Summary of Hey and Associates, Inc. Proposal for IDNR North Point Marina Dredging

This is a professional services proposal from Hey and Associates, Inc., a civil engineering and ecological consulting firm, submitted to the Illinois Department of Natural Resources (IDNR) on December 5, 2025, for civil engineering and ecological permitting services related to the North Point Marina dredging project in Lake County, Illinois. The scope of work includes sediment and water quality sampling collection in coordination with previous feedback from the Illinois Environmental Protection Agency (IEPA); up to three field batch tests with selected liner materials to assess dewatering effectiveness; delineation of the Ordinary High Water Mark for Lake Michigan; refinement of project plans to final design level with liner and breakwall modification details; preparation of an Engineer's Estimate of Probable Cost; provision of permitting and construction timeline estimates; preparation of permit submittals to IDNR for Part 3704 Public Waters permitting and the United States Army Corps of Engineers for Nationwide permitting; coordination of up to three project meetings with IDNR and regulatory partners; and response to agency comments as budget allows. This work builds upon previous efforts completed under the Regional Technical Support Services contract and targets resubmittal to IEPA within eight weeks of notice to proceed.

The contract is offered on a time and materials basis with a fee not to exceed $24,750, with all reimbursable expenses included in this amount and covering travel, reproductions, shipping, aerial photographs, communications, consultants, subcontractor fees, and equipment costs. The proposal assumes IDNR will pay all laboratory fees and permit fees directly, with all documents and data provided in editable digital format. The proposal includes standard professional liability insurance with limits of $2,000,000 and commercial general liability of $2,000,000. Hourly billing rates range from $70 for environmental interns to $240 for senior principal civil engineers, with reimbursable expense rates specified for various services including travel at $0.75 per mile and boat usage at $75.00 per hour. The proposal is valid for 60 days from the date issued and includes standard terms and conditions addressing billing practices, cost limitations, dispute resolution through mediation, and either party's right to terminate with seven days written notice.

Proposal No.: 25-0374

Re: Proposal for Civil Engineering and Ecological Permitting for North Point Marina Dredging North Point Marina, Lake County, Illinois

Dear Ms. Verden:

We understand that the Illinois Department of Natural Resources (IDNR) wishes to continue to pursue dredging of the North Point Marina to address material that has collected in the harbor and is impeding navigation and use of the harbor. Hey and Associates, Inc. (Hey) previously completed work towards this goal under the Regional Technical Support Services contract. This proposed scope of work is intended to continue that effort based upon recently received feedback from the Illinois Environmental Protection Agency (IEPA) on the proposed approach to utilize the existing inner harbor alcove for material storage and handling during the dredging operation. We propose the following scope of services:

We will:

1. Perform additional sediment and water quality sample collection based upon previous

IEPA direction to generally include the nearshore area along the outer stone breakwall adjacent to the proposed disposal location, additional sediment sampling (up to three samples) aimed at better defining PCB concentrations, and additional sampling aimed at rectifying previous sample results which showed high ammonia levels, presumed to be due to bird activity in the sample area. This task includes coordination of sample bottles and sample drop-off at a local lab.

2. We will perform up to three (3) field batch tests with selected liner materials or combinations of materials. These tests will generally consist of manually harvesting material from proposed dredging locations, allowing the material to gravity dewater through proposed liner materials, and collecting the effluent water for water quality testing. We will submit these water quality samples to a laboratory to test for key

water quality parameters to gauge the effectiveness of proposed liner materials. This task includes coordination of sample bottles and sample drop-off at a local lab.

3. We will delineate and document an Ordinary High Water Mark for Lake Michigan in the project area for use in permitting.

4. We will refine the previously submitted project plans to a final design level to include liner and breakwall modification details, access and dewatering details, and other pertinent missing information. We will also prepare a design support report for submittal, to include a proposed sampling plan for during and after dredging activities.

We will submit this information to the IEPA as a request for permitting of the proposed confined dredge disposal facility.

5. We will prepare an Engineer’s Estimate of Probable Cost reflecting the submitted plans.

6. Upon submittal we will provide an estimated permitting and construction timeline.

7. We will also prepare submittals to IDNR for Part 3704 Public Waters permitting and

USACE for (presumed) Nationwide permitting of the project.

8. This scope of work includes up to three (3) project meetings with IDNR and various partners and regulators. Meeting minutes will be prepared and distributed for each meeting.

9. We will provide response to agency comments as budget allows.

This scope of work includes the following assumptions:

1. The proposed approach will be based upon the confined disposal facility located within the inner harbor area as shown on the most recently submitted drawings.

2. All laboratory fees will be paid directly by the IDNR.

3. All structural engineering and geotechnical engineering work that may be required after initial submittal review, if any, will be by others.

4. All permit fees will be paid directly by IDNR.

5. All documents and data will be provided to IDNR in editable digital format should it become necessary for others to complete the permitting process in the future.

We will complete this work on a time and materials basis for a fee not to exceed $24,750. We anticipate engaging the noted sampling as soon as feasible based on weather after notice to proceed is issued and will target resubmittal to IEPA within eight (8) weeks of notice to proceed.

Reimbursable expenses shall be included in the fees noted above and include, but are not necessarily limited to, travel, reproductions, shipping/delivery, aerial photographs, phone and other communication charges, consultants and subcontractor fees, equipment and supply costs related to the execution of the project. Any additional meetings or supplemental work would be in addition to the above amount or by separate proposal. Our Standard Terms and Conditions are attached.
