ADDITIONAL QUESTIONS AND ANSWERS RECEIVED TO DATE:
Q10: According to the solicitation the quoter shall provide a copy of their current California Contractor State License classification C-33.... or similar license(s) applicable to this project. According to California's Contractor State License Board:
Contractors...engaged in the business of home improvement (with the exception of ... projects involving federal funding) must be licensed before submitting bids.
https://www.cslb.ca.gov/Contractors/Applicants/Contractors_License/Waiver_Application/Before _Applying_For_License.aspx
I assume this is a project involving federal funding and that a California State Contractor license is neither applicable nor required by the California State Licensing Board.. Am I mistaken?
A10: Federal and State (including local) governments have varying authority to exercise government power and authority over such lands, depending upon the type of interests the Federal government obtained when acquiring the property and what authority a State has chosen to retain. This authority, right or power of a government to act is referred to generally as legislative jurisdiction.
In areas of “concurrent” jurisdiction, which applies to the location of this upcoming construction project in Point Reyes National Seashore, the State of California has reserved the right to exercise, concurrently with the United States, all of the same governmental authority. As a result, State and local laws are applicable at the same time Federal law pertaining to the area also applies.
We have evaluated the effect of State issuance of a contractor’s license on any resultant Purchase Order award and have concluded it will not unreasonably interfere with Federal functions, and is beneficial to the Government in providing a verifiable and consistent level of technical certification by the State for this specific trade. Therefore, we drafted our Solicitation to expressly include the requirement for the necessary state license.
Q11: The Environmental Protection Agency "Lead Renovation, Repair and Painting Rule" (RRP Rule) requires that firms performing renovation, repair, and painting projects that disturb lead-based paint in homes...built before 1978 have their firm certified by EPA (or an EPA authorized state), use certified renovators who are trained by EPA-approved training providers and follow lead-safe work practices.
https://www.epa.gov/lead/lead-renovation-repair-and-painting-program
Will this contract require the use of an EPA certified firm using certified renovators complying with lead-safe work practices?
A11: Yes, that is a requirement of this project; the Contractor is required to meet Federal and State regulations. The solicitation has been updated to explicitly require offerors to provide proof of this certification with their quotation package, as follows (changed text is in red for clarity):
Solicitation No. 140P8420Q0039, Attachment No. 09
