Volume 1 should include information regarding (1) the offeror’s 8(a) certification, (2) Taxpayer Identification Numbers (TIN) and Dun and Bradstreet Numbers (DUNS) for all teaming partners, and (3) a statement whether all partners are currently registered and updated in the System for Award Management (SAM.gov) on the first page.

This shall be completed by the relevant Government agency or private entity where previous contracts were performed. If an Offeror has no relevant past performance information, please provide the following statement in your quote: "No Past Performance information available".
The Government reserves the right to utilize past performance information other than the information submitted with the quotes received in conducting the evaluation. An offeror without a record of relevant past performance or for whom information on past performance is not available will be considered Neutral. The Offeror shall furnish and the Government will consider past performance information regarding predecessor companies or teaming partners that will perform major or critical aspects of the requirement. Past Performance will be utilized as part of making a responsibility determination as per FAR Part 9. The Government will request an explanation from any offerors with negative past performance.
Volume 3: Price Quote (not more than 10 pages total excluding financial responsibility documentation).
The offeror must provide firm-fixed pricing for the work to be performed for this requirement. The subtasks must be priced out separately as displayed in the Pricing Spreadsheet (Attachment III), and they must add up to the main CLIN total.
The resultant contract will be a hybrid of Firm-Fixed and Labor Hour CLINS. The labor hour CLINS are displayed at the bottom of each Sheet, and contain Not-to-Exceed (NTE) amounts. A price quote is not necessary for these CLINS, unless the offeror believes the NTE amount should be exceptionally different than what MSHA has estimated. In this case, the estimated NTE amounts should be displayed on Sheet 4 (Assumptions), along with an explanation as to why they are different.
The total quote amounts for each task shall be supported by a breakdown of the total amount by IDIQ task numbers and any subtasks; the labor categories utilized, labor category descriptions, estimated level of effort /labor hours, and proposed fully burdened labor rates for applicable service tasks. A breakdown of products (supplies or equipment) must be provided including product descriptions, manufacturer, manufacturer part numbers, units, unit prices and subtotals for each task that requires the purchase of products.
Financial Responsibility: As per FAR Part 9.104—“To be determined responsible, a prospective contractor must have adequate financial resources to perform the contract, or the ability to obtain them…” In order to reflect financial responsibility, offerors must include documentation supporting financial capability. Examples of this documentation could be letters of credit with a bank or financial institution, or an audit conducted by a third party.
Additionally, for each product quoted that is subject to the requirements of FAR 52.223-14, 52.223-15, and 52.223-18, the offer must indicate whether the proposed product is Energy Star, EPEAT, and/or FEMP certified. If sustainable acquisition certification is required for a specific product and the offeror has not proposed a certified product, then a detailed justification and explanation must be provided explaining why a sustainable acquisition certified product cannot be provided to the Government. There are Energy Star, EPEAT, FEMP and other requirements for, but not limited to, the following product categories: A/V equipment, monitors, televisions, servers, advanced power strips, computers, digital signage, small and large network equipment, telephones, and other supplies/equipment. See https://sftool.gov/GreenProcurement for more information regarding applicable products/equipment.
If the offeror anticipates the need to purchase materials during the performance of this task, please detail these anticipated costs in the offer. The Pricing Spreadsheet attached to this RFP must be completed and submitted with the price and technical quotes. The Spreadsheet contains three Sheets, one for the base period, one for the option period, and one so offerors may include a description of any assumptions made in the preparation of the offer.
EVALUATION CRITERIA FOR AWARD (LOWEST PRICE, TECHNICALLY ACCEPTABLE)
Award of the contract resulting from this Request for Proposal will be made to the Offeror who is deemed responsible in accordance with Federal Acquisition Regulation (FAR), whose proposal conforms to the solicitation requirements, and whose proposal represents the Lowest Priced Technically Acceptable offer. In order for a proposal to be considered awardable, offerors must be considered technically acceptable.
Trade-offs between price and non-price factors are not permitted. An unbalanced, unrealistic, or incomplete price proposal may be grounds for eliminating a proposal from competition. The Government will evaluate proposed prices for reasonableness using price analysis techniques.
Award will be made on an all or none basis. Award shall be made to a single contractor. Offers must include prices for each item listed in order as according to Attachment III – Pricing Spreadsheet, that offers may be properly evaluated. Failure to do so shall be cause for the offeror to not be considered for award.
TECHNICAL: Technical Capability. The Government will evaluate each offeror’s Technical Capability to determine their capacity to meet all the requirements outlined in the PWS. The offeror’s technical capability will be rated as: Acceptable, Unacceptable.
PRICE: The total price for the base and all option periods of each quote will be evaluated for overall price reasonableness. Price analysis may be conducted in evaluating for price reasonableness.

Many of these agreements contain indemnification clauses that are inconsistent with Federal law and unenforceable, but which could create a violation of the Anti-Deficiency Act (31 U.S.C. 1341) if agreed to by the Government.
Therefore, by submitting a quotation the offeror shall agree that the inclusions of any Limitation of Liability, Indemnification, and any other terms or clauses that conflict with Federal law or regulation in any EULA or TOS are NULL AND VOID.
