About this file
This is Amendment A0004 to IFB Solicitation 36C24226B0044 for the Parking Lot Replacement and Expansion project at the James J. Peters VA Medical Center in Bronx, NY, issued by the Department of Veterans Affairs on August 20, 2026. The amendment provides final clarification on rock excavation requirements and introduces a mandatory geotechnical engineer hiring requirement. Bidders must submit a distinct line item in their bid breakdown clearly titled "Anticipated Rock / Buried Concrete Excavation (up to 4,000 CY estimated)" with associated costs included in the base bid. The contract unit price for excavation shall be a single, all-inclusive rate with no separate change orders for rock or buried concrete encountered up to the 4,000 CY estimate; any rock removal exceeding this allowance will be considered additional work. The amendment also requires contractors to hire a professional geotechnical engineer to provide reports and periodically evaluate excavation conditions throughout construction, with proof of the engineer's credentials and all testing reports required for VA approval before excavation begins. If excavation depth exceeds 5 feet, the geotechnical engineer must design shoring per specification 31 20 00 for VA approval. The bid opening date remains Monday, August 24, 2026 at 2:00 PM EST, and all bids must be submitted in hard copy format with no emailed submissions accepted. This is an SDVOSB set-aside procurement.

1. Provide final, clarification to rock excavation allowance and instruction as per previous RFI #7 Bidding contractors are to follow instruction on revised bid sheet posted in Amendment A0002.
2.Contractors must include a bid breakdown with bid that clearly indicates the amount for the estimated 4,000 CY of rock excavation in lieu of the cost range provided in previous RFI#7 response in Amendment A0003.
3. In addition, this amendment adds the requirement for a Geotechnical Engineer to be hired by the contractor (see continuation page for details of Geotechnical scope of services.
4. All bid submissions must include a general bid breakdown that clearly indicates rock excavation for 4,000 CY.

Parking Lot Replacement and Expansion Project No. 526-17-107 VA Medical Center, Bronx, NY
August 20, 2026
This amendment provides a final, revised response and clarification to RFI #7, previously posted in amendments A0002 and A0003. This response also includes a requirement for the bidding contractor to hire a professional geotechnical engineer as described in the response below. The response below supersedes response provided in previous amendments listed above. Please see revised response below:
Contractor RFI #7 VA/AE Revised Response
7) Drawing G-100 construction note no.28 states contractor shall include in its bid 3,500 CY of rock excavation. Is this correct? Also where is this rock excavation location found/encountered? Is it throughout the project area? Please clarify in detail, also modify the bid form to include the line item for the rock excavation quantity.
VA FINAL REVISED Response:
1. Unclassified Nature Remains in Effect. The contract unit price for excavation shall be a single, all-inclusive rate. No separate unit-price adjustments or change orders will be issued for rock or buried concrete encountered, regardless of actual quantity, up to or beyond the 4,000 CY estimate as per Note 28 below:
2. Contractors shall include a distinct, identifiable line item within a required Bid Breakdown with submitted bid, which must match the proposed cost-loaded schedule (Schedule of Values) upon award, and be specifically designated for the anticipated rock/buried concrete excavation component.
Bid Breakdown Line item for rock excavation costs based on an estimate of 4,000 CY should be clearly titled:
“Anticipated Rock / Buried Concrete Excavation (up to 4,000 CY estimated)”
3. In lieu of a fixed dollar value or previous range provided in Amendment A0003, contractors must submit a general bid breakdown with bid that clearly indicates the cost of rock excavation for the estimated 4,000 CY of rock as titled in item 2 above, “Anticipated Rock / Buried Concrete Excavation (up to 4,000 CY estimated)”
4. This revised RFI #7 response also confirms that no additional payments will be made for rock removal up to 4,000CY, as this should be included in the bid. Any rock removal exceeding the 4,000CY allowance will be considered additional.
5. REQUIREMENT FOR GEOTECHNICAL ENGINEER
Additionally, to maintain accuracy throughout the construction phase, contractors must hire a geotechnical engineer to provide a report and periodically evaluate the excavation conditions. This process aligns with specification 31 20 00 – section 3.2, excavation paragraph A, section 5. If the excavation depth exceeds 5 feet, shoring will be required per the specifications. The shoring must be designed by the geotechnical engineer and submitted to the VA for approval to ensure safety and regulatory compliance. The contractor will not be allowed to excavate without showing proof of an onsite geotechnical engineer and all applicable testing and reports provided by the contractor for VA review and approval.
This requirement for a geotechnical engineer will be strictly enforced during construction of this project. Contractors will be required to show proof of geotechnical engineers hired, along with credentials to that effect.
6. FINAL CLARIFICATION: The requirement for Line Item 3 on the revised bid sheet, as per Amendment A0002 is in “addition” to the information provided in #3 above, associated with 4,000 CY. Contractors must include this cost in their BASE BID and clearly indicate the associated cost within the bid breakdown. This cost must match rock excavation costs in the SOV following award as indicated above.
For bidding purposes, this has nothing to do with the Bid Sheet Line Item 3-add allowance of $100,000.00, to be used separately for unforeseen conditions.
No further clarifications will be made regarding this RFI. Contractors must bid accordingly.
End of revised RFI 7 response and clarification.
