About this file

This is a Section 3 Business Concern Certification Form issued by the Wilmington Housing Authority for use in contracting opportunities related to the Delaware Affordable Housing Group's BD26002 project for renovation of a unit located at 417 N Market Street. The form requires applicant businesses to provide standard business information including name, address, owner details, business type, and preferred contact information. Applicants must certify their eligibility under one of three criteria: ownership and control by at least 51 percent low- or very low-income persons; ownership and control by at least 51 percent current public housing or Section 8-assisted housing residents; or performance of over 75 percent labor hours by Section 3 workers during the prior three-month period. The certification is valid for six months from the date of signature.

The form establishes income eligibility thresholds based on HUD guidelines, with extremely low-income limits at $22,150, very low-income limits at $36,900, and low-income limits at $59,050 for individuals in Wilmington for fiscal year 2022. Section 3 workers are defined as low- or very low-income residents, employees of Section 3 business concerns, or YouthBuild participants, with targeted Section 3 workers including public housing residents, Section 8-assisted housing residents, and YouthBuild participants. Applicants must affirm under penalty of law that all submitted information is accurate, with understanding that misrepresentation may result in contract termination for default and debarment from future opportunities. Employers are required to retain the completed form in their Section 3 compliance file for five years.
