About this file

This document is an Amendment 0001 Attachment 2 containing Questions and Answers for RFQ 36C24825R0096 related to a solid waste removal contract. The document provides key details about the current contract, including that Hamilton Alliance Inc. is the incumbent contractor with contract number 36C24821D0017. The Q&A clarifies ownership of equipment, with the 30 CYD Compactor owned by Hamilton Alliance Inc. and 30 CYD Open Containers and 8 CYD Front End Loading Containers owned by Waste Management Inc. of Florida.

A notable clarification addresses landfill dump fees, which will count towards the 50% subcontract limitation amount. The document specifies that these fees are considered a principal purpose of the acquisition and cannot be excluded, based on references to federal procurement regulations. This information is part of a solicitation for solid waste collection services for the James A. Haley VA Hospital, which will be a 100% Service-Disabled Veteran-Owned Small Business (SDVOSB) set-aside contract.

NO. QUESTION ANSWER

Who is the current incumbent Contractor?

Hamilton Alliance Inc.

What is the current Contract Number?

36C24821D0017

What is the current or previous contract value?

The current or previous value of the contract can be found at the below Federal Procurement Data System (FPDS) website: https://www.fpds.gov/fpdsng_cms/index.php/en/

Who owns the current compactor and containers?

The 30 CYD Compactor is owned by the incumbent Contractor, Hamilton Alliance Inc.. All the 30 CYD Open Containers, and 8 CYD Front End Loading (FEL) Containers at the JAHVH and at Brooksville CBOC are owned by the current franchise hauler, Waste Management Inc. of Florida.

Are the Landfill Dump Fees excluded from the 50% Subcontract Limitation amount?

In accordance with (IAW) the below:

1.852.219-73 (d)(1) 2.852.219-75 (a)(1)(i)

3.13 C.F.R. § 125.6 (a)(1)

“Other direct costs may be excluded to the extent they are not the principal purpose of the acquisition such as airline travel, work performed by a transportation or disposal entity under a contract assigned the environmental remediation NAICS code (562910), cloud computing services, or mass media purchases.”

Therefore, a determination is made that the Hillsborough County cost for landfill/dump fees is a principal purpose of this acquisition to include collection, transporting, and disposing of solid waste service. The cost for landfill/dump fees cannot be excluded and will count towards the 50% subcontract limitation amount that cannot be exceeded.
