Pricing shall be submitted as markup percentages applied to negotiated hourly rates for each job classification, with all costs including payroll taxes, insurance, overhead, administrative fees, and profit fully inclusive in the markup with no additional fees permitted. RFP #13-02-27 Temporary Employment Services 4

SECTION 1 – SCOPE OF WORK

1.1. GENERAL

a. The City of Temple (“City”) is soliciting proposals from qualified firms to provide as‑needed temporary employment services, including administrative, professional, and labor‑related staffing. The resulting annual contract(s) will be utilized by multiple City departments to support operational and project-based needs.

b. The City intends to award this solicitation by section, which includes administrative/professional, and labor staffing services. It is the City’s preference to award a single contractor as the primary provider for each section. However, the City reserves the right to issue secondary awards to additional firms to ensure adequate coverage in the event the primary contractor is unable to meet the City’s staffing needs in a timely manner. The primary contractor will receive the first opportunity to fulfill all requests under its awarded section(s).

1.2. SPECIFICATIONS

General

a. Temporary employees shall perform the duties associated with the job classification for which they are assigned. Any temporary employee who is unsatisfactory or repeatedly late may be replaced at the City’s discretion. The City will not be charged for hours worked if a temporary employee is requested to be replaced within the first four hours of their start time.

b. The awarded contractor shall work with each City department to determine the appropriate hourly rate based on the job classification and corresponding job description. A work ticket (or similar form) shall be provided to the City prior to work startup and must identify the temporary worker(s) assigned. The work ticket shall be verified and signed by a designated City employee to confirm personnel and hours worked. Work tickets that are not signed by a City representative will be considered invalid and will not be paid.

c. The awarded contractor shall have the ability to provide temporary employees with a minimum of 24 hours’ notice from the City. While the City will make every effort to provide as much advance notice as possible, operational needs may change quickly, requiring expedited staffing support.

d. The awarded contractor is responsible for notifying the City department utilizing temporary staffing services of any staff changes prior to the scheduled work date.

e. The City will authorize overtime compensation only for temporary employees who work more than 40 hours in a single workweek for the City. No additional overtime payments shall be made to the awarded contractor without prior written authorization from the City. The awarded contractor is responsible for all wages owed to its temporary employees, whether at straight‑time or overtime rates, and shall ensure compliance with the Fair Labor Standards Act (as amended) and the Texas Workers’ Compensation Act.

RFP #13-02-27 Temporary Employment Services 5

f. The City may require temporary staffing outside of normal business hours, including evenings, weekends, and City‑recognized holidays. When such needs arise, the awarded contractor shall make reasonable efforts to provide qualified personnel and must maintain the capability to respond to after‑hours requests in accordance with the City’s required notice period. Any holiday, weekend, or after‑hours assignments shall be billed in accordance with the pricing and markup rates submitted on the contractor’s Proposed Pricing Form, and no additional surcharges or fees will be permitted unless expressly authorized in writing by the City. The awarded contractor shall ensure that assigned personnel are informed of their scheduled report times and understand all applicable requirements related to after‑hours work.

g. If a temporary worker applies for and is hired into a full‑time or part‑time City position, neither the temporary worker nor the City shall be responsible for any sourcing or conversion fees.

Screening, Compliance, and Onboarding Requirements

a. The awarded contractor shall ensure all temporary employees:

• Maintain valid proof of employment eligibility.

• Hold a high school diploma or equivalent.

• Have reliable transportation to report on time to the assigned location.

• Can speak, read, and write English when required for the position.

• Demonstrate professionalism, cooperation, and effective communication skills.

• Wear attire appropriate for the assigned role.

b. The awarded contractor shall provide a criminal background check and drug screening for all temporary workers at no additional cost to the City.

An individual may be disqualified from assignment based on the following:

• Criminal history results that, after review of the nature and gravity of the offense, the time elapsed since the offense, and the relevance to the assigned duties, are determined to present a concern.

• Are a registered sex offender or failed to register when required.

• Are subject to an outstanding arrest warrant.

• Are facing a pending criminal charge other than a traffic violation.

• A negative drug test result

• The City reserves the right to disallow other types of offenses if such offense is shown to be a concern for the type of work performed (e.g. theft when the position requires the handling of money).

c. Proof of a completed and cleared background check, along with a negative drug test for the required substances, shall be submitted to the City with the initial invoice for each temporary employee. This documentation is not required with subsequent invoices for the same employee. All test results shall clearly indicate the date of completion, which must be prior to the temporary worker beginning services for the City. Payment will not be issued for any temporary worker until the required documentation has been received.

RFP #13-02-27 Temporary Employment Services 6

d. The awarded contractor shall meet FMCSA guidelines and provide random drug and alcohol testing for CDL operators.

e. If City identification badges or access credentials are required for specific roles, the department will coordinate issuance with the People Operations department. Upon completion of an assignment or separation from service, the awarded contractor shall ensure that all City‑issued property, including badges, equipment, uniforms, or other materials, is collected and returned promptly to the City. The City reserves the right to request the immediate removal of any temporary worker whose performance, conduct, or compliance is deemed unsatisfactory. The awarded contractor shall respond to such requests without delay to maintain continuity of City operations.

f. Temporary employees with access to sensitive City information must sign a confidentiality agreement and follow all City IT and data‑security policies. Access to City systems is limited to authorized City‑issued devices or approved secure methods; personal devices may not be used. The contractor is responsible for ensuring temporary workers understand and follow these requirements.

No applicant or temporary employee may be discriminated against based on any protected classification. The contractor must ensure fair and nondiscriminatory treatment in all employment practices, including recruitment, hiring, assignment, training, promotion, and workplace conditions. Compliance with these requirements is mandatory for contract award and continued performance.

Order Placement
