About this file

This is a Business Confidentiality Claim Form issued by the Office of the Government Records Ombudsman at the Utah State Archives, applicable to the Salt Lake City School District's Invitation for Bid (IFB) for Solar Modules. The form is designed to allow vendors submitting proposals to claim protection for trade secrets and commercial financial information under Utah Code provisions 63G-2-305 and 63G-2-309. Bidders responding to the solar modules IFB may use this form to request confidential treatment of specific portions of their proposals, provided they submit both redacted and non-redacted versions of their complete bid documentation. The form requires claimants to identify specific pages and paragraphs subject to the confidentiality claim and provide a concise statement of reasons supporting the request. Incomplete submissions without a properly redacted proposal copy will not be redacted by the Division of Purchasing on behalf of the claimant.

The form emphasizes that filing a confidentiality claim does not guarantee protected classification status if the governmental entity receives a public records request under GRAMA (Government Records Access and Management Act). Claimant information required includes company name, address, representative contact details, and specific details about which records are subject to the claim, along with the reasons for the confidentiality request. The form provides designated fields for documenting up to four separate confidentiality claims with corresponding page numbers, paragraphs, and supporting explanations. Bidders must understand that only officially issued addenda and communications through the Bonfire/U3P procurement system represent the authorized position of the Salt Lake City School District.

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
