The Contractor is responsible to provide all labor, materials, tools, equipment, supplies and supervision for Project Fire Dampers at the Northport VAMC in accordance with the statement of work (SOW) and specifications attached herein.

The NAICS code for this procurement is 811310 and the size standard is $8.0 million.

This procurement is 100% set-aside to Veteran Owned Small Business. Magnitude of construction is: $100,000 to $250,000.

All prospective bidders must be registered in SAM (www.sam.gov) and are verified /visible/certified in VIP VetBiz (www.vetbiz.gov) at the time of offer submission and before award of this procurement.

A prebid site visit is scheduled for Monday February , 2020 at :30AM EST. Prospective bidders shall meet at Building 17 at the Northport VAMC.

NOTE: NO OTHER SITE VISITS WILL BE ALLOWED. INTERESTED OFFERORS ARE STRONGLY ENCOURGED TO ATTEND.

Instructions for Proposal Submittal:

1. Offerors shall provide an electronic copy of their proposal via email by COB March 4, 2020. The proposal shall be submitted in Microsoft Word and any part of the proposal illustrating calculations shall be submitted in Microsoft Excel, if available. Technical questions and/or questions regarding proposal submission must be emailed to the Michael Giaquinto, by COB February 17, 2020 at Michael.Giaquinto2@va.gov. Request for Proposal No. 36C24220R0038 must be included in the Subject Line of the email.

Responses to the solicitation must include the following

2. Evaluation Factors:

NON-PRICE EVALUATION FACTORS

a. Non-Price Evaluation Factor: Key Personnel Offerors shall submit a resume of the proposed key personnel to perform under the resulting contract that demonstrate that the proposed personnel meet the minimum qualifications for the position as outlined in the SOW. Ensure certifications are listed and described in detail.

b. PAST PERFOMANCE Non-Price Evaluation Factor 4: List of project s of similar scope completed Offerors shall provide at least three projects completed of services similar in scope to this requirement. the government reserves the right to retrieve recent (within the past 5 years from the date of issuance of this RFP) and relevant Past performance information from any sources available to include, but not limited to, PPIRS or other databases; interviews with Program Managers, Contracting Officers from any Federal Agencies. Past performance ratings will be reviewed in all categories of performance history of contracts within the last 5 years

PRICE

Price Evaluation Factor Offerors’ proposal shall include a firm fixed price for 180-day project completion. The firm fixed price shall be inclusive of, but not limited to, all direct labor expenses, materials, training, insurance coverage, travel, subcontracts, other direct costs, overhead, general and administrative expenses, and profit.

All items must be addressed fully and meet the requirements as listed in the solicitation and SOW. Offering different terms, other prices or different response times then as listed will be deemed insufficient and unresponsive and will not be considered for award.

Statement of Work For Fire Dampers Repairs, Testing and New Installation Project Number: 632-19-116 Furnish all labor and materials to inspect, prepare repair report and decommission specified fire dampers. Install new FD labels for fire dampers as per attached spread sheets labeled Exhibit 1, 2 and 3. Damper locations are referenced in PDFs labeled exhibit 4. Damper tag layouts and specification are referenced in Exhibit 5.

· All work will be coordinated with the COR ahead of time.

· The contractor to provide a project schedule showing at minimum the critical path, and a minimum of one activity for each floor to be approved by the VA prior to start of project one month minimum.

· The contractor shall submit the schedule of values ten days after NTP for approval by the VA.

· The scope of this project applies only to fire dampers and excludes smoke dampers and combination fire smoke dampers.

· Contractor to verify duct sizes as required to complete the project.

· All existing not required fire dampers as per Exhibit #1 are to be locked in the open position and tagged decommissioned with a blue tag refer to Exhibit # 5. The blue tag shall be permantely attached to damper as per direction of the COR.

· All new fire dampers as per Exhibit #3 shall be out of the air stream type and installed as per VA specification 23 31 00. New fire dampers shall be tagged with a red ID tag refer to Exhibit #5. Verify damper compliance to NFPA 80 2018 Chapter 19. Affix signed and dated test sticker to space provided on red damper ID tag. The red tag shall be permantely attached to damper as per direction of the COR. Existing required fire dampers as per Exhibit # 2 shall have a red ID tag refer to Exhibit # 5 permantely attached to damper as per direction of the COR.

· Technicians as per Exhibit # 2 and 3. need to test and visually inspect fire dampers, verify damper compliance to the NFPA 80 2019 Chapter 19 and fill out test form Exhibit #6. Technicians need to test and inspect fire dampers and if a fusible link is present, the inspector should remove it prior to beginning testing. When dynamic dampers are present, testing in normal HVAC operation with air flow is the only way to prove its operation in the case of an actual event. Static dampers do not require airflow during operational testing. Successful operation during the test will verify there is no interference due to rust or damaged blades. Affix signed and dated test sticker to space provided on red damper ID tag.

· The test sticker shall be a self-adhesive plastic type which at minimum shall include the name of company, test date, name of testing technician (Printed) and signature. Only black ink non fading ink shall be used on the test label. The sticker shall be of the type that will not fade over time.

· If a fire damper has failed to be in compliance with the NFPA a report shall be generated and sent to the COR immediately. The report shall state at a minimum the reason for noncompliance, proposed remedy, proposed cost to repair including materials.

· Fire dampers with known access issues are referenced in Exhibit 1. If the contractor discovers additional access issues they shall immediately be brought to the attention of the COR for resolution.

· Damper tags as referenced in Exhibit # 5 shall be engraved heavy duty plastic type and adhered to the dampers via construction adhesive. The tags shall be installed as directed by the COR., so the tags are not to be obscured by the duct insulation. The color, font and size of the plastic tag is referenced in Exhibit #5. Each plastic tag shall have the dampers unique ID engraved on it in place of “(Damper Number)” as shown in Exhibit #5.

· Upon completion of project the contractor shall provide a report in excel format similar to Exhibits 1, 2 and 3, in excel format as well as a final spiral bound report. Test form Exhibit #6 for each damper tested shall be part of the final report. As builts are to be part of the final report. COR shall approve preliminary report prior to final publishing of report. Four clean spiral bound hard copy of the reports shall be submitted. Electronic copies of final report on four CDs shall be submitted to the VA.

· Compliance:

· Contractor shall comply with all Infection Control requirements.

· Contractor shall comply with all VAFD penetration requirements including obtaining permits as required through fire rated assemblies (including floor slabs).

· Contractor to comply with all VA requirements for work in healthcare facilities in the proximity of patient care areas.

· Contractor to provide 1 Year Warranty on parts & labor upon acceptance of the completed project.

· Contractor to provide all close out documentation 60 days prior to completion of project.

· Upon acceptance of closeout documentation by the VA contractor can apply for final payments.

Note that this contract does not involve VA sensitive information/data.

Performance Period: All Submittals must be approved by VA prior to beginning work. Work will begin after issuance of Notice to Proceed. Project completion time after all submittals have been approved is 10 days. Contractor has 20 calendar days to submit all products to be used during the project. The total project duration from NTP will be 180 days.

Work will be coordinated with the COR. Due to impact on patients, staff and critical patient care areas the air handlers will have to be shut down, resulting in off hours work as required. Lock out – tag out procedures for air handler shutdowns shall be implemented as specified in 01 35 26, Safety Requirements.

Request for interruption of any services may be approved by the COR, however contractor shall first make a request in writing (email, letter, etc.) requesting any interruption of any service two weeks in advance. Some work may need to take place on nights and weekends.

Contractor shall be responsible to plan and coordinate all work with the COR who will coordinate and provide access. Contractor is responsible for safety, record keeping, security monitoring, and inspection of area. Maintain Certified Payroll and Daily Logs.

Contractor shall provide the COR with a list of contractor staff participating in the work and shall submit in writing an ID request with company name, address, telephone number, name of each individual contractor employee and position title, SS# (by fax), home address, copy of OSHA 10 hour; see VA Specification section 01 00 00 for a complete list of required documents.

The contractor shall designate a competent person refer to specification 01 35 26, Safety Requirements for Training documentation.

Inspection/Acceptance – VA CO and COR will conduct final inspection and acceptance of contractor work.

INSTRUCTIONS, CONDITIONS AND OTHER STATEMENTS TO BIDDERS/OFFERORS

2.1 52.216-1 TYPE OF CONTRACT (APR 1984)

The Government contemplates award of a Firm-Fixed-Price contract resulting from this solicitation.

2.2 52.222-5 CONSTRUCTION WAGE RATE REQUIREMENTS—SECONDARY SITE OF THE WORK (MAY 2014) (a)(1) The offeror shall notify the Government if the offeror intends to perform work at any secondary site of the work, as defined in paragraph (a)(1)(ii) of the FAR clause at 52.222-6, Construction Wage Rate Requirements, of this solicitation.

(2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.

(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the Contracting Officer.

(2) The due date for receipt of offers will not be extended as a result of an offeror's request for a wage determination for a secondary site of the work.

2.3 52.225-10 NOTICE OF BUY AMERICAN REQUIREMENT—CONSTRUCTION MATERIALS (MAY 2014)

(a) Definitions. "Commercially available off-the-shelf (COTS) item," "construction material," "domestic construction material," and "foreign construction material," as used in this provision, are defined in the clause of this solicitation entitled "Buy American—Construction Materials" (Federal Acquisition Regulation (FAR) clause 52.225-9).

(b) Requests for determinations of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute should submit the request to the Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-9 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American statute before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.

(c) Evaluation of offers.

(1) The Government will evaluate an offer requesting exception to the requirements of the Buy American statute, based on claimed unreasonable cost of domestic construction material, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(3)(i) of the clause at FAR 52.225-9.

(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.

(d) Alternate offers.

(1) When an offer includes foreign solicitation in paragraph (b)(2) of the clause at FAR 52.225-9, the offeror also may submit an alternate offer based on use of equivalent domestic construction material.

(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance with paragraphs (c) and (d) of the clause at FAR 52.225-9 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.

(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of the clause at FAR 52.225-9 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic construction material, and the offeror shall be required to furnish such domestic construction material. An offer based on use of the foreign construction material for which an exception was requested—

(i) Will be rejected as nonresponsive if this acquisition is conducted by sealed bidding; or

(ii) May be accepted if revised during negotiations.

3.1 52.204-8 ANNUAL REPRESENTATIONS AND CERTIFICATIONS (JAN 2020)

3.2 52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO SURVEILLANCE SERVICES OR EQUIPMENT (AUG 2019)

(a) Definitions. As used in this provision— Covered telecommunications equipment or services, Critical technology, and Substantial or essential component have the meanings provided in clause 52.204–25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition. Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115–232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Contractors are not prohibited from providing—

(1) A service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(2) Telecommunications equipment that cannot route or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(c) Representation. The Offeror represents that— It [ ] will, [ ] will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation.

GENERAL CONDITIONS

4.1 52.204-21 BASIC SAFEGUARDING OF COVERED CONTRACTOR INFORMATION SYSTEMS (JUN 2016)

(a) Definitions. As used in this clause— Covered contractor information system means an information system that is owned or operated by a contractor that processes, stores, or transmits Federal contract information.

Federal contract information means information, not intended for public release, that is provided by or generated for the Government under a contract to develop or deliver a product or service to the Government, but not including information provided by the Government to the public (such as on public Web sites) or simple transactional information, such as necessary to process payments.

Information means any communication or representation of knowledge such as facts, data, or opinions, in any medium or form, including textual, numerical, graphic, cartographic, narrative, or audiovisual (Committee on National Security Systems Instruction (CNSSI) 4009).

Information system means a discrete set of information resources organized for the collection, processing, maintenance, use, sharing, dissemination, or disposition of information (44 U.S.C. 3502).

Safeguarding means measures or controls that are prescribed to protect information systems.

(b) Safeguarding requirements and procedures. (1) The Contractor shall apply the following basic safeguarding requirements and procedures to protect covered contractor information systems. Requirements and procedures for basic safeguarding of covered contractor information systems shall include, at a minimum, the following security controls:

(i) Limit information system access to authorized users, processes acting on behalf of authorized users, or devices (including other information systems).

(ii) Limit information system access to the types of transactions and functions that authorized users are permitted to execute.

(iii) Verify and control/limit connections to and use of external information systems.

(iv) Control information posted or processed on publicly accessible information systems.

(v) Identify information system users, processes acting on behalf of users, or devices.

(vi) Authenticate (or verify) the identities of those users, processes, or devices, as a prerequisite to allowing access to organizational information systems.

(vii) Sanitize or destroy information system media containing Federal Contract Information before disposal or release for reuse.

(viii) Limit physical access to organizational information systems, equipment, and the respective operating environments to authorized individuals.

(ix) Escort visitors and monitor visitor activity; maintain audit logs of physical access; and control and manage physical access devices.

(x) Monitor, control, and protect organizational communications (i.e., information transmitted or received by organizational information systems) at the external boundaries and key internal boundaries of the information systems.

(xi) Implement subnetworks for publicly accessible system components that are physically or logically separated from internal networks.

(xii) Identify, report, and correct information and information system flaws in a timely manner.

(xiii) Provide protection from malicious code at appropriate locations within organizational information systems.

(xiv) Update malicious code protection mechanisms when new releases are available.

(xv) Perform periodic scans of the information system and real-time scans of files from external sources as files are downloaded, opened, or executed.

(2) Other requirements. This clause does not relieve the Contractor of any other specific safeguarding requirements specified by Federal agencies and departments relating to covered contractor information systems generally or other Federal safeguarding requirements for controlled unclassified information (CUI) as established by Executive Order 13556.

(c) Subcontracts. The Contractor shall include the substance of this clause, including this paragraph (c), in subcontracts under this contract (including subcontracts for the acquisition of commercial items, other than commercially available off-the-shelf items), in which the subcontractor may have Federal contract information residing in or transiting through its information system.

4.2 52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984)

The Contractor shall be required to (a) commence work under this contract within 5 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 180 days after receipt of notice to proceed. The time stated for completion shall include final cleanup of the premises.

4.3 52.223-20 AEROSOLS (JUN 2016)

(a) Definitions. As used in this clause— Global warming potential means how much a given mass of a chemical contributes to global warming over a given time period compared to the same mass of carbon dioxide. Carbon dioxide's global warming potential is defined as 1.0.

High global warming potential hydrofluorocarbons means any hydrofluorocarbons in a particular end use for which EPA's Significant New Alternatives Policy (SNAP) program has identified other acceptable alternatives that have lower global warming potential. The SNAP list of alternatives is found at 40 CFR part 82, subpart G, with supplemental tables of alternatives available at (http://www.epa.gov/snap/).

Hydrofluorocarbons means compounds that contain only hydrogen, fluorine, and carbon.

(b) Unless otherwise specified in the contract, the Contractor shall reduce its use, release, or emissions of high global warming potential hydrofluorocarbons, when feasible, from aerosol propellants or solvents under this contract. When determining feasibility of using a particular alternative, the Contractor shall consider environmental, technical, and economic factors such as—

(1) In-use emission rates, energy efficiency;

(2) Safety, such as flammability or toxicity;

(3) Ability to meet technical performance requirements; and

(4) Commercial availability at a reasonable cost.

(c) The Contractor shall refer to EPA's SNAP program to identify alternatives. The SNAP list of alternatives is found at 40 CFR part 82, subpart G, with supplemental tables available at http://www.epa.gov/snap/.

4.4 52.223-21 FOAMS (JUN 2016)

(a) Definitions. As used in this clause— Global warming potential means how much a given mass of a chemical contributes to global warming over a given time period compared to the same mass of carbon dioxide. Carbon dioxide's global warming potential is defined as 1.0.

4.5 52.219-28 POST-AWARD SMALL BUSINESS PROGRAM REREPRESENTATION (JUL 2013)

(a) Definitions. As used in this clause— Long-term contract means a contract of more than five years in duration, including options. However, the term does not include contracts that exceed five years in duration because the period of performance has been extended for a cumulative period not to exceed six months under the clause at 52.217-8, Option to Extend Services, or other appropriate authority.

Small business concern means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and the size standard in paragraph (c) of this clause. Such a concern is "not dominant in its field of operation" when it does not exercise a controlling or major influence on a national basis in a kind of business activity in which a number of business concerns are primarily engaged. In determining whether dominance exists, consideration shall be given to all appropriate factors, including volume of business, number of employees, financial resources, competitive status or position, ownership or control of materials, processes, patents, license agreements, facilities, sales territory, and nature of business activity.

(b) If the Contractor represented that it was a small business concern prior to award of this contract, the Contractor shall rerepresent its size status according to paragraph (e) of this clause or, if applicable, paragraph (g) of this clause, upon the occurrence of any of the following:

(1) Within 30 days after execution of a novation agreement or within 30 days after modification of the contract to include this clause, if the novation agreement was executed prior to inclusion of this clause in the contract.

(2) Within 30 days after a merger or acquisition that does not require a novation or within 30 days after modification of the contract to include this clause, if the merger or acquisition occurred prior to inclusion of this clause in the contract.

(3) For long-term contracts—

(i) Within 60 to 120 days prior to the end of the fifth year of the contract; and

(ii) Within 60 to 120 days prior to the date specified in the contract for exercising any option thereafter.

(c) The Contractor shall rerepresent its size status in accordance with the size standard in effect at the time of this rerepresentation that corresponds to the North American Industry Classification System (NAICS) code assigned to this contract. The small business size standard corresponding to this NAICS code can be found at http://www.sba.gov/content/table-small-business-size-standards.

(d) The small business size standard for a Contractor providing a product which it does not manufacture itself, for a contract other than a construction or service contract, is 500 employees.

(e) Except as provided in paragraph (g) of this clause, the Contractor shall make the representation required by paragraph (b) of this clause by validating or updating all its representations in the Representations and Certifications section of the System for Award Management (SAM) and its other data in SAM, as necessary, to ensure that they reflect the Contractor's current status. The Contractor shall notify the contracting office in writing within the timeframes specified in paragraph (b) of this clause that the data have been validated or updated, and provide the date of the validation or update.
