PART 1 - GENERAL

1.01 DESCRIPTION OF WORK

A. The work to be done under this Contract consists of all labor, equipment and materials and other facilities necessary and proper to complete the following: The project consists of the resurfacing and construction of an underdrain for an existing basketball court and the construction of a raingarden and level spreader adjacent to an existing tennis court.

B. The Drawings and Specifications are intended to cover a complete project, and it shall be thoroughly understood that failure to mention specifically any work which would naturally be required to complete the project shall not relieve CONTRACTOR of his responsibility to perform such work.

1.02 REFERENCED STANDARDS AND SPECIFICATIONS

A. All work shall comply with the current issues of the following codes, regulations, and requirements

(this list may not be inclusive; failure to mention any specific code, regulation or requirement does not relieve the CONTRACTOR from complying with such):

2. Federal and State Air Pollution Regulations.

3. OSHA - Occupational Safety and Health Administration.

4. ASTM - American Society of Testing and Materials.

1.03 EQUAL OR APPROVED EQUAL

A. Unless otherwise specifically provided for in the Detail Specifications, all workmanship, equipment, materials, and other items incorporated in the Work shall be new and the best grade of the respective kinds for their purpose. Where equipment, materials, other items, or workmanship are referred to in the Detail Specifications as "Equal To" any particular standard, the Engineer in its sole discretion

01 1100-2 shall decide the question of equality. The Contractor shall furnish to the ENGINEER for approval the manufacturer's detailed specifications for all machinery, mechanical and other special equipment, which the Contractor contemplates installing, together with full information as to type, performance characteristics, and all other pertinent information as may be required, and shall likewise submit for approval as required full information concerning all other materials or articles which the Contractor proposes to incorporate in the Work. Machinery, mechanical and other equipment, materials, and/or any other items installed or used without such prior written approval shall be at the risk of subsequent rejections, in which case they shall be replaced by the Contractor at its sole cost and expense. Materials specified by reference to the number or symbol of a specific standard, such as an A.S.T.M. Specification, a Federal Specification or other similar standard, shall comply with requirements in the latest revision thereof, and any amendment or supplement thereto, in effect on the date of the Invitation for Bids, except as limited to type, class or grade, or modified in such reference. The standards referred to, except as modified in the Detail Specifications, shall have full force and effect as though set forth therein. The Owner may require the Contractor to dismiss from the Work such employee or employees as the Owner or the Engineer may deem incompetent, careless, or insubordinate.

B. If, subsequent to the award of the Contract, and in normally rare occurrences, it becomes necessary

(because of delays in delivery, strikes, discontinuance of the manufacture of items specified or the equal thereof, or any other similar reasons) for the CONTRACTOR to request the use of any item of equipment or product which is of a different type than the equipment or product specified, or the approved equal thereof, the ENGINEER at his discretion, may authorize the use of such different type equipment or product of the same, greater or less cost than that specified.

C. In such cases as described in Paragraphs B above, the CONTRACTOR shall submit to the

ENGINEER in writing (1) his request for permission to make a substitution, (2) a complete description of the proposed item, including dimensions, operational characteristics, changes (if any) that will be required to other related parts of the work, etc., and (3) full information as to the costs of the item specified, the cost of the different type item being proposed, as well as costs (additional or credits) or changes (if any) to any related parts of the work. Such information shall be in such form and detail as to permit the ENGINEER to check, to his satisfaction, the reason and costs involved. Upon acceptance of the substitution, in writing, the proper credits to be allowed the OWNER or the proper additional payments to be made to the CONTRACTOR represent the difference between the net cost to the CONTRACTOR of the substituted item or material, and the price at which he could have obtained the lowest priced item or materials specified.

D. The decision of the ENGINEER, from time to time, as to the proper credits to be allowed by the

OWNER or proper payments to be made by the CONTRACTOR, shall be final and conclusive upon the CONTRACTOR.

1.04 PRIORITY OF AND DISCREPANCIES IN CONTRACT DOCUMENTS

A. If the Bidder or CONTRACTOR finds an error in or a discrepancy between any of the Contract

Documents, such error or discrepancy shall be immediately reported to the ENGINEER for correction. If found during the bidding period, the correction will be issued by Addendum, and if during the Contract period, by field order or change order, as appropriate. No work shall proceed which is affected by the discrepancy prior to the ENGINEER's resolution of the problem.

01 1100-3

B. In general, the plans and specifications are complementary; what is called for by one is as binding as if required by all. All items necessary or incidental to completely construct or erect the work denoted shall be furnished as required to provide a complete operating facility whether specifically detailed by the plans and/or specifications or not.

C. Where dimensions or locations of existing facilities are of importance to the successful performance of any part of the work of this Contract, the CONTRACTOR shall verify the correctness of such dimension or location in the field before any other procedure, whether of manufacture of related equipment or construction of related structure, shall begin. Failure of the CONTRACTOR to follow the required verification procedure here specified shall cause him to waive all right to claim for additional cost by reason on the later discovery of inaccurate dimensions or locations of existing facilities as depicted in the Contract Documents.

D. Should discrepancy be found to exist between the various Contract Documents, the following order of priority shall be followed in resolving the intent of the effected documents. In decreasing order of importance, the documents are: the Specifications; Drawings; Supplementary Conditions.

Further, it shall be understood that, in all cases, calculated dimensions shall prevail over scaled dimensions, and larger scale drawings shall take precedence over small scale drawings.

1.05 PRECONSTRUCTION MEETING

A. A pre-construction meeting will be held after award of the contract but prior to CONTRACTOR's

Notice to Proceed. A tentative meeting is scheduled for January 13, 2026 at Abington Township, 1176 Old York Road, Abington, PA 19001.

B. CONTRACTOR will be notified of any changes to the date and time of this meeting and will be expected to attend with the designated Project Superintendent.

C. CONTRACTOR is required to submit a construction schedule showing the order in which the

CONTRACTOR proposes to carry on the work, the dates on which he will start several of the more salient features and the contemplated dates for completing the same. The schedule shall be in the form of a progress chart of suitable scale as to approximately indicate the percentage of work completed at any time.

1.06 PROGRESS MEETINGS

A. During the construction period, progress meetings shall be held with the ENGINEER at the job site to discuss recent developments and future work plans as they relate to the schedule specified hereinafter.

B. Progress meetings will be held monthly in general, but the interval between meetings may be increased or decreased by the ENGINEER to suit the then current circumstances.

C. The Construction Manager, CONTRACTOR and major Subcontractors shall be represented at every meeting by a responsible member of their respective organizations.

D. All decisions and interpretations given by the ENGINEER at project meetings, shall be on behalf of the OWNER and shall be conclusive on each CONTRACTOR or Subcontractor affected.

01 1100-4

E. The proceedings of these meetings will be recorded by the Construction Manager, and each required representative at meetings will be furnished one copy.

F. The ENGINEER's act of conducting meetings, recording, and distributing meeting minutes on behalf of the OWNER, shall not be construed as coordinating or scheduling CONTRACTOR's work.

G. If a change of meeting date/time is required due to causes beyond control of the OWNER or

ENGINEER, the ENGINEER will advise each concerned party in advance of such change.

SUBMITTAL PROCEDURES

1.01 CONSTRUCTION SCHEDULE

Within fifteen (15) calendar days after the Contract commences, submit a construction schedule.

A. Construction Schedule shall be horizontal bar-chart type with a separation time bar for each significant construction activity. No activity on the schedule shall have a duration longer than fifteen

(15) calendar days, with the exception of fabrication, procurement, and punch list activities. Activity duration shall be the total number of actual days required to perform that activity including consideration of weather impact on completion of that activity. Note: The Township reserves the right to designate the sequence in which the park improvements are to be commenced, in accordance with its internal priority list and the needs of organizations utilizing the fields.

The Contractor shall adjust the project schedule as directed by the Township to reflect these priorities.

B. Prepare the schedule on a sheet, or series of sheets, of reproducible media and sufficient width to show data for the entire construction period. Provide a continuous vertical line to identify the first working day of each week. Within each time bar, indicate estimated completion percentage in 10 percent increments. As work progresses, place a contrasting mark in each bar to indicate actual completion.

C. Secure time commitments for performing critical elements of the work from all parties involved.

Coordinate each element on the schedule with other construction activities. Show each activity in proper sequence. Graphically indicate the sequences necessary for completion of related portions of the work.

D. Coordinate the Construction Schedule with the Schedule of Values, list of subcontractors, list of suppliers, and anticipated submittal schedule for shop drawings, product data, and samples.

E. Indicate completion in advance of the date established for Substantial Completion. Indicate

Substantial Completion on the schedule to allow time for the ENGINEER's procedures necessary to issue a Certificate of Substantial Completion.

F. Following favorable response to the submittal by the ENGINEER, print and distribute copies to each subcontractor and other parties required to comply with scheduled dates. Post copies in the temporary field office(s). When revisions are made, distribute to the same parties and post in the same locations. Delete parties from distribution when they have completed their assigned portion of the work and are no longer involved in construction activities.

G. In general, update the schedule every month. All Change Orders to the Contracts or other activity, where revisions have been recognized or made, must be incorporated into the schedule.

01 3300-2

1.02 APPLICATIONS FOR PAYMENT

The procedure for submittal, review, and payment of monthly applications for progress payments shall be established at the preconstruction conference. Submit one (1) executed original and four

(4) copies of each application for payment to the ENGINEER on form EJCDC 1910-8E with attachments referenced to the original Schedule of Values, which identified quantity of work completed, quantity of material stored, and the total amount completed and stored for each individual pay item. Complete every entry on the form, including notarization and execution by person authorized to sign legal documents on behalf of the CONTRACTOR. Incomplete applications will be returned without action. Entries shall match data on the Schedule of Values and Construction Schedule. Use updated schedules if revisions have been made. Include amounts of Change Orders issued prior to the last day of the construction period covered by the application.

1.03 SHOP DRAWINGS, PRODUCT DATA, SAMPLES AND CERTIFICATIONS

A. Fabricated materials or equipment to be incorporated in the work shall be subject to review by the

ENGINEER. CONTRACTOR shall obtain and check prints of manufacturers certified shop drawings and other pertinent data. When the CONTRACTOR has reviewed the shop drawings and is satisfied they are correct, they shall number each submittal (shop drawing, certificate, and manual) and submit them to the ENGINEER for review. Submittal numbering system shall be the section number referenced by these Specifications followed by the submittal number (i.e., 32 1200-1, 33 1216-1 and 33 1216-2).

B. Shop drawings are intended to mean fabrication and installation drawings. These drawings and pertinent data shall be complete and in such detail as the ENGINEER may require for providing information regarding the design, installation, testing, and operation for products and/or equipment.

C. All costs necessary for compliance with the requirements of this section of the Specifications shall be included in the bid. ENGINEER shall review individual submittals a total of two times.

CONTRACTOR shall be responsible for OWNER’s and ENGINEER’s costs for the third and all subsequent review of any submittal.

D. Detailed shop drawings, data, and literature for fabricated materials or equipment to be incorporated in the work shall be submitted to the ENGINEER for review at least two weeks before fabrication.

CONTRACTOR shall obtain and check manufacturer's shop drawings, certified prints, and other pertinent data for conformance with all requirements of the Drawings and Specifications in ample time to permit satisfactory progress of the work.

E. After completion of such checking and verification by the CONTRACTOR, the CONTRACTOR shall include a full completed copy of Attachment 1 as a cover sheet for the shop drawing. In addition, the submittal number shall be written or typed in the lower right-hand corner of all copies of each shop drawing. The submittal numbering system should be the specification section number followed by the submittal number (i.e., 33 3113-1 Ductile Iron Pipe, 33 3113-2 PVC Pipe). Failure to include a cover sheet or not numbering submittals shall be grounds for rejection of the submittal by the ENGINEER. (See Attachment 1 at the end of this section).

01 3300-3

F. All data, drawings, and correspondence from subcontractors, material men, or suppliers shall be routed through the CONTRACTOR. This procedure is required so that the CONTRACTOR's superintendent can familiarize himself with all information which the CONTRACTOR sends to the ENGINEER and also to prevent the ENGINEER from taking action upon something other than that which is desired by the CONTRACTOR. The ENGINEER shall consider for review only such data and details as are verified and transmitted to him directly by the CONTRACTOR.

G. All correspondence between the ENGINEER and the CONTRACTOR, all shop drawings, and all data for review of drawings or materials will be handled by the ENGINEER. All such data shall be delivered directly to him at the ENGINEER's office. The replies pertaining to these matters will be delivered to the CONTRACTOR or the CONTRACTOR's representative at the job site.

H. A sufficient number of shop drawings and review data shall be submitted to the ENGINEER, who will retain four (4) copies of each submittal. All additional copies, up to a maximum of four (4), received by ENGINEER will be returned to the CONTRACTOR or CONTRACTOR’s representative at the job site. The ENGINEER's notations of the action which the ENGINEER has taken will be noted on all the returned copies. Sufficient time for the review of all shop drawing submittals shall be allowed in the CONTRACTOR's schedule. A minimum of two weeks shall be allotted for each shop drawing review.

Electronic submissions may also be acceptable at the discretion of the ENGINEER and must conform to the following requirements:

1. Submit shop drawings in PDF format via email to the designated Carroll Engineering staff member.

2. Electronic submissions are limited to no more than 15 pages including Attachment 1.

3. Shop drawings “Approved” or “Furnish as Corrected,” will be emailed to the

CONTRACTOR and OWNER.

4. Shop drawings “Revise and Resubmit” or “Submit Specific Item” will be emailed to the

CONTRACTOR for revisions.

I. Drawings of minor or incidental fabricated materials and/or equipment may not be required by the

ENGINEER. The CONTRACTOR shall furnish the ENGINEER with tabulated lists of such fabrications, showing the names of the manufacturers and catalog numbers, together with samples of general data as may be required to permit intelligent determination as to their acceptability for incorporation in the work.

J. Upon successful review by the ENGINEER of the shop drawings, data sheets, samples, other data, the fabrications furnished shall be in conformity with the same. The acceptance of the shop drawings, data sheets, samples, or other data shall in no way release the CONTRACTOR from CONTRACTOR’s responsibility for the proper fulfillment, by any fabrication, of the requirements of the Agreement.

01 3300-4

K. All reviews of shop drawings, data sheets or literature are subject to the products fulfilling the specific requirements of the Drawings and Specifications. Review of items that do not conform in detail to the specified product shall place upon the CONTRACTOR the responsibility for successful operation of the proposed product. Should the item subsequently prove to be defective or otherwise unsatisfactory for the service for which it was intended, the CONTRACTOR shall, without cost to the OWNER and without obligation on the part of the ENGINEER, replace the item with the material originally specified.
