1.6 Basis of Contract Award

Subject to section 1.19 (Consideration of Offers), contract award, if any, will be made to the lowest responsive and responsible bidder based on the Total Bid Price. Optional Tire Servicing as detailed in the Scope of Work are optional and may be awarded in the best interest of the Owner.

1.7 Type and Term of Contract

This is a firm fixed unit price contract for a base term of three (3) years, commencing upon contract execution and ending on the last calendar day of the month of the third anniversary of contract award, with two 1-year options. Each option year will be automatic unless the Owner or Contractor provides written notification to the other party of its intent not to renew no later than 90 days prior to expiration of the prevailing contract term. Any extension of the contract term beyond the expiration of the final option year shall only be made with the written approval of both parties.

1.8 Economic Price Adjustment – Lease Rates

Manufacturer’s Suggested Retail Price (MSRP) adjustments to the unit price milage rate per tire may be requested from the Contractor no more than once during any six (6) month period by submitting documentation of the updated MSRP price list for the tire models utilized under this Contract to the Owner. The pricing relationship between MSRP and the awarded lease rate shall remain firm for the entire contract period.

All adjustment requests shall be made in writing. Contractor shall not be entitled to apply an upward or downward lease rate adjustment without first obtaining written approval from the Owner. Requested adjustments shall include the contract number and the updated MSRP list in an Excel, PDF, or catalog format.

Verifiable documentation of such changes, including but not limited to invoices, published price lists, official price bulletins, or similar documentation from the Contractor’s supplier, shall be provided with the request for economic adjustment in order to substantiate any requested change.

Any request for economic adjustment shall include a written certification from the tire manufacturer or the Contractor’s supplier verifying the actual published MSRP in effect at the time of bid award and the actual published MSRP in effect at the time of the requested increase. The certification shall confirm that the requested adjustment reflects only the manufacturer’s price change applicable to the tire models utilized under this Contract and does not include increases to labor, overhead, profit, or other components not directly attributable to the documented change in MSRP.

In no event shall any annual upward adjustment exceed five percent (5%) of the prior year’s approved lease rate unless otherwise approved in writing by the Owner.

If MSRP decreases, the Owner reserves the right to require a corresponding reduction in the lease rate.

The Bonfire portal permits an electronically submitted bid to be withdrawn prior to the final bid deadline.

After the bid deadline, no bid may be withdrawn for the period of time stated in Solicitation and Offer Form. Negligence on the part of a bidder in preparing its bid shall not confer a right of withdrawal after the bid deadline.
