About this file

This document is a Justification and Approval (J&A) for Use of Other Than Full and Open Competition from the Naval Surface Warfare Center, Port Hueneme Division (NSWC PHD). The document authorizes a firm-fixed price contract for specific Patton Electronics branded components: Rack Mount Chassis (RMC) part numbers RMC-3101-R or RMC-3102, and fiber optic isolators (FOIs) part numbers FOI-4411-R-ST and FOI-4451-R-ST. These components are required for interconnecting fiber-optic and copper-based networks, with specific applications in satellite communications systems.

The J&A provides extensive justification for sole-source procurement, including comprehensive supply chain risk management, counterfeit avoidance, and rigorous testing processes. The Navy conducted due diligence, including Functional Qualification Testing (FQT) and Environmental Qualification Testing (EQT), to ensure the Patton branded parts meet industry and government standards. A sources sought notice was posted on NASA SEWP and SAM.gov from 04/29/2025 – 05/08/2025, which yielded no responses from NASA SEWP and four responses from SAM.gov. The contract specialist determined that no other brand meets the specific programmatic requirements, and changing brands would result in substantial additional testing and cost.

Navy Marine Corps Acquisition Regulation Supplement APRIL 2018 (Change 18-24)

ANNEX 1 – JUSTIFICATION AND APPROVAL

DEPARTMENT OF THE NAVY

NAVAL SURFACE WARFARE CENTER

PORT HUENEME DIVISION

4363 MISSILE WAY

PORT HUENEME, CALIFORNIA 93043-4307

NSWC-PHD-JA-25-090

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

Naval Surface Warfare Center, Port Hueneme Division (NSWC PHD)

2. Description of the Action Being Approved.

NSWC PHD plans to award a firm-fixed price contract on a brand name basis for Patton Electronics branded Rack Mount Chassis (RMC) and fiber optic isolators (FOIs) in support of

3. Description of Supplies/Services.

NSWC PHD requires Patton branded fiber FOIs, part numbers FOI-4411-R-ST and FOI-4451-R- ST in addition to the RMC, part number RMC-3101-R or RMC-3102, for use with the configurations. The fiber optic isolator, part number FOI-4411-R-ST, provides complete electrical isolation for RS-232 communications and FOIs, part number FOI-4451-R-ST, provide complete electrical isolation for RS- 422 communications. The parts act as serial to fiber converters. The RMC houses the FOI-4451-R-ST fiber optic isolators and provides the Satellite Communications (SATCOM) path for communications.

The Government’s minimum needs have been verified by the certifying technical and requirements personnel.

4. Statutory Authority Permitting Other Than Full and Open Competition.

10 U.S.C. 3204(c)(1). The property or services needed by the agency are available from only one responsible source or only from a limited number of responsible sources and no other type of property or services will satisfy the needs of the agency.

5. Rationale Justifying Use of Cited Statutory Authority.

NSWC PHD requires a Patton branded FOIs for use within the configurations in order to allow the interconnection of newer fiber-optic networks and cable systems and older copper based cabling systems. Specifically, the FOI will insert a fiber segment into copper networks to increase cabling distances and enhance immunity to electromagnetic interference.

The front loading rack chassis for mounting fiber optic isolators with an integrated cable bay installed in the provides the Satellite Communications (SATCOM) path for communications. The chassis can be an RMC-3101-R model or an RMC-3102 model. Each RMC requires two Power Supply Modules (PSM), two FOI-4451-R-ST, and mounting adapters for each FOI.

In support of Supply Chain Risk Management and counterfeit avoidance, the Navy conducted due diligence on the Patton branded FOIs, (part number FOI-4411-R-ST and FOI-4451-R-ST) and the rack mount chassis (part number RMC-3102-R) to ensure that the Patton specific brand of parts adequately met the industry and government standards to be approved for use within the and ensure that no altered and/or potentially counterfeit materials are placed within a critical weapons system onboard ships. This process leveraged a combination of industry standards and government procedures, including: SAE AS5553 (Counterfeit Electrical, Electronic, and Electromechanical (EEE) Parts; Avoidance, Detection, Mitigation, and Disposition), SAE AS6171 (Test Methods Standard; General Requirements, Suspect/Counterfeit, Electrical, Electronic, and Electromechanical Parts), SAE ARP6328 (Guideline for Development of Counterfeit Electronic Parts; Avoidance, Detection, Mitigation, and Disposition Systems), and NAVSO P-7000 (DON Counterfeit Material Process Guidebook). The Patton brand of parts were determined to meet all of the industry and government standards and significantly reduce the risk of counterfeit materials within as required.

Additionally, the Navy conducted Functional Qualification testing (FQT) on the Patton branded parts in accordance with requirements to ensure these parts perform according to specification and meet functional requirements. The Patton branded parts passed the FQT and was determined to be a functional match for use within .

Finally, after ensuring that the Patton parts met the counterfeit and functional requirements, the Navy conducted Environmental Qualification Testing (EQT) on the Patton branded parts in accordance with regulations in the

, any fielded weapons system that is to be installed must first pass EQT using the same configuration of components, assembled in the same manner in for that configuration to be approved onboard U.S. Navy ships. Therefore, after ensuring the Patton parts met the above stated requirements, the Navy conducted EQT using the Patton branded parts, to verify the equipment can perform reliably under specified environmental conditions throughout its intended operational life. EQT involves exposing components or systems to various stresses like temperature, vibration, and humidity, and evaluating their performance and functionality while the ships are underway within harsh conditions. The Patton branded parts passed EQT.

Therefore, the only authorized fiber optic isolators and rack mount chassis that can be used with are the Patton branded parts, part numbers FOI-4411-R-ST, FOI-4451- R-ST and RMC-3102R.

As stated, the Patton branded fiber optic isolators, part numbers FOI-4411-R-ST and FOI-4451- R-ST and the rack mount chassis, part number RMC-3102R are the only fiber optic isolators and rack mount chassis that meet the listed performance characteristics, have passed EQT, and are listed on the approved NAVSEA drawing for Therefore, since Patton is the only brand of fiber optic isolators and rack mount chassis authorized for use within the the use of another brand would require additional testing with the new brand and a drafting of new approved drawings to account for this change. This process would result in a substantial duplication of cost of approximately that is not expected to be recovered through competition.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

Based upon the statements above no other brand meets programmatic requirements for this configuration. However, numerous sources were contacted to obtain pricing information, and obtain product availability. We looked at product, price, and availability information for all required items from all Mandatory Sources first. Based on research through GSA Advantage, Internet searches and previous suppliers, several companies are capable of providing this brand.

Contract specialist posted a sources sought to NASA SEWP and SAM.gov from 04/29/2025 – 05/08/2025 and received no responses from capable sources on NASA SEWP, and four responses from capable sources on SAM.gov.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

NSWC PHD Contracts Office will continue to conduct market research as warranted to provide a broader vendor base as applicable for the types of supplies/services covered by this document. If another potential source emerges, NSWC PHD will assess whether competition for future requirements is feasible.
