About this file
This is a Section 3 Worker and Targeted Section 3 Worker Self-Certification Form developed by the Wilmington Housing Authority in accordance with HUD's Section 3 program requirements under 24 CFR Part 75. The form is designed to identify and certify eligible workers for employment, training, and contracting opportunities targeted at low-income individuals and recipients of government housing assistance. Employees complete a voluntary self-certification by providing their name, address, hire date, and annual income range, then affirm under penalty of law that their responses are accurate. Employers must retain the completed form in their Section 3 compliance file for five years and indicate whether the employee qualifies as a Section 3 worker or Targeted Section 3 worker based on the self-certification, as well as whether the hire resulted from the Section 3 project.
Eligibility for Section 3 Worker status requires that an individual be a low or very low-income resident with annual income below HUD-established limits (Very Low-Income at $36,900 or Extremely Low-Income at $22,150 for the City of Wilmington in FY 2022), be employed by a Section 3 business concern, or be a YouthBuild participant. Targeted Section 3 Worker status for public housing or Section 8 projects requires either employment by a Section 3 business concern or documentation that the worker currently meets or met at least one qualifying category within the past five years, including residency in public housing or Section 8-assisted housing or YouthBuild participation. For housing and community development projects, Targeted Section 3 Worker status additionally includes living within the service area or neighborhood of the project as defined in 24 CFR 75.5. The form establishes income limits for individual workers regardless of actual household size, with most recent limits available through HUD's official datasets.
