SOLICITATION NO. 140P8420Q0039
PAINT HOME RANCH RESIDENCES
POINT REYES NATIONAL SEASHORE
MARIN COUNTY, CALIFORNIA
SITE VISIT – JUNE 29, 2020
SITE VISIT SUMMARY SUMMARY:
A site visit was conducted on June 29, 2020 at 8:00am. Participants met at Point Reyes National Seashore Headquarters at 1 Bear Valley Road, Point Reyes Station, CA 94956. From park headquarters, participants travelled to the job site to view the buildings.
QUESTIONS AND ANSWERS FROM SITE VISIT:
Q12: Is the list of site visit participants going to be posted?
A12: Yes, the list of site visit attendees has been made available with this Amendment 0007, as follows: Att 10_140P8420Q0039_Site Visit Sign In Sheet.pdf
Q13: What will the period of performance be for this project?
A13: The original estimated period of performance is no longer feasible due to delays in the solicitation and award process caused by the global pandemic. The actual contract performance time begins on the date the Contracting Officer issues the Notice to Proceed document, which “starts the clock” on the 45 days performance time provided under contract. At this point in time it is estimated work will begin in early September 2020.
Q14: Does the contract require or will NPS excavate around the exterior of the building to expose siding for paint?
A14: Excavation around the exterior of the buildings to prepare for treatment is not part of the contract. The NPS preservation crew may conduct excavation around the building to expose siding currently obstructed by dirt prior to the period of performance.
Q15: Are the Windowsills and Jambs included?
A15: Yes, but sash are not included.
Q16: How will damaged siding be addressed?
A16: Prior to the period of performance, damaged exterior wood materials will be repaired by the NPS preservation crew.
Q17: Are the units occupied?
A17: The Murphy house is occupied. The main house is vacant.
Q18: How will the vegetation and trees encroaching on the building be treated prior to work?
Solicitation No. 140P8420Q0039, Attachment No. 11
A18: NPS shall arrange for all of the following: Bushes, shrubs, and other small-scale vegetation to be trimmed to allow at minimum two feet clearance from the building’s siding.
Mature trees will be limbed to a height of 8 feet above the ground. Limbs that make contact with the roof or siding of the building are to be trimmed to maintain at least 3 feet of clearance. Limbs that overhang or pose a hazard to the building will be removed.
Q19: Will windows be accessible from the inside?
A19: Yes.
Q20: Will occupants be on site while work on the Murphy House is conducted?
A20: NPS will coordinate the work schedule and activities with the residents to ensure they do not interfere with project tasks and to ensure they are not exposed to hazards associated with the project.
Q21: Are metal features such as gutters to be painted?
A21: Yes, all previously painted metal surfaces are to be painted.
Q22: What are the requirements for presumed lead-based paint?
A22: The contractor is required to ensure that work is done safely and in compliance with the applicable Federal and State regulations regarding removing, handling, storing, transporting and disposing of lead waste materials. The relevant regulations include but are not limited to: the EPA’s Renovation, Repair, and Painting Program regulations, and those regulations enforced by Cal/OSHA (Title 8 of the Labor Code) and the California Department of Public Health (Title 17 of the California Health and Safety Code).
Q23: Does fencing get painted?
A23: No, treatment of fencing associated with the residences is not included in this contract.
Q24: Does the contract require painting of the adjacent outbuildings?
A24: No, only the Home Ranch Main Residence and Murphy Residence are to be painted.
Q25: Can we mask off the interior of the windows?
A25: Yes. Access to the building interiors will be provided as necessary to complete project tasks.
Q26: How many occupants are on site?
A26: Two occupants reside in the Murphy house.
Q27: Regarding the main residence, do we need to mask inside for lead as it is unoccupied?
A27: This should be conducted as necessary consistent with lead-safe work practices and containment of lead-based paint that may be disturbed as a result of project activities.
Q28: Is there water and electric available to contractor?
A28: Yes. Also see Q42.
Q29: Does the restroom in the vacant house function?
A29: Yes, but the contractor must provide their own toilet and wash station facilities. A portable toilet is acceptable. And, a wash station may be required to comply with Marin county covid-19 related guidelines for construction.
Q30: What area will be designated for staging of materials and equipment?
A30: The staging area will be determined by the Contracting Officer after award, taking into consideration the contractor’s requirements and site limitations.
Q31: Are there EPA numbers for the buildings?
A31: No. The park does not have an EPA number for this location.
Q32: Can we scaffold on the roof of the porch?
A32: Yes, but the roof must be protected by plywood material and the roof structure may require additional reinforcement/support depending on the weight. Also see Q43.
Q33: Are the decks to be painted?
A33: No.
Q34: Can a pressure washer be used for surface cleaning?
A34: No.
ALL OTHER QUESTIONS AND ANSWERS RECEIVED TO DATE:
Q35: Why can only California contractors bid on this job as a prime? Is everyone outside California excluded? We are an Arkansas contractor but our proposed subcontractor is based in California and does have the required license.
A35: As explained in detail in Amendment 0006 to the Solicitation, the requirement for a state license is allowable in areas of “concurrent” jurisdiction, which applies to the location of this upcoming construction project in Point Reyes National Seashore, and the effect of a state license is beneficial to the Government in providing a verifiable and consistent level of technical certification by the State for this specific trade.
Additionally, please consider the following:
The FAR clause 52.219-14, Limitations on Subcontracting, applies to this solicitation and any subsequent award. This project is considered construction by special trade contractors, and in that instance this clause requires the prime contractor to perform 25% of the cost of the contract, not including the cost of materials, with its own employees.
The FAR clause 52.236-6, Superintendence by the Contractor, applies to this solicitation and any subsequent award. It states, “At all times during performance of this contract and until the work is completed and accepted, the Contractor shall directly superintend the work or assign and have on the worksite a competent superintendent who is satisfactory to the Contracting Officer and has authority to act for the Contractor.”
Since the prime is required to be on-site actively supervising the project, and must perform 25% of the cost of the contract with its own employees, we require the prime as well as any proposed subcontractor to hold the required license so there is a verifiable and consistent level of technical certification by the State for this specific trade.
Finally, we are not requiring that only California contractors can bid on this job as a prime. We are not being unfairly restrictive in requiring a state license as any contractor in any state may apply for a California license, and in our experience we have seen many out of state contractors do that. The link to apply for a license is here:

Q36: If the State of California has reserved the right to exercise governmental authority on this project as noted in Amendment 6, isn't it required to have a Certified CDPH (California Department of Public Health) Lead Supervisor on staff (on top of needing to be a EPA Lead- Safe Certified RRP company)? CDPH requires stricter rules and regulations than the EPA, so will you be requiring proof of a CDPH Lead Supervisor at the time of the bid? There are also notifications that are required to be sent to Cal-OSHA and CDPH prior to performing lead-paint stabilization and require the information of the CDPH Lead Supervisor responsible for the project. Is it safe to assume that you will be requiring those to be sent prior to performing stabilization also?
A36: As we understand it, the requirements you outline are the requirements for "Lead Abatement projects for public and residential buildings designed to reduce lead paint or lead hazards for a minimum of twenty years" (Title 17, Article 16, §36100). Our project is not for Lead Abatement, and therefore those specific requirements do not apply.
Q37: The notifications for CDPH and Cal-OSHA are for any lead work being done in California on state land (that I'm aware of). Attached is an example of the CDPH notification that is necessary to fill out and submit. If you notice in Section 2 it asks whether the work being done is "abatement" (20 or more years) or "temporary" (which is for less than 20 years, as in lead stabilization). This is what we have been told in class and required to do on all other state projects where the work is simply lead stabilization.
A37: The referenced notification is for Abatement of Lead Hazards, since this is not an abatement/ lead hazard control project this notice is not required. However, other requirements in Title 17 still apply.
Q38: Do the pictures portray all of the buildings that will be painted?
A39: Yes, they do.
Q40: If acceptable to you, I would like to provide Dunn Edwards equivalent product spec to you, and ask you forward it to your technical team. It will include our product data sheets, etc.
A40: The project specifications allow for approved equals but those are evaluated post-award through the submittal process.
Q41: Due to the age of the buildings and the lead based paint, is pressure washing unable to be used to clean the building? Are you requiring the buildings to be hand washed?
A41: As indicated in the specifications, a pressure washer is not to be used to clean the buildings exterior. Instead, it is to be cleaned by hand washing.
Q42: Is water available at either of the buildings or the ranch itself for use by the awarded contractor?
A42: Yes, water is available for use on-site by the awarded contractor. Also see Q28.
Q43: On both buildings, there will be a need to get on top of some of the lower roofs in order to paint the surfaces. Since it's against OSHA and Cal-OSHA to place ladders on them, are all of the roofs safe for erecting scaffold?
A43: Where it is necessary to install scaffolding on roof structures in order to paint surfaces, the roof must be protected by plywood material and the roof structure may require additional reinforcement/support depending on the weight of the scaffolding system. Also see Q32.
Q44: What time each morning will the Park Service be opening up the various gates to reach the buildings?
A44: Per the specifications, all work shall be performed between the hours of 8:00 am and 5:00 pm Monday through Friday. Access to the site will be available by 8:00 am each morning.
Q45: Will the issue with the bees at the Main House (mentioned at the walk) be taken care of by the government prior to starting?
A45: NPS will arrange for the removal of the bees from the Main House prior to the start of the Period of Performance for the project.
