About this file
This is Standard Form 30 (Amendment of Solicitation/Modification of Contract) for solicitation 140S0326R0001, issued by the Office of Surface Mining and Reclamation (OSMRE), Department of Interior, located in Lakewood, Colorado. Amendment 3 extends the proposal submission deadline to Friday, November 20, 2026, at 5:00 PM EST and provides vendor questions with government responses and a revised bid sheet. The project, titled Pollyanna #2 Acid Mine Drainage, is a small business set-aside with a contract period of performance from January 19, 2027, to January 18, 2028, and a project magnitude between $1 million and $5 million. The work involves acid mine drainage treatment and wetland creation at a site in Latimer County, Oklahoma (GPS coordinates 34°52-7.78-N, 95°28-2.10-W).
The project requires performance and payment bonds of 100 percent of the original contract price for construction costs exceeding $150,000, furnished within 14 days of award. Applicable regulations include the Davis-Bacon Act and NAICS code 562910 (waste treatment and disposal services) for firms with fewer than 1,000 employees. A pre-proposal meeting is scheduled for Tuesday, October 20, 2026, at 11:00 AM local time, though attendance is not mandatory. Key bid line items include earth work, limestone placement (AASHTO #3 high-calcium limestone from Marble City), dosing siphon installation, riprap placement, and wetland seeding with approximately 660 plants on 24-inch centers across a 2,640-square-foot wetland. The contractor must obtain all required Oklahoma state and local licenses before performance begins, manage pond sludge and residual material, and develop a stormwater pollution prevention plan and general construction permit as necessary.

Reference Question/Clarification Government Responses
1 Bid Schedule
Where should costs associated with the performance and payment bond be included in the current bid schedule?
For federal contracts, contractors generally include anticipated bond costs in their proposals. Therefore, while there is a cost to obtaining the bonds, it is typically considered part of the contractor's cost of doing business and project pricing and not

No. All OK licenses must required must be obtained before performance begins.
3 Question Submissions
Due to the approximately one-week interval between the question submission deadline and the Government’s anticipated responses, we respectfully request an extension of the proposal submission deadline. This extension would allow sufficient time to share the complete Q&A with our vendors, obtain and evaluate updated pricing, and submit the most competitive proposal offering the best value to the Government.
Yes, the new due date for Proposals shall be 11/20/2026
4 Item 18. Should the Contractor consider NORM as a constituent waste streams? At this time, the substances (if any) residing within the onsite tanks is unknown. NORM has been known to occur in acid mine drainage related to coal mining activities. To our knownledge and based on previous information on how the active treatment of the acid mine drainage occurred and was discharged via Oklahoma Department of Mining and Oklahoma Department of Environmental Quality standards, NORM should not have to be considered but the determination will be left up t th di ti f th l t d t t
5 Item 3. Pond Dewatering
Please provide any available recent water-quality data and estimated water volumes for the two ponds to be dewatered. Please also confirm the approved discharge location(s) and whether treatment will be required prior to discharge.
We do not have any current water quality on either pond other than visual observations of aquatic life in the ponds. The estimated water volume for both ponds is anticipated to be 5.2 acre feet or less. The approved discharge location will be into either the ditch occurring to the southeast (along the entry road) or to the tributary to the northwest. No water treatment is anticipated to be required for either pond prior to discharge
SECTION C -
DESCRIPTION/SPECIFICATION
S, Background
Section C states that no Storm Water Discharge Permit is required, while the Pond Dewatering specification states that the Contractor will acquire a stormwater discharge permit if necessary. Please clarify whether any permit is expected for dewatering/discharge from the two existing ponds and identify responsibility for application fees, sampling, treatment, and compliance requirements associated with the discharge.
ODEQ has indicated no discharge permit will be required for the dewatering and discharging of water from either pond.
Pond sludge and residual management will be required to be handled by the contractor.

18 Bid Schedule
The bid schedule identifies Item 11 Wetland Seeding and Planting as 260 units, while the specification describes a 240-foot by 40-foot wetland planted on 24-inch centers, approximately one plant per four square feet. Please clarify what the bid quantity of 260 represents and provide the contractual quantity/basis for pricing and payment as that would only cover 1,040 sqft of wetland area as opposed to 9,600 sqft (240 ft x 40 ft).
The actual "floor" of the wetland is 12' x 220' or 2,640 ft^2.
The true number should be 660 units planted.

22 STORM WATER POLLUTION
PREVENTION PLAN, page 7
It is stated that a SWPPP is not required for this project and that OSMRE developed the BMPS in an attached drawing. Please provide the contract requriments for BMP installation, inspections, and maintenance.
A stormwater pollution preventation plan and a general construction permit are anticipated and will be the responsibility of the contractor. The information related to OSMRE developed BMPs and the associated attachment were attached to this RFP by mistake. The contrator will be required to develop and acquire a SWPPP
Can you confirm whether the subcontractor qualifications will count towards the past performance requirements in relation to the subject solicitation?
No, only the Prime. This is a small business set a-side and a sub-contrctor plan is not required.
24 What size riprap is to be installed per OSMRE design? AASHTO #3 25 Which line item shall riprap be included within the Bid Schedule? Line item 7.
Could you please identify the specific state and local licenses, registrations, and permits the successful contractor will need for this project? Also, which environmental permits or approvals has OSMRE already obtained, and which would be the contractor’s responsibility, particularly for stormwater, pond dewatering, and AMD discharge?
The necessary permits we anticipate this project requiring are a stormwater pollution preventation plan and a general construction permit from the state, any and all other permits necessary for the project to be successful will be determined by the contractor. The pond dewatering will not require a ODEQ permit. No discharge permit is applicable for the contractor, at this time, for the AMD as it is related directly to the permit and the former operator. The contractor will need to obtain or hold licenses to perform all work in Oklahoma related to this j ' bj iThe RFP references a site-specific Stormwater Pollution Prevention Plan (SWPPP) sheet as being included in the project plans; however, this sheet does not appear to be included in the RFP documents. Can the referenced SWPPP sheet be provided to bidders?
A stormwater pollution preventation plan and a general construction permit are anticipated and will be the responsibility of the contractor. The information related to OSMRE developed BMPs and the associated attachment were attached to this RFP by mistake. The contrator will be required to develop and acquire a SWPPP
Are contractors able/allowed to dual-hat any of the Key Personnel on this effort? Yes
Are there any specific education, experience, or certification requirements for Key Personnel? No
Is the Safety representative required to maintain a full-time site presence? No
