of meeting the requirements as listed in design drawings and specifications. Market research demonstrates that there are 1,742 SDVOSB/VOSBs registered in SBA VetCert under NAICS Code 238220. Therefore, from Market Research findings and the VA Rule of Two, it has been determined that this requirement shall be solicited as a 100% SDVOSB set aside on SAM.gov.
Competing firms will deliver fair market prices for systems and items listed as all systems are common and use standard off the shelf components. The Contracting Officer and COR were in concurrence with information provided. Approval of the items as brand name only is critical for the overall efficiency of the completed project and the GCVHCS facility.
8. Any Other Facts Supporting the Use of Other than Full and Open Competition:
Standardizing equipment across the Gulf Coast improves our ability to maintain reliable operations and respond to failures of that equipment much quicker than having an extensive list of brands. These brands have proven reliable in performance as well as quick sourcing of parts domestically or in some cases internally to the Gulf Coast from our other equipment skids. All of these factors lead to less impacts to patient care from medical gas system downtime. Our limited in-house staff and HMS have been trained in these manufacturer brands, increasing their ability to make timely adjustments or repairs in restoring medical gas services to each of our clinics.
9. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:
Not applicable. It is the responsibility of the offerors and the general contractor awarded the project to locate suppliers and obtain pricing for all materials and components, and to work with the current medical gas services contractor to include the items listed in this justification.
10. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any
Barriers to Competition before Making subsequent acquisitions for the supplies or services required:
There will be competition for the overall procurement. It will be the responsibility of the offerors to obtain pricing from the suppliers of the items and to submit a competitive proposal for the project.
11. Requirements Certification: I certify that the requirement outlined in this justification is a
Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
