About this file

This document is an Addendum from the Minnesota Office of State Procurement regarding a Request for Proposal (RFP) for Prairie Chicken Tracking Transmitters with Data Plans for the Minnesota Department of Natural Resources (DNR). The addendum provides revisions, additions, deletions, and clarifications to the original RFP, including changes to the insurance requirements and responses to questions received. The RFP seeks 60 GPS transmitters that are lightweight and able to be attached via rump mount or backpack harness. The original due date of October 25, 2024 at 3:00 p.m. CT has been revised. The addendum clarifies that responders must consider and build in all relevant duties, custom fees, permits, and brokerage fees within their unit cost submission.

The RFP is for a state and local contract opportunity in Minnesota, specifically involving Houston County. The contract will require the selected vendor(s) to provide the specified Prairie Chicken tracking transmitters with data plans. The contract does not appear to have any set-asides, and there is no information provided about incumbents or funding sources.

ADDENDUM

I. The following section of the Solicitation is amended as follows (strike through is used for deletions and underlining for insertions):

RFP Sample Contract and Exhibits, Exhibit B: Insurance Requirements, is here by REVISED as follows:

Section 4.1 Commercial General Liability Insurance. Contractor is required to maintain insurance protecting it from claims for damages for bodily injury, including sickness or disease, death, and for care and loss of services as well as from claims for property damage, including loss of use which may arise from operations under the Contract whether the operations are by the Contractor or by a subcontractor or by anyone directly or indirectly employed by the Contractor under the contract. Insurance minimum limits are as follows:

$2,000,000 – per occurrence $2,000,000 – annual aggregate $2,000,000 – annual aggregate – applying to Products/Completed Operations

The following coverages shall be included:

• Premises and Operations Bodily Injury and Property Damage

• Personal and Advertising Injury

• Blanket Contractual Liability

• Products and Completed Operations Liability

• Other; if applicable, please list__________________________________

• State of Minnesota named as an Additional Insured, to the extent permitted by law

II. Below are the State’s responses to questions received by the Question and Answer deadline stated in Addendum 2:

Q1. Insurance requirements outlined in the State of Minnesota Contract. While we hold all insurances that are required by Lithuanian law, none of the insurance companies here would provide business liability insurance for the company like ours. Such insurance is only available for a short list of businesses (e.g., medics, lawyers, etc.) and even offices of international insurers offering such coverage in other countries, could not provide it for us. Furthermore, coverage liability limits of different insurances are much lower here than required in the contract template.

A1. See Section 1 above; Requirements for Commercial General Liability Insurance have been removed from the contract.

Q2. Contract pricing requires that the offered price "takes into consideration all inherent costs of providing the requested goods and services. The Contractor agrees to pay any and all fees, including, but not limited to: duties, custom fees, permits, brokerage fees...". We never ship taking responsibility for the import duties and other taxes that can be applied locally, import is usually handled by the transmitter recipient. We do not have a way and capacity to be familiar with applicable import and taxation procedures of different countries and states.

A2. Responders must consider and build within their unit cost all relevant duties, custom fees, permits and brokerage fees when submitting their cost response to the solicitation under Exhibit D Price Schedule.

Q3. Please clarify if these units are going to be attached as a pendant/necklace or as backpack.

A3. Please review the noted specification for unit attachment under the Sample Contract and Exhibits, Exhibit C:

Specifications, Duties and Scope of Work, Item 2, Product Specifications:

2.6 Contractor provided transmitter must be able to utilize rump mount or backpack harness capable of receiving 2 harness attachments in both the front and back ends of the unit (4 harness connections).

Q4. Would 3g or 5g be considered if it meant meeting more of the stated requirements?

A4. 3G and 5G would not be considered. In the study area, 3G is no longer used and 5G coverage is patchy and intermittent.
