NBR. QUESTIONS & ANSWERS

1. Can key subcontract past performance be used instead of prime contractor past performance?

VA

Response

Past performance information pertaining to a subcontractor cannot be disclosed to the prime offeror without the subcontractor’s consent. Please provide, with your quote, a letter of consent from the key subcontractor authorizing the release of their past performance information for this requirement.

2. Can previously submitted past performance questionnaires be submitted in lieu of new past performance questions specifically for this project?

VA

Response

Previously submitted PPQs that are within 12 months of the solicitation issuance date and CPARS completed by Government personnel will be acceptable for submission in lieu of new PPQs specifically for this project.

3. Can Superintendent, QC, and SSHO Be covered by the same person?

VA

Response

No. The Superintendent can also serve as the Site Safety and Health Officer (SSHO). However, the Quality Control (QC) position cannot be combined with any other role and must be held by a separate individual. Please ensure that the QC role is filled by a designated person who is not assigned any other responsibilities.

4. NAICS Code Applicability for Design-Build Parking Garage Restoration:

The solicitation identifies NAICS 238110 (Poured Concrete Foundation and Structure Contractors) for this two-phase design-build procurement. We respectfully request clarification regarding the rationale for selecting a specialty trade NAICS code for a Design-Build requirement that includes full professional design services and multi-trade construction activities.

Based on our experience with similar VA parking garage restoration and rehabilitation projects, including design-build delivery, these procurements are typically classified under NAICS 236220 (Commercial and Institutional Building Construction), and in some cases 237990, to reflect the general construction and integrated design responsibilities. NAICS 238110 is generally associated with specialty concrete trade contractors and may not fully capture the scope, risk profile, and design responsibility contemplated under FAR 36.3 for Design-Build acquisitions.

Additionally, the use of a 238xxx specialty trade NAICS establishes a significantly lower size standard, which may unintentionally limit competition among otherwise qualified SDVOSB prime contractors with demonstrated design-build experience in parking structure restoration.

Question: Will the Government reconsider the NAICS code assignment for this procurement and evaluate the applicability of NAICS 236220 to better align with the Design-Build scope and to promote maximum practicable competition consistent with FAR Part 19?

VA

Response

Yes. The Government has reviewed your request and agrees to reconsider the NAICS code assignment for this procurement. The solicitation will be evaluated for the applicability of NAICS 236220 (Commercial and Institutional Building Construction) to better align with the Design-Build scope and to promote maximum practicable competition.

5. Reference to Missing Table 1 in Structural Condition Assessments:

Section C, Specific Project Requirements, Paragraph 2 states: “Refer to Attachment 1 and Attachment 2 for the structural assessments. Table 1 of this section provides a summary of findings based on these assessments.”

Upon review of Section C, Attachment 1 (East Garage), and Attachment 2 (West Garage), we do not see Table 1 summarizing the findings referenced. The attachments appear to include narrative descriptions and figures only, without a consolidated table identifying deficiencies, priority levels, or recommended repairs.

Question: Will the Government please provide the referenced Table 1 summarizing the assessment findings, or confirm whether such a table was omitted and is not intended to be included? This clarification is requested to ensure proposers have a consistent understanding of the identified deficiencies and scope development expectations.

VA

Response

Table 1 summary of structural assessment should have been included with the SOW. The table has been included with the RFI responses for Phase I.

6. SOW Item C.2. includes reviewing the reports in Attachments 1 & 2 – SCA East and West Garage Parking Reports and notifying the government if any additional items are noticed. Do we need to prepare a report for the government’s review of our findings before we start preparing the design documents?

VA

Response

It is recommended that the Engineer of Record (EOR) confirm the findings of the report since they will provide the necessary design for repairs. If the EOR determines other findings, than that of the report, the EOR should notify the COR.

7. Can the engineer of record be the third-party engineer if we have AWS certified welding inspectors (CWI) on staff? Contractually, both the structural engineer and the third party are part of the design-build team and are not independent from the contractor.

VA

Response

For clarification, the structural engineer can be in-house if contractor has a design team.

Otherwise, the contractor shall subcontract a structural engineer for the required design. This structural engineer must be a registered professional engineer within the State of Florida. This structural engineer must specify the special inspections in the form of a schedule under spec 01 45 35.

A structural special inspector will be required for this project. Special structural inspector must be third party and comply with all specs. A special inspector is required for this per specifications.

The certified welding inspector is under the umbrella of the special inspector, which is the final approval on all inspections. In other words, the AWS CWI is a part of the team of the special inspector and not part of the design/construction team.

8. Item C.12, does the scope of work include removal and replacement of all joint sealants in the parking garage to assess and repair the shear connectors?

VA

Response

Yes.

9. Would the government consider repairing any broken welded horizontal connections with CFRP shear biscuits instead of rewelding them? From our experience, such connectors are much more durable than typical welded connectors.

VA

Response

This is dependent on the EOR designing the repairs. If the structural EOR can provide signed and sealed calculations and plans indicating this (Florida PE), then the VA is open to other options.

10. Under Volume 1. General Information: should Attachment 3: Specialized Experience Form and Attachment 5: PPQ be submitted in both Volume 1 and Volume 2?

VA

Response

The Specialized Experience Form (Attachment 3) factor 2 and the Past Performance Questionnaire (Attachment 5) factor 3 should not be included in both Volume 1 and Volume 2.

Instead, both documents should only be submitted with Volume 2 in Phase I.
