SERVICES (NOV 2021)
A. BASIS OF AWARD
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government.
The following factors shall be used to evaluate offers:
Factor I – Price Only
1. Factor I – Cost/Price. Price will be evaluated in accordance with FAR 13 procedures. If final proposal revisions are requested, the revised price quote will be re-evaluated to assist in the final award decision. In evaluating the offeror’s proposed price for this project, the Government concern includes determining whether:
1. It reflects the prospective contractor understanding of the project and ability to successfully organize and perform the contract.
2. It is based on adequate estimating procedures, supported by backup documentation, and is realistic in terms of the offeror’s proposed technical approach.
3. Any proposed terms and conditions and/or assumptions upon which the quote is predicated. Quoters are hereby advised that any quote-imposed terms and conditions and/or assumptions which deviate from the Government’s material terms and conditions established by the solicitation, may render the Quoter’s quote unacceptable; thereby, ineligible for award.
All quotes shall be subject to evaluation by Government personnel. The Government intends to award based upon the initial evaluation of quotes. Consequently, quoters are highly encouraged to quote their best solution and price in their initial submissions. However, the Government reserves the right to communicate with any or all quoters submitting a quote, if it is determined advantageous to the Government to do so. If these communications take place, the Government is not obligated to communicate with every quoter (note that FAR Part 15 procedures do not apply; therefore, formal discussions are not applicable). All quoters will be treated fairly and impartially. A quoter may be eliminated from consideration without further communication if its quote is not among those considered most advantageous to the Government based on its initial evaluation.
Contents of the written quotes will be evaluated to determine the degree and extent to which the requirements set forth in the solicitation are satisfied or exceeded. The Government will evaluate the quote to include an acknowledgement of revisions, and any other applicable and required documents as outlined in the evaluation instructions.
A quote that is determined to be incomplete or fails to fully meet any material requirement may render a quote deficient, thus ineligible for award. If at any point during the evaluation, any aspect of a Quoter’s quote is deemed deficient, the evaluation of that quote will cease and the Quoter’s quote will no longer be in consideration for award unless the Contracting Officer deems the continued evaluation of that quote is in the Government’s best interest.
The quotes will be evaluated strictly in accordance with their written content. Quotes which merely restate the requirement or state that the requirement will be met, without providing supporting rationale, are not sufficient and will be rated Unsatisfactory and thus, ineligible for award. Quoters who fail to meet the minimum requirements of the solicitation shall be considered nonresponsive and thus will be ineligible for award. Quoter’s are cautioned that the award may not necessarily be made to the quoter quoting the lowest price, or to the Quoter with the most highly rated quote.
Any quotes that do not meet the following criteria will be eliminated from consideration (from the respective Tier):
1. All SDVOSB and VOSB concerns must be certified by SBA at the time of quote submission and small under NAICS code 811210 to qualify for Tier 1 and Tier 2, respectively to be considered an SDVOSB or VOSB. Certification by SBA alone does not meet the requirements for size standard authentication. Offerors are solely responsible for obtaining SBA Certification. The contracting officer cannot intervene with SBA regarding the processing of applications.
2. All Small Businesses must be small under NAICS code 811210 to qualify for Tier 3 and in SAM.gov following SBA guidelines for certification as a small business.
After this initial assessment, all remaining quotes will be evaluated for Technical Capability using a tiered approach based on an order of priority as established in 38 U.S.C. 8127. The review will consist of four tiers. The tiers are defined as follows:
Tier 1 - Service-Disabled Veteran-Owned Small Business (SDVOSB) Concerns
Tier 2 - Veteran-Owned Small Business (VOSB) Concerns
Tier 3 - Small Business Concerns
Tier 4 – Large Business Concerns
I. Tier 1 quotes will be evaluated first. After an evaluation of Tier 1 quotes, if an award can be made that can be determined a best value to the United States, no additional tiers will be evaluated. If a best value determination cannot be supported to make an award in Tier 1, (in the judgment of the Contracting Officer), the Government will evaluate Tier 2 quotes for award.
II. Tier 2 quotes will be evaluated second. After evaluation of Tier 2 quotes (if needed), if award can be made that can be determined a best value to the United States, no additional tiers will be reviewed. If a best value determination cannot be supported to make an award in Tier 2, (in the judgment of the Contracting Officer), the Government will evaluate Tier 3 quotes for award.
III. Tier 3 quotes will be evaluated third. After evaluation of Tier 3 quotes (if needed), if award can be made that can be determined a best value to the United States, no additional tiers will be reviewed. If a best value determination cannot be supported to make an award in Tier 3, (in the judgment of the Contracting Officer), the Government will evaluate Tier 4 quotes for award.
IV. Tier 4 quotes will be evaluated last. If a best value determination cannot be supported to make an award in Tier 4, the Government will cancel the solicitation or request quotation revisions to achieve best value and restart the process if necessary.
Note: At least two quotes must be received within a tier for an evaluation to commence within at tier. Example(s), if two SDOVSB’s quote, the evaluation will start in tier 1. If only one SDVOSB and one VOSB quotes, it will automatically be a tier 2 evaluation. If one SDVOSB and one small business quotes, it will automatically be a tier 3 evaluation. If only one SDOVBS quotes and all other quotes are from large business, it will automatically be a tier 4 evaluation.
The quotes will be evaluated as follows:
B. EVALUATION APPROACH:
(b) IAW FAR 13 procedures, Award will be made based on the Lowest Price Technically Acceptable (LPTA) for the quote meeting or exceeding the requirements of the Performance Work Statement.
The government will evaluate information based on the following evaluation criteria: an overall solution, including price, that best meets the requirements of the Performance Work Statement.
(c) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(d) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of Provision)
