About this file
This is a Question and Answer document from the Colorado Department of Natural Resources (DNR) addressing bidder inquiries regarding bonding requirements for a Mooring Ball Request for Proposals (RFP). The document clarifies that firms responding to the RFP must submit a bid bond along with labor, materials, and performance bonds if selected for award. The RFP includes Section 4.804, which contains a table requiring proposers to submit estimated costs for items 5 through 8 at the time of proposal submission.
Proposers must submit a bid bond in the amount of five percent (5%) of the combined total dollar amount from items 5 through 8 in the cost table. This same estimated amount will serve as the basis for both the bid bond requirement and the labor and materials and performance bonds required for the resulting contract. The cost estimates provided in the proposal will establish the contract dollar amount, eliminating uncertainty regarding bonding amounts despite the final project scope being determined following a post-award investigation.

Question: Firms responding to the RFP are expected to submit a bid bond and if we are awarded, a labor and materials and performance bond. Since we won't know the dollar amount of the work until after the investigation is complete, how do we submit a bid bond and how will we know the dollar amount to bond for the project?
Answer: Section 4.804 of the Request for Proposals includes a table that must be filled in with estimated costs at the time the proposal is submitted. These costs will be used for the contract resulting from this RFP. Proposers must submit a bid bond for five percent (5%) of the combined total dollar amount of items 5 through 8 in this table. This is also the amount which will be required for the labor and materials and performance bonds for the resulting contract.
