SOURCE SELECTION SENSITIVE DRAFT SIR

PART 1 - THE SCHEDULE

SECTION C - DESCRIPTION/SPECIFICATION/WORK STATEMENT

C.1.0 SCOPE

The contractor must furnish the labor, supervision, and administrative office supplies necessary to operate the Federal Aviation Administration (FAA) Contract Towers (FCT) as outlined below. Equipment, supplies, and services supplied by the Government are also outlined below in C.4.0 and C.5.0.

C.2.0 OPERATIONAL DOCUMENTS, DIRECTIVES, AND REGULATIONS

The contractor must comply with all procedures outlined in the documents, directives, and regulations listed in Section J, Attachment J-1, to ensure the safe, orderly, and expeditious movement of air traffic.

Prior to the contract award, the contractor may access items listed in Section J, Attachment J-2. The Government will notify the contractor of any revisions to any items made to Section J, Attachment J-1.

C.2.1 Distribution

Required contract documents list can be found in Section J-1. The links will be provided in Section J-2.

After contract award, FAA will provide, as required, the contractor with all documents listed in or added to Section J, Attachment J-1. This may include subsequent changes to those documents. Time critical documents, such as General Notices (GENOT) and Notices to Airmen (NOTAM), etc., will be provided by FAA directly to ATC personnel at each FCT.

C.3.0 CONTRACTOR RESPONSIBILITIES

C.3.1 Provision of ATC Services

The contractor must provide ATC services at all FCT locations in accordance with the procedures specified in Federal Aviation Regulations(FAR), Part 65, Subpart B (excluding paragraph 65.46), and in the documents, directives, and regulations listed in Section J, Attachment J-1. Required documentation can be obtained as outlined in Section J, Attachment J-2. FAA Orders must be interpreted as an expansion of a FAR. Whenever FAA Orders are more restrictive than the corresponding FAR, then the FAA Order must take precedence. Controller personnel employed by the contractor for the purpose of performing this contract must meet qualifications stipulated in FAR, Part 65, Subpart B (excluding paragraph 65.46).

C.3.1.1 The contractor must adhere to the FAA approved staffing plans for each FCT location. In addition, the contractor must provide staffing at “other times” as required to accommodate special operations, or other unscheduled activities or events. Should staffing at “other times” become recurring, the contractor must adhere to the requirements specified in subsection C.3.1.3 of this section. The contractor may also enter into agreement(s) with an entity not a party to this contract to provide ATC services during hours not required by the FAA approved staffing plan. The FAA will not be liable for any of the staffing cost associated with such work. Government provided Aviation Liability insurance will be available to the contractor for work performed during those unscheduled activities/events. The staffing plan must adhere to the number of Full Time Equivalents (FTEs) required to meet the operational hours of the specific facility, as specified in Section J, Attachment J-3. Except for emergencies, any modifications to this plan must be approved by the FAA Contracting Officer (CO) prior to implementation. In the event of an emergency situation requiring a change to the approved staffing plan, the contractor must take the necessary actions to ensure the safety of operations is not jeopardized. The CO must be notified of such occurrences as soon as practicable.

C.3.1.2 The contractor must ensure a minimum of four (4) full-time equivalents (FTE), not including the manager are assigned to a tower. Failure to comply with this paragraph may subject the contractor to the enforcement actions contained in paragraph C.6.1 of this section.

C.3.1.2.1 The contractor must ensure that no less than two (2) fully-certified and current operational personnel are assigned to midnight shifts at towers which operate 24 hours, in accordance with Section J- 3, Site Specific Information.

C.3.1.3 The contractor must advise the FCT Program Office whenever staffing changes occur, or are forecasted to occur, which may impact the provision of ATC services.

C.3.1.3.1 Contractors that request to participate in job sharing activities must:

• Submit documentation that depicts the process for implementing job sharing activities to include allocation of benefits.

• Submit a revised staffing shift schedule that depicts job sharing activities for the applicable facility.

• Submit a quarterly list of all active job sharing locations.

C.3.1.4 The contractor must submit requests for permanent changes to staffing and/or operating hours to the FCT CO and FCT Program Office for review, processing and approval.

C.3.1.5 The contractor must perform activities, such as taking weather observations, changing recorder tapes, or verifying runway lighting operability, to prepare the FCT for opening and closing on each day of operation. These preparatory and closing activities, although not necessarily performed during the hours of operation specified in Section J, Attachment J-3, may be considered integral to the required ATC services. Personnel performing these functions must have this time included as time worked.

Additionally, time allocated for consumption of meals must be considered as time worked.

C.3.1.6 The contractor must perform activities, such as attending District users or other administrative meetings. These may include, but are not limited to requirements related to Quality Assurance, Training, Facility Security, Safety Audits, Runway Safety and Low Altitude Authorization and Notification Capability (LAANC).

C.3.1.7 To satisfy the administrative requirements of this contract, the Facility Manager (ATM) must not be placed on the basic watch schedule to work operating positions.

C.3.1.8 The contractor must provide other site-specific services as identified in Section J, Attachment J-3, including hours of operation, weather reporting requirements, etc.

C.3.1.9 The contractor must ensure personnel with decision making authority are available to respond, within a reasonable time frame, to matters within their respective Areas affecting the operational effectiveness of an FCT under their contractual jurisdiction.

C.3.1.10 The contractor must provide at least one company representative for the annual FCT Program Review.

C.3.2 Notification of Termination of ATC Services

The contractor must notify the FAA Contact Facility, Contracting Officer (CO), COR and the FCT Program Office as soon as it is known that ATC services must be terminated, either temporarily or permanently. Notification is expected within 15 minutes from the time it is known that services have been or will be affected. If circumstances preclude such notification; e.g., emergencies, physical or equipment problems, etc., the FAA Contact Facility, CO, COR and FCT Program Office must be notified as soon thereafter as practicable.

C.3.3 Non-ATC Duties

During the hours of operation and while under this contract, the contractor must not impose non-ATC duties on controllers which may in any way impede the FCT controllers from providing ATC services.

Non-ATC workload, manpower or staffing factors must not in any way influence the dollar value of the subject contract between FAA and the contractor and the FAA will not be responsible for any such costs.

NOTE: The contractor must provide janitorial services to the secure air traffic manager’s office.

C.3.4 Operational Data

The contractor must comply with the provisions of appropriate FAA directives in Section J, Attachment J-1, concerning documentation of operational data and maintenance of records, including hourly traffic count data. Additionally, the contractor must permit FAA access to this data upon request.

C.3.5 Operational Directives and Charts

The contractor is authorized to enter into letters of agreement (LOA), letters of procedure, etc., with FAA facilities and/or National Airspace System (NAS) users in accordance with FAA directives in Section J, Attachment J-1. Facility charts and diagrams must be kept current and legible.

C.3.6 Designated Control Tower Operator Examiner (DCTO-E) Program

The contractor must provide for DCTO-E capability at all FCT locations, and must implement DCTO-E program in accordance with the following directives:

• 14 CFR Part 65, Certification: Airmen Other Than Flight Crewmembers

• Air Traffic Safety Oversight Credentialing and Control Tower Operator (CTO) Certification

Programs, FAA Order 8000.90

• Designee Management Policy, FAA Order 8000.95

C.3.6.1 The contractor must use the Designee Management System (DMS) to submit a DCTO-E application or check the status of a previously submitted application. Additionally, the DMS must be used to retrieve messages from the FAA Managing Specialist, request approval to conduct Control Tower Operator (CTO) evaluations, and document activities.

C.3.6.2 The contractor is responsible for obtaining and maintaining all guidance material (including FAA forms) necessary to perform their authorized functions. All designees are encouraged to obtain guidance material through the reference library located on the designee website. The reference library is intended to be the primary source of electronic designee guidance material.

C.3.6.3 The contractor must ensure the designee has access to computer with internet capability for the purpose of obtaining required materials and using DMS.

C.3.6.4 The contractor must provide equipment necessary for the designee to scan and upload documents required for designation.

C.3.6.5 Designee applicants must complete a separate application for each designation type sought. Each designation is a separate appointment.

C.3.6.6 Meeting the minimum qualifications does not guarantee appointment as a designee. During the application process, the designee applicant will be required to acknowledge the following in DMS:

a. Designation is a privilege, not a right.

b. The FAA can terminate any designation at any time, for any reason.

C.3.6.7 Applicants must update their applications whenever information changes and they must validate and verify the application data at least every 12 calendar-months. Failure to maintain up-to-date information may affect selection eligibility and appointment as a designee.

C.3.6.8 The contractor must ensure applicants meet the following requirements:

a. FAA English language standards as described in Advisory Circular (AC) 60-28

b. FAA English language standard for an FAA Certificate issued under 14 CFR Parts 61, 63, and

c. Be at least 23 years of age.

d. Possess a CTO certificate with a facility rating for the location they are applying.

e. Have at least five years of experience as a certificated or credentialed air traffic controller in a control tower.

f. Demonstrate past professional performance and personal conduct suitable for a position of responsibility and trust.

g. Be qualified and current with all training and proficiency requirements in the facility in which applying.

h. Abide by the policies rules and regulations of the FAA.

i. Possess current medical qualifications.

C.3.6.9 Personnel meeting the following criteria may be authorized to conduct CTO examinations at multiple locations:

a. Hold a DCTO-E authorization at their primary facility.

b. Complete Multi-Facility DCTO-E training.

c. Apply for the authorization using the “request additional authorizations” link in DMS.

C.3.6.10 Designees must:

a. Represent the Administrator in a manner that reflects positively on the FAA at all times.

b. Conduct only those activities approved in DMS.

c. Follow all requirements found in regulations, orders, and other policies related to the designee functions they perform.

d. Maintain technical skill and knowledge of subject matter specific to the designation held.

e. Display sound judgment at all times.

f. Demonstrate a high degree of integrity, responsibility, and professionalism at all times.

g. Comply with minimum training requirements, including obligatory meetings with the FAA Managing Specialist.

i. Maintain the security of controlled material pertaining to the issuance of the CTO certificate.

j. Initiate a request for extension in DMS annually for considerations to extend the designation beyond the expiration date.

k. Read and respond to DMS messages and provide requested information within DMS, as directed, in a timely manner.

l. Update their DMS profile when changes occur and review their profile at least annually.

m. Scan and upload documents required for designation.

C.3.6.11 The FAA must:

a. Provide a managing office and Managing Specialist for each designee.

b. Provide the designee with DMS access, training, and technical assistance.

c. Conduct Initial, Recurrent, and Specialized training for the designee on roles and responsibilities, sources of authority, limitations, and representation of the FAA.

d. Provide oversight of the DCTO-E program in accordance with the oversight requirements in FAA Order 8000.95.

C.3.7 Facility Training Program

The contractor must establish, document, and implement a facility training program for controllers. The training program must be administered in a uniform and standardized manner, reviewed and updated at least annually. The training program is subject to FAA evaluations in accordance with JO 7210.634, Air Traffic Organization (ATO) Quality Control.

C.3.7.1 The facility training program must incorporate the following elements:

- FAR, Part 91, General Operating and Flight Rules; and Part 93, Special Air Traffic Rules and Airport Traffic Patterns

- FAA Order 8000.90, AOV Credentialing and Control Tower Operator Certification Program

- FAA Order 3120.4, Air Traffic Technical Training (excluding Chapter 2 paragraph 5; Chapter 4 paragraphs 1, 2 and 3; Chapter 6 paragraphs 1-5, 11 and 12), including refresher, proficiency, and remedial training. The program must include all required briefing items of National, Regional, and Service Area concern, and other required FCT items as determined by governing/appropriate Air Traffic organizations.

C.3.7.2 The contractor must maintain a FAA Form 3120-1, Training and Proficiency Record (or a reasonable facsimile), for all operational controllers.

C.3.7.3 Except as provided in the approved Phase-in/Phase-out plan, On-The-Job (OJT) instruction must be conducted by facility rated contract personnel.

C.3.7.4 The Contractor must notify FAA in advance of any testing, certification, or training requirements, if required, to ensure the needs of a specific FCT site are met in a timely manner. This is particularly important for FCT locations that are a lengthy travel distance from the nearest FAA District facility providing the testing support.

C.3.7.5 The contractor must schedule facility rating certifications, control tower operator (CTO) testing and certification with the FAA District facility, if required. Additionally, the contractor must follow the guidance in FAA JO 3120.4 and FAA JO 7900.5 for aviation weather observation testing and certifications.

C.3.7.6 Re-certification to perform facility ATC duties must be conducted in accordance with FAA JO 3120.4, Air Traffic Technical Training.

C.3.7.7 The contractor must provide training for contractor-furnished equipment. The contractor must provide contract personnel with training on Government-furnished equipment (GFE) following initial FAA training.

C.3.7.8 Contract personnel are not authorized to participate in the Flight Deck Training program as outlined in FAA Order 3120.29.

C.3.8 Quality Control Program

FAA ATO Safety and Technical Training (AJI), is charged with evaluating the air traffic operational and administrative functions at all levels within FAA, including contract towers. Checklists and processes utilized for evaluating FCT facilities are contained in FAA JO 2900.2, Air Traffic Organization Audits and Assessments; FAA JO 7210.633, Air Traffic Organization Quality Assurance Program; and FAA JO 7210.634, Air Traffic Organization Quality Control. Checklists are subject to modification as changes are made to national directives and/or policies.

The contractor must establish and maintain a quality control program in accordance with FAA JO 2900.2, FAA JO 7210.633, and FAA JO 7210.634. The contractor quality control program is subject to evaluation. The program must include provisions for internal facility evaluations and for written responses regarding corrective actions for any problems identified and/or remaining open as a result of an FAA safety audit.

C.3.9 Contingency Plan

The contractor must develop a contingency plan outlining actions to be taken in the event of severe weather conditions such as hurricanes/tornadoes/flooding, or planned and unplanned increases in air traffic operations and any other activity peculiar to the specific FCT location that would require it be included in a contingency plan.

Should it become necessary to remain open beyond normal operating hours to support airport emergency operations due to natural or man-made disasters i.e., hurricanes, earthquakes, fire, bomb threats, etc., or other natural or man-made events, the contractor must take immediate action to extend hours to accommodate the situation. As soon thereafter as practicable, the contractor must contact the CO/COR to resolve any contractual issues. Contractor ATC personnel must conduct themselves in accordance with clause H-2.

C.3.10 Phase-in/Phase-out Plan

The contractor must develop plans for the assumption and relinquishment of ATC services at FCT locations. The plans are required to assure that orderly transitions of services are accomplished without any disruption to ATC services that could impact the needs of users of the service. Plans must describe, in detail, how the offeror would structure the assumption or relinquishment of ATC services at sites within 60 days of reporting for assumption or of relinquishment of ATC responsibilities at the site. Plans should include how the contractor must meet training and qualification requirements so that operational control can start within the allotted time for assumption of services. An explanation of the types of work that would be undertaken such as personnel recruiting, drug and alcohol testing, assignment of management personnel, are examples of items that must be included in the plans. The Phase-Out Plan must include the methodology for training successor contractors.

C.3.11 Safety Management System/Safety Risk Management

C.3.11.1 The contractor must implement a Safety Management System (SMS) program in accordance with the following directives:

• Air Traffic Organization (ATO) SMS Order JO 1000.37

• Air Traffic Safety Oversight, FAAO 1100.161

In addition, the contractor’s Safety Risk Management (SRM) process must be consistent with the current edition of the ATO Safety Management System Manual, AOV Safety Oversight Circulars, and ATO Safety Guidance Documents.

C.3.11.2 The contractor must submit for government review an FCT SMS Implementation Plan for the FCTs covered by this contract which should include the contractor’s process for conducting SRM, reviewing and developing safety documentation, and communicating with the government.

C.3.11.3 The contractor must ensure that changes to systems, procedures, operations, or personnel qualifications, including the addition of new systems, to include taxiways, runways and extensions thereto are evaluated using the SRM process as defined in this section. All changes pertaining to or possibly affecting the provisioning of air traffic management and communication, navigation, and surveillance services must undergo the contractor’s SRM process established in C.3.19.1 and subsequently be documented in either a SRM Document with hazards or without hazards.

C.3.11.4 It is the FAA’s intent to have one employee in each FCT trained to facilitate SRM Panels. The contractor must designate 8 company employees annually to attend a SRM Practitioner and SRM Facilitation Training course. The training must be taught by the FAA and will be at government expense.

All course materials will be provided by the FAA. The FAA’s expectation is that all FCT employees receiving practitioner/facilitation training serve as SRM Panel facilitators. Until such time as each FCT has one or more employees trained as SRM Panel facilitators, the contractor may be required to provide a trained SRM Panel facilitator at FAA expense from another FCT or the contractor’s corporate office to facilitate SRM Panels. FCT SRM Panel Facilitators may rely on the applicable District Manager’s office to provide more specific SRM expertise.

C.3.11.5 The contractor must ensure that any FCT employee who has not previously completed the FAA SMS training shall complete such training within the first 6 months of hire. The FAA may provide FAA Course 50338003 Managing Safety through either a web-based link or other media access. Contractor-generated training may also be used to meet this requirement provided that the training package/materials are approved by the FAA prior to their use. The contractor must report training completion percentages to the FAA every quarter.

C.3.11.6 The contractor must submit required SRM documentation through their respective FAA District Manager utilizing the assistance of the appropriate SMS District focal. If the contractor is preparing an SRM Document, the contractor must brief the government on the status of the document. Upon government request, the contractor may be required to brief the government at other phases of the SRM process.

C.3.11.7 The contractor must certify all required SRM documents indicating that the SRM process has been followed and adhered to. The contractor must then forward the SRM Documents to their respective FAA District Manager for "risk acceptance" signature or further processing. The contractor must retain copies of all SRM Documents in facility files for the life cycle of the change.

C.3.11.8 The contractor and FAA District Managers must be co-signatories in all SRM Documents created by the contractor. The contractor must retain a copy of the SRM Documents in facility files for the life-cycle of the change.

C.3.11.9 Within thirty days after the government accepts the risk the contractor must enter all hazards into the Safety Management Tracking System (SMTS) maintained by the government to include status updates of all initial high risk hazards identified in any submitted SRM Document.

C.3.11.10 Upon government acceptance of the risk identified in an FCT SRM Document, the contractor must implement, track, and monitor the change as identified in the Monitoring Plan of the SRM Document.

C.3.11.11 The contractor must immediately notify the appropriate FAA District Manager if an initial high risk hazard affecting the NAS within a facility is identified as part of an SRM Panel.

C.3.11.12 The contractor must be responsible for establishing a positive safety culture at their facilities that:

1. Fosters an understanding of hazards and risks inherent in the operations.

2. Creates an environment where employees continuously work to identify and report safety issues.

3. Provides a workplace where employees are encouraged to report safety issues.

4. Encourages the reporting of existing safety issues, and once they are reported, appropriate actions are taken in accordance with the ATO SMS Manual.

5. Provides a workplace where employees are encouraged to develop and apply their own skills and knowledge to enhance organizational safety.

C.3.12 Drug Testing Program

The contractor must establish and maintain a drug free workplace and drug testing program in accordance with policies and directives stated in 14 CFR Part 120. The contractor must ensure that reports on the Drug Testing Program are submitted to the FAA Office of Aerospace Medicine (Code AAM) as prescribed in 14 CFR Parts 120. The FAA reserves the right for the CO to require additional drug testing upon request.

C.3.13 Alcohol Misuse Prevention Program

The contractor must establish and maintain an alcohol misuse prevention program in accordance with 14 CFR Part 120. The contractor must ensure that reports on the Alcohol Misuse Prevention Program are submitted to the FAA Office of Aerospace Medicine (Code AAM) as prescribed in 14 CFR Parts 120.

The FAA reserves the right for the CO to require additional alcohol testing upon request.

C.3.14 Security

C.3.14.1 The contractor is required to implement a Facility Security Management Program (FSMP) for each FCT that meets both the required physical security and the administrative facility security protective measures, as required by the current version of FAA Order 1600.69, FAA Facility Security Management Program. The FAA Servicing Security Element (SSE) must coordinate with the contractor as necessary to ensure that the security for all FCTs and associated personnel meet those requirements. The FAA will provide the contractor with the point of contact information for their SSE upon receipt of their Security Coordinator (SC) assignment. The SSE is the individual the SC coordinates with on all matters involving facility security.

C.3.14.2 As part of the FAA’s Facility Security Management Program (FSMP), the contractor must assign a Security Coordinator (SC), in writing, for each staffed FCT. The SC serves as the facility’s designated security representative for matters involving facility security. Typically, SC’s act as the security focal point for the facility with the FAA’s SSE. Written notification of an FCT’s SC must be provided to the SSE NLT 90 days after contract award. The contractor must also notify the FAA of any changes to an FCT’s SC within 30 days of the change.

C.3.14.3 The SC is considered to be an additional administrative duty to the existing FCT staff. As such, the SC is required to be physically located at the FCT and the SC responsibilities assigned to one of the operational staff members.

C.3.14.4 The FAA must ensure the effectiveness of the contractor’s FSMP through the conduct of scheduled and unscheduled facility security assessments, inspections, facility security program evaluations, incident reporting, and monitoring the status of facility security accreditations. The SSE will conduct a facility security assessment of the FCT, which is an on-site examination of the facility in order to determine if there are any physical and administrative security vulnerabilities or findings. Contractors are required to take the required corrective actions to reduce or eliminate physical security and administrative security vulnerabilities identified as the result of facility security assessments, inspections, or other security evaluations. For security vulnerabilities or findings that cannot be closed within 90 days of the assessment report, the SC must submit a written corrective action plan (CAP) to the SSE. The CAP will be developed and coordinated with the SSE within 90 days of receipt of the SSE’s report of assessment, inspection, or other security evaluation. The CAP must detail actions taken, or planned, along with anticipated timelines for resolving each finding.

C.3.14.5 The SC at FAA-owned FCTs, is required to establish and implement a Facility Security Plan (FSP) in accordance with the current version of FAA Order 1600.69 for their facility. Templates for the FSP may be obtained by contacting their SSE. FSPs must be developed within 120 days after contract award.

C.3.14.6 The SC is required to report security incidents to the SSE as soon as possible but always within 48 hours of the incident.

C.3.15 Aviation Safety Action Program (ASAP)

C.3.15.1 The contractor must adhere to the FAA Voluntary Safety Reporting Programs in accordance with JO 7200.20

• Must sign the FAA Contract Tower Aviation Safety Action Program (FCT ASAP) MOU within 90 days after contract award

• Must structure their ASAP so that it is in accordance with the applicable FCT ASAP MOUs

• Must ensure that all employees and managers are trained on the provisions of their FCT

ASAP MOUs

• Must designate two company employees to participate in the annual voluntary safety reporting programs (VSRP) Calibration Workshop, provided by the FAA’s VSRP Office. The training will be at the expense of the government.

• Each vendor must conduct one annual Event Review Committee ERC meeting “in person” for each of its ERC members

• New ERC members must attend the FAA’s new members training course when the first training is made available. The training will be at the expense of the government.

C.3.16 Accident/Incident Reporting

The contractor must report accidents/incidents and collect applicable data in accordance with FAA Order 8020.16, Air Traffic Organization Aircraft Accident and Incident Notification, Investigation, and Reporting.

C.3.17 Provision of Information

The contractor must provide information in response to requests from FAA, such as data for aeronautical studies, operational statistics, internal facility directives, LOAs, Contingency Plans, etc.

C.3.18 Deliverables

C.3.18.1 The contractor must submit a monthly Area Facility Report, via an electronic Excel file format, to the CO, COR and FCT Program Office. The report must include the CLIN #, facility Name and identifier, number of authorized employees, number of employees on-board at the end of the month, number of facility rated personnel at the end of the month, number of FTEs worked for the month, number of hours worked for the month, hours worked year to date, annual proposed hours, and an explanation as to any unusual circumstances relating to any of the items reported. Reports are due to FAA by the 20th of the following month. The FAA reserves the right to change or modify the Area Facility Report format at its discretion. A sample Area Facility Report is shown in Section J, Attachment J-4.

C.3.18.2 The contractor must submit, to the CO, COR and FCT Program Office, quarterly and annual reports identifying the status of adherence to the performance level requirement in Section H, paragraph H.26.

C.3.18.3 The contractor , upon request, must provide the FCT Program Office with a current copy of any internal directive regarding the provision of ATC services and any external documents to which the FCT is a signatory, such as LOAs, contingency plans, etc.

C.3.18.4 The contractor, upon request, must forward a copy of each internal evaluation done at an FCT location and all mitigation plans/written responses regarding corrective actions for any problems identified and/or remaining open as a result of an FAA safety audit or follow-up evaluation to the COR and FCT Program Office.

C.3.18.5 The contractor, must provide an estimate for travel/lodging and rental car expenses for government provided training.

C.4.0 FAA RESPONSIBILITIES

FAA General Managers must, at a minimum, conduct quarterly meetings with FCT managers to discuss issues relevant to contract towers.

C.4.1 FAA Contact Facility

FAA will furnish the contractor with the identity of the FAA Contact Facility 30 days after contract award, and will keep the contractor apprised of changes thereto. The FAA Contact Facility will ensure pertinent operational information is exchanged with the contractor, as necessary.

C.4.2 Operational Forms, Publications, and Charts

FAA will make available to the FCT locations access to operational forms required by the documents, directives, and regulations in Section J, Attachment J-1 and current operational publications and charts.

C.4.3 Testing, Certification, and Training

C.4.3.1 The associated FAA District facility must perform facility rating certifications, CTO testing and certification, when required. FAA will provide training for new, different, or modified GFE. At FCT locations where the FAA furnishes a Distance Learning Platform (DLP) FAA will provide required updates.

C.4.3.2 During the contract Phase-in, the former contractor, in the event of a change in contractors must provide on-the-job training to personnel employed by the new incoming contractor.

C.4.4 Document Review/Approval Authority

During the term of the contract, FAA reserves the right to review/approve contractor initiated changes to the contractor's operational directives, contingency plan, facility training program, quality assurance program, phase-in/phase-out plan, drug testing program, security plan, and alcohol misuse prevention program.

C.4.5 Operating Hours

The FAA reserves the right to adjust operating hours at any FCT location in accordance with FAA Order

7232.5. The FCT Program Office is responsible for coordinating any requests to change operating hours submitted by the contractor with the FAA Contracting Officer. Only the Contracting Officer may execute contract changes or modifications.

C.4.6 Evaluations

FAA will conduct evaluations/safety audits in accordance with FAA JO 2900.2, Air Traffic Organization Audits and Assessments.

C.4.7 Maintenance

C.4.7.1 FAA will provide routine and corrective maintenance for all government owned operational equipment and retains the right to modify existing equipment and/or install new or different equipment in accordance with FAA standards.

C.4.7.2 At FAA owned facilities the Service Area Technical Operations District Office will be responsible for all FAA maintenance, repairs, upkeep, and janitorial services to include the appropriate surrounding grounds.

Note: At airport sponsor-owned facilities; the Sponsor is responsible for all maintenance, repairs, upkeep, and janitorial services.

C.4.8 Space Allocation

At FAA-owned facilities, FAA will provide space suitable for the provision of ATC services, administrative office, and storage of operational supplies, equipment, and records to include any site specific requirements as outlined in Section J, Attachment J-3.

Note: The airport sponsor is responsible for providing space at non-FAA owned facilities.

C.5.0 EQUIPMENT

C.5.1 Government-Furnished Equipment (GFE)

C.5.1.1 FAA will provide all operational equipment required at FAA-owned facilities in accordance with JO 7210.78, Appendix A.

C.5.1.2 The FAA will provide the contractor with the necessary office furnishings for the administrative space at FAA-owned facilities in accordance with JO 7210.78, Appendix A.

Note: The airport sponsor is responsible for providing and maintaining the tower equipment and furnishings at non-FAA owned facilities.

C.5.1.3 The contractor must be responsible for initiating service calls to the FAA Contact Facility when experiencing GFE malfunctions. The contractor must provide necessary coordination and assistance to FAA to accomplish routine and corrective GFE maintenance during normal hours of operation. The contractor must not modify GFE.

C.5.1.4 The contractor must monitor, change, and be responsible for operational voice recorder tapes, as applicable, and the applications of Digital Voice Recording Systems in accordance with the provisions in FAA Order JO7210.3. At locations where the recorders are not convenient to operating quarters, the contractor must execute an agreement with the Technical Operations manager assigning responsibility for checking and changing recorder tapes.

C.5.2 Contractor Furnished Equipment

C.5.2.1 The contractor must provide and maintain a minimum of one commercial, public access telephone line. This line must be separate and distinct from any government provided telephone equipment.

C.5.2.2 The contractor must furnish administrative supplies, such as paper, writing implements, etc.

C.6.0 ENFORCEMENT ACTIONS

C.6.1 Failure to comply with any items in this Statement of Work and the documents, directives, and regulations listed in Section J, Attachment J-1 may subject the contractor to contractual enforcement action. See Section H.5 “Enforcement Actions” for additional details relating to Enforcement Actions.

C.6.2 The contractor will be immediately notified, upon inspection and/or evaluation by FAA, if the contractor is found to be operating in a manner which does not ensure the safe, orderly, and expeditious movement of air traffic in the airspace under its jurisdiction. The contractor must take appropriate action to correct any condition, which has an adverse effect on the provision of ATC services. FAA reserves the right and authority under the provisions of FAA Acquisition Management System (AMS) Paragraph 3.10.6, "Termination of Contracts" to terminate all or part of the contract for default if the contractor fails to take immediate corrective action that is satisfactory to FAA.
