About this file

This is a Maryland Living Wage Requirements Affidavit of Agreement form for the state of Maryland's Medical Adult Day Care Private Pay Subsidy contract (Solicitation Number OCMP-26-25569, eMMA# BPM058856), effective July 2024. The affidavit is a compliance document that bidders and offerors must submit with their bid or proposal to confirm their status regarding Maryland's Living Wage Law requirements.

The affidavit provides three pathways for contractor compliance: exemption from the living wage law based on organizational type or contract value thresholds, commitment to comply with living wage requirements for covered employees, or affirmation that no covered employees will work on the contract due to specified conditions. Contractors claiming exemption must verify that they are a nonprofit organization, public service company, employ 10 or fewer employees with a proposed contract value below $500,000, or employ more than 10 employees with a proposed contract value below $100,000. If subject to living wage requirements, contractors must commit to paying covered employees at least the living wage rate established by the Commissioner of Labor and Industry, ensure subcontractor compliance, and automatically adjust wages upon any rate increases. Contractors with no covered employees must certify that proposed employees will work less than half-time on the contract, are 17 years of age or younger, or will work less than 13 consecutive weeks. The form requires authorization by a company representative with signature, contact information, and witness verification, with the Commissioner of Labor and Industry reserving the right to request payroll records and supporting documentation to verify affirmations.
