In Pricing tables 1 and 2, the proposed indirect cost rates shall reflect the impact of this potential contract. Therefore, such rates shall reflect the dollar amount the offeror anticipates to receive through the duration of this potential contract (cumulative of all task orders).
Pricing Tables 1 and 2 do not have a column for dollar amount of indirect costs. Please clarify where the offeror is to include the dollar value for the proposed indirect cost rates.
No. Offerors shall not include dollars amounts in Pricing Tables 1 and 2. Offerors shall include only provisional indirect cost rates in Pricing Table 1 and ceiling indirect cost rates in Pricing Table 2. See RFP Section L-8, Volume II Cost/Price (b) (5) through (12)..
When developing the indirect cost rates proposed in Pricing Tables 1 and 2, offerors should refer to FAR 31.203(c), which reads in part, “The contractor shall accumulate indirect costs by logical cost groupings with due consideration of the reasons for incurring such costs. The contractor shall determine each grouping so as to permit use of an allocation base that is common to all cost objectives to which the grouping is to be allocated. The base selected shall allocate the grouping on the basis of the benefits accruing to intermediate and final cost objectives.” (bolding added for emphasis)
Offerors are further advised to refer to FAR 42.704(b), which reads in part, “In establishing billing rates, the contracting officer (or cognizant Federal agency official) or auditor should ensure that the billing rates are as close as possible to the final indirect cost rates anticipated for the contractor’s fiscal period, as adjusted for any unallowable costs.” (bolding added for emphasis)
Therefore, offerors shall rely on their own business forecast to derive the dollar amount that they anticipate to receive through the duration of this potential contract (and other potential contracts and existing contracts), and subsequently, their indirect cost rates proposed in Pricing Tables 1 and 2. See also Section L-8, Volume II Cost/Price (b)(29).

Sample Task
Since Microsoft has/will discontinue their support for Smartphones, does DOS still want to consider Windows 10 OS (perhaps for a tablet vs. a smartphone)? Is DOS willing to consider developing for iOS (Apple OS)?
The requirement should be changed to the Android platform and IOS. Since we wrote this, we have changed directions based on the availability of the Android platform in Mexico. We have developed an Android based capture client since the majority of the phones and tablets sold down south use that technological platform. I would remove Windows 10 as a requirement.

Sample Task – Address #2 Installing on specified devices for use by one or more agencies
Are these agencies all owned/maned, and operated by USG and USG personnel? Or do we need to consider export regulations for these deployments?
How does DOS propose the contactor provide products services that may be protected/covered by Import/Export regulations?
Any deployment that is requested will be for use by Host government with authorization by the Host government. The deployment of the software solution does not maintain import/export requirements as it relates to the statement in the solicitation. Import and export requirements for any orders of hardware will be subject to the regulations of the applicable country. It will be the responsibility of the contractor to work with DOS and the Host partner to ensure compliance to all requirements, laws and regulations.

In Pricing Table 4, the Government provided formulas to calculate automatically each proposed Subtotal, Total, and Overall Proposed Price. Offerors shall verify all formulas and otherwise the arithmetic accuracy of all proposed information.
In Attachment 7, Table 4 requires pricing in three different currencies as well as one subtotal for all total prices (line 284). Since offerors will be providing pricing in various currencies, the Subtotal will be totaling three different currencies. Is that the government’s intention, or should there be a separate Subtotal column for each currency type?
Yes, that is the Government’s intention. Please see RFP Section L-8, Volume II Cost/Price (b)(16) and the paragraph preceding Note 1 in RFP Section M.15. The Government will take the rates proposed in Colombian and Mexican currency in Pricing Table 4 and convert them to U.S. dollars for evaluation purposes only.

The contractor will design a mobile smartphone application compatible with the Android 6.0 Marshmallow operating system for the
procurement of biographic and biometric information using the newly designed cradle technology.
When the Government refers to “the newly designed cradle technology” on Page 80 of the RFP, does the Government refer to a specific vendor proprietary technology?
This response is dependent on the proposal. If the contractor sees fit, the government is willing to review and work with the contractor on a new solution for cradle technologies. A design that meets the specifications of the government that can be owned by the government would be seen as advantageous in the long term. If the contractor determines to propose an existing solution for cradle technology, close attention should be paid to the overall design, usability, licensing, maintenance fees, and sustainability of the proposed solution.

Page 38, Paragraph 12
All invoices under the contract shall be stated in U.S. dollars, and all payments will be made in U.S. dollars.
If all invoices under this contract are in U.S. dollars and all payments in U.S. dollars, could the Government please clarify why Pricing (RFQ page 87 and Table 4) is required in U.S. dollars, Columbian pesos, and Mexican pesos? Could the Government please explain the purpose and intent of pricing in three currencies?
The principal purposes are to: 1) minimize the financial risk of each party regarding potential significant fluctuations in exchange rates during contract performance; 2) facilitate contractor’s agreements with and payments to local nationals because such agreements and payments likely will be in local currency; and 3) minimize the number of currency conversions, modifications, and problems during contract administration, which results in less time, cost, and dispute for all parties.

Capable of performing biometric capture compatible with the Android 6.0 Marshmallow and Microsoft Windows 10 Mobile operating systems.
Could the Government please clarify if the Government has identified potential candidates for biometric scanners or peripherals that are compatible with Windows 10 Mobile to be integrated with the biometric capture software to be developed?
The government cannot provide any preference to specified hardware or a manufacturing company. The current design of the working piloted mobile device requires an Integrated Biometrics Five-O four-finger platen conduit scanner. The camera can be the camera from the tablet or cellular phone. Given the variance in iris collection technologies, the government maintains no preference in iris capture. The government prefers not to require the subject to contact the device with any part of their face to attain the proper iris capture.

4. Components of an IT Solution
6. Infrastructure components of an integrated IT solution can be categorized as follows:
The government requests that open source solutions shall be promoted, but also states that COTS components be promoted to the maximum extent possible. Often times, open source licenses preclude commercial uses and licenses. Can the government state which option is preferred, open source or commercial licenses, or if the government prefers commercial open source.
Open Source is generally preferred, however, if there are no open source products that meet or exceed the requirements of the government COTS can be used. This will of course be determined at the task order level.

6. Infrastructure components of an integrated IT solution can be categorized as follows:
Back Office Services
For Back Office Services, is the government’s intention that the contractor support back office services and tools, but not directly undertake tasks such as the management of government personnel.
Correct. The contract strictly prohibits management of government personnel. This reference has been removed.

The Contractor shall obtain for the Department an Organizational Conflict of Interest Disclosure Statement or Representation from each intended Subcontractor or consultant. The Contractor shall not enter into any subcontract nor engage any consultant unless the CO shall have first notified the Contractor that there is little or no likelihood that an organizational conflict of interest exists or that despite the existence of a conflict of interest the ward is in the best interest of the Government
Can the government specify the conflict of interest language that the contractor and subcontractors must represent? Is it the subcontractor COI Certification in addition to the 52.244-2 requirements? Can the government please clarify that “engage any subcontractor or consultant” is for post award and during the Task Order process and not applicable during the teaming phase of the IDIQ?
This is a post award requirement that is standard in almost all Department of State contracts.

Failure of the Contractor to fulfill any such commitment shall render the Contractor liable for liquidated or other damages due to the Government under the terms of this contract.
Can the government please confirm that liquidated damages will be identified at the Task Order level and not at the IDIQ Level?
Yes, any liquidated damages, including the completion and application of FAR 52.211-11, will be identified and assessed at the task order level.

If a prime offeror’s corporate affiliate (i.e. a parent, subsidiary or sister company) will meaningfully contribute to performance of the awarded contract, may contracts performed by such corporate affiliate be cited for the prime’s past performance required by the RFP?
Yes. As long as the offeror can demonstrate that the resources of the affiliate company will affect the performance of the offeror and that they will meaningfully contribute to any task order awarded under the IDIQ.

Attachment 9-Key Personnel Resume Format, & Page 84, Part F: IDIQ Level Key Personnel
The General Content Requirements places a three (3) page single-sided limit on Volume I, Part F: IDIQ Level - Key Personnel.
Under Part F on page 84, it states that “The offeror shall submit resume profiles for all contractor-designated key personnel to include, as a minimum, the IDIQ Program Manager and Contract Administrator.” This seems to imply that the Offeror can propose additional key personnel. If that is true, then please consider placing a page limit on a per resume basis, e.g., a page limit of 4 pages per key person resume. This would allow a more complete description of each person’s relevant experience and quality of performance asked for in Attachment 9 as well as not constrain the number of key personnel proposed.
The solicitation has been updated to allow a total of 8 pages to be submitted for key personnel but there are only two required positions.

As a part of their proposals, offerors will submit a total compensation plan setting forth salaries and fringe benefits proposed for the professional employees who will work under the contract.
Pay scales/grades and candidate availability differ significantly within the various, states, municipalities and regions in each country. Are we to assume that the operations will function in the capitals of Mexico City and Bogota? Using other areas of Colombia and Mexico may significantly change the salary and wage structure of the program.
Offerors shall assume that performance in Colombia and Mexico may occur anywhere in these respective countries. Thus, offerors shall submit a total compensation plan that relies on this assumption.

Attachment 1, & Attachment 2 Page 79, Part A, Paragraph 2.b. FPDS-NG Unavailable, Incomplete, Or Inaccurate and Last Page of Attachment 1, and Last Page of Attachment 2 Paragraph 2.b. The completed Attachment, Relevant Experience (PSC Group) Project Template must be signed by a Contracting Officer (CO) with cognizance over the submitted project.
Last Page of Attachment 1: Signature below by a Contracting Officer, Contracting Officer’s Representative, or Corporate Official for the ordering activity constitutes acceptance of the above project information to be accurate as ordered and received by the listed entity.
Last Page of Attachment 2: Signature below by a Contracting Officer, Contracting Officer’s Representative (COR), or Corporate Official for the ordering activity constitutes acceptance of the above project information to be accurate as ordered and received by the listed entity. Signature by COR must include copy of email notification to the cognizant Contracting Officer.
The RFP requires the Government Contracting Officer to sign Attachments 1 and 2 when these are completed in lieu of a complete FDPS-NG Report. This imposes an onerous requirement on each bidder, especially if the proposal schedule is limited to no more than 30 days and due to possibly limited availability of Government personnel during the holiday season. Please consider eliminating the need to have the Government CO sign the completed Attachments 1 and 2. The Government will receive either CPARS on each project or a completed and signed Past Performance Rating Form by the Government CO, which should verify the information required.
The government will not be changing this requirement at this time.
67.
Section L-8
Page 83, 8th Paragraph
Part E:Past Performance
The Offeror shall instruct each rater to send a completed form directly back to the Offeror. The Offeror must follow up with each rater to ensure the Past Performance Rating Forms were received and completed prior to the proposal closing date. The Offeror must submit all Past Performance Rating Forms, as applicable, with their proposal submission.
Please confirm that it is the Government’s intent that the bidder include in its proposal the completed and signed Past Performance Rating Forms for those projects that do not have PPIRS information. Typically, RFPs require that the Government CO or COTR, completing and signing the Past Performance Rating Forms, send those directly to the Government. The bidder never sees the completed and signed Rating form. Please consider having the completed/signed forms sent directly to the Government as this requirement to include the completed/signed forms in the proposal poses places onerous constraints on the bidder.
The government is requiring the offeror to compile and submit all past performance questionnaires with their proposal.

Aircraft Public and Passenger Liability – When aircraft are used in connection with performing the contract, the Contractor shall provide aircraft public and passenger liability insurance. Coverage shall be at least $200,000 per occurrence for property damage.
Coverage of passenger liability bodily injury shall be at least $200,000 multiplied by the number of seats or passengers, whichever is greater.
As the contract is expected to be an IT services contract, would INL consider removing this requirement?
No. Aircraft/Air travel is expected to be used in connection with performing the contract.

Vessel Liability – When contract performance involves use of vessels, the Contractor shall provide vessel collision liability and protection and indemnity liability insurance.
As the contract is expected to be an IT services contract, would INL consider removing this requirement?
This will only apply if a task order requires the use of a vessel.

Section H-4
Page 45, H-4, a)
Workers' Compensation and Employer's Liability – The Contractor is required to comply with applicable Federal and State workers' compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a Contractor's commercial operations that it would not be practical to require this coverage. Employer's liability coverage of at least $5,000,000 is required, except in States with exclusive or monopolistic funds that do not permit worker's compensation to be written by private earners.
Would INL consider reducing the Workers’ Compensation requirement from $5M to $2M?
We will not be changing the amount at this time.

The offeror shall also submit how their team worked on this solution including pictures.
Please clarify what is meant by “how their team worked on this solution” and what is meant by “pictures to be included”?
The photo requirement refers to basic screenshots of the client that was created. If the screens are proprietary, then disregard the requirement for visuals. The “how” refers to a brief narrative of the creation of the client in which the offeror explains the methodology that was used to develop the client (waterfall, agile...) design challenges, methodologies for enabling improvements, and testing methods.

Several documents required for submission will be sizable due to the Corporate Experience information to verify incomplete FPDS-NG Reports. Please state the maximum file size for delivery. Will zipped files be allowed?
Files must be clearly labeled and indexed. Emails greater than 5MB in total size may be problematic. If submitting multiple emails, offerors must identify the total number of emails in the email subject line. To ensure proper receipt Offerors must utilize the following subject line:
