About this file

This is a Certification Regarding Lobbying Form submitted in connection with a state and local contract opportunity for Letcher County Fiscal Court in Kentucky seeking hazardous materials inspection services. The document certifies that no federally appropriated funds have been or will be paid to influence federal officials or members of Congress in connection with the awarding of this federal contract, grant, or cooperative agreement. The certification further obligates the contractor to include equivalent language in all subaward documents at all tiers, including subcontracts and subgrants, and requires all subrecipients to certify and disclose accordingly.

The contract opportunity involves conducting Hazardous Material Surveys at two residential properties acquired by Letcher County through a voluntary property buyout grant program. The environmental professionals selected must be licensed by Kentucky's Division of Air Quality and appropriately accredited within the state. This certification serves as a material representation of fact and is a prerequisite for transaction execution under section 1352, title 31 U.S. Code. Failure to file the required certification subjects the contractor to civil penalties ranging from $10,000 to $100,000 for each violation, and the contractor acknowledges that provisions under 31 U.S.C. Chapter 38 regarding administrative remedies for false claims and statements apply to this certification.
