About this file

This document contains questions and answers related to a solicitation for a prosecutorial case management system implementation. The government seeks proposals for an initial 18-month base term including development phases totaling 9 months, with potential six-month option periods and award term incentive. Offerors should separately price a six-month extension under FAR clause 52.217-8. Payment will be made upon completion of proposed iterations. The total period of performance may be up to 36 months if all options and extensions are exercised. The solicitation response deadline is June 30, 2023, with questions due by June 9. The award will be made using best value tradeoff considering price and non-price factors.

Question 33: "Given that the government intends to award using a “best value trade‐off methodology” (page 80, Solicitation), will the government consider providing a price range (or at least a not‐to‐exceed) which is acceptable?

Otherwise, the government runs the risk of ruling out an offeror solely on price (in Phase 1) without considering the associated technical approach, team structure, etc. that would allow a best‐value determination as a higher‐price bid may also offer significantly more value to the government."

Answer 33: "The Government estimates the order of magnitude of this requirement to be between $4M ‐ $6M."

Given that price is the first evaluation criteria for review, please provide clarification on the stated budget range from the Q&A , which was $4‐$6 million. Is that budget for just software or for just services or combined? Does that budget range cover the full 30‐month Period of Performance or just the 18‐month Base Term?

The $4‐$6 million is the government's estimate of this requirment. Offerors should propose a solution and price accordingly. A budget ceiling determination will be made once responses have been received and evaluated.

2 RFQ 15JA0523Q00000044 ‐ Prosecutorial Case Management System_Final_Signed, Part II Additional Terms and Conditions, Section E. Period of Performance

"The government anticipates an initial 18‐month Base Term effort and includes one 6‐month Phase Zero, one 3‐month Baselining Phase and an estimated three 3‐month Base Term Phases. The contract may also include up to two (2) six‐month option periods. The total duration of this contract including the exercise of any options and/or award of an Award Term Phase shall not exceed thirty (30) months unless otherwise amended by the Contracting Officer."

Could the Government please further clarify the anticipated period of performance with the optional periods and the Award Term Incentive? Are the following two potential scenarios accurate?

a. Scenario 1: 18‐month Base Term + 6‐month Award Term Incentive (if earned) + one 6‐month option period (Additionally, at the Government's desire potentially could have FAR 52.217‐8 Clause exercised for 6 months)

b. Scenario 2: 18‐month Base Term + 6‐month option period + 6‐month option period (Additionally, at the Government's desire potentially could have FAR 52.217‐ 8 Clause exercised for 6 months)

Yes. If FAR 52.217‐8 is exercised, the period of performance would be for six months.

3 RFQ 15JA0523Q00000044 ‐ Prosecutorial Case Management System_Final_Signed, Part II Additional Terms and Conditions, Section E.

If the Government desires to exercise the FAR 52.217‐8 clause, the total period of performance could potentially be 36 months. Is this the Government's intent? If so, does the Government prefer that Offerors propose a CLIN for the potential FAR 52.217‐8 extension resulting in a total of 36‐month period of performance?

Yes. Offerors should separately price the six month extension.

4 RFQ 15JA0523Q00000044 ‐ Prosecutorial Case Management System_Final_Signed, Part II Additional Terms and Conditions, Section C., 3.2 Options

"The options will be priced based on the accepted Base Term Phase price."

Can the Government please clarify that if an Award Term Incentive is earned, the pricing for the additional 6‐month option and any extension of services, to include Continuity of Service Clause for transition and/or an Extension of Services Clause pursuant to FAR 52.217‐8, would be at the same pricing as the Award Term Incentive price?

No. The six month extension should be priced separately and does not include the Award Term Incentive price.

5 RFQ 15JA0523Q00000044 ‐ Prosecutorial Case Management System_Final_Signed, Part I Overview, Section C.5 Reporting Requirements and Part II Additional Terms and Conditions, Section B. Payment Schedule

Part I, C.5: "The Contractor shall provide written progress/financial status reports when it submits its monthly invoice."

and

Part II, B. "The contractor shall be paid upon the completion of each iteration upon its acceptance and verification by the Product Owners and approval from the Contracting Officer’s Representative (COR). Invoices shall be submitted at the end of each iteration in accordance with the delivery schedule as established in the Performance Work Statement."

Can the Government please confirm if Offerors are able to define "iterations" as part of their proposed Payment Schedule? Would the Government consider monthly payment milestones associated with the contractor's submitted monthly reports to be an acceptable Payment Schedule?

Yes. Offerors should definer "iterations" as part of their proposed payment schedule.

No. Payments should based on the "iterations" proposed in the solution.
