About this file

This is an Invitation for Bids (IFB) issued by the Maryland Department of Health, Office of Long Term Services and Supports (OLTSS), for Medical Adult Day Care Private Pay Subsidy services. The solicitation seeks to procure health and human services from licensed Medical Adult Day Care Centers to serve functionally impaired elderly individuals aged 55 and older who are at risk of institutional placement. Services will be provided across eight geographic service areas in Maryland counties including Anne Arundel, Frederick, Howard, Montgomery, Prince George's, St. Mary's, and Wicomico. The IFB anticipates up to eight contract awards, one per service area, with an indefinite quantity contract structure based on actual days of service (ADoS) provided. The pre-bid conference is scheduled for October 5, 2026, at 11:00 a.m. via Google Meet, with RSVP required by October 1, 2026. Questions must be submitted by October 13, 2026, at 2:00 p.m., and bids are due October 22, 2026, at 2:00 p.m., with public opening at 3:00 p.m. the same day. The contract term is three base years with two one-year option periods. Current program participants average between 7 and 21 participants per county per month, with 90 to 163 days of service provided monthly across locations.

Bidders must be licensed Medical Adult Day Care Centers with at least three years of operational experience in Maryland, certified through the Office of Health Care Quality (OHCQ). Pricing is submitted on a fixed daily rate basis covering all costs including labor, overhead, transportation, and operational expenses; no other reimbursement is permitted. A 5 percent Minority Business Enterprise (MBE) subcontracting goal has been established for the total contract dollar amount. Participants pay on a sliding ability-to-pay scale approved annually by the Maryland Department of Health Secretary, with OLTSS funding covering only a portion of service costs; contractors must supplement funding through charitable contributions, grants, and other sources. The State does not guarantee minimum annual days of service, though current program participants as of the go-live date must be served if desired. Contractors must maintain commercial general liability insurance of $1,000,000 per occurrence ($2,000,000 annual aggregate), professional liability insurance of $1,000,000 per claim ($3,000,000 aggregate), and workers' compensation and automobile insurance as required. The contract is subject to Maryland Living Wage requirements as a Tier 1 contract, with all wage increases during the contract term to be absorbed by the contractor.

2 Contractor Requirements: Scope of Work

2.1 Summary Statement

2.1.1 This Invitation for Bids (IFB) is issued to procure the goods or services, as specified in this Section 2, from a contract between the successful bidder(s) and the State of Maryland (“State”): This IFB is issued to provide a range of health and human services through days of service from licensed Medical Adult Day Care Centers, to functionally impaired elderly individuals aged 55 and older who are at risk of institutional placement if their health and social needs are not met. These services are designed to assist individuals to remain at home and in their communities.

It is the State’s intention to obtain goods and services, as specified in this IFB, from a contract between the selected Bidder and the State.

2.1.2 This IFB will have up to eight (8) awards to serve current program participants in the counties listed below, in Table 2.1. Average service levels per month during Fiscal Year 2026 are shown. Please note: the number of participants are subject to change and are not guaranteed under the contract (see IFB Section 4.21 Bid Evaluation Criteria and Award Basis for more Contract award information).

A Contract award does not ensure a Contractor will receive all or any State business under the Contract.

2.2 Background and Purpose

The State is issuing this Invitation for Bids to provide a range of health and human services to functionally impaired elderly individuals who are unable to be employed and are at risk of institutional placement if their health and social needs are not met. These services are designed to assist individuals to remain at home and in their communities. Medical Adult Day Care services are to be provided to non-Medicaid participants who do not qualify for Maryland Medicaid’s Medical Adult Day Care Waiver program. Participants are Maryland residents aged 55 years or older who have physical or mental impairments, particularly chronic disease and health problems associated with aging, including Alzheimer's disease and related disorders. Program participants must be recommended for the service by Assessments, Evaluation and Review Services (AERS) in order for the Center to bill for their days of service and obtain the fee subsidy. These participants are unable to pay the full cost of care, and they pay for services based on the Ability to Pay Schedule approved by the Secretary of the Maryland Department of Health for the current fiscal year. Average service levels per month during Fiscal Year 2026 (July 1, 2025, through June 30, 2026) are shown in Table 2.1 below. Please note: The amounts listed are subject to change, based on factors such as the amount of available fiscal year funding or the daily rate for an Actual Day of Service (ADoS), and are not guaranteed under the Contract.

AERS (Assessments, Evaluation and Review Services) unit staff perform an evaluation to determine the need for Medical Adult Day Care Services and recommend the service, if it is in fact needed.

Note: Participants who are community Medicaid eligible and determined to need a nursing facility level of care are not eligible for the fee subsidy and should access day care services through one of the 1915(c) waivers.

The AERS evaluation for nursing facility level of care must be conducted annually for Program participants eligible for Medicaid. Copies of the AERS evaluations and recommendations must be maintained in the participant's record.

It is important to note that the Office of Long-Term Services and Supports (OLTSS) provides funding through this contract for only a portion of the cost of providing these services.

Participants served under this contract are assessed as co-payment based on their ability to pay, referencing MDH’s current fiscal year ability to pay schedule. This schedule is updated annually at the start of each fiscal year on July 1 and must be adequately documented on a fee assessment form of the Center’s design. Directors have the authority to waive or reduce fees on a case-by-case basis, if warranted. Vendors must also seek other sources of funding, such as food subsidies, United Way, charitable donations, etc. Some vendors rely heavily on donations of supplies and other material from the families of participants or interested supporters of the community.

The vendor must make up the difference between what they receive from OLTSS, the participant, and other sources. Vendors in this program contract to provide these services because it is their mission to provide services to individuals at all income levels, which is critically important since most centers in the State do not service individuals who cannot pay the full cost of care. These

IFB for Office of Long Term Services and Supports (OLTSS) Page 10 of 51 vendors must be extremely creative in finding methods to reduce their costs in order to be able to participate in the OLTSS program.

The amount of funding available through this Contract is only expected to allow for services to current program participants as of the Go-Live date. Participants currently receiving services must receive service under the new Contract(s) resulting from this IFB, if desired by the participant.

Bidders must be willing to provide transportation, to and from the Center to current participants who request the service. A participant may not be in transit for more than one hour without an opportunity for a rest stop. The Bidder may bid on more than one area, provided that these service conditions are met.

2.2.1 Project Goals

2.2.1.1 Provide Actual Days of Service for any eligible participant receiving service as of 03/31/2027, to meet the days requested by the participant, up to the maximum number of days per week as determined by AERS in the participant plan of care.

2.2.1.2 For the provision of the Actual Days of Service, safely transport any eligible participant requesting transportation to and from the Center.

2.2.1.3 After the days of service required by current participants as of 03/31/2027 are met, if funding allows, provide ADoS to any new eligible participants that have received an AERS recommendation for a nursing home level of care with a recommended number of days of service documented in their plan of care.

2.2.2 State Staff and Roles

The State will provide the following in the facilitation of the Contract throughout its duration.

A. The Contract Monitor is the State representative for this Contract and is primarily responsible for Contract administration functions, including issuing written direction, invoice approval, monitoring this Contract to ensure compliance with the terms and conditions of the Contract, and achieving completion of the Contract on budget, on time, and within scope. The Contract Monitor may authorize in writing one or more State representatives to act on behalf of the Contract Monitor in the performance of the Contract Monitor’s responsibilities. The Department may change the Contract Monitor at any time by written notice to the Contractor.

4.8.3 Failure to acknowledge receipt of an addendum does not relieve the Bidder from complying with the terms, additions, deletions, or corrections set forth in the addendum, and may cause the Bid to be deemed not responsive.

4.12.1 A Bidder, either directly or through its subcontractor(s), must be able to provide all goods and services and meet all the requirements requested in this solicitation and the successful Bidder (the Contractor) shall remain responsible for Contract performance regardless of subcontractor participation in the work.

4.12.2 If applicable, subcontractors utilized in meeting the established MBE or VSBE participation goal(s) for this solicitation shall be identified using Attachment D or Attachment E as appropriate. Guidance for completing the Attachments is provided in the appropriate Appendix or Appendices to this IFB (see “Appendix 4 - MBE Participation Goal” and “Appendix 5 - VSBE Participation Goal”).

4.12.3 If the Bidder is the subsidiary of another entity, all information submitted by the Bidder, including but not limited to references, financial reports, or experience and documentation (e.g., insurance policies, bonds, letters of credit) used to meet minimum qualifications, if any, shall pertain exclusively to the Bidder, unless the parent organization will guarantee the performance of the subsidiary. If applicable, the Bidder’s Bid shall contain an explicit statement, signed by an authorized representative of the parent organization, stating that the parent organization will guarantee the performance of the subsidiary.

4.12.4 A parental guarantee of the performance of the Bidder under this section will not automatically result in crediting the Bidder with the experience or qualifications of the parent under any evaluation criteria pertaining to the actual Bidder’s experience and qualifications. Instead, the Bidder’s responsibility will be assessed to the extent to which the State determines that the experience and qualifications of the parent are applicable to and shared with the Bidder, any stated intent by the parent to be directly involved in the performance of the Contract, and the value of the parent’s participation as determined by the State.
