This solicitation will be evaluated on a Trade-Off basis. As stated elsewhere in this solicitation, this procurement is a two (2) Phase Design/Build. IAW FAR 36.3 one solicitation will be issued covering both phases. In Phase I proposals will be evaluated to determine which offerors will submit proposals in Phase II. Block 13a refers to Phase I proposals.

VA Caribbean Hospital is a smoke free facility. Contractors to enter at VA campus, you must have picture ID.
All contractors are required to wear a face covering (covering nose and mouth per CDC guidelines) while on campus.
All contractors will be screened at the entrance of the campus. A series of questions will be asked, and temperature taken. While working on the Medical Center (both inside and outside) the contractor will be responsible to wear a face mask covering their faces at all times. PPE is not provided. See COVID-19 Local Protocol located in Attachment 14.
Refer to solicitation instructions for Phase One cutoff date for submission of Requests for Information (RFIs), or Questions (if any). No Site Visit will be conducted during Phase One of this solicitation.

A. FOREWORD
1. The purpose of the project is to repair damages that occurred during Hurricanes Irma and María in September 2017. The scope of work (SOW) for this project follows the recommendations of the Damage Assessment Team (DAT) Findings for VAMC in San Juan, Puerto Rico.
2. This document contains minimal submission requirements specified for each submission in the production of Construction Documents for this project. It will give VA reviewers and the Design Build-A/E (DB-A/E) a clear understanding of what is required to design.
3. The goal of this SOW is to ensure the quality of VA facilities. This document is not to be used as a standard design and does not relieve the project DB-A/E responsibilities to develop a complete and accurate project design that best meets the users' needs and applicable code requirements or to conduct and produce a correct, complete, and fully coordinated project.
4. The work description below represents the narrative of the work to be performed for the Hurricanes Recovery Project Phase 2 (Project # 672-21-000).
5. This solicitation includes 35% technical specification and drawings t(See Attachments 1 , 2, and 3) that the awardee must complete as a part of his execution of this Design Build contract.

B. PROJECT ACTIVITIES DESCRIPTION
1. Narrative of the work to be performed is described below:

II. Building 2 Laundry
a) Interior System I.2.1 – Repair/Replace damaged ceiling assembly system in office. Detail provided under the 35% Design submission.
C. TENTATIVE SCHEDULE
1. The contractor shall complete the work required under this package is nine hundred and ten (910) calendar days from receipt of “Notice to Proceed” (NTP). Working hours will vary depending on the tasks being accomplished. Work affecting hospital’s operations, for example, interruption of loading dock or normal pedestrian traffic, must be done with timely advance coordination through the COR and the VA Project Manager. Required Electrical Shutdowns must be notified four weeks in advance and shall also be coordinated with the COR and the VA Project Manager.
2. The Offeror shall propose a total contract duration in number of calendar days after the Notice to Proceed (NTP) is received by the Contractor. After review and approval of the proposed total number of calendar days, the duration shall become the required contract duration. The proposed contract duration must include the time required for design, submittals, procurement of materials, construction activities, and inspections. All submittals will be returned to the Contractor within two (2) weeks of submission. Disapproved submittals are not reason for additional time or delay claim for the Contract.
3. The Contractor shall provide the work schedule for all the services that will be performed and must be included in the proposal package.
4. Drawing phase submission schedule:
a. First Submission 50%: The Contractor will receive an A/E 35% complete design from the Government. After the NTP, the Contractor will have 8 weeks to submit a 50% Design Document (DD) to the VA for review and approval. The Contractor shall also coordinate with the COR and the VA Project Manager to present the design verbally. VA will return the schematic design documents review comments, two weeks after the presentation.
Prior to moving into the next submission, the 50% schematic must be approved.
b. Second Submission 75%: Within 8 weeks of 50% DD approval, the Contractor shall submit the 75% DD to VA for review and approval with the incorporated VA comments of the 50% DD. The Contractor shall also coordinate with the COR and the VA Project Manager to present the design verbally. VA will return the schematic design documents review comments, two weeks after the presentation. Prior to moving into the next submission, the 100% schematic must be approved.
c. Final Submission 100%: Within 4 weeks of 75% DD approval, the Contractor shall submit the final 100% Construction Documents (CDs) to VA for review and approval with the incorporated VA comments of the 75% DD. This submission must include finalize full set drawings and specifications including all disciplines/packages to be used for construction. The CDs will incorporate all VA supplied comments from the earlier 50% and 75% submission package reviews and will comply with the Request for Proposal (RFP). If the final construction documents submission package is not complete a post submittal may be required, the cost of which will be borne by the DB Contractor.
5. The Contractor is expected to start construction activities before submitting the 50% design package since there would be already enough design information based on the A/E 35% complete design (pending approval of the construction phasing plan for that 35% design).
Similarly, construction activities will continue before submitting the 100% design package (pending approval of the construction phasing plan for that 50% design).
6. If climate or weather conditions become unsuitable for work or may induce an environmental hazard, the work shall be re-scheduled to a mutually agreed-upon date.
Postponement will not reflect any penalties assessed to the Contractor, nor should there be any additional cost to the Government.
D. SPECIAL OPERATION/CONSTRUCTION CONSIDERATIONS
1. The Contractor is free to propose phasing as best they see fit to complete the activities described above within the specified timeframe, however, the Contractor shall take into consideration VACHS Operational Requirements for Hurricanes Recovery efforts Ph2 document (See Attachment 11) and the following:
a. Work Plan
i. The outside work can be performed simultaneously considering the VACHS Operational Requirements for Hurricanes Recovery efforts Ph2 (See Attachment 11).
ii. After the contract award, the contractor will need to submit a work plan/schedule within 2 weeks for VACHS’s evaluation and approval.
b. Noise and Vibration
i. Contractor shall minimize noise and vibration that will disrupt patient care at each building. Please refer to Specs 01 57 19 TEMPORARY ENVIRONMENTAL CONTROLS and the VACHS Operational Requirements for Hurricanes Recovery efforts Ph2 (See Attachment 11).
c. Infection Control
i. Contractor will need to comply with VACHS’s Infection Control Guidelines on Construction and Renovation, Center Memo No. 11B-17-05 (See Attachment 10).
d. Fumes
i. In addition to the Infection Control Guidelines attached, for all work outside that will generate fumes, contractor will need to install carbon fiber filters and duct diverters on all HVAC intakes within a 50ft radius of the impacted area.
This approach considers changes in wind direction.
e. Leaks
i. Contractor to provide means to cover area impacted to avoid leakages\infiltration. If water damage occurs, the contractor shall deploy cleaning crew within 30 minutes of the event. The Contractor restore space to the pre-existing condition, including mold and mildew removal, floor waxing, ceiling tile replacement, and wall painting. Contractor will be responsible for any damaged equipment.
f. Work Shifts
i. It is important that shifts established in the Operational Requirements document VACHS Operational Requirements for Hurricanes Recovery efforts Ph2 (See Attachment 11) are considered.
ii. Summary
Outpatient Areas 2nd/3rd Shift Inpatient Areas 1st/2nd shift
1st Shift: 8:00am - 4:00pm (16:00 hrs.)
2nd Shift: 4:00pm (16:00 hrs.) – 12:00am (24:00 hrs.)

g. Contractor’s Staging Area and Parking
i. The staging area for this project will be discussed during the initial meetings.
It is important to consider that only a limited staging area will be provided for quick turnaround material deliveries and dumpster and/or HAZMAT containers. At this time the contractor will need to consider office and storage space outside VACHS premises
ii. VACHS will not provide parking to contractor.
E. GENERAL CONSTRUCTION REQUIREMENTS
1. Some of the General Construction Requirements listed below may be repetitive from other specifications included in this package. These requirements are not listed in any specific order; the requirements are intended to stress important areas to the VA; however, the selected Contractor shall follow all the requirements described below and, the ones presented on the specifications and plans documents provided in this package.
2. The contractor shall provide all labor, materials, tools and equipment, and design-build services necessary for design and construction of a project described in the entire package of the Hurricanes Recovery Projects Ph2 for the VA San Juan Medical Center. Work includes the specialized construction labor, certified technicians and supervision work, Technical Support; materials & equipment’s provision; and certain other related architectural, mechanical, structural, electrical, and demolition work.
3. All the quantities that are indicated or successively added are estimates. Therefore, the government shall not be held responsible for the accuracy of the estimated quantities. It is therefore the responsibility of the contractor to calculate, foresee and perform all quantities and work necessary even if not mentioned in the specifications but included in the drawings and/or are manifested, to deliver a complete project based on its overall scope. The Government will not be responsible for any error or variation in the square footage listed.
Contractor shall verify square footage by means of a proper site visit and shall be responsible with the intent of the areas covered in this solicitation thereafter called “contract”.
4. Any drawings provided in the solicitations are to be considered as informational only. All drawing data must be contractor verified in the field.
5. The contractor shall be responsible to obtain all state and federal permits required for construction and waste disposal. The contractor shall be responsible for preparing all the necessary documentation for all the endorsements and applicable permits including all environmental permits. Also, the contractor shall be responsible to submit all applicable permit applications and obtain the approval of such permits.
6. The contractor shall comply with the Federal Government policy on waste recycling, disposition and shall present a Waste Management Plan to be approved by the facility Environmental Department.
7. The Contractor is responsible for ensuring that materials and supplies are in accordance with VA policy for no or low Volatile Organic Compounds (VOC).
8. Contractor shall completely prepare site, prior to the installation of the equipment, and furnish all labor, equipment, and materials necessary to perform work for this specific project as required by this statement of work and the project specifications and drawings (See Attachments 1, 2, and 3).
9. All projects’ associated construction and temporary works shall conform to the latest VA specifications, VA Standards, energy conservation methods, EPA, OSHA, NFPA, NEC, ASHRAE, LIFE SAFETY CODE, UBC, local, Federal and industry requirements and regulations.
10. Temporary construction partitions must meet the guidelines set forth in the ICRA specific to the Contract
11. Contractor shall keep the VA Project Manager/COR and Contracting Officer informed at all times of the status and progress of the project.
12. Detailed Schedule and Narrative: The Contractor shall provide a detailed phasing schedule and written narrative, indicating specific dates for each step of the construction process in concurrence with the progress schedule.
13. Contract Progress Schedule: The progress schedule will be provided in a time scaled bar graph format for each project phase. The horizontal axis will be scaled for time beginning with the Notice to Proceed and concluding with contract completion. The vertical axis will show the milestones and a detailed breakdown of the construction tasks. All schedule items will show a start date and a completion date.
14. The Contractor shall breakdown the construction period in construction tasks as required, (e.g.: site preparation, demolition, equipment procurement, equipment/materials delivery, equipment installation, tests, and final inspection, etc.)
15. The Contractor shall develop a well-organized, practicable and complete written narrative construction phasing for the proposed project in order that the normal hospital operations will not be interrupted except by previous and timely coordination with VA staff through the VA Project Manager/COR.
16. The narrative will also detail how the contractor intends to prepare the site, disassemble, relocate, reassemble, and reactivate the services to the Medical Center within the specified time limits.
17. The staging area for this project has been designated as a 60ft x 40ft area located near Building 10 – Community Living Center (CLC). The attached document (See Attachment 6) Proposed Staging Area - Site Plan- Hurricanes Recovery Ph1.pdf depicts the location in red color.
18. The Contractor shall specify how much allowance has been made for bad weather in the schedule.
19. The Contractor shall specify the days of the week and the hours of construction operations during each phase of the work and report entry and exit in Operations Control Center office.
20. The Contractor shall prepare written minutes of each meeting with the Government concerning contractual, design and construction matters. Copies of the minutes shall be furnished to the Contracting Officer and within two (2) calendar days of the meetings. The Contractor shall prepare written records of phone conversations addressing major project issues and furnish a copy to the Contracting Officer within five (5) calendar days of contract.
21. Other submittals: The Contractor shall submit test results, certificates, manufacturer’s instructions, manufacturer’s field reports, installation & operation manuals, etc.
22. Project Record Drawings: The Contractor will maintain a set of Record Drawings. The Contractor will maintain a set of construction documents (field as-built drawings) to record actual construction changes during the construction process. The project record drawings will be always available for review by the COR or the VA Project Manager.
23. Shop drawings and submittals: The DB A/E shall check government furnished and/or the DB construction contractor's shop drawings, detail drawings, schedules, descriptive literature and samples, testing labor-laboratory reports, field test data and review the color, texture, and suitability of materials for conformity with the RFP documents and construction documents. The DB A/E shall recommend approval, disapproval, or other suitable disposition to the COR. The COR have final approval authority. The DB AE shall evaluate the submittals with reference to any companion submittals that constitute a system. When necessary, the DB A/E will request the DB Construction Contractor to submit related components of a system before acting on a single component. Should this procedure be inappropriate, the DB A/E shall review all prior submittals for related components of the system before acting on a single component. The DB A/E may be required to hold joint reviews with the VA technical staff and /or the COR on complicated system submittals. The DB A/E shall notify the COR in writing of all deviations from the requirements of the construction documents that he has found in the submittals.
24. The DB contractor shall distribute a total of two (2) packages of the approved construction documents prepared by the DB Team: one (1) package for the COR and one (1) package for the VA Project Manager.
25. Design and construction submission packages: The DB/AE shall prepare and submit required submission packages. Each submission package shall include: two (2) full, two (2) half hard copies, and two (2) set on CD-ROM (one set in DWG format, and one set in PDF format). Also, the package shall include an index of drawings (by sheet number and tittle) and specifications (by section number and tittle). Drawings will be executable in AutoCAD version 2016. The DB/AE shall provide for each submission a verbal presentation of his/her work to the COR, the VA Project Manager and any other VA staff as determined to be appropriate by the COR. Verbal presentations shall be coordinated with the COR.
26. The Contractor shall develop a complete set of as-built drawings at the end of the construction work and submit it for VA review and approval in AutoCAD 2016 (or newer version).
27. Any related supporting system, apparatus, material or work not mentioned, or any incidental accessories necessary to make the work complete in all respects and ready for operation even if not particularly specified, shall be furnished, delivered, and installed by the Contractor without additional cost to the Government.
28. Construction General Sections' applicable requirements: the Contractor shall comply with the applicable construction project requirements (e.g. submission of final as-built drawings, shop drawings, tests, safety requirements, new material and equipment provision and installation requirements, Buy American Act, payment and performance bonds requirements; insurance requirements; progress payments and schedules, work inspection and supervision, daily logs requirements, material and workmanship, warranty, cleaning up, accident prevention, and other requirements) included in the specifications.
29. The contractor guarantees the equipment against defective material, workmanship, and performance for a period of one year, said guarantee to run from date of acceptance of the equipment by the Government. The contractor agrees to furnish, without cost to the Government, replacement of all parts and material that are found to be defective during the guarantee period. Replacement of material and parts will be furnished to the Government at the point of installation, if installation is within the continental United States, or f.o.b. the continental U.S. port to be designated by the contracting officer if installation is outside of the continental United States. Cost of installation of replacement material and parts shall be borne by the contractor.
30. Any equipment system must be installed and integrated by a manufacturer certified personnel.
31. The contractor must provide adequate Training for all end users.
32. All contractor employees and subcontractor employees requiring access to VA information and VA information systems shall complete VA Privacy and Information Security Awareness and Rules of Behavior Training before being granted access to VA information and its systems.
33. The contractor shall provide to the Contracting Officer and/or the COR a copy of the training certificates and certification of signing the Rules of Behavior for each applicable employee within 1 week of the initiation of the contract and annually thereafter, as required.
34. Failure to complete the mandatory annual training and sign the Rules of Behavior annually, within the timeframe required, is grounds for suspension or termination of all physical or electronic access privileges and removal from work on the contract until such time as the training and documents are complete.
35. Prior to any mobilization and construction, the contractor shall request and have approved an Infection Control Construction Permit, a Construction Safety Certification, and an Interim Life Safety Measures Certification from the VA Medical Center. Also, project schedule and construction phases must be approved by COR, and VA Chief Engineering. Contractor shall provide all necessary environmental documents and related EQB approved permits for construction.
36. The Contractor shall comply with all applicable federal, state, and local requirements for protecting the safety of the contractor’s employees, building occupants and the environment.
All applicable standards of the Occupational Safety and Health Administration (OSHA) shall be followed when working in accordance with this project. No process or materials shall be employed in such a manner that they will introduce additional hazards into occupied space.
37. Contractor shall have comprehensive knowledge, experience, expertise, equipment, and personnel to complete this work.
38. Pedestrian and Vehicular Maintenance of Traffic: The construction of the proposed project shall always allow for full operation of the existing hospital and maintaining the operations of all existing utility services and fire exits. In addition, it shall maintain free and unobstructed access to facility emergency vehicles and for fire, police, and other emergency response forces in accordance with NFPA 241. The phasing plan on the contract drawings will indicate, primarily throughout written and graphical instructions, the general sequencing and staging for each phase of the site and project development construction. Contractor is to submit a phasing plan for VA final approval. The Contractor shall provide an equivalent continuous secured perimeter while work is performed to prevent intrusion to the federal premises.
39. Prior to the initial Pre-Construction Meeting, Contractor shall submit a list key personnel (Project Manager, on-the-job Superintendent, Quality Control Manager, Safety Representative, etc.) to be involved in this project including name of individual, tasks to be assigned to that individual on this Project, percentage of workweek to be committed to this Project, and authority of that individual to act on behalf of the Contractor. All key personnel shall submit evidence of their OSHA 30-hour construction safety training. VA expects to have a Project Manager, Quality Control Manager, Safety Representative (Site Safety Health Officer or SSHO), and Superintendent on-site fully devoted for this project. The Project Manager shall be committed a minimum of 30% of work per week on this project and be present on site the same percentage. The Quality Control Manager, Safety Representative and Superintendent, shall be committed a minimum of 100% of work per week on this project and be present on site the same percentage. The Safety Representative and Superintendent may be the same person without requiring more than 100% of work per week.
40. The DB A/E who prepares the construction documents shall be a professional architect or engineer licensed in Puerto Rico. The professional seal indicating such license by Commonwealth of Puerto Rico shall appear on the final construction documents. The architect whose seal is shown will be known as the Architect of Record. The DB A/E shall certify compliance with the solicitation and all applicable codes.
41. Quality Assurance/Quality Control (QA/QC): To reduce design errors and omissions, the DB team shall develop and execute a QA/QC plan that demonstrates the project plans and specifications have gone through a rigorous, thorough review and coordination effort. Within two (2) weeks of receipt of Notice to Proceed, the DB Team will submit a detailed QA/QC plan describing each QA/QC task that will be taken during the development of the various design submission packages and the name of the DB Team member responsible for QA/QC. Upon its completion, each task shall be initialed and dated by the responsible DB Team member.
42. A 100% completed QA/QC plan shall be submitted with the final construction document submission package.
43. Include, as a minimum, the following to cover all design and construction operations, both onsite and offsite, including work by subcontractors, designers of record, consultants, architect/engineers (AE), fabricators, suppliers, and purchasing agents:
a. A description of the quality control organization, including a chart showing lines of authority and acknowledgment that the CQC staff will implement all aspects of the work specified.
b. The name, qualifications (in resume format), duties, responsibilities, and authorities of each person assigned a CQC function.
c. Procedures for scheduling, reviewing, certifying, and managing submittals, including those of subcontractors, designers of record, consultants, architect- engineers (A/E), offsite fabricators, and suppliers.
d. Control, verification, and acceptance testing procedures for each specific test to include the test name, specification paragraph requiring test, feature of work to be tested, test frequency, and person responsible for each test.
e. Procedures for tracking preparatory, initial, and follow-up control phases and control, verification, and acceptance tests including documentation.
f. Procedures for tracking design and construction deficiencies from identification through acceptable corrective action. Establish verification procedures that identified deficiencies have been corrected.
g. Reporting procedures, including proposed reporting formats.
h. A list of the definable features of design and construction work. A definable feature of work is a task which is separate and distinct from other tasks, has separate control requirements, and may be identified by different trades or disciplines, or it may be work by the same trade in a different environment. Although each section of the specifications may generally be considered as a definable feature of work, there are frequently more than one definable feature under a particular section.
44. All vendor/contract personnel must report to the Police Service and identify themselves upon entering the VACHS facility. They shall all abide by Police Service rules and personal identification verification (PIV) regulations, process and to carry the identification card throughout the entire period while providing the service.
45. Contractor shall coordinate activities closely with the COR and the VA Project Manager.
Personnel is required to interrupt their work at any time so as not to interfere with the normal functioning of the facility, including utility service, fire protection systems, and the passage of facility patients, personnel, equipment, and carts.
46. Contractor shall take all measures and provide all necessary means for protecting existing equipment and property in affected areas of construction against damage, dust, and debris, so that equipment and affected areas to be used in the Medical Centers operations will not be hindered.
47. Any Damage caused by contractor to Medical Center property, despite protection measures shall be immediately restore/ repair to its original condition at no additional cost to the government.
48. Site Visits and Inspections: During the construction period the DB A/E shall make weekly visits to the project site when requested by the COR. The COR or the VA Project Manager may also request visits for special purposes and access shall be granted within 2 hours of request. Only registered architects and engineers thoroughly familiar with the project may make these site visits. The COR has the prerogative to determine the professional discipline(s) required for any visit. The DB A/E shall observe the construction, advise the COR of any deviations or deficiencies or solutions to issues discussed. A site inspection report which includes the purpose of the inspection, items reviewed, deficiencies observed, recommendations and additional actions required, shall be furnished to the COR within three (3) workdays following the site visit date.
49. Clean-up and Disposal: The Contractor shall be responsible for the removal and disposal of all trash/debris connected with construction activities daily. The Medical Center will provide access to necessary dumpsters. Recyclable products shall be disposed of in accordance with applicable statutes, in respective containers.
50. Project Close-Out: The DB team shall comply with the requirements in FAR 4.804 Closeout of Contract Files, for submission of final RFP as built drawings, manuals, and other documents as noted. Required as built drawings and specifications will be submitted in the same format required for the construction documents.

SECONDARY SITE OF THE WORK (MAY 2014)
(a)(1) The offeror shall notify the Government if the offeror intends to perform work at any secondary site of the work, as defined in paragraph (a)(1)(ii) of the FAR clause at 52.222-6, Construction Wage Rate Requirements, of this solicitation.
(2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.
(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the Contracting Officer.
(2) The due date for receipt of offers will not be extended as a result of an offeror's request for a wage determination for a secondary site of the work.

2.3 52.222-23 NOTICE OF REQUIREMENT FOR AFFIRMATIVE ACTION TO
ENSURE EQUAL EMPLOYMENT OPPORTUNITY FOR CONSTRUCTION
(FEB 1999)
(a) The offeror's attention is called to the Equal Opportunity clause and the Affirmative Action Compliance Requirements for Construction clause of this solicitation.
(b) The goals for minority and female participation, expressed in percentage terms for the Contractor's aggregate workforce in each trade on all construction work in the covered area, are as follows:

(c) The Contractor's compliance with Executive Order 11246, as amended, and the regulations in 41 CFR 60-4 shall be based on (1) its implementation of the Equal Opportunity clause, (2) specific affirmative action obligations required by the clause entitled "Affirmative Action Compliance Requirements for Construction," and (3) its efforts to meet the goals. The hours of minority and female employment and training must be substantially uniform throughout the length of the contract, and in each trade. The Contractor shall make a good faith effort to employ minorities and women evenly on each of its projects. The transfer of minority or female employees or trainees from Contractor to Contractor, or from project to project, for the sole purpose of meeting the Contractor's goals shall be a violation of the contract, Executive Order 11246, as amended, and the regulations in 41 CFR 60-4. (d) The Contractor shall provide written notification to the Deputy Assistant Secretary for Federal Contract Compliance, U.S. Department of Labor, within 10 working days following award of any construction subcontract in excess of $10,000 at any tier for construction work under the contract resulting from this solicitation. The notification shall list the—
(1) Name, address, and telephone number of the subcontractor;
(2) Employer's identification number of the subcontractor;
(3) Estimated dollar amount of the subcontract;
(4) Estimated starting and completion dates of the subcontract; and
(5) Geographical area in which the subcontract is to be performed.

2.4 52.225-11 BUY AMERICAN—CONSTRUCTION MATERIALS UNDER
TRADE AGREEMENTS (NOV 2021) ALTERNATE I (JAN 2021)
(a) Definitions. As used in this clause—
Bahrainian, Mexican, or Omani construction material means a construction material that—
(1) Is wholly the growth, product, or manufacture of Bahrain, Mexico, or Oman; or
(2) In the case of a construction material that consists in whole or in part of materials from another country, has been substantially transformed in Bahrain, Mexico, or Oman into a new and different construction material distinct from the materials from which it was transformed.
Caribbean Basin country construction material means a construction material that—
(1) Is wholly the growth, product, or manufacture of a Caribbean Basin country; or
(2) In the case of a construction material that consists in whole or in part of materials from another country, has been substantially transformed in a Caribbean Basin country into a new and different construction material distinct from the materials from which it was transformed.
Commercially available off-the-shelf (COTS) item—
(1) Means any item of supply (including construction material) that is—
(i) A commercial product (as defined in paragraph (1) of the definition of ‘‘commercial product’’ at Federal Acquisition Regulation (FAR) 2.101;
(ii) Sold in substantial quantities in the commercial marketplace; and
(iii) Offered to the Government, under a contract or subcontract at any tier, without modification, in the same form in which it is sold in the commercial marketplace; and
(2) Does not include bulk cargo, as defined in 46 U.S.C. 40102(4), such as agricultural products and petroleum products.
Component means an article, material, or supply incorporated directly into a construction material.
