About this file
This document consists of standardized bond and lien waiver forms for the County of Montgomery, Pennsylvania, applicable to the Road Repair Program 2026-2027 contract. The file includes templates for Performance Bonds, Payment Bonds, and Labor and Material Bonds that contractors must submit as conditions of contract award. The bonds serve to guarantee that the selected contractor will perform all work in a complete and workmanlike manner in accordance with contract documents, and that all labor, materials, and equipment suppliers will be paid promptly. The contract covers roadway pavement removal and replacement, asphalt base repairs, leveling, drainage improvements, pavement markings, ADA-compliant concrete curb ramps, and signal improvements across multiple roads in Montgomery County during calendar years 2026 and 2027. The County reserves the right to modify the scope, order, or priority of roads to be repaired during the contract term.
The bond amounts, contract price thresholds, and specific performance dates are left blank in these template forms, indicating they will be completed upon contract finalization. Payment Bonds are governed by Pennsylvania's Public Works Contractors' Bond Law of 1967 and protect claimants supplying labor or materials for up to one year following project completion or ninety days after materials are supplied. All disputes and enforcement actions shall be brought in the Court of Common Pleas of Montgomery County under Pennsylvania law. The Labor and Material Bond specifically prohibits contractors, subcontractors, and material suppliers from filing mechanic's liens against the project, with this stipulation subject to filing with the County Prothonotary in accordance with Pennsylvania's Mechanics Lien Law of 1963.
