Conduct TCRA under CERCLA at burned sites Rocky Mountain NP Attachment 9a: Clarifications 52 - 62
Clarifications 52 – 62 for Solicitation #140P2123R0008
Amendment 4 posted on 5/19/23
This document provides clarifications based on submitted queries. Clarifications 1 – 51 are in Attachment 9, posted with Amendment 2.
52. The RFP stated to assume that friable ACM is present in the ash, debris, and soil although no sampling data has been provided for asbestos. Since no sampling data appears to have been collected to confirm the presence/absence and/or limits of potential friable ACM, can the Offeror propose sampling to confirm or deny the presence of friable ACM and thus confirm the safety considerations necessary for the TCRA?
a. Pre-removal sampling for presence/absence and/or limits of potential friable ACM in ash/debris shall not be performed. Sampling the ash and debris for asbestos prior to removal in accordance with a CDPHE-approved sampling plan was NPS’s original intent. However, pursuant to discussions with CDPHE Indoor Air Program, NPS was informed if the sites are sampled for asbestos prior to removal and asbestos is found at any concentration (presence/absence), then the full requirements of Colorado Regulation No. 8 apply – i.e., the “relaxed” procedures described in the CDPHE October 2020 East Troublesome Wildfire Guidance would no longer be available.
53. What will be the criteria for executing the options for the HHRA/SLERA and when would they be executed? Section 7.1 of the SOW references executing the HHRA/SLERA option to determine alternative Remedial Goals. Section 7.2 of the SOW goes on to suggest that over excavation of additional 6 inches of soil may be requested in the event that post-removal samples indicate constituents greater than the Remedial Goals. Please define specific thresholds that would trigger each event.
a. Presently, NPS’ intent is to cleanup to site-specific background/reference levels.
Decision to execute options for the HHRA/SLERA will be made, in part, on confirmation results after initial removal. NPS has identified timelines for executing these options in section 12 of the SOW.
54. Are biodegradable demarcation layers allowable to mark the terminus of excavations while awaiting post-removal sample results and potential results of the executed optional
HHRA/SLERA?
a. Yes, water-based environmentally friendly spray paint is acceptable. Contractor shall submit product data for approval by the Contracting Officer or designee prior to use.
55. May the Offeror suggest pre-removal endpoint sampling to define excavation ends points?
a. If the question is asking about subsurface sampling prior to excavation (e.g., 6 inches or 12 inches below ground surface within excavation areas), this may be suggested in accordance with FAR 52.215-1 Alternate II; however, NPS may not accept the suggested approach. To be considered by NPS, the contractor must provide details regarding proposed sampling methods, depths, counts, and analyses for each site. NPS recommends that the Contractor submit a proposal that fully conforms with SOW as well as the proposed alternative.
b. If the intent of the pre-removal sampling is to also fulfill post-removal confirmation sampling requirements, it must be collected in accordance with the Draft Final SAP (metals and dioxins/furans via ISM and asbestos as described in SAP). The SAP would require updating to reflect any such proposed sampling approach.
56. Can we use water from nearby sources for dust control?
a. Water for dust control may not be withdrawn from surface water. Section 9.10.6 of the SOW addresses water availability via connection to potable water system on east and west sides of the park.
57. In discussion with both Foothills and Front Range Landfills, both facilities state that the exemption from CDPHE to accept waste from the East Troublesome fire has expired and will not be renewed. Please confirm that these two facilities are no longer an option.
a. NPS has conferred with CDPHE and confirmed that the October 2020 CDPHE East Troublesome Wildfire Guidance (Guidance) is not withdrawn/rescinded;
however, the landfill waivers that allowed disposing of friable asbestos waste / unsampled ash in certain landfills have expired, including Foothills Landfill and Front Range Landfill. These two facilities are no longer an option. Landfills that are permitted for friable asbestos waste can still accept the waste, packaged as described in the Guidance. According to CDPHE, landfills identified in the Guidance permitted to accept friable asbestos include Denver Arapaho Disposal Site, Tower Landfill, and Buffalo Ridge Landfill. It is possible that other landfills permitted by CDPHE to accept friable asbestos waste could receive wastes from this project. It is the contractor’s responsibility to identify any such alternative landfills and confirm ability to accept wastes from this project, along with waste packaging and profiling requirements. Please remain mindful that the selected landfill(s) must also be approved by EPA to accept CERCLA wastes.
58. Attachment 6: Archaeological Monitoring Requirements. The durations for preparing, reviewing the Archaeological report have conflicting durations and versions from Section 1.3 (C & D) and Section 2.3 (8 & 9). Is the report to be in draft & final or draft, draft-final and final versions? Please confirm all durations.
a. The deliverables specified in section 2.3 are correct, it will be draft, revised draft, and then final. The draft report is due 30 days after completion of field work. NPS will provide comments within 30 days of receiving the draft. Contractor shall submit revised draft within 21 days of receiving the initial comments, NPS will have 30 days to review and comment on the revised draft. Final report is due 15 days after receiving the NPS comments on the revised draft.
59. Amendment 02 – Revised Price Schedule. Items 4, 9, BDG-3, FLR-3 are for the collection/excavation of ash, debris, METAL, and soil from the various locations. These items have a unit of measure of Tons (TN) and a quantity provided for each. The Green Mountain- Onahu Ranch Area includes Item 12 “Transport scrap metal for recycle” which has a unit of measure of Cubic Yards (CY) while the Betty Dick Garage has Option BDG-6 “Transport scrap metal for recycle” which has a unit of measure of Tons (TN).
a. Should these 2 units of measure be the same? If so, which unit of measure should be used?
• Yes, the units of measure should be the same: cubic yards (CY).
b. Are the quantities of metal in Items 12 and BDG-6 accounted for in the quantities for collection?
• Yes, best available estimates of metal quantities are provided in Table 1 of the SOW.
c. Is the contractor required to separate out any collected metal from the Moraine Park Stables Areas or Fern Lake Ranger Station? If so, where should the transportation cost of that material be captured?
• Limited quantities of metal remain at the Fern Lake Ranger Station and Moraine Park Stables Area. NPS assumed metal at these locations will not be segregated for recycling and will be disposed as contaminated debris.
60. Technical Factor 1C. What date should be used as the Contract Award date in the proposal schedule?
a. August 1, 2023. This is based on the 60-day acceptance period for proposals;
actual award date may be a bit earlier.
61. RFP Section L5. PART I -- TECHNICAL INFORMATION. 4. Proposed approach for completing the project (4 pages). Four pages is not adequate space to demonstrate the Technical Evaluation requirements for this component. To allow proper evaluation, will NPS increase the page count for Technical Factor 1D to 6 pages?
a. Yes.
62. Amendment 02 – Revised Price Schedule. On Form_2_Price_Schedule_(corrected_5-10- 23)_0002.xls, the formula at cell E41, TOTAL FOR OPTIONS BDG-1 through BDG-7 and SBDG-1 and SBDG-2 sums up the costs from cells E34 to E40 but excludes E32 and E33.
Previous version of the form totals from E32 to E38 and excludes E39 & E40. Please verify.
a. Corrected Form 2 (dated 5-18-23) is provided with this amendment. Changes were made to cells B37 and E41. It is the offeror’s responsibility to check all formulas prior to submission.
