About this file

This is a Price Schedule for a federal construction contract for Project P-200 CNATT (a facility construction project). The contract consists of one base price line item (CLIN 0001) valued at an estimated total, broken into three subtotals: CLIN 0001A for facility work complete to the 5-foot line outside the building, CLIN 0001B for sitework outside the facility's 5-foot perimeter, and CLIN 0001C for temporary site and facilities. The Government will award based on the total sum of CLIN 0001, with evaluation of optional CLINs 0002-0008 added to the base price for evaluation purposes only. Award will be within 360 calendar days of contract award, with a firm fixed contract completion date of 981 calendar days after award.

Five optional construction-related line items (CLINs 0002-0006) are unit-priced: CLIN 0002 covers removal and replacement of geotechnically unsuitable subgrade soils (*500 CY); CLIN 0003 addresses excavation and disposal of PFAS-impacted soil (*500 Tons); CLIN 0004 covers non-hazardous contaminated soil excavation and disposal (*500 Tons); CLIN 0005 addresses demolition and disposal of unknown buried concrete and debris (*75 Tons); and CLIN 0006 covers handling and treatment of PFAS-impacted dewatering effluent (*75,000 gallons). Two additional option items (CLINs 0007-0008) involve Audio Visual Equipment and Furniture, Fixtures, and Equipment (FF&E) with Government-estimated costs of $174,404 and $207,764 respectively, allowing contractors to propose a Handling and Administration Rate (HAR) not to exceed 5 percent. All estimated quantities are subject to equitable adjustment if actual quantities vary more than 15 percent above or below estimates. The Performance Bond must reflect 100 percent of aggregate amounts if any optional CLINs are exercised, and additional bonding is required at the time of A/V and FF&E option award.

TOTAL PRICE FOR CLINs 0001 - 0008 $_____________

1.1 GENERAL BID NOTES

a. Award will be made on the total sum of Contract Line Item (CLIN) 0001. For CLINs 0002 through 0006, enter unit price and extended total in space provided. If there is a difference between a unit price and the extended total, the unit price will be held to be the intended bid and the total recomputed accordingly. If an Offeror provides a total but fails to enter a unit price, the total divided by the specified quantity will be held to be the intended unit price.

b. The Government reserves the unilateral right to award CLINs 0002 through 0006 (Option Items 1 through 5) to the Contractor at the proposed price within 360 calendar days after the contract award, and in accordance with all bid notes. A firm fixed proposed price is required for CLINs 0002 through 0006. No provision is made for economic price adjustment. If CLINs 0002 through 0006 are exercised, the contract completion date remains 981 calendar days after award of the contract.

c. Evaluation of Options (JUL 1990). Except when it is determined in accordance with FAR 17.206(b) not to be in the Government's best interest, the Government will evaluate offers for award purposes by adding the price for the option(s) (CLINs 0002-0008) to the total price for CLIN 0001. In accordance with FAR 52.217- 5 Evaluation of Options, evaluation of options will not obligate the Government to exercise the option(s).

d. In FAR 52.217-7; Option for Increased Quantity-Separately Priced Line Item (Mar 1989), the Government may require the delivery of the numbered line item, identified in the Schedule as an option item, in the quantity and at the price stated in the Schedule. The Contracting Officer may exercise the option by written notice to the Contractor. Delivery of added items shall continue at the same rate that like items are called for under the contract, unless the parties otherwise agree. Quantities on the bid schedule that are followed by an asterisk (*) are estimated quantities. If the quantity of a unit-priced item in this contract is an estimated quantity and the actual quantity of the unit-priced item varies more than 15 percent above or below the estimated quantity, an equitable adjustment in the contract price shall be made upon demand of either party.

The equitable adjustment shall be based upon any increase or decrease in costs due solely to the variation above 15 percent or below 85 percent of the estimated quantity. If the quantity variation is such as to cause an increase in the time necessary for completion, the Contractor may request, in writing, an extension of time, to be received by the Contracting Officer within 10 days from the beginning of the delay, or within such further period as may be granted by the Contracting Officer before the date of final settlement of the contract. Upon the receipt of a written request for an extension, the Contracting Officer shall ascertain the facts and make an adjustment for extending the completion date as, in the judgement of the Contracting Officer, is justified.

e. The Government may reject an offer as non-responsive if it is materially unbalanced as to prices for the basic requirement and the option quantities. An offer is unbalanced when it is based on prices significantly less than cost for some work and prices which are significantly overstated for other work.

If any of the CLINs 0002 through 0006 are exercised, additional bonding and consent of surety is required.

Consequently, the Performance Bond must reflect 100 percent of the aggregate amount of all items.

f. All work required in accordance with the drawings and specifications must be included in the Contractor’s proposed price.

g. Failure to enter a price for any CLIN may result in a proposal being rejected.

1.2 OPTION BID NOTES

1.3 A/V and FF&E BID NOTES

These notes apply to CLINs 0007 and 0008

a. The estimated amount for FF&E and AV has been supplied by the Government, to provide offerors with the projected magnitude of effort. The estimated amount includes the actual cost of the FF&E including freight and installation charges. The Government FF&E and AV Estimate is only an estimated amount.

b. If awarded, line items will be funded separately after completion of FF&E and AV design package review by the Government, and receipt of appropriate funding by the Government. Requirements and details are provided in E20, FURNISHINGS and E10, EQUIPMENT.

c. Bonding

i. No Bonding for A/V and FFE at Time of Construction Contract Award

FAR 28.102-1(a) requires that performance and payment bonds be included in all construction contracts exceeding the SAT, except under the conditions listed. Since the A/V, FF&E, and CEQ Option Items are not part of the original contract award, the Construction Contractor must not be required to secure bond for the A/V, FF&E, and CEQ at the time the basic contract is awarded.

ii. Additional Bond at A/V and FF&E Option Item Award

FAR 28.102-2(d) requires the Government to secure additional bond from the Construction Contractor for any contract price increases. Therefore, an increase to the original contract bond is required at the time of the A/V and FF&E Option Items award, to protect the Government against the Construction Contractor not providing A/V and FF&E ordered and to ensure that the vendor(s) receive payment if the Construction Contractor goes out of business. The increased cost of the bond must come from the A/V and FF&E funding source and is not a part of the Construction Contractor’s HAR.

iii. Bonds Required by the Construction Contractor

If the Construction Contractor requires bonding from the A/V and FF&E subcontractor(s), the cost must be covered in the Construction Contractor’s HAR.

d. Offerors may propose a Handling and Administration Rate (HAR) for the FF&E and AV not to exceed 5 percent. This fee will account for all administrative costs, overhead, bonding fees, administration of subcontracts, profit, and any other costs associated with and related to the coordination and processing of the procurement and installation of FF&E and AV. The Contractor’s proposed HAR percentage will be incorporated into the contract award and will not be adjusted regardless of fluctuations from the estimate amount for the FF&E and AV. The proposed HAR is a fixed rate.

e. The Government is not obligated to award the Option line item(s). Should the Government choose to award

Option 7 and/or Option 8, the line item will be awarded as a negotiated modification to the contract/task order. The Contractor's proposed HAR will be applied to all vendor/supplier costs for the FF&E and AV.

f. If awarded, the FF&E and AV modification will be awarded at least six months prior to the contract completion date. A minimum of six months is required for the Contractor to purchase, deliver and install the FF&E and AV without impacting the overall completion date of the project. The Contractor's schedule must assume the award of the FF&E and AV as a modification. No schedule extensions will be granted if the modification is awarded at least six months prior to the contract completion date. If the Government decides to negotiate and award the furniture modification with less than six months prior to the contact completion date, the Contractor may be entitled to a contract extension and extended field overhead. A contract extension and extended field overhead will only be granted in those cases where the Contractor demonstrates that an accepted Final FF&E and AV packages were submitted within the approved schedule deadlines and sufficient lead time for the FF&E and AV is not available and the Government's award of the modification is in the last six months of the contract.

g. The Contractor and the Contractor's Designers must strictly adhere to the A/V and FF&E submittal schedule to ensure that the final FF&E package endorsement is completed at least 9 months prior to Beneficial Occupancy Date (BOD). If projected final FF&E package endorsement date falls between 15 July and 15 November, then endorsement must occur no later than 10 July for any given calendar year.
