About this file

This is Amendment 0001 to solicitation 36C24826R0064 for the Upgrade Video Assessment Surveillance System (Bid-Build Services) issued by the Department of Veterans Affairs, Network Contracting Office 8, located in San Juan, Puerto Rico. The amendment extends the proposal submission deadline to April 24, 2026 at 3:00 PM AST and provides responses to 71 questions received from offerors, along with solicitation clarifications and additional attachments.

The project requires the design and construction of a new closed-circuit television (CCTV) surveillance system for the VA Caribbean HCS facility. Key deliverables include installation of new IP cameras with facial recognition and analytics capabilities, a new Video Management System (VMS), network video recorders (NVRs), workstations with 60-inch monitors (3 in surveillance room, 1 in supervisor office), and a CISCO 9300 network switch to be contractor-furnished. The system must integrate with existing Software House PACS and Honeywell Vindicator IDS systems. Existing cameras, cabling, and conduits must be completely removed and replaced with new infrastructure. All work must be performed during non-business hours only. The Project Manager must be a Professional Engineer licensed in Puerto Rico with minimum 10 years of construction management experience and must be designated exclusively to the project. The solicitation is a 100% Service-Disabled Veteran-Owned Small Business (SDVOSB) set-aside. Training for 30 VA personnel on two components—Fundamental CCTV Operation and Analytics/Integration Training—must be conducted at the facility with groups limited to 15 participants. Final as-built drawings are required in both PDF and CAD formats with two hard copies submitted. The Davis-Bacon Act does not apply to this Puerto Rico project; wage obligations are governed by Puerto Rico labor laws. Existing asbestos-containing materials are present in the main building, with the contractor responsible for all abatement costs in impacted areas; any additional asbestos discovered will be treated as a differing site condition under FAR 52.236-2.

Amendment 0001 - 36C24826R0064 - Upgrade Video Assessment Surveillance System

CONTINUATION PAGE

# Questions Government Response

1.

Existing PACS System Information Could the Government provide the existing manufacturer, model, software version, communication protocols, and any current integrations with VASS or other systems?

The facility’s PACS is Software House system. The keypads and card readers in use are HID. Currently, there is no integration between the existing PACS and VASS systems.

2.

Asbestos and Lead Survey Reports Could the Government provide the most recent asbestos and lead survey reports for the affected buildings?

There are no asbestos or lead survey available. The main building (Building No. 1) is the only facility structure that contains asbestos. The identified Asbestos-Containing Materials (ACM) include roof fireproofing, duct insulation, wall materials, and floor tiles. Please refer to Exhibit - A in the scope of work for the areas within the main building that are confirmed to be asbestos-free (highlighted in green).

3.

Sequence of Work Could the Government confirm whether the contractor may propose an alternative sequence of work if it improves efficiency and does not interfere with hospital operations?

For bidding purposes, the offeror shall follow the work sequence set forth in the solicitation documents.

Following award, the Government may, at its sole discretion, consider and evaluate a proposed alternative sequence. No alternative sequence shall be implemented unless the Offeror receives prior written approval from the Government. If the Government does not approve the proposed alternative, the Offeror shall comply with the work sequence and all related requirements specified in the solicitation documents.

4.

Definition of “Exclusively Assigned” Personnel Could the Government clarify whether “exclusively assigned” requires full time, 100% dedicated personnel, or if personnel may support other projects as long as performance is not impacted?

As stated in SOW, Section 3.2, key personnel -specifically the Project Manager must be “designated exclusively for our project and dedicated to it.”

This requirement means that the named key personnel must be primarily assigned to this project and readily available to perform their responsibilities without delay or conflict. However, the solicitation does not require:

full-time, 100% sole employment, or prohibition from working on any other project.

Personnel may support other work as long as:

1. Their responsibilities on this project are fully met;

2. Their availability is not diminished or delayed;

3. The Government does not experience performance impacts; and

4. Any change or replacement continues to meet all qualification requirements and receives CO approval, as required by SOW, Section 3.2.

Thus, “exclusively assigned” means dedicated for the purposes of this contract, remain continuously available, and not that the individual must be restricted solely to this contract for all working hours.

5.

Existing PACS Model and Version Could the Government provide the existing model and software version of the Physical Access Control System (PACS) currently in use?

The facility’s PACS is Software House system.

6.

No intercom.

18.

Project Manager Qualifications The solicitation requires the designated Project Manager to be a professional engineer licensed in the Commonwealth of Puerto Rico, in addition to possessing a minimum of ten (10) years of experience in the management of construction projects of similar complexity.

We acknowledge the government's objective to ensure a high degree of technical proficiency for this critical role. The primary duties of a Project Manager, however, are focused on the management of scope, schedule, cost, quality, and risk, rather than the execution or certification of engineering design work. The ten-year experience requirement specified in the solicitation directly addresses the core management competencies essential for project success.

The requirement for a Professional Engineer (PE) license may unintentionally limit the pool of available talent, excluding highly qualified candidates with extensive federal construction management experience who possess engineering degrees but have focused their careers on project management rather than design.

To ensure the government has access to the broadest possible range of experienced candidates while still prioritizing local expertise, we respectfully request clarification on this qualification.

Question: Would the government consider a Project Manager who possesses a Bachelor's degree in Engineering from a university within the Commonwealth of Puerto Rico, in addition to the required ten (10) years of demonstrated experience in managing construction projects of similar or greater complexity, to be technically acceptable in lieu of holding a Professional Engineer license?

No. The solicitation requires that the designated Project Manager shall be a Professional Engineer (PE) licensed in the Commonwealth of Puerto Rico, with a minimum of ten (10) years of experience managing construction projects of similar or greater complexity. This requirement is stated in the Statement of Work (SOW), Section 3.2 and Evaluation Factor 1 Technical Qualifications. A degree and experience alone, while valuable, do not satisfy the solicitation’s stated requirement.

19.

Clarification of Key Personnel Requirements for SDVOSB Prime We acknowledge and support the government’s decision to designate this procurement as a 100% Service-Disabled Veteran-Owned Small Business (SDVOSB) set-aside. The Project Manager is the most critical management position for ensuring successful contract performance and serves as the primary point of contact for the government. As such, this role is fundamental to the prime contractor's ability to manage and control the project.

To ensure clear lines of authority, accountability, and compliance with the performance requirements stipulated for SDVOSB set-asides under 13 CFR 125.6, we respectfully request clarification on the employment status of this key individual.

Question: To be considered technically acceptable, must the proposed Project Manager be a direct, W-2 employee of the offeror (the prime SDVOSB contractor) at the time of contract award?

No. The solicitation requires the Project Manager to be a Professional Engineer licensed in the Commonwealth of Puerto Rico with at least ten (10) years of relevant experience, to be designated exclusively to this project, and not replaced without CO approval. The solicitation does not mandate the PM be a W-2 employee of the prime. A PM provided through a similarly situated SDVOSB or as a subcontractor/consultant may be acceptable, provided:

1. The offeror meets all PM qualification and submission requirements (license evidence, resume, dedication to project) stated in the RFP; and

2. The offeror complies with the Limitations on Subcontracting requirements applicable to general construction (VAAR 852.219-75; 13 CFR §125.6). The prime must retain overall management control and avoid unusual reliance on any non-similarly situated subcontractor for primary and vital contract requirements.

Provide a letter of commitment (Attachment 06) for any proposed subcontractor/team member supplying the PM and affirm availability throughout performance

Document the prime’s project control approach (who directs work, approves submittals, leads meetings, signs QA/QC) in Factor 1 to show no unusual reliance.

Ensure the PM’s license evidence (PR PE) and resume are included exactly as required; missing license documentation is a material deficiency under Factor 1.

20.

Process for Differing Site Conditions The mandatory site visit on 3/17/2026 provided restricted access to many key installation areas, including but not limited to above-ceiling spaces, electrical closets, and patient care areas. Due to the age of the facility and these access limitations, there is a high potential for encountering differing site conditions. Please confirm the process and mechanism (e.g., Request for Equitable Adjustment, contract modification) for addressing unforeseen obstructions or conditions that impact the cost and schedule of the work.

Unforeseen, material Differing Site Conditions will be handled under FAR 52.236-2 (Differing Site Conditions) and the Changes framework (FAR 52.243-4 and VAAR 852.243-70), which are incorporated in the solicitation.

Note that only actual, material differences from the contract indications qualify for adjustment.

21.

Post-Award Detailed Site Survey To mitigate delays and change orders during construction, will the Government permit the successful contractor to conduct a comprehensive, room-by-room, above-ceiling survey with VA facilities staff after award but prior to the commencement of installation activities? This would allow for the formal documentation of existing conditions and collaborative re-routing of pathways if required.

Post-award site surveys and above-ceiling inspections may be performed as part of the offeror’s means and methods, provided they are carried out in accordance with all contract terms and conditions, including VA coordination, safety, and access requirements. No additional compensation or schedule extensions will be granted for activities that fall within the offeror’s responsibility to verify existing conditions and plan the work.

22.

Existing Condition Documentation Given the inability to perform a thorough visual inspection during the limited site visit, can the VA provide any existing documentation that could clarify concealed conditions? This would include any recent architectural, electrical, or low-voltage as-built drawings, above-ceiling photos from previous projects, or reports from past facility upgrades.

The concealed conditions are moderate, which is defined as several systems present, but workable space remains for routing new systems. Consider the following utilities may be present: Ductwork, Sprinkler pipes, Conduits and cable trays, Chilled water, VAV boxes, HVAC equipment and Communication cables.

23.

Asbestos and Lead Survey Report Section 9.3 notes the presence of lead and asbestos. As the site visit did not permit inspection of areas where abatement may be required (e.g., pipe insulation in plenums, mastic behind wall-mounted devices), it is critical that the Government provide the complete, existing hazardous material survey report for bidder review.

There are no asbestos or lead survey available. The main building (Building No. 1) is the only facility structure that contains asbestos. The identified Asbestos-Containing Materials (ACM) include roof fireproofing, duct insulation, wall materials, and floor tiles. Please refer to Exhibit A in the scope of work for the areas within the main building that are confirmed to be asbestos-free (highlighted in green).

24.

Protocol for Undocumented Hazardous Materials As concealed spaces could not be visually inspected, please confirm the required protocol should the contractor discover suspected hazardous materials in areas not identified in the survey report. Will the Government cover all costs for testing, abatement design, third-party monitoring, and schedule impacts related to the discovery?

Refer to the response to Question #23. If the offeror discovers ACM in areas not identified in Question #23, this will be treated as a Differing Site Condition, as stated in the response to Question #20.

25.

Asbestos Remediation We understand that asbestos remediation is required, and an exhibit has been provided identifying the affected areas. Can you please confirm whether mitigation is limited only to the areas shown in the exhibit, or whether any unexpected asbestos encountered during construction must also be remediated?

As per Exhibit. Please note this Exhibit shows areas confirmed to be asbestos-free (highlighted in green).

Refer to question # 23 for ACM in non asbestos-free areas.

26.

Asbestos Remediation If additional asbestos-containing material is discovered outside the areas identified in the exhibit, should such remediation be included within the project scope, or would it be handled through a change order or separate authorization?

Please note that this exhibit identifies areas confirmed to be asbestos-free (highlighted in green). All areas within the exhibit that are not highlighted in green shall be considered to contain asbestos. Any asbestos-containing material discovered outside the areas indicated in the exhibit will be treated as a Differing Site Condition, as stated in the response to Question #20.

Refer to question # 23 for ACM in non asbestos-free areas.

27.

Wall and Ceiling Construction Visual inspection of interior partition construction was limited. Can the VA confirm if walls are standard drywall and metal stud, or if they consist of plaster and lath, concrete masonry unit (CMU), or terracotta block? This information is essential for determining appropriate anchoring hardware and labor costs for penetrations.

The existing walls are standard drywall, CMU and concrete.

28.

Above-Ceiling Plenum Conditions Access to above-ceiling plenum spaces was not granted during the site visit. To properly estimate labor and materials for cable pathways, can the VA provide any information on the level of congestion from existing utilities (HVAC, plumbing, electrical), and confirm if fire-rated cable (plenum) is required throughout?

The level of congestion is moderate, which is defined as several systems present, but workable space remains for routing new systems. Consider the following utilities may be present: Ductwork, Sprinkler pipes, Conduits and cable trays, Chilled water, VAV boxes, HVAC equipment and Communication cables.

Refer to the solicitation documents for the required cable specifications.

29.

Circuit Identification Support Tracing and identifying existing electrical circuits for demolition in an operational hospital is highly disruptive. Will the VA provide support from facility maintenance staff with intimate knowledge of the building to assist in locating and verifying the circuits feeding the existing surveillance system?

The offeror is fully responsible for tracing the electrical conduit as required. The facility may, however, offer limited support and guidance to help streamline and expedite the tracing process.

30.

Fire-Stopping Systems for Concealed Barriers It is assumed that the facility contains a variety of fire and smoke barriers that were not visible during the site visit. Please confirm if the VA has a standard, required manufacturer or specific UL-rated system for fire-stopping penetrations through these varied assembly types (e.g., drywall, CMU, plaster).

The facility does not have a specific standard for this;

however, we typically use Hilti firestop products. The offeror shall comply with all firestopping requirements outlined in the solicitation documents.

31.

Medical Gas and Fire Alarm Panel Relocation The relocation of medical gas and fire alarm panels requires specialized technicians and potential system shutdowns. Please confirm the recertification requirements for these systems upon completion of the relocation.

Before the relocation, the offeror must certify the current operational condition of the panel and submit this certification to the VA.

After relocation, the offeror must certify that the fire alarm panel is in the same condition as it was prior to being relocated.

32.

Refer to solicitation documents.

37.

VMS Software Licensing Please clarify the Video Management System (VMS) software licensing requirements. Does the VA currently hold an enterprise license, or must the contractor procure all necessary camera, server, and client access licenses for this project?

VA does not hold an enterprise license. The offeror must provide all necessary cameras, server, and client access licenses for this project.

38.

Fire Alarm System We understand that the existing fire alarm system is to be removed and replaced with a new system. Can you please confirm whether the new fire alarm system must be compatible with any existing systems or devices that will remain in service in other parts of the hospital?

Refer to solicitation documents. Must be compatible with Notifier.

39.

Final Camera Mounting Locations The drawings indicate proposed camera locations. Please confirm the process for adjusting camera mounting locations in the field to optimize fields of view and account for unforeseen obstructions (e.g., lighting, ductwork). Will a final walk-through with the COR be required to approve all locations prior to installation?

If any obstruction affects the camera’s field of view, the offeror must coordinate with the COR to determine the required adjustments before installation.

40.

Existing System Demolition and Conduit Use Please clarify the full extent of demolition for existing cameras, cabling, and equipment.

Should existing conduits be demolished and removed or abandoned in place? Can existing, accessible conduit be re-used for new cabling if it is properly inspected and verified?

The existing cameras, conduits, cables, and related equipment must be removed. Reuse of any conduits or cables is not permitted, and abandoning conduits in place is also prohibited.

41.

Phasing & System Downtime Please provide a required phasing plan or allowable downtime windows for migrating from the existing system to the new system to ensure continuous surveillance coverage in critical areas of the medical center.

Refer to solicitation documents.

42.

Infection Control Risk Assessment (ICRA) Levels Please provide the specific ICRA classification levels for the different work areas within the facility. This is critical for accurately pricing the required containment, negative air, and cleaning protocols.

Refer to scope of work.

43.

Refer to scope of work.

45.

Site Access/Badging Please describe the process and typical lead time for obtaining site access and security badges for all personnel.

All offeror employees must complete the facility’s security badge process, which includes submitting the required forms and undergoing a background check.

The COR will assist the offeror throughout this process.

46.

Funding We note that funding for the project is currently not available. Are there any current projections or anticipated timelines as to when project funding may become available?

At this time, the Government has no projected timeline or estimate for when project funding will become available. As stated in the solicitation, “Funds are not presently available for this acquisition. No contract award will be made unless and until appropriated funds are made available. The Government reserves the right to cancel the solicitation if funding is not obtained.”

The Government will proceed with award only upon receipt of appropriated funds, and no further schedule information is currently available.

47.

Definition of "Most Recent and Updated Equipment" Section 4.11 requires the contractor to propose the "most recent and updated CCTV equipment and components." Please clarify the baseline date for this requirement. Is it the date of solicitation, date of proposal submission, date of award, or date of installation?

The requirement to provide the “most recent and updated CCTV equipment and components” is tied to the date of proposal submission. Offerors must base their technical proposals and pricing on the most current equipment and components commercially available as of the proposal submission date, consistent with SOW, Section 4.11.

After award, if newer versions of products become available before installation, the offeror may propose substitutions; however, any substitutions require Contracting Officer approval and must meet or exceed the performance, compatibility, and specification requirements of the original proposed equipment.

48.

Precedence of Documents Please clarify the process for addressing discrepancies between the construction drawings and the specifications. Which document takes precedence in the event of a conflict?

The precedence of documents is established in VAAR 852.236-71, Specifications and Drawings for Construction, which is incorporated in this solicitation.

The clause provides that:

Drawings of greater detail govern over drawings of lesser detail, unless noted otherwise.

Figures and numerical quantities on drawings take precedence over measurements obtained by scale.

Omissions or misdescriptions of details that are necessary to carry out the intent of the drawings and specifications do not relieve the offeror of performing the required work.

In practice, when a discrepancy exists:

1. The offeror must immediately notify the

Contracting Officer as required by the clause.

2. The Contracting Officer’s interpretation of the drawings and specifications is final, subject to the Disputes clause.

This solicitation does not state that drawings or specifications automatically take precedence over the other; instead, the Contracting Officer determines the correct interpretation based on contract intent, clarity, and technical requirements.

49.

VA Maintenance Contractor Coordination Section 4.15 requires the contractor to coordinate with the VA’s maintenance contractors. Please provide a list of these contractors, their points of contact, and any government-furnished information regarding scheduling and coordination protocols.

Security Integration Group has the maintenance of the current CCTV, PACS and IDS.

ARA Security Integrators has the maintenance of the fire alarm.

The Fire Sprinkler, Medical Gases, and the Emergency Communication System have no maintenance contract.

50.

Warranty Start Date Please confirm if the warranty period for the entire system begins at the date of substantial completion or the date of final project acceptance by the Government.

The warranty period begins on the date the Government takes final acceptance of the entire project, not at substantial completion. This follows FAR 52.246-21, Warranty of Construction, which is incorporated in this solicitation by reference. Under this clause, the warranty period commences upon the Government’s final acceptance of the completed work.

Substantial completion does not trigger the warranty period unless a specific warranty provision is separately stated for early-accepted portions of work (none are included in this solicitation). Accordingly, the warranty for the CCTV system, equipment, materials, and all installed components begins upon final acceptance of the project.

51.

VA Standard Test Procedures The specification states that test procedures must be "compliant w/ VA standard test procedures." Please provide a copy of these standard test procedures for our reference and use in developing the submittal.

Refer to VA Technical Information Library.

https://www.cfm.va.gov/til/

52.

Witness Testing Availability & Protocol The specification requires the COR to witness all testing. What is the required lead time for scheduling the COR, and what is the process if the designated COR is unavailable on a scheduled test date?

The COR will be available; if not, an alternate COR will be designated. To ensure proper coordination, the offeror must schedule activities at least three weeks in advance.

53.

OEM Certified Representative for PVT The Performance Verification Test (PVT) requires an "OEM certified representative" to be present.

Please clarify if this representative must be a direct employee of the Original Equipment Manufacturer (OEM) or if a certified partner/integrator is acceptable.

Davis- Bacon Act / Wages With respect to the Davis-Bacon Act wage requirements, can you please confirm whether the applicable wage obligations are affected in any way by the Biden Executive Order regarding minimum wages for contractors performing work on federal projects?

No. As stated in General Information, paragraph 21, the Davis–Bacon Act does not apply to this project, and therefore prior Executive Orders regarding federal offeror minimum wages have no effect on this solicitation.

The solicitation explicitly states:

“The Davis-Bacon Act… does not apply to VA-funded, VA-awarded construction contracts performed in Puerto Rico. No other statute independently requires payment of Davis-Bacon wages for this project.

Therefore, FAR 52.222-6 and related clauses are not applicable to this solicitation.”

Because Davis-Bacon is not applicable, offeror wage obligations are governed by Puerto Rico labor laws and any other applicable federal wage requirements, excluding Davis-Bacon-based minimums and excluding prior federal offeror minimum wage Executive Orders (such as former EO 14026), which are not incorporated into this solicitation.
