1. Description The Contractor shall furnish all management, supervision, labor, trained personnel, vehicles, transportation equipment, contractor-furnished containers and compacting equipment, maintenance and repair services, disposal and recycling services, documentation, reporting, emergency response, and quality control necessary to provide complete general waste and recycling services for the John D. Dingell VA Medical Center and Fisher House #99.

Covered waste streams include non-hazardous municipal/general solid waste, corrugated cardboard, construction and bulk waste, and scrap metal. This PWS does not authorize the Contractor to accept regulated medical waste, hazardous waste, radioactive waste, pharmaceutical waste, universal waste, or other separately regulated waste unless expressly added by Contracting Officer modification.

The Government owns and manages the Real Time Continuous Monitoring System (RTCMS). The Contractor shall respond to authorized RTCMS alerts and service notifications as required by this PWS but shall not furnish, license, administer, manage, maintain, repair, or replace the RTCMS unless separately authorized by the Contracting Officer through contract modification.

2. Period of Performance The anticipated contract structure is one 12-month base period and four 12-month option periods, exercisable at the Government’s discretion.

2.1 Transition Plan

The transition shall be performed so the VA does not experience a lapse in general-waste or recycling capacity when the incumbent contractor removes contractor-owned equipment. The incumbent contractor is expected to remove its equipment on September 30, 2026, March 31, 2027. The incoming Contractor shall coordinate delivery, placement, connection, and operational readiness with the COR and designated VA personnel.

The Contractor shall submit a written transition/installation plan no later than five business days before the equipment-change date. The plan shall identify equipment, delivery sequence, personnel, vehicles, contacts, safety controls, and contingency actions for delayed removal or installation.

All contractor-furnished equipment shall be Government-approved, safe, operational, clean, and ready for use at the time shown above. Any utility, interface, or fit issue shall be reported immediately to the COR.

RTCMS remains Government-owned and Government-managed. The Contractor shall coordinate the transition of any Government RTCMS component associated with an exchangeable container, but shall not install, program, administer, maintain, or repair RTCMS.

Contractor personnel entering the station for transition work shall use OR Trax for check-in or the COR-designated backup procedure.

If the outgoing contractor has not removed equipment as expected, the incoming Contractor shall immediately notify the COR and shall not remove, move, or interfere with another contractor’s property unless authorized by the Contracting Officer.

3. Scope Management and Changes The Government may add or remove locations, change authorized container quantities, adjust pickup frequencies, or modify estimated waste volumes to address actual demand. No change affecting price, quantity, location, equipment, period of performance, or delivery terms is effective unless authorized by the Contracting Officer. The COR may coordinate performance within the existing contract but may not modify contractual requirements or authorize additional charges.

The Government does not guarantee the estimated number of pulls, tons, container exchanges, or emergency responses unless a minimum quantity is expressly stated in the solicitation or contract. The Contractor shall not impose penalties or administrative charges merely because actual waste volumes or pickup quantities are above or below estimates.

4. General Performance Requirements Provide uninterrupted, sanitary, compliant service for each location and waste stream at the required frequency and response time.

Maintain all licenses, permits, registrations, insurance, vehicle qualifications, and disposal/recycling facility approvals required for the services actually performed.

Use trained, competent employees who wear visible company identification and comply with VA access, conduct, safety, parking, and smoking requirements.

Coordinate site access, container exchange, compactor service, schedule changes, and emergency response with the COR or authorized designee.

Protect patients, visitors, employees, property, traffic routes, and the environment during loading, hauling, container exchange, maintenance, spill cleanup, and emergency operations.

Keep contractor-owned containers and equipment structurally sound, clean, functional, odor-controlled, leak-resistant as applicable, and suitable for the assigned waste stream.

Provide all ordinary administrative support, reporting, tickets, weight documentation, recycling records, account management, and quality-control records without separate surcharges unless an expressly priced CLIN/SLIN authorizes the charge.

Ensure no service interruption occurs because a container is removed for emptying. Where a compactor container or other continuously required container is exchanged, an empty compatible replacement shall be positioned before or at the time the full container is removed.

5. Definitions and Waste Streams

Term
Performance Definition
General Waste
Non-hazardous municipal solid waste generated by normal facility operations and suitable for disposal at an authorized municipal solid-waste facility.
Cardboard Recycling
Corrugated cardboard collected separately for recycling. The Contractor shall preserve the material as a recyclable commodity to the maximum extent practicable and document weights and revenue/credits.
Construction/Bulk Waste
Non-hazardous bulky debris and construction-related materials authorized by the COR, including recyclable wood, concrete/brick/stone, plasterboard/drywall, and metal when suitable for recovery.
Metal Recycling
Scrap metal collected separately for recycling and revenue recovery.
RTCMS
Government-owned Real Time Continuous Monitoring System used by VA to monitor designated waste containers/compactors and issue service alerts. RTCMS ownership, licensing, administration, maintenance, and repair are Government responsibilities.
OR Trax
VA-designated station check-in system. Contractor personnel shall use OR Trax to record arrival/check-in before beginning routine on-site contract work unless the system is unavailable or the COR directs an alternate procedure.
Pull
Removal/exchange of a full or service-due container or compactor body and transportation of its contents to an authorized processing, recycling, transfer, or disposal facility.

6. Government-Furnished RTCMS and OR Trax Check-In

6.1 Government-Owned RTCMS

The Government owns, furnishes, administers, and manages RTCMS. No RTCMS rental, subscription, portal, sensor, communications, monitoring-management, maintenance, or repair charge is authorized under this PWS unless added by Contracting Officer modification.

The Government will determine which waste containers or compacting systems are equipped with RTCMS and will manage system access and sensor configuration.

The Contractor shall establish and maintain a reliable method to receive authorized RTCMS service alerts or equivalent notifications transmitted by the Government and shall acknowledge alerts within two hours.

When RTCMS indicates a monitored compactor/container has reached 75 percent capacity, the Contractor shall complete the required pull/exchange by the next authorized service day unless the COR directs a different response.

If RTCMS is unavailable, the COR or authorized designee may issue the pickup request by telephone, email, or another documented method. The Contractor shall treat the manual request as equivalent to an RTCMS alert.

The Contractor shall promptly notify the COR of any apparent RTCMS damage, missing sensor, or condition observed during container service, but shall not troubleshoot, repair, relocate, reprogram, or replace RTCMS components unless expressly directed under a separate authorized requirement.

When a Government-owned RTCMS component must be transferred between exchangeable containers, the Contractor shall coordinate the exchange so authorized VA personnel or the Government’s RTCMS support resource has a reasonable opportunity to transfer the component before the outgoing container leaves the site.

6.2 OR Trax Station Check-In

Contractor employees performing on-site service shall check in to the station using the OR Trax system before commencing routine work and shall check out or complete the service record when required by the local process.

OR Trax records shall identify, at minimum when the system supports it, the contractor/company, arrival time, location, and service activity.

If OR Trax is temporarily unavailable, the Contractor shall notify the COR and use the alternate check-in method designated by the COR. For after-hours emergency work when the COR/designee is unavailable, contractor personnel shall follow the VA Police or other station-designated emergency check-in procedure.

Failure to use OR Trax or the authorized backup process may be treated as a performance deficiency even when the physical waste service was otherwise completed.

7. Contractor-Furnished Containers and Equipment Unless specifically identified as Government-owned, the Contractor shall furnish the containers and equipment necessary to perform the services below. Contractor-furnished items shall remain the Contractor’s responsibility for cleaning, preventive maintenance, repair, replacement, safe operation, and regulatory compliance.

Keep all Contractor-owned and Government-owned waste containers and compactors covered by this PWS in good working condition, free of unreasonable odor, dirt, debris, leakage, and pests, and maintained so they do not create a safety or environmental hazard.

Perform cleaning, painting, lubrication, adjustment, repair, and other maintenance needed to keep covered equipment operational. Trucks and trailers used for hauling shall be washed as needed to remain free of unreasonable odor, dirt, debris, and pests.

Maintenance shall be scheduled and coordinated to preserve waste-system uptime and avoid interruption of facility operations. Maintenance records shall identify equipment, date/time, condition found, work performed, parts/materials used, downtime, authorization when required, and return-to-service status.

10.2 Contractor-Owned Equipment

Submit a recurring preventive maintenance plan before performance describing inspection, general cleaning, oiling/lubrication, adjustment, repair, replacement, and service intervals for Contractor-owned compactors, containers, locks, and associated equipment.

Perform all routine maintenance, repair, and replacement of Contractor-owned equipment at no additional cost beyond the applicable priced rental/service CLIN/SLIN.

Replace Contractor-owned equipment that cannot be restored promptly to safe, reliable operation so waste service is not interrupted. Any Contractor-owned replacement shall be equal to or better than the required equipment and remain subject to Government approval.

10.3 Government-Owned Compactor/Chute Equipment

A separate priced CLIN/SLIN shall be established for preventive maintenance and repair service associated with the Government-owned compactor/chute equipment. RTCMS is Government-owned but is expressly excluded from this maintenance requirement.

Before performance, submit a recommended recurring maintenance plan for the Government-owned compactor/chute equipment. The plan shall follow manufacturer recommendations and identify inspection, cleaning, lubrication, adjustment, testing, preventive maintenance, normal-wear repair, and recommended service intervals.

Provide maintenance and repair necessary to keep the Government-owned compactor/chute system in working order. Normal-operation repair work may include hydraulic lines, pumps, hydraulic components, worn mechanical components, and repair of metal/container damage or holes resulting from normal wear and tear.

No maintenance or repair work on Government-owned equipment that will create an additional charge may begin until the work is authorized by the Contracting Officer and coordinated/technically approved by the COR. The COR alone may not authorize an unpriced or out-of-scope charge.

When the Government-owned compactor is out of service, provide a temporary replacement container at no additional rental charge sufficient to maintain safe waste capacity until the Government-owned compactor is returned to service. The COR will determine the required temporary container size based on operational need.

The Government retains responsibility to replace Government-owned equipment that the Contracting Officer determines is unserviceable or beyond economical repair unless replacement is separately acquired under the contract.

10.4 Repair Parts, Materials, and Supplies for Government-Owned Equipment With its proposal, the Contractor shall provide a priced schedule/list for repair parts, materials, and supplies reasonably anticipated for the Government-owned compactor/chute system. The schedule shall identify manufacturer/part number when available, unit of issue, unit price, and any applicable warranty.

Routine consumables, minor materials, and normal maintenance supplies inherent in preventive maintenance shall be included in the Government-owned equipment maintenance/repair service price and shall not be billed separately.

Replacement parts, materials, or supplies not included as routine maintenance items may be ordered only under the authorized Government-owned equipment repair-parts SLIN and only after written Contracting Officer authorization. The Contractor shall not install or invoice an unapproved part.

Before requesting authorization for a separately priced part, the Contractor shall provide the COR and Contracting Officer a written diagnosis, recommended repair, estimated labor if not already included in the maintenance CLIN/SLIN, itemized parts/materials, price-list reference, anticipated downtime, and warranty information.

No duplicate billing is permitted. Labor or routine maintenance already included in the monthly Government-owned equipment maintenance/repair SLIN shall not be billed again through the repair-parts line.

RTCMS sensors, communications devices, software, portal services, batteries dedicated to RTCMS, and other RTCMS components are not repair parts under this PWS and shall not be invoiced.

11. Safety, Transportation, Spill, and Overflow Response Use vehicles, containers, lifting equipment, and work practices appropriate for the waste transported and compliant with applicable federal, State of Michigan, and local transportation, environmental, occupational safety, and traffic requirements.

Maintain vehicles and containers in sanitary condition and prevent leakage, blowing litter, dropped debris, odors, and uncontrolled releases during service and transportation.

Provide spill-control and cleanup equipment appropriate to the non-hazardous waste streams being serviced and promptly clean any contractor-caused spill, leakage, or debris.

Immediately notify the COR of spills, container failures, traffic incidents, rejected loads, or other events that may affect VA operations, safety, regulatory compliance, or continuity of waste service.

The Contracting Officer or COR may stop work that presents an unsafe, unhealthy, environmentally harmful, or property-damaging condition. The Contractor shall promptly correct the condition without additional cost when caused by Contractor performance.

Weapons and contraband are prohibited on VA property. Contractor personnel and property brought onto VA premises are subject to applicable VA security and inspection requirements.

12. Permits, Licenses, Disposal and Recycling Facilities Obtain and maintain all business licenses, permits, transporter authorizations, vehicle registrations, insurance, and other approvals legally required for the non-hazardous waste and recycling services performed under this contract.

Use only facilities lawfully authorized to receive the specific material delivered. Provide the name, address, contact information, and applicable permit/registration information for transfer, recycling, processing, composting, and disposal facilities used under the contract.

Notify the COR and Contracting Officer before changing a primary disposal, transfer, recycling, or processing facility when the change could affect price, service continuity, reporting, or contract compliance.

Provide current permits/licenses and evidence of insurance before performance, upon renewal, and upon Government request. The Government reserves the right to inspect proposed facilities when permitted by law and contract terms.

Identify proposed subcontractors and the services they will perform. Subcontractors shall meet the same legal, safety, documentation, and performance requirements applicable to their assigned work.

13. Weighing and Measurement Use a currently certified weighing system suitable for commercial or contractual weight determination.

For each billable tonnage line, net billable waste weight shall be based on documented net material weight. Reusable contractor container, compactor body, truck, or other tare weight shall not be billed as waste.

Provide weight tickets traceable to the site, service date, waste stream, vehicle/container, gross weight, tare weight, net weight, and receiving facility.

Maintain scale certification and make it available to the Government upon request.

When recyclable commodity revenue is based on weight, use the same verified net-weight basis or clearly document the recycler’s settlement weight and any variance.

14. Recycling, Diversion, and Revenue Return Recycle cardboard and metal collected under this PWS and maximize diversion of eligible and construction/bulk waste when lawful and commercially practicable.

For cardboard and metal, report commodity weight, receiving recycler, applicable market/settlement price, gross recycling revenue, allowable deductions if any, net revenue, and the Government’s share or credit.

Recycling revenue/credits due to the Government shall be remitted or credited using the method established by the Contracting Officer. Payments/checks and supporting statements shall be directed to the Government recipient designated in the contract, with a copy of the documentation provided to the COR.

The Contractor shall not commingle recyclable materials in a manner that defeats a required revenue or diversion accounting requirement unless authorized by the COR and consistent with the contract.

Construction/bulk recycling should prioritize recovery pathways identified in the source requirement, including wood for reuse/energy recovery, masonry/concrete for aggregate, plasterboard/drywall for recycling where accepted, and metal for commodity recovery.

VA/CO TO CONFIRM before solicitation release: establish the Government recycling revenue formula. The source SOW requires a monetary return and reporting of “the Government’s portion” but does not define the percentage, gross-versus-net basis, allowable deductions, benchmark market price, or remittance method.

15. Documentation, Recordkeeping, and Reports The Contractor shall maintain electronic records sufficient to trace each pickup, weight, disposition, recycling transaction, repair, and invoice charge. Records shall be exportable to Microsoft Excel or another Government-approved format.

16. Emergency, Inclement Weather, and Continuity Operations

16.1 Emergency Service Response

Maintain a 24-hour, 7-day contact method capable of receiving an emergency service request involving overflow, failed containers, compactor outage, missed service, unexpected temporary waste increase, or another condition that could create a safety, environmental, sanitation, or continuity-of-operations concern.

Upon notification of an emergency, the Contractor shall respond within one hour to coordinate with the COR or COR designee and initiate the emergency-service process. When directed to proceed, Contractor personnel shall begin work within two hours unless another timeframe is mutually agreed to and approved by the Contracting Officer or COR/COR designee within existing contract authority.

Provide a walk-in bulk waste container at the location designated by the COR when needed for emergency overflow or continuity of operations.

Contractor personnel responding on site shall use OR Trax or the authorized backup check-in procedure. Emergency notification by the Government-owned RTCMS does not create any Contractor responsibility to manage, maintain, or repair RTCMS.

Work requested outside the normal coverage hours or outside the priced scope of this contract shall not be performed as an unpriced extra. Such work requires Contracting Officer authorization through an appropriate contract action or separate procurement, as applicable.

16.2 Inclement Weather and Service Recovery

The Contractor shall continue refuse and recycling service during inclement weather when safe and legally permissible.

When severe weather, city infrastructure disruption, or facility-access limitations prevent service, the Contractor shall immediately notify the COR and implement the approved contingency plan.

When the COR authorizes a missed collection because of severe weather, the Contractor shall make up the missed collection within 24 hours after the condition has ended unless the COR authorizes additional time.

16.3 Disaster Recovery and Contingency Plan

Before performance, the Contractor shall submit a comprehensive written contingency plan and maintain it throughout the contract. The plan shall support at least 96 hours of essential-service sustainability and shall address the following:

Purpose, scope, covered emergencies, and activation criteria, including natural disasters, technical/equipment failures, labor disruptions, transportation interruptions, disposal/recycling facility outages, and access restrictions.

Roles and responsibilities of Contractor leadership, dispatch, drivers, maintenance personnel, and emergency-response personnel, with current primary and alternate contact information.

Risk assessment identifying likely threats, operational impact, preventive measures, and required resources.

Emergency-response procedures, communication protocols for the CO, COR, site POCs, and local emergency services, and worker safety/evacuation procedures.

Service-continuity procedures, including backup vehicles, backup personnel, temporary containers, alternate hauling arrangements, and alternate permitted disposal/recycling facilities.

Recovery and restoration steps, timelines, damage/loss documentation, and return-to-normal-service criteria.

Training and periodic exercises/drills sufficient to ensure Contractor personnel understand the contingency plan.

An inventory of emergency-response equipment and a process for keeping that equipment in working condition.

Plan review and update procedures and retention of records showing revisions, training, incidents, and lessons learned.

16.4 Emergency Documentation

Document each emergency request and response, including request time, one-hour response/coordination time, direction to proceed, work-start time, OR Trax check-in or backup record, equipment provided, actions taken, service completion, and any operational impact.

Submit an incident/after-action report to the COR within one business day after the emergency unless the COR establishes a different timeframe. The report shall identify cause, response, outcome, corrective actions, and preventive recommendations.

17. Contract Line-Item Number (CLIN) Structure and Pricing The contract should use one parent CLIN for each service location and separately identified SLINs for each independently billable service, equipment requirement, pickup/transport activity, disposal/recycling quantity, or authorized emergency service. This structure allows invoice validation by location and prevents unrelated equipment or service costs from being allocated across sites.

Base-period parent CLINs: 0001 Main Campus and 0002 Fisher House #99. Option-year CLINs repeat the same site structure as 1001/1002, 2001/2002, 3001/3002, and 4001/4002.

The two-letter SLIN suffix should remain consistent across contract periods.

Estimated quantities are for evaluation and funding and do not guarantee a minimum unless expressly stated.

RTCMS ownership, monitoring, portal access, licensing, administration, maintenance, and repair shall not be separately priced under this PWS.

Ordinary reporting, weight tickets, account management, contractor QC, permits, insurance, container cleaning, and routine contractor-owned equipment maintenance shall be included in the associated priced service/equipment lines unless the solicitation expressly establishes a separate line.

19. Contract Administration The Contractor shall contact the Contracting Officer on matters affecting contract terms, price, quantity, period of performance, place of performance, or other contractual changes. The COR may monitor performance, coordinate service, issue service requests within existing contract authority, review documentation, and validate invoices, but may not modify the contract or authorize unpriced work.

The Contractor shall provide a primary and alternate point of contact and current contact information for managers, dispatch/customer service, field service/maintenance personnel, and emergency response personnel supporting the contract.

20. Contractor Quality Control Submit a written Quality Control Plan before performance. The plan shall address every performance objective in Section 21 and identify inspection methods, frequency, responsible personnel, records, trend analysis, and corrective-action processes.

Inspect contractor-owned containers and equipment often enough to detect damage, sanitation issues, lock failures, leaks, unsafe conditions, or developing maintenance problems before they cause service failure.

Inspect Government-owned compactor/chute equipment as part of the maintenance program while excluding RTCMS from Contractor maintenance responsibility.

Maintain QC records throughout the contract and make them available to the COR upon request.

Investigate complaints and service failures promptly, document cause and corrective action, and prevent recurrence.

21. Government Quality Assurance and Surveillance Plan (QASP) The Government will evaluate outcomes through OR Trax records, RTCMS alert/service data available to the Government, trip tickets, weight records, monthly reports, equipment observations, maintenance records, recycling documentation, customer complaints, invoice review, and direct observation. The QASP may be administratively updated to improve surveillance methods but shall not change contract requirements without Contracting Officer action.

21.1 Acceptable and Unacceptable Performance

When unacceptable performance occurs, the COR may document the deficiency and notify the Contractor and Contracting Officer. The Government may issue a Contract Discrepancy Report (CDR) or require a corrective-action plan. Repeated or serious failures may affect past-performance evaluations and support contractual remedies available to the Contracting Officer. Nothing in the QASP authorizes the COR to change contract terms or impose remedies outside the contract.

22. Information Security and Privacy The work is not expected to require routine storage or transmission of VA sensitive information in contractor systems. Incidental exposure may occur while working at VA facilities. Contractor personnel shall protect information encountered during performance, use Government systems such as OR Trax only for authorized contract purposes, and immediately report known or suspected privacy or security incidents through the COR and other VA officials identified by the contract.

23. Service Contract Labor Standards and Wage Determinations Service Contract Labor Standards apply when incorporated by the solicitation/contract. The Contracting Officer shall insert the current wage determination applicable to each place of performance before solicitation release. Offerors and the Contractor remain responsible for compliance with incorporated labor requirements.
