About this file

This is a Rolling Owner Controlled Insurance Program (ROCIP) manual for the Loading Dock Expansion project at Ben Taub Hospital administered by Harris Health in Texas, with insurance services provided by Alliant Insurance Services. The manual establishes a unified insurance program covering workers' compensation, employers liability, commercial general liability, excess liability, and products/completed operations coverage for all enrolled contractors and subcontractors performing on-site work at the project. Participation in the ROCIP is mandatory for all eligible subcontractors of any tier unless specifically excluded by Harris Health. Contractors and subcontractors must complete online enrollment through Alliant's WrapX portal prior to commencing work, provide monthly payroll reports by the tenth of each month, maintain current certificates of insurance, and comply with all safety and claims reporting procedures outlined in the manual. The project contact directory identifies Chris Alle and Mary Moore as the ROCIP Program Administrator and Manager respectively, with additional support from loss control and claims advocates at Alliant Insurance Services.

Harris Health, as the project sponsor, bears all costs of ROCIP insurance premiums for on-site work performed by enrolled parties. Enrolled subcontractors must exclude insurance costs from their bids for work covered under the ROCIP and are responsible for maintaining separate insurance for all off-site activities including workers' compensation, commercial general liability with limits of $1,000,000 each occurrence/$2,000,000 aggregate, commercial automobile liability of $1,000,000 combined single limit, and umbrella/excess liability of $5,000,000. Excluded parties—including architects, engineers, vendors, suppliers, security firms, hazardous materials contractors, and those performing solely off-site fabrication—must procure and maintain equivalent insurance coverage at their own expense. The ROCIP provides completed operations coverage extending ten years beyond project completion, with defense expenses additional to policy limits. All subcontractors must assign return premiums, refunds, and dividends to Harris Health and comply with a return-to-work program for injured employees, with potential liquidated damages of $500 per day assessed for failure to provide reasonable work accommodations.

1.0 INTRODUCTION

Harris Health (Sponsor) has arranged insurance for this construction project under a Rolling Owner Controlled Insurance Program (ROCIP). An ROCIP is a single insurance program that insures the project Sponsor, Contractor and appropriately enrolled Subcontractors and Sub- subcontractors of any tier, along with their eligible employees and other designated parties for work performed at the project site. Certain parties and their employees are excluded from the ROCIP as identified in this manual.

This Manual is intended to provide general information as to the insurance afforded and/or required of enrolled parties, claims reporting procedures, safety & loss control requirements, and the procedures to be followed in administering the program. All questions concerning the ROCIP requirements should be referred to the ROCIP Administrator identified in Section 2, the Project Contact Directory.

The ROCIP provides coverage for this project for enrolled parties whose employees perform actual on-site labor at the project site. This coverage includes:

• Workers’ Compensation

• Employers Liability

• General Liability

• Products/Completed Operations

• Excess Liability

SPONSOR will pay insurance premiums for the ROCIP coverage described in this manual. It is recommended that you inform your current insurer(s) that you are participating in an ROCIP.

Eligible and Enrolled Parties

Parties eligible to enroll in the ROCIP are the Contractor and Subcontractor(s) of all tiers performing Work on the Project Site (“Eligible Parties”). Upon enrollment, an Eligible Party shall become an “Enrolled Party.” Owner’s separate contractors that furnish labor, materials and/or services on, or at, the Project Site may enroll in the ROCIP as Enrolled Parties.

Only to the extent that they bear workers compensation responsibilities, temporary labor services and leasing companies are to be included as Subcontractor(s). Eligible Contractors and Subcontractor(s) of all tiers must complete all necessary enrollment forms in Alliant’s (WrapX) system. Acceptance into the ROCIP is evidenced by a confirmation of enrollment letter and Proof of Insurance prior to commencing work on the project.

Participation in the ROCIP is mandatory for ALL Subcontractors and their Sub-subcontractors of any tier unless excluded by SPONSOR or as outlined later in this manual. However, enrollment is not automatic. Work will not be permitted at the project site until the Subcontractor, regardless of tier, are properly enrolled in the ROCIP. To be properly enrolled in the ROCIP, an enrolled Subcontractor must complete their insurance enrollment through Alliant’s online

SECTION

platform (WrapX) and upload the necessary documents as described in this Project Insurance Manual for review by ROCIP Administrator.

Coverage applies only to work performed at the project site by the enrolled parties. Enrolled parties must provide their own insurance for off-site activities including but not limited to work at their permanent shops, fabrication or manufacturing of building products, materials or supplies and travel to and from the project.

Excluded Parties

Parties that are ineligible to enroll in the ROCIP, and who are excluded from the ROCIP (the

(“Excluded Parties”), are:

a) Hazardous materials remediation, removal and/or transport companies.

b) Architects, surveyors, engineers, and soil testing engineers, and their consultants.

c) Vendors, suppliers, fabricators that solely fabricate or manufacture products, materials, supplies away from the Project Site, material dealers, truckers, haulers, drivers and others who merely transport, pick up, deliver, or carry materials, personnel, parts or equipment, or any other items or persons to or from the Project Site.

d) Manufacturing representatives, equipment rental companies who perform equipment maintenance (does not apply to those who provide operators).

e) Security firms/watchmen services, guard services and janitorial services, but not final cleaning.

f) On-site medical contracted services.

g) Contractors whose sole scope or work includes Exterior Insulation and Finish Systems (EIFS).

h) Contractors whose sole scope of work includes blasting.

i) Any Subcontractor of any tier that does not perform any actual labor or services at the Project Site; and

j) Any other party or entity not specifically identified herein, that is excluded by Owner in its sole discretion, even if such party or entity is otherwise eligible.

All Excluded Parties and/or non-enrolled parties shall carry the insurance required in Section 5.

The provisions herein for the ROCIP shall in no way be interpreted as relieving the enrolled parties of any responsibility under their contract. All enrolled parties will be required to carry certain other insurance as outlined later in this manual and may carry, at their own expense, any additional insurance they deem necessary.

NOTE: Enrollment into the ROCIP is required, but not automatic Eligible contractors MUST complete the online enrollment for ROCIP coverage to apply.

Access to the Project Site will not be permitted until enrollment is complete. Parties performing labor at the Project site are required to enroll in the ROCIP unless they are an excluded party. All questions regarding this procedure should be directed to the ROCIP Program Administrator at Alliant as outlined in the Project Contact Directory.

Cooperation:

The enrolled parties will:

1. Furnish to SPONSOR, the ROCIP Administrator or the ROCIP insurer(s) all information and documentation which the ROCIP may require in connection with the issuance of any policies, in such form and substance as SPONSOR or its designee may require.

2. Furnish to SPONSOR, the ROCIP Administrator or the ROCIP insurer(s), online on-site payroll reports as required and described in this Manual on a monthly basis for prior month (including months with no payroll), by the 10th of the month.

3. Permit the ROCIP insurer(s) to audit the enrolled parties’ books and records and provide documentation as may be required to assure accuracy of those payroll reports. The enrolled parties (Subcontractors and their Sub-subcontractors) agree that their failure to submit documents as required may result in withholding progress payments until said payroll reports are received by SPONSOR or its designee.

4. Promptly comply with the requirements, obligations and recommendations of SPONSOR, its ROCIP Administrator or ROCIP insurer(s) so that the ROCIP may be properly administered and so that the insurance companies will continue to provide the coverage as specified in this the document under the ROCIP. If the enrolled parties should fail to comply with any requirement, obligation or recommendation, SPONSOR may withhold any payments due the enrolled parties until such time as they will have performed the requirements, obligations and recommendations as required by this contract.

5. The enrolled parties will provide SPONSOR, its ROCIP Administrator or ROCIP insurer(s) with all information necessary for the issuance of said policies and will maintain and make available to the insurance companies payroll records and such other records relating to the Work as may be necessary for the proper computation of the insurance premiums.

6. The enrolled parties will cooperate with SPONSOR with regard to administration and operation of the ROCIP. The enrolled parties’ responsibilities will include but are not limited to: operations and insurance information; inclusion of ROCIP provisions in all subcontracts; notification to SPONSOR’s representative of all subcontracts awarded;

maintenance and provision of monthly payroll records and other records as necessary for premium computation; compliance with applicable loss control (safety),return to work program, and claims reporting procedures; maintenance of an OSHA Log to be provided as required by SPONSOR. In addition, should a contractor enroll with an EMR above a 1.25 additional documentation may be required for review and safety mitigation plan in place before enrollment is approved.

Any fines assessed for claims which are reported late are the responsibility of the Subcontractor and/or Sub-subcontractor of any tier.

Payroll or Contract Value Reporting

Each enrolled party must complete the monthly payroll reporting form in WrapX by the 10th day of the month following the end of the previous month identifying Project site workhours and payroll.

Only the payroll of the Subcontractor's employees who perform duties at the Project site should be included on the payroll report. If your general liability insurance is rated on contract value, you will have to report your completed contract value to date. This information will be used to provide the ROCIP insurer with information required to determine SPONSOR’s premium.

If you did not perform any work at the Project site in a given month you must still submit your payroll form showing zero (0) payroll and applicable completed contract value to date (if applicable) for the month.

The ROCIP insurer is required to file experience data for each enrolled party with the appropriate rating authority. The loss experience of the Subcontractor for work performed on the Project site may affect the experience modification factor of that Subcontractor.

To avoid paying premiums to your primary insurance insurer on payroll associated with work performed under the ROCIP, payroll reported as described above should be excluded from payrolls submitted to your primary insurer. In addition, there are a number of ways to endorse or modify your primary insurance to assist in this process. The workers’ compensation policy issued to you and the certificate of insurance showing you as a named insured on the general liability policy may be used to provide evidence of your enrollment in the ROCIP to your primary insurer.

ROCIP Insurer Payroll Audits

Each enrolled party is required to maintain payroll records for the Project Site in accordance with the Basic Manual of Rules, Classifications, and Experience Rating Plan for Workers’ Compensation and Employer’s Liability Insurance. Such records allocate the payroll by Workers’ Compensation classification(s) and shall exclude the excess or premium paid for overtime (i.e., only the straight time rate shall apply to overtime hours worked). Furthermore, such records shall limit the payroll for Executive Officers and Partners/Sole Proprietors to the limitations as stated in the state manual rules.

It is important that you properly classify payrolls, as these will be reported to the rating bureau for promulgation of future Experience Modifiers for your firm. All enrolled parties shall make available their books, vouchers, contracts, documents, and records, of any and all kinds, to the auditors of the ROCIP insurer at any reasonable time during the policy period, any extension, or during a final audit period as required by the insurance policies.

Notice of Work Completion – Close-out of Each Contract

SPONSOR will close out each contract as the enrolled parties complete their work. No retainage will be released until the closeout has been completed. The enrolled parties must complete a

NOTE: Failure to submit the payroll reports as required may result in the withholding of payments until required documentation is received.

“Notice of Work Completion” Form in WrapX (see Section 6 – Forms) for each contract that has been completed on the Project site. Once the form has been completed it should be submitted to the ROCIP Administrator via fax, email or mail.

The ROCIP insurer may audit the enrolled parties at time of close out.

Claims Reporting

Each enrolled party shall follow the claims procedures as established by SPONSOR or its ROCIP Administrator. The enrolled parties agree to assist and cooperate in every manner possible in connection with the adjustment of all claims and demands in which SPONSOR’s insurer(s) is called on to adjust or defend. Return to Work

As required by the Controlled Insurance Program, all Enrolled Parties shall implement a “Return To Work” (RTW) program to assist workers who are temporarily disabled due to an injury or illness. The RTW Program will provide a modified or alternate duty position for an employee who has sustained a work-related injury or illness and is medically unable to perform all or any part of his / her normal duties during all or any part of the normal workday or shift, but who can perform some type of work.

- The Subcontractor shall provide alternate or modified work until the employee is able to resume regular duties. All alternate or modified work is temporary in nature and is designed to facilitate a return to regular duties as soon as possible.

- In no case shall an injured employee be laid-off or terminated from an alternative or modified work position, unless first discussed with Contractor, Harris Health Director Construction Operations or the ROCIP Administrator.

- All enrolled parties shall participate as requested in incident review meetings and claims review meetings related to workers receiving Workers Compensation benefits.
