| N/A | In previous INL solicitations, a clause has been incorporated to mitigate war risks for contractors, with the government assuming partial or total responsibility in cases of war-related loss or damages. Would INL consider including a similar clause in this solicitation? | |||

12.0 ADVANCE UNDERSTANDING
f) The Contractor agrees that the Government may, at its sole discretion, unilaterally issue delivery orders based on the technical specifications, price, and other terms submitted by the Offeror under seed delivery order 1 (Seed DORP Attachment 1) and seed delivery order 2 (Seed DORP Attachment 2). The Government must exercise its unilateral right no later than 120 days after award of the IDIQ contract. The Contractor understands that the seed delivery orders formed a partial basis for award of this contract. As such, failure to accept or fully comply with the unilateral delivery orders will result in termination of this IDIQ contract for cause.
Appendix D - Pricing Att 5_Pricing Table In clause f) section 12.0 of the RFP, the government refers to the two DORP as "seed", however, in Appendix D - Pricing, INL refers to PR12162571 as sample and PR11587625 seed. Could INL confirm which of the documents mentioned is correct?
| In addition, could INL clarify if both DORPs will be awarded upon contract award? | Correction made in AMD1. Seed - PR11587625. Sample - PR12162571. The government intends to award both DORPs at the time of award of the IDIQ, however the sample may receive a partial award for less units. |

2) In some cases, the US emission standards are higher than Euopan’s -e.g: California LEV-III ULEV70 is higher than Euro 5.
| 3) Giving OEM production capacity, the 180-day delivery lead time may not be achivied for Euro 5 vehicles. | INL Kyiv will not be able to accept vehicles with lower emission level than euro 5. | L.8 INSTRUCTIONS – PHASE I | Discussion: Paragraph indicates up to 10 project experiences may be submitted. However, the Government does not state if Multiple Award IDIQ contracts can be used at the IDIQ level or if we must use individual task orders under a multiple award IDIQ. | Question: Please clarify if past performances at the IDIQ level can be included in Appendix B as a standalone project, or if Appendix B projects are exclusively task order level past performances. | Experience and Past Performance are seperate submittals and the terms should not be confused.
