A. Except as provided in these specifications for drawings to be furnished by Contractor, Contract
Drawings will be supplemented by additional or revised general and detail drawings as necessary or desirable as work progresses.

1.3 MEASUREMENT AND PAYMENT
The work performed by the Contractor under this Section shall not be paid for directly, but shall be included in the various Bid Items under this Contract.
1.4 DEFINITIONS
A. Within this section, the following terms are used interchangeably.
1. Bid - Offer - Proposal
2. Solicitation - Request for Proposal - RFP
3. Bidder - Offeror - Contractor
1.5 DUTY TO INQUIRE
A. Contractors shall review the full Solicitation including Technical Specifications, Contract Drawings, attachments, etc. to determine the full scope of work required.
B. The Contractor shall take no advantage of any item of which they have a duty to inquire.
C. If during review of these items, the Contractor finds discrepancies, omissions, conflicts, defects, errors, or ambiguities, they have a duty to inquire. The Contractor shall also inquire about items that are unclear or open to interpretation.
1.6 BID SUBMISSION
A. Submission of a bid shall be conclusive evidence that the Bidder has reviewed, investigated, and acknowledged all items detailed in FAR 52.236-3.

B. Submission of a bid shall be conclusive evidence that the Bidder has investigated and is satisfied as to the conditions to be encountered, the character, quality and scope of work to be performed, the quantities of materials to be furnished.
C. Submission of a bid constitutes agreement that Bidders has provided written notice of all conflicts, errors, ambiguities, and discrepancies discovered in the Contract Documents, that responses to these written notices are acceptable to Bidder, and that Contract Documents are sufficient to indicate and convey understanding of all terms and conditions for performing and furnishing required work.
D. Bidder has the sole responsibility to make such independent instigation and examination as they deem necessary in order to satisfy themselves as to the conditions to be encountered in the performance of work and the quantities required to complete the work in a accordance with the
Contract Documents.

3.1 REQUESTS FOR INTERPRETATION
A. Contractors shall submit requests for interpretation, questions, and other concerns about the
Solicitation, Technical Specifications, Contract Drawings, attachments, etc. to the Contracting
Officer identified on SF-1442.
B. Such requests shall be made even if the question and answer period identified in the Solicitation has passed.
C. Failure to request interpretation prior to providing a bid shall result in the Contractor being fully responsible for any cost or time impacts involved to perform the work required.

A. Field assessment of existing conditions within the project limits was performed by Tetra Tech. The findings are available in a report titled "Channel Maintenance Alternatives and Sediment-Transport
Studies for the Rio Grande Canalization Project: Final Report," dated October 20, 2015.
B. A design report was written by URS entitled "Design for the Construction of Channel Maintenance
Alternatives within the Rio Grande Canalization Project Doña Ana County, New Mexico," dated
June 14, 2018.
C. Geotechnical investigations were performed as noted in Section 00.31.32.

1.4 SURVEY CONTROL
A. Horizontal and vertical controls are based on New Mexico State Plane Coordinate Grid System
(NMSPCGS) NM Central Zone North American Datum of 1983 (NAD 83) in US survey feet, using
GEOID 03, and North American Vertical Datum of 1988 (NAVD 88) in US survey feet, respectively.
B. The survey was based on LiDAR data of the area collected in 2011. Data were provided by
USIBWC.
1.5 RIGHT OF WAY (ROW)
The existing ROW was provided by USIBWC as a GIS shapefile.
1.6 EXISTING UTILITY SURVEY
A. The surveyor performed a utility survey of the project areas to determine if any above-ground structures, utilities, or markers were present. In addition, the surveyor contacted New Mexico's 811
(www.nm811.org) to obtain any available utility information for the project areas.
1. NOTE: It is the Contractor’s responsibility to verify locations of all existing utilities (shown and not shown) prior to construction.
2. Additionally, attention is called to Sections 02.02.00 for additional requirements and guidelines for existing utility survey.

1.5 GENERAL
A. The project’s Environmental Assessment (EA), entitled "Final Environmental Assessment and
Finding of No Signification Impact: Channel Maintenance Alternatives at Thurman I and II Arroyos in Hatch, NM, Rio Grande Canalization Project," dated December 6, 2017. The Contractor shall review and comply with the requirements provided in the EA document.
B. The project’s Biological Opinion (BO), entitled "Final Biological Opinion for US International
Boundary and Water Commission Long-Term River Management of the Rio Grande Canalization
Project, New Mexico," dated August 16, 2017. The Contractor shall review and comply with the requirements provided in the BO document.
C. Also see the "Final Biological Assessment: Integrated Land Management for Long‐Term River
Management of the Rio Grande Canalization Project," dated October 2011 by SWCA
Environmental Consultants and "Record of Decision: River Management Alternative for the Rio
Grande Canalization Project," dated June 9, 2009.
D. These documents lists environmentally and culturally sensitive areas that need to be protected from any disturbances of construction activities. The environmentally and culturally sensitive areas that were identified on the document are identified below.
1. Biological Resources
Work should be scheduled to occur outside of the bird breeding season whenever possible.
Migratory birds may be present within the project area; birds, nests, and eggs are to be protected and avoided during construction. The breeding and nesting season is identified in
Section 01.57.13. If work continues into the bird breeding/nesting season the areas proposed for disturbance shall be surveyed in order to avoid the inadvertent destruction of nests and eggs.
2. Natural Resources
Equipment cannot be parked, staged, or used under large, mature trees. Keeping equipment away from the large, mature trees will prevent incidental damage to the tree and prevent compression of the root ball.
E. Further details of environmental requirements are in Sections 01.57.00 and 01.57.13.
1.6 PRESERVATION OF CULTURAL AND NATURAL RESOURCES AND THE
ENVIRONMENT
A. If the Contractor initiates changes to the Contract and USIBWC approves the changes, the
Contractor is responsible for obtaining clearances and coordinating with the appropriate regulatory agencies.
B. Culturally Sensitive Areas
If a site, building, or location of historical, archaeological, educational, or scientific interest is discovered within the right of way, cease all work immediately, secure the site from further disturbance and possible vandalism, and notify USIBWC. The site, building, or location will be investigated and evaluated by USIBWC.
1.7 OTHER CONSIDERATIONS
The Contractor is required to ensure that all Environmental Permits, Issues, and Comments (EPIC), which are included within the Contract Documents are followed and implemented to ensure potential impacts are avoided.

1.9 USE OF GEOLOGIC MATERIALS ON A FEDERALLY FUNDED PROJECT
A. To ensure preservation of historical and archaeological data, prior to use of any soil, rock, or gravel, the source must first be compliance confirmed by the COR to ensure compliance with Section 106 of the National Historic Preservation Act (NHPA).
B. Take no action to use or alter the proposed location until written approval for site use is received from the COR.
C. If the quarry or borrow site already provides materials for NMDOT, USACE, or other governmental agency, a copy of the environmental approvals from said agencies may be provided to the COR.
D. Include permission for Government access to any geological source locations.

1.3 GEOTECHNICAL REPORTS
A. Geotechnical analysis for this project was performed by S&B Infrastructure, Ltd. and summarized in their report entitled, "Final Technical Memorandum Volume I for Geotechnical Explorations of
Levee System with the Rio Grande Canalization Project, hatch-Tonuco Levee Segment," and "Final
Technical Memorandum Volume II for Geotechnical Explorations of Levee System with the Rio
Grande Canalization Project, hatch-Tonuco Levee Segment," both dated August 4, 2008.
B. The data and report are not intended as a representation or warranty of continuity of conditions between soil borings nor of groundwater levels at dates and times other than date and time when measured. Additional test borings and other exploratory operations may be made by Contractor subsequent to award of the Contract.
C. Due to the site location adjacent to the Rio Grande, groundwater levels may fluctuate, sometimes to extreme levels, based upon time of year and amount of water in the river. Higher groundwater levels than those shown in the bore logs may occur causing changes in soil saturation and strength.
D. The worksite is adjacent to the Rio Grande and is located in an area where the river flowed in the past. Fluvial deposits can change rapidly in type (sand, slit, clay, loam, gravel, rocks, etc.) both horizontally and vertically due to depositional characteristics and channel shifting. Rocks may be present even if not visible on the ground surface. Rocks larger than the borehole would not have been captured in any logging data.
E. The Contractor is charged with the duty to read and understand the geotechnical data provided, including any data referenced within. The Contractor shall consider all geotechnical information including geotechnical reports, bore logs, and site visits as a whole. The Contractor shall consider the limitations of any geotechnical tests performed including the auger size, borehole spacing and location, consistency of borehole data, as well as the frequency of testing, results of testing, and groundwater level at time.

1.4 GENERAL
Prior to the beginning of construction, the Contractor shall be responsible for researching, coordinating, obtaining, and paying all applicable fees for all permits required by Federal, state, and local entities, including, but not limited to, a specific or general stormwater permit prepared in accordance with the requirements of Stormwater Pollution Prevention Plan (SWPPP).
1.5 WORK IN WATERS OF THE UNITED STATES
A. For work in the right of way, USIBWC has obtained a Section 404 permit from the US Army Corps of Engineers as well as the associated New Mexico Section 401 permit. Adhere to all agreements, mitigation plans, and standard best management practices required by the permits.

B. If Contractor initiated changes in the construction method result in impacts to waters of the US, the
Contractor shall have sole responsibility to obtain all required new or revised Section 404 permit and shall adhere to all agreements, mitigation plans, and standard best management practices required by these permits.
1.6 RESPONSIBILITIES
A. The Contractor shall be responsible for providing the proposed location of the project staging areas for compliance confirmation of the COR prior to installation of stormwater pollution prevention
(SWPP) measures.
B. The Federal Government is not subject to local jurisdictions' building codes, nor is it required to obtain building permits from local jurisdictions for construction on real estate owned or controlled by the USIBWC. However, borrow pits and other offsite locations are subject to local regulations.
The Contractor is responsible for researching and obtaining all necessary permits for offsite work.
C. The Contractor shall be responsible for obtaining all necessary permits and rights of entry for all work required under this Contract.
D. The Contractor will also be required to research the need for any other required permits, based on the information available from the Contract Drawings and Technical Specifications prior to the beginning of construction. For the work under this Contract, the Contractor shall be responsible for coordinating and obtaining all permits required by Federal, state, and local entities, unless otherwise specified within the Contract Provisions and these Technical Specifications.
E. The Contractor shall apply and pay for all required permits. The Government is not responsible for any existing or newly introduced permits required before, during and/or after construction.
F. The Contractor shall be responsible for and shall give and maintain any and all notices required by applicable regulations, laws, or permitting authorities pertaining to construction of this project.

1.3 GENERAL
The project site may be exposed to vandalism and theft. The Contractor shall be responsible for providing adequate security of the project site in order to prevent vandalism and theft.
1.4 SECURITY
A. The Contractor is responsible for securing the worksite, equipment, and materials from vandalism and theft.
B. The Contractor shall implement a security program that:
1. Protects the work, the existing premises, and the Government’s operations from theft, vandalism, and unauthorized entry.
2. Initiates a security program in coordination with Government’s existing security system at mobilization.
3. Maintains the security program throughout construction duration until Contract Closeout.
C. The Contractor shall implement entry control to the work area that notifies people of the construction area, of PPE required, and of the dangers of entry.
D. The Government shall not be responsible for the security of any items within the work area and associated PSLs.
1.5 INSURANCE
A. When not required by the Contract clauses, the Contractor has the right to purchase coverage for property insurance, builder's risk insurance (including perils of wind, collapse, vandalism/malicious

1. Losses shall include architects' and engineers' fees that may be necessary to provide drawings and specifications for the repair and/or replacement of damaged property.
2. Losses shall include appropriate supervision and quality control of all work for the repair and/or replacement of damaged property.
C. Any insurance policies purchased for work or property related to this Contract for coverages not required by the Contract clauses shall list the International Boundary and Water Commission, United States Section, as an additional insured.
1.6 DEPARTMENT OF HOMELAND SECURITY
In any event the staff of the US Department of Homeland Security (also known as US Customs and
Border Protection (CBP)) alerts and directs any field crews to stop work in for any security reasons in the area, the Contractor shall consider this as top priority and fully cooperate with the directions of DHS at all times until the security alert is cleared by the DHS. In addition the Contractor shall contact and coordinate with the COR for any additional steps to be taken during and after the security alert from the DHS is cleared.

1.5 WORK COVERED BY THE CONTRACT DOCUMENTS
A. The work for this project generally consists of the construction of two sediment basins, and the removal of river sediment from within the Rio Grande.
B. The major construction efforts include, but are not limited to, the construction of the two sediment basins – one each at Thurman I Arroyo and Thurman II Arroyo – will include the following major construction tasks:
1. Excavation and offsite disposal of existing rocks, sediment, and soil from Thurman I and II
Arroyos within the limits of USIBWC's right of way to construct sediment basins;
2. Construction of reinforced concrete drilled shaft piers.
3. Construction of reinforced concrete sediment basin end walls.
4. Installation of rock riprap erosion protection.
5. Installation of flexible base maintenance roads.
6. Site grading and associated drainage improvements.
7. Removal of river sediment from with the Rio Grande main channel and disposed of in an manner meeting Section 01.74.19.
C. The final product shall be two earthen sedimentation basins with concrete end walls. The basins shall have maintenance roads to allow workers to access and clean the basins of sediment.
1.6 SEQUENCE OF WORK/TIME FOR COMPLETION OF WORK
A. The Contractor shall comply with all submittal requirements as covered under these specifications and obtain Government review of each submission.
1. No construction shall be started, until the Government reviews the required submittals and determines they are satisfactory for purposes of beginning construction.
2. The Government will not grant any time extension for any resubmittal required when, in the opinion of the CO, the initial submission failed to meet the minimum quality requirements as set forth in the Contract.
3. If the Government allows the Contractor to proceed with limited construction based on pending minor revisions to the reviewed submittals, no payment will be made for any in-place construction related to the pending revisions until they are completed, resubmitted and are satisfactory to the Government.
4. No payment will be made for any in-place construction until all submittals required for that portion of the work and/or required prior to the start of construction have been made, reviewed, and are satisfactory to the Government.

B. The work under this Contract shall be completed within the timeframe specified in the Contract
Provisions.
1.7 WORK UNDER OTHER CONTRACTS
No construction work is anticipated to be performed at the project site under separate Contract with other
Contractors during the Contractor’s performance period.
1.8 LABOR AND STAFFING
A. Contractors are responsible for determining the appropriate staffing necessary to perform the
Contract work. Contractors are also responsible for complying with the minimum wage and benefits requirements for each labor classification performing work on the Contract.
B. If a classification considered necessary by the Contractor for performance of the work is not listed on the applicable wage determination, the Contractor must initiate a request for approval of an additional classification along with the proposed wage and benefit rates for that classification.
C. The Contracting Officer will attach the appropriate Davis-Bacon wage determination to this
Contract. The Contractor is responsible for all requirements of the Davis-Bacon Act.
1.9 PROJECT LOCATION
The work is within the United States Section of the International Boundary and Water Commission
(USIBWC) Rio Grande Canalization Project, in Doña Ana County, New Mexico.
1.10 INVESTIGATION OF SITE CONDITIONS
A. The Contractor, as well as their subcontractors, is urged to visit the jobsite and to become fully aware as to the existing conditions affecting the work to be performed under the Contract documents.
B. The Contractor shall be responsible for ensuring that all of its suppliers, manufactures, and subcontractors have reviewed all applicable Contract documents relative to their work. The
Contractor shall provide all labor, material, equipment, and services not provided by the
Contractor’s suppliers, manufacturers, fabricators, and/or subcontractors but required for complete and operable facilities as described in the Contract documents.
1.11 OTHER CONTRACTUAL REQUIREMENTS
A. Items mentioned in the Technical Specifications and not shown on the Drawings, or shown on the
Drawings and not mentioned in the Technical Specifications, shall be of like effect as if shown or mentioned in both.
B. In any case where these Technical Specifications conflict with the Federal Acquisition Regulations
(FAR), use the following rules of precedence.
1. In any case where FAR requirements are stricter or impose a higher standard than these
Technical Specifications, FAR requirements will take precedence.

2.1 GOVERNMENT FURNISHED MATERIALS
The Government will not provide any materials for this project.
2.2 PRODUCTS TO BE FURNISHED BY THE CONTRACTOR
A. The Contractor shall provide all labor, all equipment, and all other products required to execute the project.
B. All materials provided by the Contractor for the project shall be new or recycled, high grade, free from defects, meeting the specifications herein. The minimum quality of the work shall be in accordance with the specifications herein. The Contractor's Quality Control System Manager will ensure compliance confirmation and the Contractor's testing company will ensure that materials, equipment, and work quality strictly adhere to the requirements of the Contract documents.
C. Materials, equipment, and work quality not conforming to the requirements of these specifications shall be considered defective and will be subject to rejection. Defective work material, whether in place or not, or equipment shall be removed immediately from the site by the Contractor, at its expense, when so directed by the COR.
D. If the Contractor fails to replace any defective or damaged work, materials, or equipment after receiving notice, the COR may cause such work or materials to be replaced by other forces. The replacement expense shall be deducted from the amount to be paid to the Contractor. Defective equipment will not be allowed in the performance of any work.
E. Water for All Construction Activities
1. The water required for all construction activities including, but not limited to, dust control
(Section 01.57.13), shall be considered as incidental and shall be provided from a metered source that is compliance confirmed by the USIBWC.

2. Water from the Rio Grande shall not be used by the Contractor at any time.

B. Once these required submittals have been compliance confirmed by the COR, the Contractor will be allowed to mobilize and begin work within USIBWC's right-of-way.
3.2 USE OF RIGHT-OF-WAY
A. Construction operations shall be confined to the USIBWC right-of-way. Portions of the site beyond areas on which the work is to be performed are not to be disturbed.
B. Roads serving the right-of-way, identified as such or not, owned by the USIBWC or CBP shall be clear and available to these agencies.
