II. RFQ INSTRUCTIONS
A. FAR 52.212-1 INSTRUCTIONS TO OFFERORS – COMMERICAL PRODUCTS AND
COMMERICAL SERVICES. (AUG 2025) (DEVIATION 25-21)
(a) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. As a minimum, offers shall include—
(1) The solicitation number;
(2) The name, address, telephone number of the Offeror;
(3) The Offeror’s Unique Entity Identifier (UEI) and, if applicable, Electronic
Funds Transfer (EFT) indicator;
(4) Information necessary to evaluate the factors contained in the provision at
52.212-2 or as described in the solicitation;
(5) Responses to provisions that require Offeror completion of information, representations, and certifications (other than those collected via the System for Award Management (SAM)); and
(6) A statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation and any solicitation amendments.
(b) Period for acceptance of offers. The Offeror agrees to hold the prices in its offer firm for 60 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.
(c) Late submissions, modifications, revisions, and withdrawals of offers.
(1) Offerors are responsible for submitting offers and any modifications or revisions to the Government office designated in the solicitation by the time specified in the solicitation.
(2) Any offer, modification, or revision received after the time specified for receipt of offers is “late” and will not be considered unless it is received before award is made and the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition. However, a late modification of an otherwise successful offer that makes its terms more favorable to the Government will be considered at any time it is received and may be accepted.
(3) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(4) Offerors may withdraw their offers by written notice to the Government received at any time before award.
(d) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with Offerors. Therefore, the Offeror’s initial offer should contain the Offeror’s best terms. However, the Government reserves the right to conduct discussions, if necessary. The Government may reject any or all offers if such action is in the public interest, accept other than the lowest offer, and waive informalities and minor irregularities in offers received.
(e) Debriefings. If a post award debriefing is given to requesting Offerors, the Government will disclose the following information, if applicable:
(1) The agency’s evaluation of the significant weak or deficient factors in the debriefed
Offeror’s offer.
(2) The overall evaluated cost or price and technical rating of the successful Offeror and the debriefed Offeror and past performance information on the debriefed Offeror.
(3) The overall ranking of all Offerors when any ranking was developed by the agency during source selection.
(4) A summary of the rationale for award.
(5) For acquisitions of commercial products, the make and model of the product to be delivered by the successful Offeror.
(6) Reasonable responses to relevant questions posed by the debriefed Offeror as to whether the agency followed source-selection procedures set forth in the solicitation, applicable regulations, and other applicable authorities.
(End of provision)
B. SUBMISSION REQUIREMENTS
All submissions shall be submitted electronically via email on or before the RFQ closing date as stated above.
Offerors shall submit their quotes in accordance with the solicitation. Failure to follow the solicitation instructions may result in the quote to be determined non-complaint and removed from further consideration.
The offeror’s response must be submitted in three parts: Volume I: Technical Quote, Volume II:
Past Performance and Volume III: Price Quote. Each of the parts shall be separate and complete so that evaluation of each may be accomplished independently.
Volume I – Technical Quote
The Offerors technical quote shall include a detailed description of the proposed Bath and Shower items including manufacturer, model, and configuration. The technical quote shall also include a compliance matrix showing how the proposed items meet each of the required regulations (e.g. American National Standard A117.1, Uniform Federal Accessibility Standards (UFAS) and Americans with Disabilities Act (ADA), and 16 Code of Federal Regulations (CFR) Chapter II Subpart Consumer Product Safety Act.
Volume II – Past Performance
The offerors shall provide past performance information, demonstrating experiences in having supported a requirement similar in scope and complexity to CONUS and OCONUS locations. The offerors shall submit at least one up to three (3) Attachment 3:
Past Performance Questionnaire (PPQ) and their respective reference information.
The past performance shall be for projects completed recently in the last three (3) years or currently in progress, which are relevant to this requirement by similarity in size and scope of complexity. Past performance listed may include those entered into by the Federal government, agencies of State and local governments.
Volume III – Price Quote
The Price Quote shall be submitted in accordance with the excel Attachment 4 Pricing Table. The Government is requesting discounts. The offeror shall provide a firm fixed price for the Base four (4) Option Periods.
The offeror must submit firm-fixed prices for every line item listed under each performance period in Attachment 4 Pricing Table. The offeror must also provide a Total Evaluated Price for the overall performance period. All prices quoted shall be inclusive of the equipment and shipping.
The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). To account for the option periods possible under FAR 52.217-8 (maximum of six months), the Government will evaluate the option to extend services by adding six months of the Offeror’s final option period price to the Offeror’s total price.
The Government may choose to exercise the Option to Extend Services at the end of any performance period (base or option periods). Prices for the base and option periods, including the 6-month option available under FAR 52.217-8, will be evaluated to ensure that they are fair and reasonable for performance of the requirements established in the solicitation and as proposed in the technical submission. The price for the effort associated with FAR 52.217-8 will not be included in the total awarded value at contract award. If, at the end of the contract’s/order’s period of performance (the end of the base period or any option period) and within the time period established in the clause, the Government chooses to exercise this option, the pricing will be pursuant to the rates specified in the contract for the preceding performance period.
C. QUOTE SUBMISSION FORMAT
All documents shall be submitted electronically in .pdf, .doc/.docx, and/or .xls/.xlsx format, searchable format via email. If the quoter fails to materially follow the RFQ instructions, then the quoter may be declared ineligible for further evaluation and consideration for task order award.
The quote page limitation is as follows:
Volume Title Page Limit 1 Technical Quote 10 2 Past Performance 6 (2-pages for each reference) 3 Price Quote N/A

III. EVALUATION CRITERIA
The government shall perform an Highest Technically Rated Offeror with Reasonable Price evaluation.
Volume I: Technical Quote
The Government will evaluate Volume I: Technical Quote to ensure the offeror demonstrates a clear understanding of the scope of work and proposes items that meet the requirements included in the solicitation.
Volume II: Past Performance
The Government will use the Contractor Performance Assessment Reports (CPARS) and Past Performance Questionnaires to evaluate the vendor’s past performance. The government will consider the past performance information obtained in relation to similar complexity and magnitude of this procurement, considering such factors as similar size, scope, and complexity completed by the firm. If a vendor has no past performance, it will be rated neutral. The government may evaluate other sources of information such as CPARS or other databases.
Volume III: Price Quote
The Price Quote will be evaluated to determine whether the proposed price is fair and reasonable to the Government and in alignment with the technical requirements.
IV. BASIS FOR AWARD
It is the Government’s intent to award multiple (up to three (3)) Blanket Purchase Agreement(s) to the responsible quoter(s) whose quote, in conforming to the RFQ, provides the highest technically evaluated, with a fair and reasonable price, and is determined to be the most advantageous to the Government.
Highest Technically Rated Offeror with Reasonable Price (HTRO-RP): This practice allows award to the highest technically evaluated offer that is also found to have a reasonable price without using trade-offs between price and technical. This practice evaluates offerors in accordance with the technical evaluation criteria. Price evaluation of only the highest technically evaluated offer(s) proceeds next.
Price reasonableness will be determined through a comparison of the highest technically evaluated quotes received in response to this solicitation. If the offeror’s price is not determined to be fair and reasonable, the offer is rejected. Award will be made to the highest offeror(s) with a fair and reasonable price.
