Q&A
| Column1 | Question from Industry | RFP Reference | FBI Response | Amendment |
| 1 | Is "(2% FFP)" an objective or fixed value for the maximum award fee percentage for the contract? | "Attachment J-6 Award Fee Plan" page 2 and 3 | Fixed value | |
| 2 | Please confirm that Section B should not be populated at time of submission. | 15F06724R0000188_Amendment+0001 | Confirmed | |
| 3 | Prior Q&A seem to state that the positions listed in L.4.1 are the IDIQ positions but these are not the positions listed on the Price Templates for the IDIQ and/or TSC TORFP. Instead the positions from L.9.1 are listed on the Price Templates. Please confirm that Offerors are to use the positions listed on the Price Templates and L.9.1 as the IDIQ positions. These positions will NOT be included in the FFP pricing (2nd tab of the TSC TORFP Price Template). The positions listed in L.4.1 would be included in the FFP pricing (2nd tab of the TSC TORFP Price Template). | 15F06724R0000188_Amendment+0001 |
Attachment+J-4+EFOM+IDIQ+Labor+Rates+Price+Template
| TSC TORFP Price Template | Relook at these sections and the price template as this information has been completely overhauled and updated. | ||||
| 4 | There is no list of Government Furnished Equipment/Property (GFE/GFP) provided in the solicitation. Are any tools provided by the Government? If so, please identify them. | All solicitation documentation | All GFE/GFP will be identified at the Task Order level | ||
| 5 | Please confirm that the extension of the proposal due date from 9/2/2024 to 9/4/2024 applies to both the IDIQ proposal and the TSC TO. | Amendment 1 | Both have been extended | Yes | |
| 6 | Can the information on the KMP list be consistent with the information provided to DCSA? | Attachment J-1 | We are not aware that it does not match. Please share the differences as the original KMPL was provided by security. | ||
| 7 | Question 3 asks: Are there any non-U.S. citizens holding a position at the organization as either a corporate officer, member of the Board of Directors (or other similar governing body), or any other position such as |
executive / senior management personnel, partners, regents, or trustees?
| If the Offeror's answer is No, do we still have to provide all Board of Directors members full legal names, titles, dates & places of birth, Social Security Numbers and citizenship? | Attachment J-2 ARQ | Yes, this is required by security to process the DD254. | |||
| 8 | Electrical Testing - Electrical testing is defined in IDIQ Section 5.44.4 for the electrical testing of breakers, relays, transformers (e.g., NETA standards). There is a deliverable in IDIQ Attachment 2 to submit an annual Breaker/Switchgear report as being "TBD in the task order". Can the government please confirm that the frequency of electrical testing is also to NETA standards. | Attachment J-3 Performance Work Statement (PWS) - 7.1.2 Attachment 2 - Deliverables Schedule | Updated | Yes | |
| 9 | Drinking Water Testing - Can the government confirm who is to perform drinking water testing and analysis (e.g., Legionella, coliform, chlorine levels). The building lessor or O&M contractor? | Attachment J-3 Performance Work Statement (PWS) 5.27, page 54-55 | This would be defined at the Task Order level | ||
| 10 | Is a site safety officer and/or superintendent/quality control expected onsite during After Hours Service Calls? | Attachment J-3 Performance Work Statement 5.2.2 After Hours Service Calls page 23 | This would be defined at the Task Order level | ||
| 11 | Please provide the "FBI Safety and Health Requirements Manual" and any "FBI institutional and site-specific safety programs and directives". For review | Attachment J-3 Performance Work Statement 5.24.6 Contractor Safety Program (page 50) |
and
| 5.24.16 Safety and Security (page 53) | As it states they are "site-specific" this information would be shared at the Task Order level. | |||
| 12 | Is an Accident Prevention Plan following the outline of the EM 385-1-1 (November 2014) or (March 2024) acceptable? | Attachment J-3 Performance Work Statement 5.24.7 Accident Prevention Plan page 50 | This would be defined at the Task Order level | |
| 13 | Is a separate Accident Prevention Plan required for each of the seven (7) locations listed in the PWS? If yes, are all seven (7) Accident Prevention Plans due 30 days after IDIQ contract award or individual task order awards? | Attachment J-3 Performance Work Statement 5.24.7 Accident Prevention Plan pages 50, 51, and 1.3 Objectives page 2 | Individual Task Order award | |
| 14 | "The Contractor shall develop and implement a Safety Program detailing how the Contractor |
plans, staffs, performs, and controls all safety practices while delivering best value services to the Government without any preventable accidents."
and
"The Contractor’s Accident Prevention Plan shall be submitted to the Contracting Officer within 30 calendar days following award of contract, for approval."
| Are these deliverables (and other listed safety plans) due 30 days after IDIQ contract award or individual task order awards? | Attachment J-3 Performance Work Statement 5.24.7 Accident Prevention Plan pages 50, 51, and 7.1.2 Attachment 2 – Deliverables Schedule page 81 | Individual Task Order award | ||
| 15 | Hours of Operation**: The document states that work hours may vary and will be determined at the Task Order level but also mentions target work hours from "7:30am to 4:00pm Monday through Friday." This could create confusion about the exact working hours expected from the contractor. | Attachment J-3 Performance Work Statement, Section 1.5.1 | The use of the word "target" should be self explanatory. | |
| 16 | **Response Time**: The document mentions that the contractor may be required to be available on-call at all times but also states that this requirement will be outlined in the individual Task Order if required. | Attachment J-3 Performance Work Statement, Section 1.5.1.1 | The intent is to ensure the vendors understand what "could" be required so they can't say they weren't told later. | |
| 17 | **Travel Expenses**: The document states that contractor travel will be authorized consistent with the Federal Travel Regulation and FAR but also requires government approval/notification to the COR at least "14 days prior to travel." This could be seen as contradictory or unclear regarding the process for travel approval and reimbursement. | Attachment J-3 Performance Work Statement, Section 1.5.8 | One goes with the other. The travel must be pre-approved by the COR and that approved travel (rates, flights, hotels, etc.) must be in accordance with the FTR/JTR. | |
| 18 | Please confirm which sites have pest/weed control contracts in place. | Attachment J-3 Performance Work Statement, Section 5.12.2 | Currently the only known location is the TSC which does not include the grounds. | |
| 19 | Could the Government please clarify if the positions listed under the IDIQ contract require Top Secret (TS) clearances, | Attachment J-3, Performance Work Statement (PWS), Section 7.1.3, "Position Descriptions," pages 79-80 | Only key personnel at the Task Order level require TS clearance. | |
| 20 | Would the Government please release incumbent contract information for the Facility Operations and Maintenance contract (s) at each of the locations identified in the RFP. Requested information includes: Contract Name, Contract Award Number, Contract award amount (total contract value), Awardee name, Beginning date, contract ending date: |
1. Washington DC
2. Quantico, VA
3. Vienna, VA
4. Winchester, VA
5. Clarksburg, WV
6. Huntsville, AL
| 7. Pocatello, ID | Attachment J-3, Performance Work Statement, Paragraph 1.3 Objectives | There are not contracts at those locations - those are potential Task Order locations. |
| 21 | Letter of Commitment. |
2.1 Definitions […]
"Key Personnel - Contractor personnel that are evaluated in a source selection process and that may be required to be used in the performance of a contract by the Key Personnel listed in the PWS. When key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does not have a firm commitment from the persons that are listed in the proposal."
Section L does not identify a requirement for the submission of a Letter of Commitment (LOC) or resume format for each key in the Seed Task Order Response. Would the Government please confirm the requirement, or remove it from the PWS?
If LOC is required, does the Government have a prescribed LOC form?
| Does the Government have a prescribed resume format? | Attachment J-3, Performance Work Statement, Paragraph 2.1 Definitions | Resume format has been added to the TSC Seed Task Order. | Yes | |
| 22 | Is the offeror required to bid on the TSC task order to be considered for award for the overall EFOM IDIQ contract? | B.1 | No. | |
| 23 | B.1 states task orders will be competed among all awarded IDIQ contract holders unless determined to be a small business set-aside. Are awarded contractors required to bid on all task orders that are released? | B.1 | No. | |
| 24 | How many small business EFOM contracts will be awarded? | B.1 PARTIAL SMALL BUSINESS SET ASIDE | 2-3 | |
| 25 | Does the FBI intend to award a seat on the EFOM to all small businesses who are qualified based on L&M criteria? | B.1 PARTIAL SMALL BUSINESS SET ASIDE | Yes. | |
| 26 | Section L.2.1.c): Line Spacing |
| Will the government allow single spacing in graphics, tables, and resumes? | Draft RFP Section L.2.1 | Yes. | Yes |
| 27 | Section L.9.1 Key Personnel Resumes |
| Could the government confirm if resumes can be single-spaced for both the IDIQ and Seed Task Order submissions | Draft RFP Section L.4.1 and L.9.1 | Yes. | |
| 28 | Section L.2.1 and L.9 from the Final IDIQ RFP differs from the format and instructions in the Final TSC TORFP. Will the Government please confirm which holds the authoritative format and instructions, given the differences between them? | Final RFP Sections L.2.1 and L.9 |
| TSC TORFP | They are individual and not linked. If the IDIQ calls for a certain format - that only pertains to documents submitted for the IDIQ. The TSC Task Order RFQ can set it's own requirements. They are not in conflict because they are not linked. | ||||
| ERROR:#REF! | Is the offeror required to escort their own subcontractors if they do not have full clearance? | General | Yes. | ||
| ERROR:#REF! | Would the government please provide equipment criticality analysis or criticality designation(s)? If they do not exist, is that something the contractor needs to perform, and if so, by when? | General | This is only answerable at the Task Order level as it will vary for each site. | ||
| ERROR:#REF! | Is the contractor responsible for providing all required preventative maintenance tools? | General | Yes unless the government already has them onsite. | ||
| ERROR:#REF! | Would the Government consider granting a two-week extension to the proposal submission deadline to allow offerors adequate time to fully address the requirements outlined in the solicitation and any forthcoming amendments? | General | Yes. | Yes | |
| ERROR:#REF! | The government mentioned on the Microsoft Teams call and during the site walk that they are electing to forego the requirement to price out the seed task order to allow contractors without Tier 3 Data Center experience to be eligible to bid the IDIQ. Can the government please reconsider changing Tier 3 Data Center experience to just “data center” experience? If not, will the government evaluate contractors with regular data center as favorable as those with Tier 3 Data Center? | General | Tier 3 data center is a hard requirement. However all contractors will be rated fairly and independently based on the merits of their proposals. | ||
| ERROR:#REF! | Please provide the number of anticipated awardees for the IDIQ contract for both the Large Business and Small Business programs. | General | Unknown. Ideal would be 5 to 6. | ||
| ERROR:#REF! | Can Key Personnel resumes (e.g., Program Manager) cover all IDIQ zones? | General | Yes. | ||
| ERROR:#REF! | Is the contractor required to submit the KPML and ARQ for any potential subcontractors for this submission or will this be handled on a task order basis? | H.1 | Yes but this is something that happens after IDIQ award as the Prime needs to issue the sub a DD254 to work on this contract which they cannot do until they have their own DD254. | ||
| ERROR:#REF! | If a small business falls into multiple categories does this credit the prime contractor for each category they fulfill or must we designate a specific category? For example, if a subcontractor is a woman owned small business will the prime contractor get credit towards the 30% small business goal and the 5% woman owned goal? | H.3.7 | Yes you can get credit for multiple categories. | ||
| ERROR:#REF! | Are the subcontracting goals tied to the overall contract value for each task order, or are they tied to the portion of the contract value that the prime contractor utilizes subcontractors for? | H.3.7 | It's tied to the total subcontracting dollars you pay out as a Prime in support of EFOM as a whole each year. | ||
| ERROR:#REF! | There is no waiver labor category position description at the IDIQ or Seed Task Order level. In the facility operations and maintenance work area, waiver to minimum education, experience, certification and licensure are rarely provided, but there is always a Government approval process to address this situation. We recommend the Government add a sentence to both the IDIQ PWS and the Seed Task Order PWS that labor category waivers for education, experience, certification and licensure will be submitted to and approved/disapproved through the Government COR and Contracting Officer. | IDIQ Attachment J-3 PWS, Attachment 3 Position Descriptions | |||
| Seed Task Order - TSC Facility Operations PWS | The issue with that is if we do that most vendors bid to the lowest level and then can't afford to hire properly credentialed personnel if the individual Task Order location is not willing to accept anything less than | ||||
| ERROR:#REF! | Will the government allow offerors to include an acronym list that is excluded from the page count? | IDIQ RFP and TSC TORFP | Yes. | ||
| ERROR:#REF! | Given the volume of questions and quickly approaching proposal due date, we would like to request an extension of at least 3 weeks from when questions are answered in order to fully review and implement the required changes. | IDIQ RFP L.1.3 (pg. 54) | An extension has been granted. | Yes | |
| ERROR:#REF! | Would the government consider excluding the resumes in Volumes 2 and 7 from their respective page counts? | IDIQ RFP L.2.1 (pg. 56) | Yes | Yes | |
| ERROR:#REF! | Table L-2 provided in IDIQ RFP section L.2.1 references a 10-page Price Narrative for IDIQ in Volume 5, but submission instructions were not provided in section L.7, Volume 5: Factor 5-Price. Can the government please confirm whether a pricing narrative is required in Volume 5, and if so, provide instructions for what information needs to be included? | IDIQ RFP L.2.1 (pg. 56) | This has been updated to reflect no price narrative is required at IDIQ. | Yes. | |
| ERROR:#REF! | The RFP states the Seed Task Order consists of two factors submitted in one volume, Volume 7; however, the TORFP states that each factor is its own volume. Please confirm whether the Seed Task Order should be submitted with the MATOC proposal as Volume 7 or submitted separately in two volumes, Volumes I and II. | IDIQ RFP L.2.1 (pg. 56), L.9 (pg. 61-63); TORFP 9.2.1 (pg. 4) | Volumes in TSC Seed TO have been changed to "section". Submit all of the TSC proposal with Volume 7 per instructions at L.9. | Yes | |
| ERROR:#REF! | Please confirm that the formatting guidance in L.2.1 is intended to allow offerors to use 11 or 12 point font for primary text and 10 point font for tables, charts, graphs, figures, captions, and other non-primary text elements, such as callout boxes and resumes. | IDIQ RFP L.2.1 (pg. 57) | Confirmed | ||
| ERROR:#REF! | Can the offeror use fonts larger than 12 pt for headings, etc.? | IDIQ RFP L.2.1 (pg. 57) | No. | ||
| ERROR:#REF! | For Subfactor 1: Experience, c) 3., please expand on what types of digital tools the Government is looking for information on. | IDIQ RFP L.4.1 (pg. 58) | They types of digital tools an Offeror has used in the past on previous facility O&M projects. | ||
| ERROR:#REF! | Section L.6.1 does not provide specific instructions for the small business subcontracting plan, although both FAR 19.407 and 52.219-9 are cited in the RFP. Please confirm whether the FBI has a specific template for completing the subcontracting plan or if offerors are to follow the outline given in the FAR. | IDIQ RFP L.6.1 (pg. 60) | FAR 19.407? - we will assume that should have been 19.704. L.6.1 states, "Offerors will provide a narrative that outlines the offerors’ approach to fulfilling the stated subcontracting goals." It is at the Offeror's discretion how they will create that submission. Yes, follow the FAR clause guidance. | ||
| ERROR:#REF! | FAR 19.407 and 52.219-9 provide instructions for subcontracting plans that include veteran-owned small businesses (VOSB); however, the RFP (section H.3.7, L.6.1) do not provide goal percentages for VOSB, only service-disabled veteran-owned small businesses (SDVOSB). Please confirm whether offerors are to propose goals for both VOSB and SDVOSB in their subcontracting plan. | IDIQ RFP L.6.1 (pg. 60), H.3.7 (pg. 27) | VOSB should be included to comply with the FAR clause but the goal is at vendors discretion. DOJ does not define SB goals for the VOSB group. | Yes | |
| ERROR:#REF! | IDIQ RFP section L.8.3 states that, “Offerors must submit in Volume IV the completed Acquisition Risk Questions (attachment J-2) and KMPL (attachment J-1) for the prime Contractor.” Please confirm that ARQ and KMPL for subcontractors will not be required until after award through the Procurement Risk Assessment Process outlined in TSC TORFP section 6.3. | IDIQ RFP L.8.3 (p. 61); TSC TORFP 6.3 (p. 53) | Correct - confirmed. | ||
| ERROR:#REF! | IDIQ RFP Section 1.5.3 "The contract(s) will include Fixed Price Award Fee (FPAF) values representing the line item that provides all daily services that do not exceed $10,000, or an amount determined |
at the individual Task Order level."
IDIQ RFP Section L.9.2.1 indicates "Comprehensive Coverage: The flat monthly rate should cover all labor, materials, equipment, subcontractor costs, overhead, and any other expenses with the exception that no single repair will exceed $10,000.00. All projects/repairs that exceed $10,000.00 will be accomplished via the Over and Above (OAA) line item via a work order approved by the government."
Seed Task Order - TSC Facility Operations PWS, para 3.7.3 "The Contractor shall procure and provide under its assumed risk (AR), all parts, materials, and supplies not available from the in -house supply for CM where the total cost per incident is $25,000 or less."
Comment - We believe the $10,000 liability is excessive based on industry practices for a critical mission facility. Certainly a Tier III Data Center to have a $25K liability limit with an aging infrastructure shifts unknown and unpredictable liability to the offerors.
| We request the liability limit at the IDIQ level and the TSC Facility Operation have a $5K limit. | IDIQ RFP Section 1.5.3 L.9.2.1 |
| Seed Task Order - TSC Facility Operations PWS, para 3.7.3 | There is no actual question contained here. |
To reiterate - the limits defined at the IDIQ level are informational only. Individual risk level will be identified at the TO level.
ERROR:#REF! IDIQ RFP Section L.9 states "All submittals for the Seed Task Order will be contained in Volume 7"; however TSC TORFP 9.2.1 states "All volumes are to be provided as separate files." There are 2 volumes for the TSC Task Order (Vol 1-Technical and Volume 2-Price).
| Could you please confirm it is the Government's intended for the IDIQ proposal submission to be six volumes and the Seed Task Order proposal submission would be separated into two volumes Volume 7 (Factor 1 Technical) and Volume 8 (Factor 2 - Price)? | IDIQ RFP Section L.9 and TSC TORFP 9.2.1 | Yes submit Seed Task Order in Vol. 7. Volumes in Seed Task Order have been changed to "Sections". | Yes |
| ERROR:#REF! | Section M.4.3 states: "The government will use the following metrics to evaluate the Offeror submitted PPQ as well as Past Performance data from the CPARS Assessment Reports" but there wasn't a PPQ form released with the RFP. |
While we recognize that CPARS should be issued on contract over $1M/year, the reality is that some Government areas do not issue CPARS. Subcontract references do not have CPARS. Given the proposal instructions offerors will not receive Past Performance credit for the use of a Prime representative contract (where a CPARS is not issued) or a subcontract, without a PPQ.
| Question - Will the government please provide the PPQ template as soon as possible given these forms are generally due from our customer to the government by the proposal due date and time? | IDIQ RFP Section M.4.3 | See updated Factor 3 | ||||
| ERROR:#REF! | Is 1.5 line spacing required in tables as well? | IDIQ RFP, L.2.1 (pg. 57) | No. | |||
| ERROR:#REF! | We request that Past Performance Questionnaires be allowed. Contractors may have all or some of the following qualifying past performance for which CPARS are not available: contract experience with valid commercial clients who do not submit CPARS; performance as a subcontractor (per L.1.4 instructions) for which CPARS would not be available; or performance on contracts that have not yet had CPARS posted, but otherwise meet past performance qualifications. | L.1 VOLUME 3: FACTOR 3 – PAST PERFORMANCE | See updated Factor 3 | Yes | ||
| ERROR:#REF! | Reference :"IDIQ Proposals shall not propose nor contain capabilities and experiences of subcontractors, partners, or teaming partners unless it is a sister subsidiary that includes a clear statement of meaningful involvement or the RFP package includes a signed subcontractor agreement with the proposal." Question: Where should bidders put the signed subcontracting agreement if one is submitted as part of a bidders proposal? We request that any signed subcontract agreement be page exempt. | L.1.1 Past Experience Defined | It is not part of the page count and should be included in Volume 6. | Yes | ||
| ERROR:#REF! | We request an extension to the submission date to allow for time to adjust proposals to answered questions as well as provide ample time to contact critical subcontractors identified during the site visit. Request at least two weeks after questions are answered. | L.1.3 | Proposal Submission Due Date and Location | Extension is included with amendment | Yes | |
| ERROR:#REF! | Please will the Government allow single spacing for tables? | L.2.1 Proposal Format | Yes | Yes | ||
| ERROR:#REF! | Please confirm we can use a single space for tables. | L.2.1 Proposal Format | Yes | |||
| ERROR:#REF! | Can the Government consider either increasing page count or reducing line spacing requirement from 1.5 pt to 1pt spacing? Including the required content and staying with the page counts is very difficult with this. | L.2.1 Proposal Format | Page counts have been increased | Yes | ||
| ERROR:#REF! | Please will the Government exclude resumes are from 45 page limit? | L.2.1 Proposal Format. Subfactor 3: Management Team Capabilities | Yes. | Yes | ||
| ERROR:#REF! | Under Subfactor 1: Experience, the RFP states bidders should include information for the following area: "3. Integration of specialized services or unique requirements, such as security, environmental controls, or energy management." Can the government provide details on what type of "security" services it is looking for? | L.4 Volume 2, Factor 2 Technical | It refers to a secure facility. | |||
| ERROR:#REF! | Can the government confirm if it is acceptable for proposed key team members to not hold a Top Secret Clearance for the IDIQ contract? | L.4 Volume 2, Factor 2, Subfactor 3 Management Team Capabilities | Key personnel are designated at the Task Order level. There are no key personnel at the IDIQ level. Key personnel need to have Top Secret Clearance. | Yes | ||
| ERROR:#REF! | Is it acceptable for bidders to include reference information or Past Performance Questionnaires (PPQs) in this volume for programs that may not be available in CPARS (e.g., commercial contracts)? | L.5 Volume 3, Factor 3 Past Performance | See updated Factor 3 | Yes | ||
| ERROR:#REF! | Please confirm we can submit a list of projects and CPAR copies in the Volume 3 Past Performance since we are using our sister subsidiary projects and want to ensure the correct entity is used. | L.5 VOLUME 3: FACTOR 3 – PAST PERFORMANCE | See updated Factor 3 | |||
| ERROR:#REF! | Would FBI consider it a proposal enhancement for some or all of the IDIQ key personnel to possess Top Secret Clearances? | M.3.2 Technical Factor 2 Subfactor 3 Management Team Capabilities Pg. 66 | Unfortunately, we can't provide an answer to questions of this nature. | |||
| ERROR:#REF! | The USG notes that this is a partial SBSA under FAR Part 19.5. Will the USG confirm how many awards will be performed for F&O vs. SBSA? | Model Contract Section B.5 | There is no way to answer this as we do not know how many Task Orders requests will be received. | |||
| ERROR:#REF! | Service Contract Act is applicable. Will the USG confirm that WDs will be provided at the task order level? | Model Contract Section I | Yes, confirmed. | |||
| ERROR:#REF! | Given the intended contract types that include Cost Reimbursable line items - will the USG be providing CR related clauses at the IDIQ level or will they be included with each task order as solicited and awarded? (e.g. 52.216-7 Allowable Cost and Payment, 52.246-3 Inspection of Supplies - Cost Reimbursement) | Model Contract Section I | 52.216-7 is not required when the contract is a commercial service (refer to FAR 16.307(a)(1)). The Cost reimbursable line is only for Travel because only the actual cost of travel is payable in accordance with FAR 31-205-46. 52.246-3 is not applicable because there will be no furnishing of supplies against this line item. | |||
| ERROR:#REF! | 2852.212-4 Contract Terms and Conditions, Commercial Items (FAR Deviation) (Nov 2023). It is noted that this is a FAR Part 15 procurement. Will the USG clarify the intent of the inclusion of this clause that applies to commercial items? | Model Contract Section I | According to the definition in FAR Part 2 the term "commercial item" can refer to a product or service. In the case of this effort the commercial item is a service and DOJ requires the inclusion of the clause. | |||
| ERROR:#REF! | Will the USG be updating the Model Contract to consistently reflect the stated contract types in Section B - for example 52.216-1 Type of Contract notes it is only FPAF. | Model Contract Sections B.2 and I | 52.216-1 is updated | Yes | ||
| ERROR:#REF! | Can the government provide a forecast or timeframe for when individual task orders will be released (e.g., Pocatello, Idaho or Huntsville, Alabama)? | N/A | No. | |||
| ERROR:#REF! | Please consider deleting PWS Section 1.5.10 Data Rights. Data Rights should be governed by a FAR clause appropriate for commercial products or commercial services and not addressed in the PWS. | PWS 1.5.10 | FAR clause 52.227-14 added / PWS altered. | Yes | ||
| ERROR:#REF! | Please clarify that NIST SP 800-171 standards must be used when transmitting Controlled Unclassified Information--and not ALL government documents or information. NIST SP 800-171's scope is CUI, and not all government documents or information will meet the CUI definition. | PWS 1.5.11.3 | PWS updated | Yes | ||
| ERROR:#REF! | PWS requires Contractor to develop, implement and maintain a QCP and program. Does the Government envision a single IDIQ level QCP that can be tailored to each awarded TOO or is it the Governments intent for each TO have a separate QCP specific to that locations mission demands and priorities? | PWS 1.6 Quality Control Plan (QCP) | QCP needs to be tailored to the individual Task Order | |||

This is how the FBI contract writing system creates the SF forms. We have no control over it. Yes Amendments SHOULD be 0001 and not P00001. We can attempt to alter the form after the fact so that it looks correct, but this is what our system creates. Same with all the instructions showing throughout - we can't control that. | ||

| ERROR:#REF! | Please consider revising the incorporated FAR Clauses to be consistent with FAR 52.212-4 and 52.212-5. The Government is soliciting commercial products and commercial services, and have included FAR 52.212-4 and FAR 52.212-5, which appropriately provide terms and conditions for commercial products, however the Government has also included many non-commercial FAR clauses, which are (at best) redundant, but may also create ambiguity in the contract--for example, prompt payment, changes, disputes, liability, etc. are all covered in 52.212-4, but their non-commercial variants have also been included. | Section I Contract Clauses | So is it "redundant" or "ambiguous" since the two words are not synonymous. If vendor has evidence to the contrary please submit to the CO. | Yes | |
