About this file
Summary
This document is a Questions and Answers (Q&A) file for federal contract solicitation 191BWC26R0011, issued by the International Boundary and Water Commission (IBWC) for sediment disposal services related to the Las Cruces Facility Sediment Disposal in the Rio Grande Canalization Project. The contract requires contractors to remove stockpiled sediment from two locations (Rincon Syphon Stockpile and Hershey Arroyo Stockpile) and transport and spread the material at the Angostura Gravel Pit. The contract is structured as a firm fixed-price lump-sum contract with no Government-provided quantity estimate; bidders are responsible for conducting their own surveys to determine volumes. The disposal pit requires no compaction, and sediment material may contain vegetation that does not need removal prior to disposal. All rock sizes found at the stockpiles are acceptable.
Key operational constraints include work hour restrictions (Monday–Friday, 7:00 AM–5:30 PM MDT/MST), with no weekend or night work permitted, and a six-month maximum period of performance from Notice to Proceed. No gate access is required, levee roads are not permitted as haul routes, and all permits and water sources are the contractor's responsibility. The migratory bird nesting season (March 1–August 31) imposes a 9:00 AM work-start restriction and one-quarter-mile buffer if nests are located. Cultural resources clearance has been completed on IBWC property. The proposal deadline has been extended to September 14th. Wage determination WD NM20260039 (05/18/2026) applies, with performance and payment bonds required at 100 percent of contract price and no bid bond required. Small dredging concern status requires 51 percent self-performance calculated using labor hours, and rented or leased equipment may qualify if uncrewed and operated exclusively by the contractor's W-2 employees.

191BWC26R0011 Las Cruces Facility Sediment Disposal in the Rio Granade Canalization Project
1. Can you please confirm that compaction is not required in the disposal pit?
Compaction is not required.
2. Can you please confirm that the dirt can be disposed of with the brush and weeds that are growing in it?
Per PWS 1.2.A.1.a., sediment material may contain vegetation. There is no requirement to remove prior to disposal.
3. Please provide the current Government-estimated or surveyed quantity of sediment to be removed, expressed in cubic yards for Rincon Syphon Stockpile, each individual Hershey Arroyo Stockpile and the total contract quantity.
This is the Bidders’ responsibility. Bidders will have the opportunity to conduct a survey of the stockpiles to assist with their proposals.
4. Please identify the date and method used to calculate these quantities.
This does not apply.
5. The historical quantities contained in the 2015 and 2016 planning documents do not appear to represent the current stockpiles. Please confirm that bidders should not use those historical quantities as the contract quantity.
Refer to PWS 2.1.B.
6. The PWS identifies “Hershey Arroyo Stockpiles (various).” Please provide the exact number of stockpiles, coordinates or surveyed boundaries for each stockpile, estimated cubic yards for each stockpile; stockpile heights, footprints, and existing-ground limits; and any recent topographic surveys, CAD files, TIN surfaces, point files, or drone data available to offerors.
The boundaries surveyed are:

The Contractor shall remove all stockpiled material within these boundaries.
Bidders are responsible for surveying the stockpiles, as per the solicitation amendment.
7. If no current survey exists, will the Government provide access for offerors to perform a pre-bid survey before the proposal deadline?
Yes, offerors will have the opportunity to conduct surveys to develop their proposals. Refer to solicitation amendment for requirements.
8. Please confirm the method that will control measurement and payment-difference between pre-work and post-work topographic surfaces, average length, width, and height calculations, truck or load counts, loose cubic yards versus in-place cubic yards or another method.
This is a lump-sum contract. The Contractor shall remove all stockpiled material within the provided boundaries. The pre- and post-work topographic survey requirement has been removed.
9. Please also provide the required survey datum, control points, tolerances, software/file format, rounding rules, and procedure for resolving quantity disagreements between the contractor’s surveyor and the COR.
This is a lump-sum contract. The Contractor shall remove all stockpiled material within the provided boundaries.
10. Please provide exact coordinates and surveyed boundaries of the Angostura Gravel Pit, current available capacity in cubic yards, approved dumping and spreading limits, existing and final elevations, whether there is any disposal or tipping fee, whether all contract sediment is expected to fit within the pit; and whether debris, vegetation, oversized rock, or unsuitable material may be accepted at the pit.
The boundary surveyed is:
Angostura Gravel Pit
32°39'04.31760"N 107°05'48.14899"W IBWC-1 ENTRANCE
32°39'05.57779"N 107°05'47.98053"W IBWC-2

32°39'04.20540"N 107°05'44.07228"W IBWC-6
No disposal and tipping fees are required. All stockpiled sediment, as described in PWS 1.2.A.1.a., will be accepted and is expected to fit within the Angostura Gravel Pit.
11. Please provide the authorized haul route from each stockpile to the Angostura Gravel Pit and the one-way road mileage for Rincon Syphon, each Hershey Arroyo stockpile and any proposed staging or water location.
The levee roads are not available as haul routes. The haul routes are the responsibility of the Contractor, excluding levee roads.
The staging areas shall be proposed by the Contractor once the contract is awarded.
The water location is the responsibility of the Contractor.
12. Please identify applicable speed limits, gate procedures, work-hour restrictions, bridge or road weight limits, road-width restrictions, turning limitations, public-road permits, traffic-control requirements, and any restrictions on the number of trucks operating at one time.
No gate access is required to perform the work. Work hour restrictions are Saturday, Sunday, Monday – Thursday from 5:30 PM – 7:00 AM MDT and Friday from 5:30 PM – 11:59 PM MDT. When Daylight Saving Time ends, it will be Saturday, Sunday, Monday
– Thursday from 5:30 PM – 7:00 AM MST and Friday from 5:30 PM – 11:59 PM MST.
The Contractor shall stay within the levee road width. No driving is permitted on the levee slopes. The levee roads are not permitted as haul routes. All permits are the responsibility of the Contractor. The number of trucks operating at one time shall be governed by safety. The Contractor shall address this in the work and health and safety plans.
13. The PWS states that the COR will determine when the Angostura Gravel Pit has reached capacity. Please clarify what will occur if the COR determines that the pit is full before all stockpiled material has been hauled.
This is not expected to occur as the Angostura Gravel Pit has sufficient capacity.
14. Please identify the alternate disposal location, additional haul distance, who will obtain and pay for permits and disposal fees and whether additional time and compensation will be provided.
This is not expected to occur as the Angostura Gravel Pit has sufficient capacity.
15. Please define “spread evenly” at the Angostura Gravel Pit, including maximum lift thickness, required final slopes and elevations, maximum allowable rock size, moisture-conditioning requirements, compaction requirements, density or proof-roll testing, drainage requirements and final grade tolerances.
Spreading sediment material evenly means the distribution of dumped sediment across the Angostura Gravel Pit at a consistent depth. Final slopes, elevations and grade tolerances shall be determined on site if the Angostura Gravel Pit reaches capacity which is not expected. All rock sizes found at the stockpiles will be allowed. The other requirements do not apply.
16. Please confirm whether material must only be spread or whether grading and compaction are also required.
Per PWS 1.2.A.4., material requires to be spread.
17. Please provide available information regarding estimated moisture content and in-place density, percentage of gravel and rock, maximum anticipated rock size, vegetation, roots, trash, concrete, metal, or other debris, potential contaminated or hazardous material and whether screening or separation is required.
There is no information available. No screening or separation is required unless contaminated material is discovered, which is not expected.
18. Please identify who is responsible for testing, separating, transporting, and disposing of unsuitable, contaminated, hazardous, or oversized material.
No such material is expected. IBWC will make the appropriate determination in accordance with our Environmental Management Division (EMD) should contaminated material be discovered.
19. Please confirm that front-end loaders may be used to load upland stockpiles into belly-dump trucks and that loaders and bulldozers may be used to spread the material at the Angostura Gravel Pit.
Yes, front-end loaders and bulldozers may be used to perform the work.
20. Please identify any stockpile, haul-road segment, pit area, or access point located below the ordinary high-water mark or within Waters of the United States.
Refer to PWS Sections 4.2.A. and 4.2.C.
21. Please provide the applicable Section 404 permit and conditions, current OHWM/WOTUS mapping, and the Environmental Protection and Improvement Conditions referenced in the PWS.
Refer to PWS Sections 4.2.A. and 4.2.C. PWS 1.4.A. has been revised for clarification.
22. Please provide existing-condition documentation for the access and levee roads, the measurable standard for required road maintenance and final restoration, whether imported aggregate or road base may be required, the approved water source, location, availability, price, and metering procedure, whether the Government will provide any water connection or hydrant access and the expected frequency of watering.
The Contractor shall refer to Resources and Information - IBWC for levee road maintenance and restoration, including aggregate and base course. The water source is the responsibility of the Contractor. The Government will not provide water access or connections. Watering frequency is the responsibility of the Contractor.
23. The PWS discusses dust control during non-working hours, weekends, and holidays.
Please confirm whether the contractor must maintain a water-truck crew on call 24 hours per day while a stockpile is active and identify the objective standard the COR will use to determine compliance.
This is the responsibility of the Contractor. The Government and Contractor will adhere to the Contract requirements.
24. Please provide current biological surveys and maps showing any active or potential flycatcher, yellow-billed cuckoo, migratory-bird, or other protected-species territories and buffers affecting Rincon Syphon, each Hershey stockpile, the Angostura Gravel Pit, all haul routes; and the staging area.
https://www.ibwc.gov/resources-info/
Maps showing nest locations are confidential and will only be provided at the time the contract is awarded, if needed.
25. Please reconcile the different seasonal dates contained in the PWS, River Management.
The migratory bird season of March 1 to August 31 shall be followed.
26. Please confirm whether any 9:00 a.m. work-start restriction or one-quarter-mile buffer applies to this project. Also identify who will provide and pay for required biological surveys, monitoring, relocation, or mitigation. Plan, and 2017 Biological Opinion, including the August 15 and September 1 dates.
The 9:00 a.m. work-start restriction and one-quarter-mile buffer apply only if work occurs during the bird nesting season (March 1–August 31). No biological surveys, relocation, or mitigation are needed if work is conducted outside this period.
If work must occur during the nesting season, a survey of the affected area(s) will be required. EMD can assist with completing that survey. If any nests are located, then the 9:00 a.m. work-start restriction and the one-quarter-mile buffer will apply.
27. Please provide written confirmation that NMSHPO and other required cultural-resources clearances have been completed for every stockpile, the entire authorized haul route, the Angostura Gravel Pit and the staging area.
Clearance has been completed. Clearance does not apply outside of IBWC property.
28. Please confirm that these clearances will be complete before Notice to Proceed and explain how Government-caused clearance delays or unexpected discoveries will affect contract time and compensation.
Clearance has been completed.
29. The PWS identifies a maximum period of performance of six months, while the QASP references 365 days. Please confirm the controlling period of performance and the anticipated Notice to Proceed date.
The period of performance shall be no more than six (6) months from Notice to Proceed (NTP). NTP shall be provided once all required documents, from the Contractor, are complete.
30. Please also clarify permitted working hours and days, whether weekend or night work is permitted, whether the October-to-February work window applies only to in-channel work or also to upland stockpile loading and hauling, whether biological restrictions may delay the start of work and whether weather, flooding, irrigation operations, locked gates, or Government access restrictions will provide additional contract time.
Working days are Monday - Friday. Working hours are 7:00 AM - 5:30 PM MDT during Daylight Saving Time and 7:00 AM - 5:30 PM MST when Daylight Saving Time ends.
There are no biological restrictions to cause delays in the start of work or gates to access. Should there be a delay in the ability of the Contractor to perform the work, not caused by the Contractor, it shall be the responsibility of the Contractor to submit a request with proper documentation to the Government for approval of additional contract time.
31. Please provide a corrected and consolidated list of required submittals and due dates, including the Work Plan, baseline schedule, Safety and Health Plan, Job Hazard Analyses, SWPPP, SPCC Plan if applicable, environmental permits, equipment lists, topographic surveys, progress reports, recovery schedule, and final restoration documentation.
Corrections have been provided within the amended PWS and QASP. It is the responsibility of the bidder to understand the documents posted in the solicitation and submit all requirements. Per PWS 4.3, it is the responsibility of the Contractor to understand and obtain all permits required.
32. Please reconcile any deadlines stated as being after award with those stated as being after Notice to Proceed.
Deadlines have been corrected.
33. The PWS footer ends at “Page 26 of 28,” and the table of contents does not align with several body-page numbers. Please confirm whether the complete PWS has been posted. If pages or requirements are missing, please issue the complete corrected PWS by amendment.
The page numbering has been corrected.
34. Please also correct or clarify any QASP references that do not correspond to the current PWS sections.
References have been corrected.
35. Please confirm whether attendance at the August 14, 2026 site visit was mandatory and whether an otherwise qualified offeror that did not attend remains eligible to submit a proposal.
Attendance was not mandatory. Offerors not in attendance remain eligible to submit a proposal.
36. If attendance was not mandatory, will the Government allow another controlled site inspection before proposals are due?
A site visit to survey the stockpiles will be made available. Refer to the solicitation amendment for requirements.
The following statement refers to questions 37-41.
The solicitation price schedule appears to request lump-sum pricing, while PWS Sections 8.3 and 8.4 discuss unit-price work and measurement by cubic yards.
37. Please clarify whether CLIN 002 is firm-fixed-price regardless of the actual quantity removed.
CLIN 002 is explicitly labeled Firm Fixed Price in Section A of the Solicitation.
Under PWS §8.4(A), lump-sum items (LS) are not measured by quantity; payment is based on percentage of work completed, not cubic yards.
Therefore, even if actual cubic yards differ from the Contractor’s estimate, CLIN 002 remains FFP unless the Government issues a modification under PWS §8.6.
38. Please clarify the official quantity all offerors must use to develop the lump-sum price.
There is no Government provided official quantity.
PWS §8.3(B)(1) states:
“Any estimated quantities provided in the Proposal documents are for comparative proposing only. The Government does not express or imply that the actual amount… will correspond to the estimated quantities.”
PWS §1.10 places responsibility on the Contractor to independently assess the site and quantify the material to be removed.
Thus, each offeror must perform its own site investigation and develop its own quantity assumptions.
39. Please clarify whether there is a minimum or maximum guaranteed quantity.
There is no minimum or maximum guaranteed quantities.
40. Please clarify how the contract price will be adjusted if the actual quantity is substantially higher or lower than the bidding quantity.
A FFP lump-sum CLIN is not adjusted due to actual measured quantity.
If sediment volume is higher or lower than a Contractor estimated, the lump sum price remains unchanged unless the Government formally modifies the contract.
41. Please clarify whether the Government will consider revising CLIN 002 to a unit price per surveyed cubic yard.
The government does not intend to convert CLIN 002 to a unit-priced CLIN.
42. Please provide the required limits and endorsements for commercial general liability, commercial automobile liability, workers’ compensation, employer’s liability, umbrella or excess liability, contractor’s equipment/inland marine coverage and pollution or environmental liability, if required.
See SECTION H – SPECIAL CONTRACT REQUIREMENTS in Amendment.
43. Please confirm whether a bid bond is required. The solicitation identifies performance and payment bonds at 100 percent of the contract price. Please confirm the required forms and the deadline for providing those bonds.
No Bid Bond is required.
44. Please also confirm the controlling wage determination and the applicable classifications for belly-dump truck drivers, front-end-loader operators, bulldozer operators, grader operators, water-truck drivers, laborers, and working foremen.
See WD NM20260039 05/18/2026 for this information.
45. IBWC Form 245 requires experience with comparable or greater quantities. Because the solicitation does not provide a current contract quantity, please identify the quantity the Government will use to determine whether a project is comparable.
Provide experience in removing, hauling and spreading of materials in any quantity.
Please include total CY, if completed.
46. Please also clarify whether completed subcontractor experience may be used with a signed commitment, whether an ongoing project may qualify, whether the same project may support both company and superintendent experience, the documentation required for superintendent experience and how the 51-percent self-performance requirement will be calculated—surveyed cubic yards, truckloads, labor hours, equipment hours, or contract dollars.
Yes. The prime must submit “a signed statement explaining exactly what work they will perform along with a certification that said subcontractor will be used for this project and will not be substituted.”
Yes — ongoing projects may be used. Please see the instructions in Form 245.
Yes, the same project may support both company and superintendent experience.
IBWC Form 245B requires the superintendent’s projects to include:
• Brief Description of Work
• Description of Quantities of Work
• Description of Project Complexity
• Contracting officer contact information
The 51-percent self-performance requirement will be calculated using labor hours.
47. Please confirm whether rented or leased equipment operated by the offeror qualifies as the offeror’s equipment and what documentation is required when using equipment owned by another small dredging concern.
Yes. Rented or leased equipment qualifies as the offeror's equipment provided that it is an uncrewed lease (machinery only) and is operated exclusively by the direct, W-2 employees of the prime contractor. Uncrewed equipment leases are treated as an operational expense, not a subcontract, and therefore count 100% toward the prime contractor’s self-performance threshold. If the equipment is provided with operators from another firm, it is legally a subcontract and must be evaluated under Similarly Situated Entity (SSE) guidelines.
48. Because the requested information is necessary to prepare a responsible lump-sum proposal, please advise whether the Government will extend the proposal deadline if quantities, routes, surveys, and other material information are not issued with sufficient time for offerors to incorporate them into their pricing.
Due date for offers extended to September 14th.
