About this file
This is Amendment 0001 to Solicitation 191BWC26R0011, issued by the International Boundary and Water Commission (IBWC) for LCF Sediment Removal services. The amendment extends the offer due date to September 14, 2026, at 3:00 PM Mountain Time and clarifies bidder responsibilities and contract requirements.
The solicitation is a total small business set-aside with limitations on subcontracting. Bidders are solely responsible for conducting site investigations, measurements, and verifications at their own expense, with no government reimbursement for these pre-bid activities. Bidders may use technology tools including drones, imaging systems, and measurement devices subject to applicable federal, state, and local regulations and facility security requirements. Site visits are available by appointment only between September 2-4, 7:00 AM to 5:30 PM, and bidders planning drone surveys must provide screen name, make, model, serial number, and visit schedule to seone.jones@ibwc.gov and olga.castro@ibwc.gov. The contract requires contractors to maintain comprehensive insurance including workers' compensation (statutory Texas limits with $1,000,000 employer's liability), commercial general liability ($1,000,000 per occurrence/$2,000,000 aggregate), business automobile liability ($1,000,000 combined single limit), contractor's equipment floater with $1,000,000 minimum limits on replacement cost basis, contractors pollution liability ($1,000,000 per occurrence/$2,000,000 aggregate), and a $5,000,000 commercial umbrella policy. All policies must name the United States Government as additional insured with 30-day cancellation notice requirements. For compliance tracking, contractors must submit semi-annual limitations on subcontracting reports due within 15 calendar days after each six-month period, using only direct labor costs in calculations, with penalties including payment withholding up to 10% and statutory civil penalties up to $500,000 for non-compliance.

52.219-6 - Notice of Total Small Business Set-Aside (DEVIATION FEB 2026)
(a) Definition. Small business concern, as used in this clause—
(1) Means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the size standards in this solicitation.
(2) Affiliates, as used in paragraph (a)(1) of this clause, means business concerns, one of whom directly or indirectly controls or has the power to control the others, or a third party or parties control or have the power to control the others. In determining whether affiliation exists, consideration is given to all appropriate factors including common ownership, common management, and contractual relationships. SBA determines affiliation based on the factors set forth at 13 CFR 121.103.
(b) Applicability. This clause applies only to-
(1) Contracts that have been set aside for small business concerns; and
(2) Orders set aside for small business concerns under multiple-award contracts as described in 8.4 and 16.5.
(c) General. (1) Offers are solicited only from small business concerns. Offers received from concerns that are not small business concerns shall be considered nonresponsive and will be rejected.
(2) Any award resulting from this solicitation will be made to a small business concern.
(End of clause)
Clause 52.219-14 Limitations on Subcontracting (DEVIATION FEB 2026) was added or modified.

Document Number: 191BWC26R0011 PROCESSED Page 4 of 5
(a) This clause does not apply to the unrestricted portion of a partial set-aside.
(b) Definition. Similarly situated entity, as used in this clause, means a first-tier subcontractor, including an independent contractor, that—
(1) Has the same small business program status as that which qualified the prime contractor for the award (e.g., for a small business set-aside contract, any small business concern, without regard to its socioeconomic status); and
(2) Is considered small for the size standard under the North American Industry Classification System (NAICS) code the prime contractor assigned to the subcontract.
(c) Applicability. This clause applies only to—
(1) Contracts that have been set aside for any of the small business concerns identified in 19.000(a)(3);
(2) Part or parts of a multiple-award contract that have been set aside for any of the small business concerns identified in 19.000(a)(3);
(3) Contracts that have been awarded on a sole-source basis in accordance with sections 19.105, 19.106, 19.107, and 19.108;
(4) Orders expected to exceed the simplified acquisition threshold and that are set aside for small business concerns under multiple-award contracts, as described in 8.4 and 16.5;
(5) Orders, regardless of dollar value, that are set aside in accordance with sections 19.105, 19.106, 19.107, and
19.108 under multiple-award contracts, as described in 8.4 and 16.5; and
(6) Contracts using the HUBZone price evaluation preference to award to a HUBZone small business concern unless the concern waived the evaluation preference.
(d) Independent contractors. An independent contractor shall be considered a subcontractor.
(e) By submission of an offer and execution of a contract, the Contractor agrees that in performance of a contract assigned a North American Industry Classification System (NAICS) code for—
(1) Services (except construction), it will not pay more than 50 percent of the amount paid by the Government for contract performance to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count towards the prime contractor's 50 percent subcontract amount that cannot be exceeded. When a contract includes both services and supplies, the 50 percent limitation shall apply only to the service portion of the contract;
(2) Supplies (other than procurement from a nonmanufacturer of such supplies), it will not pay more than 50 percent of the amount paid by the Government for contract performance, excluding the cost of materials, to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count towards the prime contractor's 50 percent subcontract amount that cannot be exceeded. When a contract includes both supplies and services, the 50 percent limitation shall apply only to the supply portion of the contract;
(3) General construction, it will not pay more than 85 percent of the amount paid by the Government for contract performance, excluding the cost of materials, to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count towards the prime contractor's 85 percent subcontract amount that cannot be exceeded; or
(4) Construction by special trade contractors, it will not pay more than 75 percent of the amount paid by the Government for contract performance, excluding the cost of materials, to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count towards the prime contractor's 75 percent subcontract amount that cannot be exceeded.
(f) The Contractor shall comply with the limitations on subcontracting as follows:
(1) For contracts, in accordance with paragraphs (c)(1), (2), (3) and (6) of this clause—[Contracting Officer check as appropriate.]
__ By the end of the base term of the contract and then by the end of each subsequent option period; or
__ By the end of the performance period for each order issued under the contract.
(2) For orders, in accordance with paragraphs (c)(4) and (5) of this clause, by the end of the performance period for the order.
(g) A joint venture agrees that, in the performance of the contract, the applicable percentage specified in paragraph (e) of this clause will be performed by the aggregate of the joint venture participants.
(1) In a joint venture comprised of a small business protégé and its mentor approved by the Small Business Administration, the small business protégé shall perform at least 40 percent of the work performed by the joint venture. Work performed by the small business protégé in the joint venture must be more than administrative functions.
(2) In an 8(a) joint venture, the 8(a) participant(s) shall perform at least 40 percent of the work performed by the joint venture. Work performed by the 8(a) participants in the joint venture must be more than administrative functions.

AMENDMENT 0001 TO INVITATION FOR BIDS (IFB)
Subject: Site Investigation and Measurement Responsibilities; Technology Tools;
Environmental & Quality Obligations; Site Visit Scheduling; Due Date Extension
1) PURPOSE
This amendment clarifies bidder responsibilities for site investigations and measurements, permits the use of technology tools to verify quantities, affirms environmental and quality obligations, provides site-visit scheduling details, and extends the due date for offers.
2) SITE INVESTIGATION & MEASUREMENT RESPONSIBILITIES (NO GOVERNMENT
REIMBURSEMENT)
a. Bidders are solely responsible, at their own expense, for conducting any site investigations, measurements, verifications, identifications, and documentation necessary to prepare an accurate and complete bid. No compensation, reimbursement, or equitable adjustment will be paid by the Government for any costs associated with site visits, investigations, measurements, testing, or data collection performed by bidders or their representatives.
– See FAR 52.237-1 “Site Visit” (Services) (prescribed by FAR 37.110(a)), which urges offerors to inspect the site and states that failure to inspect will not constitute grounds for a claim after award.
– Where the contemplated work includes construction or removal/demolition activities, FAR 52.236-3 “Site Investigation and Conditions Affecting the Work” (prescribed by FAR 36.503) applies; the Government assumes no responsibility for conclusions drawn by the bidder and failure to investigate does not relieve the bidder of proper performance without additional expense.
b. The Government does not assume responsibility for performing measurements or quantity takeoffs on the bidder’s behalf. Bidders shall tender bids based on their own verified data and remain accountable for estimating and performance risk consistent with the above clauses.
3) PERMITTED TECHNOLOGY TOOLS
To ensure accuracy and compliance, bidders/contractors may use technology tools— including drones/UAS, imaging systems, measurement devices, and digital geolocation tools—subject to applicable Federal, state, and local law, airspace rules, and facility security requirements. All necessary permissions/authorizations are the bidder’s responsibility. The Government will not reimburse any associated costs.
For drone use, the following information needs to be provided ASAP by any bidder who plans to use a drone to survey the stockpiles.
1. Screen name
2. Make
3. Model
4. Serial no.
5. For all bidders performing a survey, regardless of method of surveying, provide the day and time you will be out at the site. Available dates are September 2-4, 7am-5:30pm.
4) QUALITY CONTROL OBLIGATIONS
The contractor is responsible for quality control and for tendering only supplies or services that conform to contract requirements, maintaining substantiating evidence, and performing inspections/tests unless specifically reserved for the Government. See FAR
46.105 “Contractor responsibilities” and, for fixed-price service contracts, FAR 52.246-4 “Inspection of Services—Fixed-Price.”
5) ENVIRONMENTAL/WASTE-MANAGEMENT RESPONSIBILITIES
In addition to contract-specific requirements, contractors shall ensure waste-management practices (including removal, handling, and transportation of debris) comply with all applicable environmental protection, pollution prevention, and waste-reduction requirements.
– For performance at a Federal facility, include FAR 52.223-5 “Pollution Prevention and Right-to-Know Information” (prescribed by FAR 23.406(a)).
– Where applicable, include FAR 52.223-10 “Waste Reduction Program” (prescribed by FAR 23.406(c)).
– These implement the policies in FAR Subpart 23.4 (Pollution Prevention, Environmental Management Systems, and Waste Reduction).
6) BIDDER SELF-CERTIFICATION OF QUANTITIES REMOVED
Prior to submitting an offer, bidders are responsible for accurately measuring, verifying, identifying, and documenting all project materials proposed to be removed from the site (and any associated disposition plans), consistent with the above quality/environment clauses. Documentation shall be made available to the Government upon request.
7) SITE VISIT – BY APPOINTMENT ONLY
The site will be available between September 2 – 4, by appointment only. To schedule, send an email to seone.jones@ibwc.gov and olga.castro@ibwc.gov. Bidders are urged and expected to inspect the site in accordance with FAR 52.237-1.

SECTION H – SPECIAL CONTRACT REQUIREMENTS
H.01 INSURANCE REQUIREMENTS AND SPECIAL HAZARD ENDORSEMENTS
(a) General Provision.
In accordance with FAR 52.228-5, "Insurance—Work on a Government Installation," the Contractor shall, at its own expense, procure and maintain throughout the entire performance period of this contract the minimum insurance coverage and specialized endorsements specified below. Proof of insurance shall be submitted via an ACORD 25 Certificate of Insurance (COI) to the Contracting Officer (CO) for approval within ten (10) calendar days after contract award and prior to the commencement of any on-site operations.
(b) Required Baseline Insurance Coverages.
The Contractor shall maintain the following primary liability policies with limits not less than those prescribed below:
1. Workers' Compensation and Employer's Liability: Statutory limits as required by the State of Texas, with Employer's Liability limits of not less than $1,000,000 per accident/$1,000,000 per disease.
2. Commercial General Liability (CGL): $1,000,000 per Occurrence / $2,000,000 General Aggregate for bodily injury and property damage.
3. Business Automobile Liability: $1,000,000 Combined Single Limit (CSL) per accident, covering all owned, non-owned, and hired vehicles utilized in the hauling of sediment under this contract.
(c) Contractor’s Equipment and Inland Marine Coverage.
Because this contract involves the deployment of high-value specialized civil machinery along an active waterway, the Contractor shall maintain a specialized Contractor’s Equipment Floater / Inland Marine Policy to guarantee operational continuity and rapid asset replacement.
1. Minimum Limits:
o Any One Loss / Catastrophe Limit: Not less than $1,000,000 (or 100% of the total aggregated market value of all equipment deployed on-site at any single time).
o Leased or Rented Equipment Endorsement: Not less than $250,000. This is mandatory to cover any machinery leased or rented from third-party commercial vendors or other small dredging concerns utilized to meet self-performance thresholds.
2. Valuation Basis: All property and equipment coverage must be written on a Replacement Cost Basis (Actual Cash Value formulations are non-compliant).
3. Mandatory Waterborne / Near-Water Operational Endorsement: The policy must explicitly feature an endorsement extending coverage to machinery operating on, adjacent to, or over water, including riverbanks, shorelines, mud retention basins, or floating platforms. Standard water submersion or flood exclusions affecting heavy machinery are strictly prohibited.
(d) Contractors Pollution Liability (CPL).
Due to the proximity of operations to the Rio Grande waterway, the Contractor shall maintain a dedicated Contractors Pollution Liability policy. Standard CGL policies containing an "Absolute Pollution Exclusion" will not satisfy this requirement.
1. Minimum Limits: $1,000,000 per Occurrence / $2,000,000 Policy Aggregate.
2. Scope of Coverage: The policy must provide coverage for both sudden/accidental and gradual releases of pollutants, sediment turbidity spikes violating environmental permits, and third-party downstream damages resulting from operations.
3. Mandatory Transport and Disposal Endorsements: The policy must explicitly include:
o Transportation Pollution Liability (TPL): Covering pollution conditions arising out of the loading, transit, spilling, or unloading of sediment/waste on public roadways.
o Non-Owned Disposal Site (NODS) Coverage: Extending liability protection to the government and contractor should the designated third-party sediment dump facility become compromised.
(e) Commercial Umbrella / Excess Liability.
The Contractor shall procure a Commercial Umbrella or Excess Liability policy providing a minimum ceiling of $5,000,000 per occurrence and in the aggregate.
1. Follow-Form Requirement: The policy must be written on a True Follow-Form basis, inheriting all standard protections, definitions, and requirements of the underlying primary policies.
2. Underlying Schedule: The Umbrella policy must apply as excess directly over the primary Commercial General Liability, Business Auto Liability, Employers Liability, and Contractors Pollution Liability policies.
(f) Mandatory Government Protections and Endorsements.
All policies required under paragraphs (b), (c), (d), and (e) of this clause shall be endorsed to include the following legal clauses:
1. Additional Insured: The United States Government, [Insert Specific Agency Name], and its officers, agents, and employees shall be named as an Additional Insured for all liabilities arising out of work performed under this contract.
2. Waiver of Subrogation: The insurance carrier shall agree to waive all rights of subrogation against the United States Government, its modifications, or its changing site conditions.
3. Notice of Cancellation: The Contractor’s insurance policies shall feature an endorsement requiring the insurance company to provide at least thirty (30) calendar days advance written notice to the Contracting Officer prior to any material policy cancellation, non-renewal, or restrictive modification.
H.02 Post-Award Limitations on Subcontracting Reporting and Enforcement (FAR 52.219-14)
A. Definitions
As used in this clause, Similarly Situated Entity (SSE) means a first-tier subcontractor that has the same small business program status that qualified the Prime Contractor for the award, and is considered small for the NAICS code assigned to this subcontract.
B. Mandatory Performance Tracking Metric
The contractor shall track compliance with FAR 52.219-14 using contract dollars incurred for personnel (direct labor costs). Materials, equipment, travel, overhead, and profit shall be excluded from all compliance calculations.
C. Reporting Frequency and Deadlines
1. Semi-Annual Reports: The Contractor shall submit a Limitations on Subcontracting Compliance Report every six (6) months from the date of contract award. Reports are due within 15 calendar days following the end of each six-month period.
2. Period of Performance / Option Year Reconciliations: A cumulative report covering the entire preceding performance period must be submitted no later than 30 calendar days prior to the expiration of the base period or any subsequent option period. The Government reserves the right to withhold the exercise of option periods if compliance cannot be verified.
3. Final Closeout Report: A final, comprehensive project report shall be submitted within 45 calendar days of the completion of the contract period of performance.
D. Required Submission Documentation
Each report submission must be sent to the Contracting Officer (CO) and the Contracting Officer’s Representative (COR), containing:
• SBA Form 2406 (or an equivalent agency-approved spreadsheet template).
• Certified payroll summaries or redacted general ledger labor reports isolating the Prime’s direct labor spend.
• Written certifications from each SSE confirming their small business status remains active and valid for the tracking period, alongside copies of their invoices detailing personnel costs.
E. Remedies and Penalties for Non-Compliance
1. Withholding of Payments: In accordance with FAR 52.232-5, if the CO determines the Contractor is failing to maintain the required 50% self-performance ratio (inclusive of SSE labor), the Government may withhold up to 10% of subsequent progress payments until a realistic corrective action plan is approved.
2. Past Performance Impacts: Failure to meet the 50% threshold at the conclusion of any period of performance will be documented as an "Unsatisfactory" rating under the "Compliance" element within the Contractor Performance Assessment Reporting System (CPARS).
3. Statutory Penalties: Pursuant to 15 U.S.C. 645(g), any contractor found to have intentionally misrepresented or failed to comply with the Limitations on Subcontracting rule without an approved waiver may be subject to a civil penalty equal to the greater of $500,000 or the total amount spent on subcontractors beyond the permitted 50% limit.
