About this file

This is a Supplemental Specifications document for Hillsborough County's Public Utilities Department in Florida for a competitive bid, undefined quantity, term contract for Low Pressure Sewer System (LPSS) installations and repairs. The scope of work includes furnishing and installation of prefabricated reinforced concrete interceptor tanks, submersible pump assemblies, electrical control panels, conduit, wiring, low pressure service lines, tapping of existing force mains, general site restoration, traffic control, and retrofitting of existing LPSS facilities. The County has historically completed an average of 50 LPSS installations annually, though the exact number of future installations and retrofits is unknown. The contract is structured as an "as-needed" term contract with work authorized only through written Work Orders issued by the Public Utilities Department Director. Contractors must assemble and maintain an inventory of five LPSS tanks within 45 days of the Notice to Proceed and maintain this inventory throughout the contract term. All work must comply with Hillsborough County Standard Specifications for Construction, Water, Wastewater, and Reclaimed Water Technical Manuals, Standard Pump Station Drawings, and related technical guidelines. The contract will expire upon completion of all authorized work or the second anniversary of the Contract Commencement Notice, whichever occurs first, with a maximum award amount of $4,000,000 or the recommended total bid price, whichever is less.

Award will be made to the responsive and responsible bidder with the lowest total bid price based on estimated quantities. Unit prices must remain firm and non-negotiable throughout the contract term and any renewal periods, with adjustments only permitted under specified Cost Escalation Clause conditions. The County guarantees a minimum of $10,000 in contract usage and has established a 5% Small Business Enterprise (SBE) subcontractor participation goal. Contractors must include all costs for labor, equipment, materials, tools, overhead, profit, bond premiums, insurance, design and engineering support, and all contingencies in their bid prices. An allowance of $10,000 has been included for Electrical Permit reimbursement based on actual costs without markup. The Contractor is responsible for obtaining Right-of-Way Use and Maintenance of Traffic permits at no charge from the County, while the County furnishes all required environmental agency permits. Contractors must provide independent laboratory testing and inspection services, maintain as-built drawings and GPS data using the Florida West State Plane coordinate system, submit pre- and post-construction photography, and immediately report and remediate any sewage spills. Final payment will not be issued until all required documentation including as-built drawings, digital photographs, and GPS data have been submitted and approved.

SUPPLEMENTAL SPECIFICATIONS

SC - 1

SECTION 1 - GENERAL

1.1. INTRODUCTION

These specifications modify or supplement the General Terms and Conditions and other provisions of the Contract Documents. To the extent such provisions are not modified or supplemented herein; all provisions remain in full force and effect.

The purpose of these specifications is to describe the requirements of the Public Utilities Department for a competitive bid, undefined quantity, and term contract for LOW PRESSURE SEWER SYSTEM as described herein. Work authorized under this term contract will be ordered only on an "as needed" basis.

1.2. NUMBER OF CONTRACT(S)

The County reserves the right to award one (1) or more Contracts.

1.3. SCOPE OF WORK

It is anticipated that the work to be performed under this Contract may include, but is not limited to, the furnishing and installation of prefabricated reinforced concrete interceptor tanks, submersible pump assemblies, electrical control panels, conduit, wiring, low pressure service lines, tapping of existing force mains, general site restoration, traffic control, and other miscellaneous construction activities necessary for the successful installation of the LPSS facilities, including the retrofitting of existing LPSS facilities. Work performed to retrofit existing LPSS facilities may also include the removal and/or rehabilitation of existing tanks and other LPSS equipment.

The number of future LPSS installations is unknown. However, the County has installed an annual average of 50 LPSS installations. The number of existing LPSS facilities to be retrofitted is unknown.

Except as otherwise provided herein, the CONTRACTOR shall furnish all labor, tools, vehicles, supplies, equipment, materials, and permits to accomplish the Work contemplated in these Contract Documents in an expeditious and workmanlike manner.

1.4. TECHNICAL SPECIFICATIONS

All work regardless of the scope, shall be performed in strict accordance with the Hillsborough County Standard Specifications For Construction (latest edition) and/or Hillsborough County Water, Wastewater, and Reclaimed Water Technical Manual and/or Technical Specifications (latest editions) and/or Hillsborough County Standard Pump Station Drawings, and/or Utility

SC - 2

Accommodation Guide (latest edition), and/or Hillsborough County Stormwater Technical Manual (latest edition), The Hillsborough County Standard Pump Station Drawings, Technical Manual, and Technical Specifications may be located on the Public Utilities Department Website:

https://www.hillsboroughcounty.org/en/businesses/land-development/technical-publications

In all conditions, the most stringent requirement/specification as determined by the Project Manager shall apply to the project. It is the Contractor’s sole responsibility to purchase/locate at their expense the necessary drawings, specifications, and technical guideline material to perform the necessary scope of work and be advised of any updates, modifications, alterations, and any deviations of the above mentioned during the life of the contract.

1.5. BASIS FOR AWARD AND CONTRACT PRICE

Award will be made to the responsive and responsible bidder meeting specifications who submit the lowest total bid price, based on the estimated quantities included herein.

For budgetary and other reasons, the total amount of award for this Contract will be established at $4,000,000 or the recommended total bid price whichever is less.

If the recommended total bid price is greater than the award amount of $4,000,000, authorized work (and bid estimated quantities) will be reduced accordingly.

Notwithstanding the above, the actual amount of work to be performed is not known, and the County only guarantees a minimum of $10,000 usage on this Contract.

The amount of award referenced in the above statements is defined as the upper dollar limit beyond which no further work may be authorized without approval of the Board. Specifically, the amount of award shall not be construed as indicating the actual value of work anticipated by the County under this Contract. The actual value of work to be authorized is not determined until the time of need for that work occurs, and may be significantly less than the amount indicated in the award.

1.6. UNBALANCED BIDS

For unit-price contracts, a balanced bid is one in which each bid item is priced to carry its share of the cost of the work and also its share of the contractor’s profit.

The County reserves the right to reject any bid in which unit prices, in the sole opinion of the County, are unbalanced. In addition, where the County has decided to make an award, it further reserves the right to non-utilize a particular line item that is, in the sole opinion of the County, excessively priced. The County reserves the right to obtain that item from another source.

Determination of an unbalanced bid or excessively priced line item is made utilizing one or more of the following:

https://www.hillsboroughcounty.org/en/businesses/land-development/technical-publications

SC - 3

1) A comparison of prior bid prices with recent bid prices for the same or similar item or service.

2) A comparison with published price lists published market prices, similar indices and discount or rebate arrangements.

3) A comparison of proposed prices with independent cost estimates.

4) A formal cost study using appropriate professional experts.

5) A comparison of the proposed bid price with the average unit price bid.

6) The price for the item or service is not priced to carry its share of the cost of the work and also its share of the contractor’s profit.

1.7. CONTRACT COMMENCEMENT AND EXPIRATION

The Contract resulting from this Solicitation Document shall commence on the date specified on the Contract Commencement Notice and shall expire upon completion of all authorized Work. The Work Order Authorization Period will expire on the second anniversary of the Contract Commencement Notice, or when the actual authorized work equals the awarded Contract amount, whichever occurs earlier.

Expiration dates for both the Contract and the Work Order Authorization Period can only be adjusted as outlined in the Contract Renewal Clause.

Bid Proposal item unit prices shall remain firm and non-negotiable during the life of the

Contract, including any renewal periods. Bid Proposal item unit prices can only be adjusted under the conditions outlined in the Cost Escalation Clause.

1.8. CONTRACT ESTIMATED QUANTITIES

Unit quantities are provided as a means of comparing bid proposals and as a basis for award.

However, these quantities are estimated and actual unit quantities may vary greatly during the term of this contract. THE BIDDER IS ADVISED THAT THE TOTAL QUANTITY OF

WORK REQUESTED MAY BE LESS THAN THE QUANTITY ESTIMATED, AND

IN FACT THE COUNTY ONLY GUARANTEES A MINIMUM OF $10,000 USAGE

ON THIS CONTRACT.

Bidders are cautioned against predicating their bid prices on an assumed scope of work or estimated bid quantities. The amount of award represents only the upper dollar limit beyond which no further work shall be ordered, except as may be approved by the Board through a Change Order. It is not known how much or how little work will be ordered during the term of this contract.

Bidder acknowledges that actual quantities may be significantly less than those indicated in the bid, and agrees that, as the Contractor, he/she will not make any claim for damages or for loss of profits because of a difference between the quantities bid and the quantity of work actually ordered.

SC - 4

Work Order pricing shall be based on actual field measurement, not estimated bid or planned quantities.

Because quantities are estimated and actual requirements will not be determined until time of need, Section “Change in the Work” and Section “Change Of Contract Price” of the General Terms and Conditions are hereby modified to delete the necessity for a Change Order in the event of line item quantity over or under runs, provided that total purchases do not exceed the amount of award.

1.9. AUTHORIZATION OF WORK

No work may be performed under this term contract except as authorized by a Work Order issued by the Public Utilities Department Director, or designee and a Purchase Order. The Work Order will establish the Notice to Proceed date. The Contractor shall not proceed with, and shall not be compensated for, any work that is not authorized by written Work Order.

Verbal authorization may be given when immediate response conditions occur at night and/or on weekends and followed-up with a written authorization within 24 to 48 hours of the occurrence.

1.10. WORK ORDER DEVELOPMENT PROCEDURE

The Project Manager shall provide the Contractor with a site plan indicating the customer’s preferred LPSS tank location. The Contractor shall visit the property and ascertain constructability and then develop a cost estimate for each Work Order. The Contractor shall be expected to expeditiously prepare its proposal and in no event shall the proposal preparation time exceed more than five (5) calendar days. Failure to respond within the time specified above may result in: the work being performed by others; no further Work Orders being issued to the Contractor; termination of the Contract; the filing of a claim by the County against the Performance Bond.

1.11. PRECAST CONCRETE INTERCEPTER TANK

The Precast Concrete Interceptor Tank shall be as shown on the construction drawings or equal. Bidders/Proposers submitting a tank they believe to be an equal or better shall provide a detailed submittal package, which will consist, of all information and details prescribed in the specification, including structural, supporting calculations, affected mechanical, and electrical details, and complete specification in a report signed and sealed by a Florida Registered Engineer. The burden of proof that the Bidder’s/Proposer’s proposed brand is in fact equal lies with the Bidder/Proposer.

1.12. INITIAL LPSS TANK INVENTORY

As stated, time is of the essence for LPSS installations. To expedite installations, the Contractor shall assemble an inventory of five (5) LPSS tanks within 45 days of the Notice to Proceed.

The Contractor shall ensure that it maintains its inventory of five (5) LPSS tanks on its premises throughout the term of this contract.

1.13. BID PRICES

The Contractor shall include all costs for completing all WORK identified in the Contract Documents in the bid items listed on the bid form. The contract unit price bid items shall

SC - 5

include all labor, equipment, materials, tools and incidentals required to accomplish the Work contemplated in these Contract Documents in an expeditious and workmanlike manner.

The bidder's bid prices must contain all cost items in amounts deemed sufficient by the Contractor for overhead, profit, bond premiums, performance and payment bond premiums, insurance, minimal design, engineering, drafting support, site superintendent, administrative support, progress meeting expenses, contract startup costs, computer equipment and supplies, all contingencies, and all risks associated with this contract.

1.14. PRICING OF WORK ORDERS

Pricing of Work Orders shall be accomplished by multiplying the appropriate unit prices times the quantities of each line item required for the work order, to arrive at a Pay Quantity for that line item, then adding all such line item Pay Quantities to arrive at the Work Order Cost. It shall be the Contractor's responsibility to advise the County and obtain prior approval for any additional quantities to be utilized beyond those specified in the Work Order. The Contractor will not be compensated for any materials or work without written authorization from the Project Manager. The Contractor will be compensated for authorized additional quantities on the Revised Work Order after Final Completion of the Work Order

1.15. DISPUTES REGARDING WORK ORDERS

In the event the County and Contractor are unable to agree on final quantities or items for the performed work, the County may reject the Contractor's pay request and require the Contractor to provide verifiable documentation as to the quantities and items actually used. The burden of proof is on the Contractor. If the Project Manager finds the verifiable documentation sufficient, the pay application will be processed. If the Project Manager finds the documentation insufficient or unverifiable, the Contractor and the Project Manager may appeal to the Public Utilities Department Director. The decision of the Public Utilities Department Director is final.

If the Contractor refuses or otherwise fails to perform any of its obligations under the Contract or fails to perform the Work Order work, the County reserves the right to take any or all of the following actions:

1) Obtain the services from another Contractor;

2) Terminate the Contract;

3) Debar the Contractor from bidding on County construction projects for a period of up to

36 months;

4) File a claim against the Contractor’s Performance Bond.

If the Contractor believes there is good cause for not performing requested Work, the

Contractor may submit Notice which cites the refusal and contains supportive documentation and may appeal an adverse decision to the Public Utilities Department Director.

SC - 6

1.16. PERMITS

The Contractor shall apply for an Electrical Permit for each project site. An allowance of $10,000 has been included in the Bid Proposal section to reimburse the Contractor for fees associated with the cost of obtaining Electrical Permits. Reimbursement to the Contractor for permits shall be based on the actual amount paid by the Contractor without any mark-up and shall be made upon presentation of an invoice evidencing the Contractor’s payment of the same. Any unused allowance remaining at the end of the contract will be credited back to the County by change order.

The County shall furnish all required environmental agency permits. It shall be the Contractor’s sole responsibility to obtain the Right-of-Way Use Permit, and Maintenance of Traffic Permit (MOT) permit for all Work Orders. There will be no charge from Hillsborough County for the Right-of-Way Use and MOT permits.

1.17. PROJECT SITE SAFETY AND CLEAN-UP

The Contractor shall be responsible for site safety and clean-up. The Contractor will be responsible for keeping the site safe for pedestrians and traffic. The Contractor shall dispose of all debris on a daily basis and be responsible for hauling all debris to an appropriate and permitted disposal site. The Contractor will not be allowed to accumulate excess debris on the site, unless approved by the Project Manager. All costs associated with the safety, clean-up, and disposal of debris shall be included in the Contractor’s overhead.

The County does not participate in the purchase or sale of excess excavated soils at these sites. All excavated soils not used as backfill shall become the property of the Contractor.

If the homeowner wants to retain the excess fill, a letter shall be provided to the County stating such and acknowledging the homeowner is responsible for the removal or disposal of the excess fill. The letter shall bear the signature of the property owner, the printed name of the property owner, and shall be dated.

Requests made by tenants or other persons are not acceptable. In the absence of a letter, any excess soil shall be removed from the site prior to the placement of sod.

1.18. RECORD DRAWING SUBMITTAL

The Contractor shall keep adequate records and supporting documentation for each Work Order. Upon completion of the Work Order Work, the Contractor shall furnish to the Project Manager record drawings. Recording of all information in the field shall be done by the Contractor.
