1. Amendment 1 provided the Ohio Environmental

Protection Agency’s Approved Construction Site

Stormwater General Permit. However, the National

Park Service has not obtained the USACE NWP approval or provided bidders a copy of their proposed submitted USAC NWP outlining all requirements and procedures necessary for installation of the proposed Box Culvert and

Brandywine Creek Stream Modifications. Current solicitation, specifications, and plans do not stipulate if construction equipment will be permitted in the waterways of Brandywine Creek.

We request that the National Park Service provide the proposed USACE NWP and confirm to the bidding contractors that necessary construction equipment shall be permitted in the Brandywine

Creek.

March 15 – June 30th is the typical ODNR in‐ water work restriction.

USACE in‐water work restrictions are not known at this time, we will share the NWP when it is issued. The contractor must follow the final permit conditions and restrictions. Here is our application.

We are also attaching the Stormwater Pollution Prevention Plan (SWPPP) that was submitted to the OEPA
