Bidders claiming business confidentiality must document the specific pages and paragraphs containing protected information and provide detailed reasons supporting their confidentiality claims based on the statutory definitions of trade secrets or competitive harm. Pricing and cost proposals may not be classified as confidential and will be considered public information, and entire proposals cannot be designated as "PROTECTED," "CONFIDENTIAL," or "PROPRIETARY." Bidders will be notified if records claimed as protected are classified as public or if the governmental entity determines that records should be released after weighing relevant interests under applicable Utah Code sections.
