F.1 52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION
OF WORK
APR 1984
The Contractor shall be required to:
(a) Commence work under SCHEDULE A of this contract within 10 calendar days after the date the Contractor receives the notice to proceed, (b) Prosecute the work diligently, and (c) Complete the entire work ready for use not later than 334 calendar days after the date the Contractor receives the notice to proceed. The time stated for completion shall include final cleanup of the premises.
Commence work under SCHEDULE B of this contract within 10 calendar days after the date the Contractor receives the notice to proceed, (b) Prosecute the work diligently, and (c) Complete the entire work ready for use not later than 274 calendar days after the date the Contractor receives the notice to proceed. The time stated for completion shall include final cleanup of the premises.
Commence work under SCHEDULE C of this contract within 10 calendar days after the date the Contractor receives the notice to proceed, (b) Prosecute the work diligently, and (c) Complete the entire work ready for use not later than 274 calendar days after the date the Contractor receives the notice to proceed. The time stated for completion shall include final cleanup of the premises.
F.2 52.211-12 LIQUIDATED DAMAGES—CONSTRUCTION SEPT 2000
(a) If the Contractor fails to complete the work within the time specified in the contract, the Contractor shall pay liquidated damages to the Government in the amount of $1,800.00 for each calendar day of delay beyond the final contract completion date.
(b) If the Government terminates the Contractor's right to proceed, liquidated damages will continue to accrue until the work is completed. These liquidated damages are in addition to excess costs of repurchase under the Termination clause.
F.3 52.211-13 TIME EXTENSIONS SEPT 2000
Time extensions for contract changes will depend upon the extent, if any, by which the changes cause delay in the completion of the various elements of construction. The change order granting the time extension may provide that the contract completion date will be extended only for those specific elements related to the changed work and that the remaining contract completion dates for all other portions of the work will not be altered. The change order also may provide an equitable readjustment of liquidated damages under the new completion schedule.
F.4 52.211-18 VARIATION IN ESTIMATED QUANTITY APR 1984
If the quantity of a unit-priced item in this contract is an estimated quantity and the actual quantity of the unit-priced item varies more than 15 percent above or below the estimated quantity, an equitable adjustment in the contract price shall be made upon demand of either party. The equitable adjustment shall be based upon any increase or decrease in costs due solely to the variation above 115 percent or below 85 percent of the estimated quantity. If the quantity variation is such as to cause an increase in the time necessary for completion, the

Contractor may request, in writing, an extension of time, to be received by the Contracting Officer within 10 days from the beginning of the delay, or within such further period as may be granted by the Contracting Officer before the date of final settlement of the contract. Upon the receipt of a written request for an extension, the Contracting Officer shall ascertain the facts and make an adjustment for extending the completion date as, in the judgment of the Contracting Officer, is justified.
F.5 52.242-14 SUSPENSION OF WORK APR 1984
(a) The Contracting Officer may order the Contractor, in writing, to suspend, delay, or interrupt all or any part of the work of this contract for the period of time that the Contracting Officer determines appropriate for the convenience of the Government.
(b) If the performance of all or any part of the work is, for an unreasonable period of time, suspended, delayed, or interrupted (1) by an act of the Contracting Officer in the administration of this contract, or (2) by the Contracting Officer's failure to act within the time specified in this contract (or within a reasonable time if not specified), an adjustment shall be made for any increase in the cost of performance of this contract (excluding profit) necessarily caused by the unreasonable suspension, delay, or interruption, and the contract modified in writing accordingly. However, no adjustment shall be made under this clause for any suspension, delay, or interruption to the extent that performance would have been so suspended, delayed, or interrupted by any other cause, including the fault or negligence of the Contractor, or for which an equitable adjustment is provided for or excluded under any other term or condition of this contract.
(c) A claim under this clause shall not be allowed -
(1) For any costs incurred more than 20 days before the Contractor shall have notified the Contracting Officer in writing of the act or failure to act involved (but this requirement shall not apply as to a claim resulting from a suspension order); and
(2) Unless the claim, in an amount stated, is asserted in writing as soon as practicable after the termination of the suspension, delay, or interruption, but not later than the date of final payment under the contract.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.
Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at www.dol.gov/whd/govcontracts.
Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).
file:///ibr6gprfp002.bor.doi.net/...Dam%20Contraction%20Joint/PREAWARD/Solicitation/Amendments/Amendment%20No.%205/CO12.txt[5/22/2018 1:58:31 PM]
The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).
Union Rate Identifiers
A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or "UAVG" denotes that the union classification and rate were prevailing for that classification in the survey. Example:
PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.
Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.
Survey Rate Identifiers
Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.
Survey wage rates are not updated and remain in effect until a new survey is conducted.
Union Average Rate Identifiers file:///ibr6gprfp002.bor.doi.net/...Dam%20Contraction%20Joint/PREAWARD/Solicitation/Amendments/Amendment%20No.%205/CO12.txt[5/22/2018 1:58:31 PM]
Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.
A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.
WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination
* a Wage and Hour Division letter setting forth a position on a wage determination matter
* a conformance (additional classification and rate) ruling
On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)
and 3.) should be followed.
With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:
Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:
file:///ibr6gprfp002.bor.doi.net/...Dam%20Contraction%20Joint/PREAWARD/Solicitation/Amendments/Amendment%20No.%205/CO12.txt[5/22/2018 1:58:31 PM]
Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.
3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:
Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
4.) All decisions by the Administrative Review Board are final.
END OF GENERAL DECISION
M - 3 (Revised) corrective actions taken. Additionally, list any safety or environmental awards or recognition your company has received during the past five years.
ii. Include job hazard analyses (JHAs) that addresses hazards associated with the primary phases of the project including working near outlet works intakes, fluctuating reservoir levels, and work restrictions or limitations during wind/storm events. The JHAs will be used to determine the offeror’s understanding of the occupational safety and health issues associated with the work. A general company safety program with references to regulations and/or general references to meeting the safety requirements in the specifications is not acceptable and will result in a lower rating.
2. Company Experience – Furnish a list (no more than 5) of Federal, State, local government or
Commercial projects completed within the last 10 years similar in scope and complexity to the work required under this solicitation. The projects must clearly demonstrate the ability to successfully accomplish projects in a timely manner, utilize resources efficiently, and work with project owners and/or water utilities. Similar projects are defined as work involving underwater construction, placement of underwater materials, underwater work involving similar work and flow restrictions, water deliveries during construction period, fluctuating water surfaces, and complex work involving barges, floating work platforms and/or scaffolding.
Provide the following information for each project:
• Name and location of project.
• Description of work.
• Contract number, date and type.
• Original completion time and date, and actual dates and duration for each project

• Features of work similar to this solicitation.
• Any problems encountered in performance of the work and corrective actions taken.
• Name(s), telephone number(s), e-mail addresses of references from the acquiring customer who may be contacted for further information. References with incorrect or missing phone numbers, contact names, or e-mails may not be evaluated, potentially resulting in a less favorable rating or the offeror’s proposal. In addition, to the past performance information submitted by the offeror, the Government may obtain past performance information from other Federal or State agencies.
If an offeror intends to utilize subcontractors to perform any of the major components of work, all of the above information shall be provided for each proposed subcontractor.
3. Key Personnel - Furnish complete and detailed resumes for all key personnel (any staff who will oversee major components of the work). At a minimum, key personnel includes the project manager, superintendent, onsite safety and health professional, and dive master.
Resumes are limited to 2 pages per individual and, at a minimum, shall address the following:
• Name and role/responsibilities for this project
• Educational background, professional registrations or certifications

iii. Accomplishments or other pertinent information which demonstrates their suitability for the work assigned to them on this project.
If an offeror intends to utilize a subcontractor or subcontractor employee to occupy any of the key positions identified above, submit resumes for these individuals.
Your proposal must contain a statement of assurance that these individuals will be available to work on this project, if awarded the contract. In addition, if any of the key personnel identified in your proposal are subcontracted, your proposal must contain a statement of assurance that they will be available to work on this project as well.
4. Past Performance - The reference information provided under company experience above will be used to determine past performance information. In addition, Offerors shall have a Past Performance Questionnaire (PPQ), contained in Section J, completed by at least three (3) of the offeror’s previous clients/owners. Offerors are strongly encouraged to inform previous clients of the importance of the questionnaires as it is a determining factor in rating the proposal. It is the offeror’s responsibility to ensure that the government receives the requested questionnaires by the time and date specified in the solicitation for the receipt of proposals. If an offeror intends on utilizing subcontractors to perform major portions of the work, (excluding suppliers), PPQs shall be submitted on behalf of each proposed major subcontractor.
5. Price - All proposed prices will be reviewed for price reasonableness and any instances of unbalanced pricing. For any trade-offs performed, the price component will be the sum of the total prices for Price Schedule A + Price Schedule B + Price Schedule C.
NOTE 1 - If an offeror intends on utilizing subcontractors to perform any of the work, all of the above information must be provided for each subcontractor.
NOTE 2 - The Government intends to award this contract without conducting negotiations; therefore failure to submit any of the information addressed above for each of the factors and/or subfactors may result in an unacceptable proposal.
NOTE 3 – The Government will use oral presentations as a means to ensure the offeror with the best written technical proposal can effectively portray their plan to implement their proposed construction plan, schedule, and means and methods.
Oral Presentations – The TPEC will conduct an initial evaluation of the written proposals and assign an initial rating for each individual factor and subfactor by proposal, and then establish an overall technical rating for Volume II -- Technical Proposal. Each offeror that submits a technical proposal, which receives a technical rating of Acceptable or better, will be required to provide an oral presentation for the Government’s review and evaluation. The TPEC will evaluate each offeror’s oral presentation, to arrive at a final overall technical rating for each proposal. Proposals that do not receive a technical rating of Acceptable or better, based on the initial evaluation of written proposals, will not be further considered for award.
Schedule for Presentation – Presentations will be scheduled with offerors within two to six weeks of receipt of proposals. Each offeror will be contacted regarding scheduling the date and time of the presentations. However, all presentations will be held within the same week, based on the availability of the Technical Proposal Evaluating Committee (TPEC) members and each offeror. For scheduling purposes, oral presentations will likely take place between mid-June, 2018 to early July, 2018.

22. Can the Government provide an approximate schedule award date to incorporate into the
Construction Schedule as required for the technical proposal?
Yes. Proposer should anticipate and Award date of August 31, 2018; in preparing the
Construction Schedule.
23. Specification 01 56 32 Part C(1) calls out is “In accordance with approved manufacturer’s product data.” No product is provided and floating barriers have a significant range of cost.
Please define the threat, what fence is protecting (just around the barge, etc.) or provide a manufacturer and type.
Refer to the following response that was provided in Amendment No. 0004, issued on May 10, 2018 to contractor question No. 17:
“Refer to revised specifications Section 01 56 32 – Temporary Safety Fence, and revised design drawing 382-D-60011 regarding the type of floating buoy required.”
24. Please reference drawing 382-D-60018, Section B. What is the width of the top of dam
(at elevation 4921.00). Also, is there any load restrictions for the top of the dam and/or parapet wall?
Refer to new “For Information Only” drawing 382-D-1317 – Pueblo Dam, Concrete Dam, Top of Dam, Plan Elevation, and Sections, sheet 17a, regarding the width of the top of dam. All existing conditions shall be field verified by contractor.
Refer to the following response that was provided in Amendment No. 0004, issued on May 10, 2018 to contractor question No. 14:
“Refer to revised specifications Section 01 55 00 – Vehicular Access and Parking, and
Section 01 14 10 – Use of Site, regarding the use of existing concrete and embankment roadways.”
25. Amendment 0004, section 01 14 10-2, paragraph 1.04.A revised the project conditions to allow the contractor to work up to 10 hours per day, five days per week unless otherwise approved by the COR in advance. We have developed a very detailed schedule for the project which includes over 400 activities. The schedule we have developed with estimated durations for each activity requires working 6 days per week and we still come up short of meeting the CCD for Phase 1 by 28 days. This is due in large part to the submittals and procurement durations needed for the Schedule A work. Please consider doing one or more of the following:
a. Revise the duration for Schedule A work to 334 calendar days from NTP
b. Allow the contractor to work Saturdays.
c. Allow the contractor to work second shift
Refer to revised Section F – Deliveries or Performances, and Section M – Evaluation
Factors for Award, Pages 3 and 4, regarding schedule updates.
