PROJECT LOCATION: Charlie Norwood VAMC, 1 Freedom Way (Uptown), Augusta GA 30904

GENERAL DESCRIPTION: The scope of this project is renovation of 32,600 square feet (SF) of existing building footprint of the 1st floor of wings 1D & 1E, plus 7,680 SF of new 1 story addition all combined to house a 27 bed Community Living Center located on the Charlie Norwood Veterans Affairs Medical Center Campus – Uptown in Augusta, Georgia. The work includes complete demolition of 3,900 SF of existing 1 story structure to accommodate the new community living center.

SET-ASIDE INFORMATION: This solicitation will be issued pursuant to the authority under Public Law 109-461 (38 U.S.C. 8127) and is a 100% Set-Aside for Service-Disabled Veteran-Owned Small Business (SDVOSB). The SDVOSB must be a small business under the relevant North American Industrial Classification Standard (NAICS) code and MUST be registered and verifiable at http://www.vip.vetbiz.gov and www.sam.gov to be eligible for award. Offerors MUST ensure registration in these websites are accurate, complete and have not expired prior to proposal due date.

NAICS CODE: The applicable NAICS code is 236220 and the small business size standard is $36.5 Million.

MAGNITUDE OF CONSTRUCTION: Between $5,000,000.00 and $10,000,000.00

Request for Information (RFI): RFI/questions are due by 03/06/18 at 4:00 pm EST by email to elissa.goodman@va.gov. Late RFIs may not be accepted and offerors are responsible of ensuring questions are received by the Contracting Officer.

Site Visit: Only one site visit will be conducted and is scheduled for 2/28/18 at 10 A.M. EST, 1 Freedom Way, STE GD110 Information provided at the site visit shall not alter the terms and conditions of the solicitation and specifications.

Terms of the solicitation and specifications remain unchanged unless the solicitation is amended in writing.

Contractors are required to submit all questions in writing to the Contracting Officer following the site visit.

The Government intends to make a single award the Base Item and Additive Alternates 2 through 13. If funding is not available to award the Base Item and Additive Alternates 2 through 13, the Government will proceed with awarding the Base Item and as many Additive Alternates that the budget will permit.

The Period of Performance for the base proposal is established as 365 Calendar days for the Base Bid and includes the completion of all punch list items For each additive alternate listed (Item 2 through Item 15), each offeror is to provide the time that it will add to complete the work.

ITEMIZED COST BREAKDOWN - All proposals shall include a detailed cost breakdown (materials, labor, and equipment) by trade and include overhead, profit, and bond costs and breakdown of G&A. Failure to submit a complete cost breakdown may render your proposal as non-responsive.

A.2 STATEMENT OF WORK

509-326 Construct Community Living Center Charlie Norwood VAMC, Augusta, GA Construction Scope of Work

III. SELECTION CRITERIA

I. OVERVIEW:

Contractor shall provide all materials, equipment, and labor to complete Construct Community Living Center project at the Charlie Norwood VAMC (CNVAMC) Uptown Division in accordance to A/E design and specifications. Work shall include renovation of Building 110 wings 1D & 1E, courtyard and adjoining atrium area.

Contractor shall phase construction in order to accommodate patients currently in the 1D wing.

Period of construction is not to exceed 365 days.

II. CONSTRUCTION REQUIREMENTS

1. Provide daily on-site project management to coordinate all building trades and provide liaison for construction and VA Project Engineering. General Foreman will be designated and be on-site at all times with authority to act on behalf of the construction firm.

2. Contractor shall follow Infection Control Risk Assessment (ICRA) guidelines for dust control during all construction work. A construction dust “Risk Assessment” will be conducted by the Medical Center’s Infection Control Nurse.

3. The construction contractor shall provide barriers to separate the construction area from the patients, staff and visitors at the medical center. Special considerations will need to be considered for this design, such as shielding of the rooms.

4. When installing equipment that requires a crane, work must be coordinated through VA Project Engineering and VA Police to close roadways – one week notice is required Submittals shall be sent to VA for approval (minimum five copies) before starting that portion of the work.

5. All equipment and materials shall be approved prior to being brought on job site.

6. Normal work hours are Monday through Friday 7:00 a.m. to 5:00 p.m. Contractor shall make prior arrangements to work earlier or later with Project Manager. Also, contractor shall make arrangements for sub- contractors to work in secured areas. VA will not grant access to subs, it is the responsibility of the contractor.

7. Daily logs are required the following date of each day worked.

8. When using special keys for access to roof, mechanical and electrical areas, and doors must be kept closed and locked while in such spaces.

9. Contractor must obtain a welding permit from VA Safety Office prior to any welding, soldering work and burning.

10. Contractor must obtain penetration permit from VA Project Manager prior to any penetrations being made.

11. Contractor shall report any previous unsealed penetrations to COR. If not notified, contractor assumes responsibility of unsealed penetrations.

12. Contractor supervisors and tradesmen must obtain Augusta VA Contractor badges before working in Medical Center. Security forms must be completed and fingerprints taken to obtain a badge. The COR shall schedule the badge process with the contractor. Badges must be worn at all times while on Site.

13. The work is in a professional environment, employees must conduct themselves accordingly. Employees shall not use abusive language, carry firearms, or bring alcoholic beverages on site. Employee's dress code shall consist of normal work uniform. Shirts must be worn at all times.

14. Contractor shall provide general clean up to construction area daily to the satisfaction of the VA Project Manager. Prior VAMC approval must be obtained by the contractor for locating a trash dumpster. The cost of the dumpster will be at the expense of the contractor.

15. The Hospital smoking policy is NO SMOKING WITHIN 35 FEET OF THE BUILDING.

16. OSHA and VA CONSTRUCTION SAFETY STANDARDS will be enforced. The Contractor Job Superintendent must have 30 hour OSHA Construction Safety course. Other construction trades must have a minimum of a 10 hour OSHA construction Safety course.

17. Contractor and any sub-contractors, shall provide parking of station for personnel, except for loading and unloading purposes.

18. Contractor shall maintain a full set of as-built drawings during construction that shall be submitted to VA Project Engineer at project conclusion.

19. Start up, test, check and adjust all new units in the presence of the VA COR.

20. Remove all demolished equipment and restore site.

A.3 PROPOSAL PREPARATION, EVALUATION, AND BASIS FOR AWARD

This part describes the precise mechanism for evaluating and selecting offers for Project No. 509-326, Construct Community Living Center.

1. PROPOSAL SUBMISSION INSTRUCTIONS:

Due to size limitation in posting requirement, specifications and drawing will not be attached. Prospective offerors will have access to the specifications and drawing by clicking on the following link:

Once the link is no longer active, prospective offerors will not have access to specifications and drawings.

Prospective offerors must submit:

Interested firms are responsible for ensuring electronic delivery of submission by the time and the date specified. It will be highly recommended interested firms confirm electronic submissions have been received by the Contracting Officer.

To assure timely and equitable evaluation of proposals, offeror must follow the instructions contained herein. Proposals must be complete, self-sufficient, and respond directly to the requirement of this solicitation.

Offerors must provide all requested information for each factor and sub-factor. Proposals must separately address each element of each factor and sub-factor as applicable to be considered responsive to this RFP. Factor and sub-factors headings must be highlighted in yellow or typed in bold text for identification. It is the contractor’s responsibility to ensure the submitted proposal is in the proper format, the provided information is clearly understood and free of ambiguities.

2. TECHNICAL EVALUATION FACTORS:

Relative Importance of the Factors: Factor 1 is significantly more important than Factor 2. Factor 2 is significantly more than Factor 3 and 4. Factor 3 and 4 are of equal importance. All technical factors, when combined, are of significantly more importance than cost/price.

A. FACTOR 1 - CORPORATE RELEVANT SPECIALIZED EXPERIENCE:

1) Provide information for at least five projects for which the Offeror has been responsible as prime contractor. Included in the five submitted projects shall be a minimum of three projects in which in-patient or extended living is main purpose of the renovation. Three of the projects must have been performed at a medical facility. The projects should be similar in project type, scope, and complexity. Similar also means Demolition and Construction projects with a value between $5 Million and $10 Million within NAICS 236220 (Commercial and Institutional Building Construction). If the Offeror represents the combining of two or more companies for the purpose of this RFP, each company should list project information. Submitted projects must have been completed or substantially (70%) completed within the last six years.

2) The information regarding the project should include at a minimum the following information:

· Contact names and telephone numbers for all Project(s)

· General character of the project(s)

· Scope of the Project(s)

· Location of the project(s)

· Cost of the project(s)

· Date of completion of the project(s)

B. FACTOR 2 - CORPORATE RELEVANT MEDICAL EXPERIENCE:

1) Offerors will be evaluated to the extent to which they identify as prime contractor’s past and present experience in performing work in a hospital, Department of Veterans Affairs Medical Center or Department of Defense Medical Facility. If the Offeror represents the combining of two or more companies for the purpose of this RFP, each company should list project information. Submitted project must have been completed or substantially (70%) completed within the last six years and should be within the dollar magnitude of this solicitation. (Identify at least four projects).

2) The information regarding the project should include at a minimum the following information:

· Contact names and telephone numbers for all Project(s)

· General character of the project(s)

· Scope of the Project(s)

· Location of the project(s)

· Cost of the project(s)

· Date of completion of the project(s)

C. FACTOR 3 - TECHNICAL AND MANAGEMENT APPROACH (Maximum of 4 pages):

1) Sub Factor 1- Organizational Chart:

Discuss key personnel and individuals on the project team that show clear lines of authority, responsibility, and communication between corporate staff, key on-site staff, and subcontractor interface. The chart should propose a logical flow of authority and demonstrate that assigned responsibilities and experience of proposed on-site personnel will enhance the operation of the project. For these individuals, the Offeror shall also supply brief biographical data including name of individual, company position, years with the company, work and educational background (including degrees, certificates and granting institutions), experience applicable to this project, and percentage of work week to be committed to this project.

2) Sub Factor 2 - Quality Control:

Discuss how quality issues will be dealt with on various types of construction projects. Include in the discussion as a minimum, meetings, inspections, submittal reviews, correction of non-compliant work and how you intend to ensure non-reoccurrence and reporting of quality problems to Government officials. (Note: A full Quality Control Plan will be required if you are awarded a contract and is NOT required with the proposal. If you do provide a plan, indicate if it is a draft for this contract or a sample from another project. Also, provide on this form the page numbers where the required information (list of minimum information above) can be found. If you fail to follow these instructions, your proposal may not be adequately evaluated.)

3) Sub Factor 3 - Safety:

Discuss your Safety Program in general, and provide as a minimum, details on training, documentation, and your plan to ensure adherence to OSHA Standards. (Note: A full Safety Plan will be required if you are awarded a contract and is NOT required with the proposal. If you do provide a plan, indicate if it is a draft for this contract, a sample from another project or a corporate plan. Also, provide on this form the page numbers where the required information (listed above) can be found. If you fail to follow these instructions, your proposal may not be adequately evaluated.)

4) Sub Factor 4 - Schedule:

a. The Offerors shall provide a draft progress schedule that demonstrates the offeror’s knowledge of appropriate sequencing and duration of work activities. The schedule shall identify all major tasks expected during project performance recognizing the appropriate sequence and realistic duration of each task.

b. Each offeror shall submit a draft Progress Schedule required by VAAR 852.236-84(a) of the General Conditions to support capability to meet the project completion schedule. The draft shall be prepared as if award on the Base Bid is made on or about April 1, 2018, and Notice-to-Proceed issued within ten (10) calendar days of award. The timeframe shall be from Notice to Proceed through Final Acceptance in accordance with the performance period specified on the SF 1442. The schedule shall be broken down by trade or major division of work showing start and completion dates. The major work divisions shall be further broken down into detailed tasks and critical milestones with linkages between tasks. The Offeror shall specify allowances for bad weather, days of the week and hours of operation during each phase of the work, and the percentage of contract completion that will be achieved at the end of each month of the contract period.

D. FACTOR 4 - PAST PERFORMANCE:

1) The Government will evaluate the Offerors past performance using the sources available to it including the example projects identified by the Offeror under Factor 1. Offerors may be provided an opportunity to address any negative past performance about which the Offeror has not previously had an opportunity to respond. The Government treats an Offeror’s lack of past performance as having no positive or negative evaluation significance. Past performance, which is considered by the Government to be similar in size and scope, may be considered by the Board to be more advantageous. The Offeror shall submit past performance information on a minimum of at least three completed project in the past three years that are relevant in scope, complexity, and size to the work identified in the SOW.

2) Offeror or subcontractor must not review the past performance questionnaire prior to submission. They must be submitted by the client/evaluator directly to the Contracting Officer. It is the responsibility of the offeror to ensure past performance questionnaires are received in accordance with the instructions listed and that each questionnaire clearly identifies the Offeror. Questionnaires submitted with the proposal will not be accepted. Completed past performance questionnaires shall be mailed to: emailed to elissa.goodman@va.gov

3) Recent – ongoing contracts with a performance history, and contracts with a minimum of 70% completion within six (6) years from the issue date of this solicitation (see Standard Form 1442, Block 3); (2) Relevant – construction work within operating hospital environment which is the same or similar in scope, magnitude, trade, and complexity, as described in the solicitation, including the specifications and drawings, contract type, contract environment, subcontractor interaction, and price. If a project is used in Factor One and it is 100% complete the CPARS MUST be included in this section.

4) Projects shall demonstrate work similar to that described in the RFP. Below is a list of project information that shall be identified for the projects submitted.

· Project name, location and description

· Type of facility

· Nature of firm’s responsibility (design, construction or both)

· Project owner’s name and address and project manager’s (point of contact) name, telephone number, fax, and email address (if known)

· Original scheduled completion date

· Actual completion date

· Overall size of project (in square feet or square meters)

· Construction cost

· Duration of construction

· Problems encountered and corrective actions taken

· Copies of recent performance evaluations for similar projects

· Performance rating of that project

· Letters of Appreciation or Awards (limit to three (3))

5) If the Offeror is made up of separate construction companies that have combined for this project, then Past Performance Information must be completed for each company.

6) Contractor Team Arrangements. Contractor Team Arrangements are considered an arrangement in which (1) two or more companies form a partnership or joint venture to act as a potential prime contractor; or (2) a potential prime contractor agrees with one or more other companies to have them act as its subcontractors under a specified Government contract or acquisition program.

7) Offeror proposed teaming arrangements, as defined above, and company relationships shall be fully disclosed in the proposal. All prospective Joint Ventures must comply with Part 13 Code of Federal Regulations (CFR) 124.513. For reference and evaluation purposes the Offeror shall identify the major or critical aspects to be performed by those identified in the Contractor Team Arrangement.

8) Other Sources. The Government may contact sources other than those provided by the Offeror for information with respect to past performance. These other sources may include Past Performance Information Retrieval System (PPIRS), Dun and Bradstreet, Excluded Parties List System, Central Contractor Registration, Online Representations and Certifications Application, and other publically accessible databases, telephone interviews with organizations familiar with the Offeror’s performance, and Government personnel with personal knowledge of the Offeror’s performance capability

9) The offeror may include client or third party documentation as part of their proposal demonstrating how well they performed on relevant projects. Submit awards, customer letters of commendation, or customer performance evaluations. The offeror must submit this information for past performance evaluation or affirmatively state that it possesses no relevant past performance.

10) The Government will evaluate the offerors past performance based upon the project information submitted. Offerors lacking relevant past performance history will not be evaluated favorably or unfavorably in past performance. However, the proposal of an offeror with no relevant past performance history, while rated as “Neutral” in past performance, may not represent the most advantageous proposal to the Government.

E. FACTOR 5 – PRICE: Price proposal shall be submitted separately from the technical proposal

3. BASIS FOR CONTRACT AWARD

A. Source Selection Using Tradeoff Process IAW: This is a competitive Request for Proposal (RFP) that represents the best value to the Government conducted under Federal Acquisition Regulation (FAR) Subpart 15.1 using the tradeoff process and evaluated in accordance with FAR Subpart 15.3, Source Selection.

B. Evaluation Overview:

1) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, technical and price factors considered. The proposals must conform to the RFP's requirements and evaluated to represent the Best Value to the Government using the trade-off approach. The Best Value is the most advantageous offer, consistent with the Government's stated importance of evaluation criteria.

2) To receive consideration for award, a rating of no less than “Satisfactory” must be achieved for all technical factors. Offerors are cautioned that the award may not necessarily be made to the lowest priced offeror.

3) Offerors must provide all requested information for each factor and sub-factor. Proposals must separately address each element of the factors as applicable to be considered responsive to this RFP. Factors and sub-factor headings must be highlighted in yellow or typed in bold text for identification. Recommend each titled factor and sub-factor heading in the submitted proposal be stated in the chronological order shown below. This format establishes a direct correlation between the information provided and the factor and sub-factor for evaluation. It is the contractor’s responsibility to ensure the submitted proposal is in the proper format, the provided information is clearly understood and free of ambiguities.

4) Best value will be determined by a comparative assessment of proposals against all source selection criteria in this RFP. In order to determine which proposal represents the best overall value, the Government will conduct a tradeoff analysis, comparing the strengths and weaknesses of the competing proposals to determine which proposal(s) represent(s) the best value to the Government and thus shall receive contract award.

5) The Government reserves the right to accept other than the lowest priced offer. The right is also reserved to reject any and all offers. The basis of award will be a conforming offer, the price or cost of which may or may not be the lowest. If other than the lowest offer, it must be sufficiently more advantageous than the lowest offer to justify the payment of additional amounts.

6) Offerors are reminded to include their best technical and price terms in their initial offer and not to automatically assume that they will have an opportunity to participate in discussions or be asked to submit a revised offer. The Government may make award of a conforming proposal without discussions, if deemed to be within the best interests of the Government.

7) Award will result in a firm-fixed price contract. It is the Offeror’s responsibility to ensure the submitted price proposal includes all costs for total project requirements and completion in accordance with the specifications and drawings herein. The Offeror assumes all risk for omissions in subcontractor proposals.

8) The Government intends to award the Base Item and Additive Alternates 2 through 13. If funding is not available to award the Base Item and Additive Alternates 2 through 13, the Government will proceed with awarding the Base Item and as many Additive Alternates that the budget will permit.

9) The Government evaluation team will consider all information provided in the proposal individually. Once these individual analyses are completed, the team will meet and determine a rating by consensus decision.

10) Exceptions to the contractual terms and conditions of the solicitation (e.g., standard company terms and conditions) may result in a determination to reject a proposal.

11) Failure to submit all the data in the format indicated in this section may be cause for determining a proposal incomplete and, therefore, not considered for evaluation, and for subsequent award.

C. SDVOSB Verification: The Government will review VetBiz (https://www.vip.vetbiz.gov/) to confirm Service Disabled Veteran-owned Small Business (SDVOSB) status verification for the submitted proposals. Evaluations will be performed on proposals submitted by verified SDVOSBs only. Subsequent confirmation of SDVOSB verification status will be performed for the apparent award.

D. EMR Rating: As indicated above, as part of the technical proposal, the offeror must provide documentation to substantiate a current EMR rating of 1.0 or less. Failure to do so may result in the overall proposal being considered non-responsive. See page 71 for form.

E. Discussions: The Government intends to evaluate proposals and award a contract without discussions. Communication between the Government and offerors will be limited to exchanges for clarification as described in FAR 15.306(a). The Government reserves the right to enter into discussions if necessary. Thus, an offeror’s proposal should contain the offeror’s best terms from a price and technical standpoint. Communication conducted to resolve minor or clerical errors would not constitute discussions and the Contracting Officer reserves the right to award a contract without the opportunity for proposals revisions or discussions.

F. Contract Type: Any resultant contract awarded in response to this solicitation will be firm-fixed price.

G. Responsibility Determination: A Determination of Responsibility will be accomplished for the apparent awardee prior to processing the award. The above information, along with other information obtained from Government and commercial systems, such as EXPERIAN, will be used to make the Determination of Responsibility. Any information received by the Government that would be cause for a negative Determination of Responsibility will make the offeror ineligible for award.

H. Public Announcement of Contract Award: Offerors submitting price proposals in response to this solicitation do so with the complete and full understanding that the Government reserves the right to publically announce the total contract award amount.

4. Personal Identity Verification: Security: FAR 52.209-4, Personal Identity Verification of Contractor Personnel (Jan 2011), is incorporated into this solicitation by reference with the same force and effect as if given in full text. The full text of a clause may be accessed electronically at http://www.acquisition.gov/far/index.html.

A. Upon Contract Award, all key personnel shall be subject to the appropriate type of background investigation or screening per VA Handbook 0710 and mush receive a favorable adjuration from CCA Personnel Security Specialist or VA Security and Investigations Center (SIC) depending on investigation or screening required. This requirement is applicable to all subcontract personnel. If the investigation or screening is not completed prior to the start date of the contract, the Contractor will be responsible for the actions of those individual they provide to perform work for the VA.

B. In accordance with FAR 52.204-9 and VA Directive 0735, prior to providing services under the contract, each contract person will be asked to provide two (2) forms of identification from the accepted identification documentation list to the appropriate VA representative in order to obtain a proper VA issued identification card.

C. The contractor shall submit the required forms for background investigation for the Site Superintendent, Project Manager, and any staff that routine access to the VA facility grounds for 45 calendars days or at the discretion of the VA. Required forms shall be submitted within 10 calendar days of receipt of the Notice to Proceed.

INSTRUCTIONS, CONDITIONS AND OTHER STATEMENTS TO BIDDERS/OFFERORS

2.1 52.216-1 TYPE OF CONTRACT (APR 1984)

The Government contemplates award of a Firm-Fixed-Price contract resulting from this solicitation.

2.2 52.222-5 CONSTRUCTION WAGE RATE REQUIREMENTS—SECONDARY SITE OF THE WORK (MAY 2014) (a)(1) The offeror shall notify the Government if the offeror intends to perform work at any secondary site of the work, as defined in paragraph (a)(1)(ii) of the FAR clause at 52.222-6, Construction Wage Rate Requirements, of this solicitation.

(2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.

(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the Contracting Officer.

(2) The due date for receipt of offers will not be extended as a result of an offeror's request for a wage determination for a secondary site of the work.

2.3 52.222-23 NOTICE OF REQUIREMENT FOR AFFIRMATIVE ACTION TO ENSURE EQUAL EMPLOYMENT OPPORTUNITY FOR CONSTRUCTION (FEB 1999)

(a) The offeror's attention is called to the Equal Opportunity clause and the Affirmative Action Compliance Requirements for Construction clause of this solicitation.

(b) The goals for minority and female participation, expressed in percentage terms for the Contractor's aggregate workforce in each trade on all construction work in the covered area, are as follows:

These goals are applicable to all the Contractor's construction work performed in the covered area. If the Contractor performs construction work in a geographical area located outside of the covered area, the Contractor shall apply the goals established for the geographical area where the work is actually performed. Goals are published periodically in the Federal Register in notice form, and these notices may be obtained from any Office of Federal Contract Compliance Programs office.

(c) The Contractor's compliance with Executive Order 11246, as amended, and the regulations in 41 CFR 60-4 shall be based on (1) its implementation of the Equal Opportunity clause, (2) specific affirmative action obligations required by the clause entitled "Affirmative Action Compliance Requirements for Construction," and (3) its efforts to meet the goals. The hours of minority and female employment and training must be substantially uniform throughout the length of the contract, and in each trade. The Contractor shall make a good faith effort to employ minorities and women evenly on each of its projects. The transfer of minority or female employees or trainees from Contractor to Contractor, or from project to project, for the sole purpose of meeting the Contractor's goals shall be a violation of the contract, Executive Order 11246, as amended, and the regulations in 41 CFR 60-4. Compliance with the goals will be measured against the total work hours performed.

(d) The Contractor shall provide written notification to the Deputy Assistant Secretary for Federal Contract Compliance, U.S. Department of Labor, within 10 working days following award of any construction subcontract in excess of $10,000 at any tier for construction work under the contract resulting from this solicitation. The notification shall list the—

(1) Name, address, and telephone number of the subcontractor;

(2) Employer's identification number of the subcontractor;

(3) Estimated dollar amount of the subcontract;

(4) Estimated starting and completion dates of the subcontract; and

(5) Geographical area in which the subcontract is to be performed.

(e) As used in this Notice, and in any contract resulting from this solicitation, the "covered area" is Richmond County

2.4 52.222-58 SUBCONTRACTOR RESPONSIBILITY MATTERS REGARDING COMPLIANCE WITH LABOR LAWS (EXECUTIVE ORDER 13673) (DEC 2016)

(a) Definitions.

Administrative merits determination, arbitral award or decision, civil judgment, DOL Guidance, enforcement agency, labor compliance agreement, labor laws, and labor law decision as used in this provision have the meaning given in the clause in this solicitation entitled 52.222-59, Compliance with Labor Laws (Executive Order 13673).

(b) Subcontractor representation. (1) The requirements of this provision apply to all prospective subcontractors at any tier submitting an offer for subcontracts where the estimated subcontract value exceeds $500,000 for other than commercially available off-the-shelf items. The Offeror shall require these prospective subcontractors to represent, to the Offeror, to the best of the subcontractor’s knowledge and belief, whether there have been any administrative merits determinations, arbitral awards or decisions, or civil judgments for any labor law violation(s) rendered against the prospective subcontractor during the period beginning October 25, 2015 to the date of the offer, or for three years preceding the offer, whichever period is shorter.

(2) A contractor or subcontractor, acting in good faith, is not liable for misrepresentations made by its subcontractors about labor law decisions or about labor compliance agreements.

(c) Subcontractor responsibility determination. If the prospective subcontractor responded affirmatively to paragraph (b) of this provision and the Offeror initiates a responsibility determination, the Offeror shall follow the procedures in paragraph (c) of 52.222-59, Compliance with Labor Laws (Executive Order 13673).

Note to 52.222-58: By a court order issued on October 24, 2016, 52.222-58 is enjoined indefinitely as of the date of the order. The enjoined section will become effective immediately if the court terminates the injunction. At that time, DoD, GSA, and NASA will publish a document in the Federal Register advising the public of the termination of the injunction.

2.5 52.228-1 BID GUARANTEE (SEP 1996)

(a) Failure to furnish a bid guarantee in the proper form and amount, by the time set for opening of bids, may be cause for rejection of the bid.

(b) The bidder shall furnish a bid guarantee in the form of a firm commitment, e.g., bid bond supported by good and sufficient surety or sureties acceptable to the Government, postal money order, certified check, cashier's check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States. The Contracting Officer will return bid guarantees, other than bid bonds—

(1) To unsuccessful bidders as soon as practicable after the opening of bids; and

(2) To the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the bid as accepted.

(c) The amount of the bid guarantee shall be 20% percent of the bid price or $3,000,000, whichever is less.

(d) If the successful bidder, upon acceptance of its bid by the Government within the period specified for acceptance, fails to execute all contractual documents or furnish executed bond(s) within 10 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default.

(e) In the event the contract is terminated for default, the bidder is liable for any cost of acquiring the work that exceeds the amount of its bid, and the bid guarantee is available to offset the difference.
