Solicitation No. 140R3024R00
Questions & Answers
1. Per Solicitation documentations - the Contractor shall complete the Work within 365 calendar days after receiving notice to proceed. Please confirm if there are any Liquidated Damages tied to this milestone. If so, please confirm the value and limits of the Liquidated Damages.
There are no Liquidated Damages tied to this solicitation.
2. Per Section L - the contractor is to use October 21st, 2024 as the Notice to Proceed for the purpose of developing the construction schedule. Please confirm new NTP date as the project bid date is now November 7, 2024.
Contractor is to use December 9, 2024 as the Notice to Proceed for the purpose of developing the construction schedule.
3. Per specification section 01 35 30 Section 1.04 B.4, the Contractor's Part-time Onsite Safety and Health Professional is required to have a 4-year Bachelor's Degree from an accredited college or university in 1. Safety Engineering. Or 2) Safety and Occupational Health. Please confirm if the degree can be expanded to other Engineering topics such as Civil Engineering or Mechanical engineering or if other safety certifications such as a Construction Health and Safety Technician (CHST) certification can be provided in lieu or a Bachelor's Degree.
The importance of this requirement is that the contractor is employing a qualified safety professional. This means the individual has the necessary experience and knowledge/education, which includes field experience. Whether this individual has other certifications is not as important as their experience as a safety professional. Note that in the referenced specification section 01 35 30, 1.04.B.3, this individual shall be qualified by virtue of education, training, certification, and experience in which professional status in the construction safety field has been established. As described, this individual is a certified safety and health professional.
In this specification section, it mentions two individuals, 1) contractor's onsite safety representative, and 2) contractor's part-time safety professional. The contractor may employ one individual to be onsite full-time if they meet the requirements of a safety professional, as described.
4. Per Drawing 423-D-60220, Mojave Electric is provided the step down transformer and power meter, please provide the duration/lead time that should be assumed for bid purposes. Please be advised that if Mojave Electric has not already procured the transformer, the current lead time is roughly 52 weeks.
Mohave Valley Electric Cooperative (MVEC) acknowledges that lead times for pad-mounted transformers is lengthy. MVEC does have some pad-mounted transformers in stock;
however, they will need to verify the selected Archimedes Screw Pump motors and load calculations to ensure the correct size of pad-mounted transformer is selected and that they have this transformer in-stock.
5. Drawing 423-D-60175 shows the typical slope for the RCPP trenches to be 2.5:1.
Drawing 423-D-60146 shows the corresponding pipe trench earthwork excavation extents. Typically, excavation slope protection/support of excavation is considered a means/methods for construction; different means/methods would generate different excavation extents, including reduced excavation extents.
Please clarify if the 2.5:1 slope dimension is a design requirement or if it was intended to show the maximum extent of ground disturbance by the contractor. If the slope dimension is not a design requirement, please confirm the backfill extents will only be what is required to replace the contractor's excavation extents.
The sideslope of (2.5:1) is the maximum/steepest slope permissible with the soils on site. The Contractor may propose via RFI to use an alternate means & methods of excavation support, provided it is safe. This RFI would result in a submittal wherein the contractor provides suitable information and data for the engineer of record/designer to evaluate and confirm this is a safe approach to the work.
6. Could you please confirm if the Buy American Act applies to the purchase of Archimedes Screw Pumps for the Fire Break Canal Pump Station project -Topock Marsh, Colorado River Front Work and Levee System, Lower Colorado Region 8?
Additionally, are we allowed to supply Archimedes screw pumps manufactured in the Netherlands with 100% European sourced steel for this project?
Please read FAR Clause 52.25-11, Buy American Act-Construction Materials under Trade Agreements, located on Page I-5 of the solicitation.
