TIMU 335507 Stabilize Kingsley Plantation Shoreline – RFI Responses
This document is a comprehensive Questions and Answers file containing 114 responses to pre-proposal inquiries for solicitation 140P2026R0081, issued by the National Park Service (NPS) for the stabilization of the Kingsley Plantation shoreline in Florida. Amendment 07 extends the question submission deadline to November 6, 2026, at 17:00 Eastern Time, with proposals due November 13, 2026, at 17:00 ET. The contract is structured with three Contract Line Items (CLINs 0001–0003) with no options, and award will include all base line items. The NAICS code is 237990 with a $45 million size standard.
The project scope encompasses sheet pile wall installation (PVC or FRP acceptable), riprap scour protection, and Spartina planting across three sequential phases with a 259-calendar-day performance period following Notice to Proceed. Key environmental and operational restrictions include low-tide work requirements (substrate fully exposed) limited to areas waterward of the high-tide line, maximum 10 piles per day installation by impact hammer with no limitation for vibratory hammers, Monday–Friday 8:00 AM–5:00 PM work hours, excusable delays for tide/weather/wildlife stop-work events with contract time extensions, and comprehensive protected species monitoring (gopher tortoises, red knots, manatees, sea turtles, Eastern indigo snakes). The contractor bears responsibility for gopher tortoise relocation permitting and habitat coordination. Division 1 submittals including the Environmental Protection Plan are due after contract award but before NTP, with 30-day Government review periods. Material source approval for riprap must occur prior to site delivery. The Government will withhold the 259-day NTP until environmental permits (SJRWMD ERP, 401 Water Quality Certification, Submerged Land Lease Letter of Consent) are issued and will provide the archaeologist, USFWS Enclosure 3 notification, and FWC gopher tortoise permit designation. Minimum wage per EO 13658 is $13.65 per hour effective May 11, 2026. A limited NTP may be issued for permit application work before full construction NTP.

# Question Response
Section B refers to "base line items and all option line items," but only 3 CLINs 0001- 0003 are listed. Please confirm there are no option CLINs and that award will include all three CLINs?
Only 3 CLINs, No options
Section H lists "steel sheet pile" please confirm PVC/FRP sheet pile experience satisfies this. Can you use steel pile and/or PVC/FRP experience?
Yes. For key trades in both Section H and Section L, E.3. Factor 5 Project Experience. The intent is to show sheet pile driving experience. PVC/FRP experience satisfies this and steel and/or PVC/FRP experience is also acceptable.
Phasing (01 11 00): May Phase 3 clearing along the FRP wall be done early (January- February, before migratory bird nesting season), ahead of Phase 1 and 2 completion
Yes. Clearing is acceptable outside of the phasing requirements.
May phases overlap (a second crew starting Phase 2 or Phase 3 before the prior phase is substantially complete)?
No. Project should be bid in accordance with Specification 01 11 00 1.3. Value engineering proposals may be discussed following contract award.
May sheet piles and stone be delivered on days other than Monday/Tuesday if visitor areas are protected? May work start at 7:00 AM? Can you work 7 days a week?
Require coordination with COR for delivery on other days, however large deliveries are unlikely to be approved outside of Monday/Tuesday when the Park is closed to visitors. Work hours 8am to 5pm Monday to Friday, no work on the weekend.
Please provide all permits and any special conditions of NWP 13 SAJ-2000-03466, SJRWMD ERP 224839-1, the 401 WQC, the Submerged Land Letter of Consent, and the FWC gopher tortoise permit. Please identify any manatee, sea turtle, or nesting-bird work windows, and whether an in-water work window applies (31 10 00 indicates in-water work is required).
NWP 13/54 is provided in the amended solicitation. SJRWMD permits are currently in process with discussions captured in the drawings and specs of this soliciation package. Gopher Tortoise relocation and associated permitting will be the responsibility of the contractor. Appendix C to the specificationsis being developed with natural resource protection requirements and will be provided in the next amendment to this solicitation.
NPDES or UPPP: Drawing G0.1 says an approved general NPDES permit before disturbance; 01 57 23 uses a UPPP for sites under 1 acre. Which governs, and who files?
Will the project "owner" sign the permit in a timely manner if contractor required to obtain?
The anticipated disturbance for this project is less than 1 acre which would only require the UPPP submitted as part of the Division 01 submittals to be approved before mobilization (01 31 00 1.4.D.10). If the contractor's means and methods require greater than 1 acre of disturbance, the NPDES permit through the state with SWPPP is triggered and the contractor can coordinate obtaining the required information and signature of the project owner (park superintendent or delegated authority) as part of the list of required construction permits submittal before mobilization (01 31 00 1.4.D.12.c).
Please confirm NPS provides the archaeologicalist at no cost to the contractor, the availability, and the stop-work procedure and time compensation for a "find".
NPS will provide an archaeologist if needed. The Park has an archaeologist on staff who can respond to inadvertant finds. Stop-work and time compensation to be coordinated with CO. See 01 35 13.22 3.5.
S3.1 and the plans call for a 3/4" diameter rod, while the S5.1 details call for a "2.5"x0.75" HDG steel tie rod." Please confirm size, material grade, and connection detail.
The tie rod shall consists of 2.5"x0.75" rod head, turnbuckle, 0.75" extension rod and other accessories. For material specs refer drawing G0.1 (STEEL TIE RODS AND ACCESSORIES Section) and Division-2-49 Specification, Section 05 12 00. Details are as shown in Drawing S5.1 - SHEET PILE WALL DETAILS 1.
Tie rod corrosion protection: G0.1 requires HDG plus polymer coating, and 09 97 14 adds petrolatum tape. Are all three layers required, or HDG plus tape only?
Requirement for tie rod protection is HDG plus tape per Division-2-49 Specification, Section 09 97 14.
The geotechnical report recommends pre-augering/jetting, but 31 41 16.16 prohibits them. Will pre-augering or jetting be allowed if refusal occurs above tip elevation, and how will it be paid?
Pre-augering/jetting is prohibited for PVC/FRP pile driving. Refer Specification Division-2-49 Section 3.2, E6 of 31 41 16.16 for obstructions. The bidders shall include contingency in their bid for such unexpected obstruction.
The drawings specify limestone ; 31 37 16 prefers igneous and prohibits limestone in acid-sensitive waters. Please confirm limestone is acceptable, and provide the referenced sections 31 23 33 and 31 05 16 or delete the references.
Riprap stones shall be limestone. Refer General Notes drawings G0.1. Disregard reference for specification Sections 31 23 33 and 31 05 16. These Sections are not relavent for this project.
Please confirm deadman sheet length/embedment (S3.1 shows bottom at +3.50) and the total count and lengths of Type I and Type II deadmen.
Top of deadman wall is +8.5 (refer drawing S5.1) and the bottom of deadman wall is +3.5, so total embedment is 5 feet. Refer drawing S5.1 - SHEET PILE WALL DETAILS 1 for length of Type I and Type II deadman walls.
Existing tie rods/deadmen: Please confirm the extent of "cut and remove" vs. abandon in place (X1.1/X1.2), and the number of core-drilled 2" holes through the existing sheets.
Refer drawing X3.1 DEMOLITION SECTION, Section A for extent of cut and remove and abandon in place tie rods. Every alternate sheet piles of existing wall to be core drilled. Refer Section A, drawing S3.1.
May suitable excavated material be reused as backfill (31 23 00 all backfill as imported)?
Please identify disposal and stockpile limits.
Yes, excavated material behind the existing wall shall be used for backfill. Refer drawing S3.1 - SHEET PILE WALL DETAILS 1. - Section 1, Section A. Additional imported backfill material shall be as per Specification Section 31 23 00 Excavation and Fill .
Please provide planting areas and quantities (C3.1 gives none; the alterniflora band "+2 to +1.95" is effectively zero width). Please confirm how the 730-day period (32 93 00) relates to the 259-day contract duration, and how it is paid and released. How much retainage? Will QC and SSHO need to be on staff for inspections and any minor replanting?
The river bed is very flat at this location, so it is not zero width. The estimated Spartina Alterniflora planting area is 0.019 acre and Spartina Patens is 0.010 acre. Establishment period of 730 days shall commence as per Section 3.1G, Specification 32 93 00.The 730-day period will be handled as a warranty period on the plants similar to the 1-year general warranty on all work following final acceptance. Planting will be paid upon satisfactory completion of the work (initial planting), with no retainage. The government will periodically inspect and issue warranty letters for replacement of plants if needed during the warranty period. QC and SSHO will not be required for any inspection or replanting during the warranty period. Subcontractors should continue to follow established site safety and quality standards established for the project for any warranty inspection, maintenance, or replacement work.
Please confirm the haul road alignment and length (C1.4) and whether restored haul road/staging areas receive sod or just seeding.
The temporary haul road alignment shall be as shown in drawing C1.4. The haul road and staging area shall receive seeding. Road alignment must be based on existing site conditions, avoiding any disturbance of trees, and include pull-off areas. Contractor to define based on its equipment, laydown area and construcability needs.
Can the SSHO also serve as Environmental Manager and Waste Management? May the Superintendent also serve as SSHO? Must the QC Manager be on site full time during non-definable-feature work? Who can be dual hatted?
SSHO can serve as Enviromental Manager/Waste Manager and QC Manager.
Superintendent cannot have other role.
Do you need to be a Florida Licensed General Contractor or Marine Contractor to perform this work? Will you need local county contractor license registration of your Florida State License??
You will have to check with the state to see if they require license and registration.
Site visit RSVP deadline reads "December 12, 2025" and uses joseph_wingfield@nps.gov, which differs from the ios.doi.gov address elsewhere.
Confirm RSVP deadline and correct email for the Oct 20 site visit.
See Amendment 01 for the update.
Factor 5 asks for boardwalk construction and small building/utility work; Factor 1 refers to "historic seawall reconstruction." Neither appears in the Section C scope. Should offerors address these, or are they carryover text?
This response edits the text as follows:
Natural, Cultural, & Historical Resources - Working in close proximity and protecting (1) natural resources such as wetlands and (2) sensitive cultural resources where archaeological finds are likely similar to scope, magnitude and complexity of this solicitation.
Means/Methods – Construction of a seawall on-time and within budget that are similar in scope, magnitude, and complexity to this solicitation.
Section H, SR 1 says "fifteen 10 calendar days"; SF 1442 says 10 days. Confirm start-of-work period is 10 calendar days after NTP.
Start of work is ten (10) calendar days after NTP.

Sheet S5.1 calls for “MARINE GRADE ALUMINUM PILE CAP CONNECTED TO SHEET PILE THROUGH 3/8"x2 1/2" STAINLESS STEEL BOLTS”. It does not state what gauge aluminum to use for the cap. The specs also do not cover this. Please specify what gauge aluminum to use for the cap material.
Marine grade aluminum correspond to grade 6063 T6. Refer Division 2-49 Section 2.3-C Specification 31 41 16.16.
G1.1 Note 3 calls for the existing rubber trail to be reinstalled at the completion of the project. Is the existing rubber to be reused or new rubber to be used? If new rubber is to be used, please provide a detail for the rubber trail with material spec.
Existing rubbers shall be reused for reinstalling the trail after completion of construction activity.
C1.4 upper left corner note shows to install a fence to block access thru the trail during construction. Can a temporary chain link fence be used for this? Please provide the length of fence required.
Yes, this fence shall be temporarily installed and removed after completion of construction activity. The length of the temporary fence shall be sufficient to block pedestrian access during the construction the activity.
Spec 31 41 16.16 – Synthetic Sheet Piling – Installation requires us to use a blow hammer & count blows. Can we use a vibratory hammer to drive the sheets & drive them to the shown tip elevation on the drawings? The soils on the C drawings shows that a vibratory hammer should be able to drive the sheets to the proper tip elevation.
Vibratory hammer is acceptable if the Contractor find suitable for driving sheet piles at the project location. Refer Section 2.5-B, Specification 31 41 16.16.
Please provide the locations for construction temporary power & water connections. Water and electrical connections are not available on site. Contractor to provide, refer Specification 01 50 00 3.2-C & F.
Spec 31 41 16.16 – 3.5 calls for vibration control & monitoring within 200 feet from pile activity. It does not call out how many monitoring devices that you want used for this.
Do you want one at the Visitors Center, one at the Planters House & one at the Kitchen House? Please acknowledge if this is too many detection devices or if you want other structures monitored (Barn)?
The contractor shall install minimum two (2) monitoring devices, one at Visitor Center and other at Planter's House.
Spec 01 31 00 – 1.9 Permits - Are a Demolition & general building permits going to be required for this project from the city/county or are only the government procured regulatory permits listed in this section going to be required for this project?
Demolition and general building permits from city/county are not required for this project.
C1.4 Temporary Access Road – Is the entire temporary access road going to need to be removed after the project? If not, please specify the areas that can remain after construction is completed.
Yes. The entire temporary access road will need to be removed.
Has a gopher tortoise survey been completed by the government? Are any gopher tortoise burrows expected to be encountered by the contractor during construction?
Yes, please refer to drawing C1.4 for location of gopher tortoise burrows. The contractor will be responsible for obtaining the permit and relocating gopher tortoises as needed for construction.
Section 01 11 00 states that "All material deliveries must be planned on Mondays and Tuesdays". Does this restriction apply strictly to all deliveries (including minor couriers and small tools), or is it intended solely for heavy equipment and bulk material deliveries?
See response to #5. Require coordination with COR for delivery on other days, but generally intended to restrict heavy equipment and bulk material deliveries to days when the park is not open to the public.
Section 01 11 00 mandates that Phase 1, Phase 2, and Phase 3 must be conducted sequentially, with each phase substantially complete before the next begins. Will the National Park Service (NPS) allow for overlapping phases if the contractor utilizes multiple crews to accelerate the schedule?
No. Project should be bid in accordance with 01 11 00. See response to #3 for tree clearing exception.
The demolition plans and wall sections require the contractor to remove, salvage, and reinstall the 2"x6" horizontal facing timbers located above the splash zone. Given the existing wall's age and potential timber degradation, what percentage of the facing boards should bidders assume will need to be replaced with new timber?
Horizontal facing boards at or below splash zone to be demolished and replaced 100%. All boards above splash zone shall be reused except for those are in bad condition.
The typical PVC sheet pile wall section requires core drilling 2-inch holes through the existing PVC sheet piles to accommodate the new tie rods. Because the existing tie rods and concrete deadmen are to be abandoned in place, what is the approved protocol if a new tie rod coring location directly conflicts with the existing buried tie rods or hardware?
Existing tie rods shall be demolished and disposed up to the extent shown in drawing X1.1, X1.2 and X3.1. Core drilling 2" holes are for drainage purpose.
Section 31 41 16.16 prohibits pre-augering, spudding, or the use of water jets during synthetic sheet pile installation. If unanticipated dense soils or obstructions cause pile refusal before reaching the design tip elevation, how will the removal or penetration of these obstructions be compensated?
Refer response to question #11.
Section 31 23 00 designates "Gravel #57" for the gap between the existing and new walls. Can the NPS confirm that standard Florida Department of Transportation (FDOT) #57 stone is the acceptable material for this gravel fill?
Yes, FDOT Gravel #57 is acceptable material for filling the gap between existing and new wall.
Section 01 31 00 lists several government-furnished permits, including an Environmental Resource Permit (ERP) from the St. Johns River Water Management District and a Nationwide 13 permit from the U.S. Army Corps of Engineers. Will the full text of these permits be provided prior to the proposal deadline so contractors can review specific in-water work windows, turbidity monitoring mandates, or specialized marine protection conditions?
NWP 13/54 is provided in the amended solicitation. SJRWMD ERP permit is currently in process with discussions captured in the drawings and specs of this soliciation package. Permit will be shared when available. Appendix C to the specificationsis being developed with natural resource protection requirements and will be provided in the next amendment to this solicitation.
Section 32 93 00 establishes a 730-day (2-year) establishment period for the Spartina alterniflora and Spartina patens plantings. Will the contractor be responsible for all maintenance, watering, and replacement for the full two-year duration, and are there specific bonding requirements to cover this extended period after Substantial Completion?
See requirements of 32 93 00 for maintenance and replacement requirements.
The spartina plantings will be handled as a warranty item, no retainage or additional bonding required.
We respectfully request that the due date be extended to Friday, November 20, 2026, or to 14 calendar days after the amendment issuing Appendix C, whichever is later, with the question deadline reset to 7 days before the new due date. Please also state whether Appendix C will add work windows (nesting season or in-water restrictions), monitoring staff or reporting beyond the NWP conditions.
Appendix C has been included in Amendment 3 for requirements. The deadline will be extended to 11/13/2026 at 17:00 ET. Questions shall be submitted a minimum of 7-days prior to this new due date.
Placing stone with an excavator: S3.1 note 12 calls for hand-placed riprap. May the riprap be set with an excavator along the sheet pile wall, with hand chinking and hand setting against the wall where needed to meet the hand-placement requirement?
The stones may be transported to the location through excavator but needs to be hand installed. The contractor shall coordinate with the Contracting Officer for installation means and method and follow permit conditions. Refer Division 2-49 Section 3.1-B-13 Specification 31 37 16 for Hand Installation. No excavation is permitted infront of the existing wall.
Design quantities: Please provide the design tonnage for riprap and bedding stone and the design excavation cubic yardage so all offerors price on the same basis.
Plan dimension and cross sections for riprap shown in drawing S1.1, S1.2, S1.3 and C3.1. The bidders shall calculate the volume/tonnage based on these details.
Trees in conflict with tie rods and deadmen: The plans call for removal and replacement of one cedar tree, but the drawings show many existing trees directly in line with the new tie rods and deadmen. How will these trees be handled: are they removed only, or removed and replaced? Will a separate CLIN or unit price be provided per tree, or how should offerors budget for an unknown number of trees?
The contractor shall not remove any trees other than a ceder tree to be replaced shown in drawing S1.1. The contractor to inform the Contracting Officer if any tree is present at the deadman or tie rod location. The design will be modified based on the findings. Refer Note 6 & 7 of drawing S1.1 and S1.2. All palm trees to be protected during the contruction.
Aluminum cap vs. timber cap: The pile cap details (S5.1) show a marine-grade aluminum cap and a timber cap. Enlarged, the two appear to interfere. Should the timber cap be cut or notched to fit around the aluminum cap, or is only one of the two required?
Both are required. The timber board to be cut or notched to fit around the aluminum cap.
During the walk thru, we were shown the access road pathway. This is heavily wooded with overgrowth. Will we be allowed to clear this overgrowth thicket? Is there a possibility to remove one of the palm trees since there isn’t 12’ between the trees currently making truck passage difficult? Photo included for clarity.
Clearing of overgrowth is allowed. All palm trees must remain, and clearing to the east may proceed to the required width while ensuring protection of the cedar tree noted on the plans.
The schedule 80, 316 SS sleeves that are called out for the tie rods & thru bolts. Can you please clarify what the required diameter will be for the tie rod sleeves? A ¾” sleeve may not work with the required protective wraps on the tie rods.
The nominal size schedule 80, 316 SS sleeves for 3/4" tie rod shall not be less than 1".
Phase 3 area – will we be allowed to clear the overgrowth, 20’ back from the fall off as needed, so we can have a workable area to install the sheet pile system from the land side? Currently the overgrowth goes all the way to the fall off.
Yes.
Sheet S3.1, S3.2 & previous RFI response calls for 2” holes in existing sheet pile & 3” holes in new sheet pile for drainage. There isn’t any call out for geotextile fabric behind either the sheet pile system to retain the existing soils or new gravel fill. Is there a requirement for geotextile fabric to be installed behind either / or both walls to prevent cave in / erosion of fill materials? If so, please specify which type of geotextile fabric materials will be required.
No geotextiles fabric is required to be installed for 2" existing piles holes.
Stainless steel maintainable weepholes with stainless steel housing and woven geotextiles shall be installed at new sheet pile. Refer Note 7 of Drawing S3.1 and Note 4 of Drawing S3.2.
Can we use ½” diameter, 316 SS threaded rod cut to length with nuts, washers & lock washers for the thru bolt connections instead of hex head bolts? S5.1.
No, the through bolts for extension wall (Section C, Drawing S 5.1) shall be hex bolts type.
There are PVC sleeves on the existing tie rods from the sheet pile wall to the deadmen.
Will there be PVC sleeves required on the new tie rods from the new sheet pile to the new deadmen?
No, please refer question number 10 of Addendum 2 for tie rod protection requirement.
Is the 5 piles per day maximum correct and a firm contract requirement for all PVC and FRP sheet piles, including the deadman?
Refer revised Appendix C document. Installation of synthetic main sheet piles (PVC or FRP) wall by Impact hammer are limited to a maximum10 piles per day.
No limitation for installing of synthetic main sheet piles (PVC or FRP) wall by Vibratory hammer. No limitation for installing deadman wall by Impact or Vibratory hammers.
Does "pile" mean a single sheet, or a pair or panel of interlocked sheets driven together?
Often pile means matched pair.
Pile means single Z profile sheet.
Combined with Section 1.a (sheet pile installation only at low tide with the substrate fully exposed), the 8:00 AM to 5:00 PM Monday through Friday work hours, and no phase overlap, this limit greatly extends the pile driving duration and the overall schedule. Will the Government extend the contract performance period to account for this limit? Has the government scheduled sufficient time?
Refer the revised limitation under response for question number 58.
Does the limit apply to piles set in place by excavators or pushed without a hammer, and to the upland FRP wall and deadman piles installed behind the shoreline that are not in or adjacent to the water? Does the low-tide requirement apply to upland work?
Refer to the revised limitation under response for question number 58 and revised Appendix C. Low tide requirement is limited to work below (waterward) the High Tide line. The limit does not apply to upland works.
Are days lost to tide, weather, or wildlife stop-work (manatee, sea turtle, sawfish within 50 feet) excusable time? Excusable delay with no cost to government.
RFI response 50 indicates one cedar tree is to be removed, while Appendix C section 4.d states approximately three mature red cedars will be removed for the access road.
It is estimated that maximum three (3) ceder trees to be removed at the entrance of the temporary access road to construct the road. This shall be finalize with the Contracting Officer prior to construction of the access road. No palm tree shall be removed to construct the access road. One Ceder tree near to the existing wall (refer Drawing S1.1) to be replaced with minimum 10 years old same species tree.
Gopher tortoise relocation is the contractor's responsibility. May tortoises be relocated on site within the park, and may the FWC permit application be filed before Notice to Proceed?
The gopher tortoise to be relocated within the park. A limited NTP can be provided to start the permit application. All habitat relocation requires prior coordination with Contracting Officer and based on the provisions of Preservation of Natural Features, Section 01 11 00 Item 1.6-E.
Field inspection qualifications (Specifications pp. 80-81 and the STSI report) a. Can a certified technician witness sheet pile installation and material inspections (tie rods, hardware, etc.) instead of the licensed Professional Engineer the specifications call for?
b. What level of certification or license is required for field inspection of the piling installation?
c. May the field inspector work under the direct control and supervision of a licensed PE?
The field inspector required for sheet pile driving operation may work under direct supervision of a licenses PE. License PE shall be available when Contracting Officer (or the representative) at the site and respond all questions.
Production limit of 5 piles per day (Amendment 0003, Appendix C, Section 1.c) Combined, the tide, protected-species, and park work-hour limits will stretch pile driving to roughly 128 workable days, and possibly many more. On many days the crew can work only a few hours, at a different time each day as low tide shifts. Is the Government aware of the cost of keeping the QC Manager, SSHO, Superintendent, pile driving crew, laborers, and PE on site for a few hours a day to install 5 sheets?
Normal production would be about 100 LF per day, so installation could cost about 12 times more than normal. It would also extend disturbance to the park and its visitors from a few weeks to 6-9 months or more, and push the work into hurricane season. A shorter installation period seems better for everyone involved.
Refer to the revised limitation under response for question number 58 and revised Appendix C.
Would the Government consider letting the contractor place the riprap along the shoreline first, as a cofferdam, together with a turbidity curtain? This would contain vibration and sediment to a small area right next to the sheet piles and allow more piles to be installed per day.
Refer to the revised limitation under response for question number 58 and revised Appendix C. Placing riprap prior driving sheet pile wall is not acceptable.
Since installation will take a long time, will the Government pay for materials on hand (stored on site or in a bonded off-site location) per FAR 52.232-5?
Yes, as long as the Contracting Officer can verify the materials either in person or through photos along with the corresponding invoice.
This also came up during the site visit, On sheet S5.1 details A,B,C – it calls for ¾” schedule 80 stainless steel pipe sleeves at the Tie Rods & Through Bolts. Can we use schedule 40 or 80 PVC for these sleeves since the purpose is to prevent the hardware from being in contact with the treated lumber. The PVC material would serve the same purpose & would provide a substantial cost saving to the project. We’d prefer to use schedule 40 PVC if acceptable. Please advise.
Marine grade, UV resistant Schedule 80 PVC pipe sleevs may be used as an alternate to Schedule 80 Stainless Steel pipe sleevs.
SF-1442 block 13.a refers to "Sealed offers in original and 1 copies," while Section L paragraph D.1 states "Proposals shall be submitted via email. Proposals submitted via any means other than email shall not be accepted," paragraph F.1 states "No hard copies shall be submitted," and 52.228-1(a) states that "Failure to furnish a proposal guarantee in the proper form and amount, by the time proposals are due, may be cause for rejection of the proposal." The offeror interprets Section L as governing and intends to transmit with Volume II a PDF of the SF 24 (Attachment 08) executed by the offeror and the surety, with the surety's power of attorney, and no wet-ink original. Does that submission satisfy 52.228-1?
Yes, please submit everything electronically through email.
Amendment 0003 states "The proposal due date is extended to 13 Nov 2026 at 5:00PM EST," and Section L paragraph B states "Pre-proposal questions shall be submitted a minimum of 7-days prior to the due date and time for proposals." Amendment 0004, posted on SAM.gov on October 28, 2026, revises Appendix C §1.c, answers RFIs #52 through #69 and marks the proposal due date as "is not extended." The offeror interprets the responses to these questions on the low-tide restriction, on excusable time for days lost to tide and on the Notice to Proceed as determining the Factor 2 schedule and Volume II pricing. Will the Government extend the proposal due date to not less than 14 calendar days after the date of the amendment that responds to these questions?
Questions remain due on Nov 6, 2026 @ 1700EST. No additional extension will be granted. The proposal due 11/13/2026 @ 1700 EST
Section L Factor 7 item 1 directs offerors to "Direct them to complete and submit the survey to the address and point of contact in paragraph B above," and paragraph B lists joseph_wingfield@ios.doi.gov and marlon_bynum@contractor.nps.gov, while Attachment 06 (as revised by Amendment 0002) directs the questionnaire to "Joseph_wingfield@nps.gov." The offeror interprets both routes as acceptable and will instruct references to send to all three addresses. Will a questionnaire received at any of those three addresses by the due date be considered?
Only send to joseph_wingfield@ios.doi.gov and marlon_bynum@contractor.nps.gov
52.219-14(e)(3) provides that the Contractor "will not pay more than 85 percent of the amount paid by the Government for contract performance, excluding the cost of materials, to subcontractors that are not similarly situated entities," while Attachment 10 computes cell C26 as (C12 − C24)/C12 with no entry for the cost of materials, and Section M paragraph C.3.g states "This worksheet will be reviewed for completeness and correlation to proposed pricing." 13 CFR 125.6(a)(3) states "Cost of materials are excluded and not considered to be subcontracted." The offeror interprets the clause test as excluding the cost of materials from both amounts. May offerors submit with Attachment 10 a supplemental computation that excludes the cost of materials as 52.219-14(e)(3) provides?
Yes exclude the materials.
Section I includes 52.222-55, Minimum Wages for Contractor Workers Under Executive Order 14026 (DEVIATION MAY 2026), requiring "a minimum hourly wage rate of $15.00 per hour beginning January 30, 2022," while Executive Order 14026 was revoked by Executive Order 14236 of March 14, 2025, and Attachment 04 (WD FL20260202) carries only an Executive Order 13658 note. Paragraph (b)(2) of the clause states "The applicable published E.O. minimum wage is incorporated by reference into this contract." The offeror interprets the clause as applying as written unless deleted and will price the last annual rate published under paragraph (b)(2), $17.75 per hour effective January 1, 2025 (89 FR 79644), on classifications listed below that rate. Will the Government confirm by amendment whether 52.222-55 applies to the resulting contract?
The applicable minimum wage requirements are those associated with EO 13658, as identified in Wage Determination FL20260202. The current EO 13658 minimum wage rate is $13.65 per hour, effective May 11, 2026. Offerors should price their proposals accordingly.
Section L Factor 2 states "for evaluation purposes only assume a Notice to Proceed date of 4 January 2027" but states no award date. Section 01 32 16 para. 1.3.C requires the Construction Baseline Schedule "After contract award and before Pre-Construction conference," and Section 01 33 23 para. 1.3.D.1.a requires offerors to "Allow 30 days for initial review of each submittal." The offeror interprets Factor 2 as permitting the schedule to show submittals due after award and their Government reviews before 4 January 2027. What contract award date should offerors assume for the Factor 2 schedule?
For schedule submission assume NTP is 10 days after contract award.
Section 01 31 00 para. 1.4.D lists "Division 1 submittals required prior to mobilization," and Section 01 32 16 paras. 1.3.B and 1.3.C require the Schedule of Values and the Construction Baseline Schedule "After contract award and before Pre-Construction conference," and Section 01 32 16 para. 2.2.A.1 requires the baseline to be developed "so it can be accepted for use no later than 30 days after date established for the Notice of Award." The offeror interprets these as permitting submission between contract award and the Notice to Proceed that starts the 259-calendar-day period so that the 30-day initial review under Section 01 33 23 para. 1.3.D.1.a can run before that period begins. May the Contractor submit the Division 1 submittals after contract award and before the Notice to Proceed that starts the 259-calendar-day period?
Yes, Division 1 submittals should be submitted after contract award and before NTP is issued.
Section 01 31 00 para. 1.7.A lists among the preconstruction conference agenda items "Resolution of comments on required Division 1 documents" (item 4) and "Notice to proceed" (item 14), SF-1442 block 11 requires the Contractor to "complete it within 259 calendar days after receiving" the notice to proceed, and Amendment 0004 RFI #64 states "A limited NTP can be provided to start the permit application." The offeror interprets the Division 1 submittals and their Government review as work that may proceed under a limited Notice to Proceed before the Notice to Proceed that starts the 259-calendar-day period. Will the Government issue a limited Notice to Proceed at contract award for preparation, submission and review of the Division 1 submittals?
If a limited NTP is issued for the permit application then Division 1 submittals can be submitted and reviewed during that time.
SF-1442 block 11 requires the Contractor to "complete it within 259 calendar days after receiving" the notice to proceed, Section H Special Requirement 1 requires completion of "the entire work ready for use not later than 259-calendar days after receipt of notice to proceed," and Amendment 0004 RFI #64 states "A limited NTP can be provided to start the permit application." The offeror interprets a limited Notice to Proceed as authorizing only the work it names, with the 259-calendar-day period measured from the Notice to Proceed for construction. Does a limited Notice to Proceed issued under Amendment 0004 RFI #64 start the 259-calendar-day period in SF-1442 block 11?
No it does not start the actual work time.
Section 01 31 00 para. 1.9.B lists the SJRWMD Environmental Resource Permit 224839- 1, a "401 Water Quality Certification (WQC) with identification number TBD," and the Submerged Land Lease Letter of Consent as Government-furnished permits, and Amendment 0002 RFI #45 states the "SJRWMD ERP permit is currently in process."
Nationwide Permit General Condition 25(b) provides that, where the certifying authority has not previously certified compliance of an NWP with CWA section 401, an activity that may result in a point-source discharge "is not authorized by an NWP until water quality certification is obtained or waived." The offeror interprets work below the high tide line as not authorized until those permits issue. Will the Government withhold the Notice to Proceed that starts the 259-calendar-day period until the ERP, the 401 Water Quality Certification and the Submerged Land Lease Letter of Consent have been issued?
Yes.
Section H Special Requirement 1 requires completion of "the entire work ready for use" within 259 calendar days and states "The time stated for completion shall include final cleanup of the premises," while Section 01 77 00 para. 1.4.B states "If work is determined substantially complete, following final inspection, Contracting Officer will prepare Punch List and issue a Letter of Substantial Completion" and para. 1.4.D states "Contractor shall complete Punch List within 30 calendar days." The offeror interprets the 259-day completion requirement and the 52.211-12 liquidated damages period as measured to the date of Substantial Completion in the Contracting Officer's letter under para. 1.4.B, with the 30-day Punch List period following that date. Is that interpretation correct?
Yes
Section 01 32 16 para. 2.2.B.7.d.3 states "Weather days shall be based on data for local area from a reliable source like the National Oceanic and Atmospheric Administration (NOAA), National Park Service records, or source acceptable to Contracting Officer" and names no station or threshold. The offeror interprets NOAA 1991–2020 climate normals for Jacksonville International Airport (station USW00013889), counting each day with
0.50 inch or more of precipitation as a non-working weather day, as the basis for the Factor 2 schedule and the Weather Calendar. Is that basis acceptable to the Contracting Officer?
Yes
Appendix C §1.a states that sheet pile installation, riprap scour protection and spartina planting "shall only be conducted during low tide conditions when the substrate is fully exposed," Amendment 0004 RFI #61 states "Low tide requirement is limited to work below (waterward) the High Tide line," and Sheet G0.1 Design Criteria note 5 gives project tidal elevations for NOAA "TIDAL STATION ID 872-0186." The offeror interprets the §1.a condition as met at a given work location below the high tide line whenever the water surface is below the substrate elevation at that location, read against station 872- 0186 and the existing grades on Sheets S3.1, S3.2 and C3.1. Is that interpretation correct?
Your interpretation is correct. Low tide work condition requirement only applicable to the works at waterward side of high tide line.
Appendix C §1.a states that sheet pile installation, riprap scour protection and spartina planting "shall only be conducted during low tide conditions when the substrate is fully exposed." Amendment 0004 RFI #62 asked whether days lost to tide, weather or wildlife stop-work are "excusable time," and the Government responded "Excusable delay with no cost to government." The offeror interprets that response as entitling the Contractor to an extension of the contract time, without liquidated damages, for each workday on which the Appendix C §1.a low-tide condition prevents scheduled work below the high tide line. Will the Government extend the contract time for each workday on which the Appendix C §1.a low-tide condition prevents scheduled work below the high tide line?
Yes, at no cost to government
Section 01 11 00 para. 1.12.A states "Geotechnical Engineering Report, prepared by AECOM is available with Appendix A of this package," and Appendix A is an AECOM Draft Submittal dated June 14, 2024; Section 31 23 00 para. 1.2.O lists a "Geotechnical Report by TERRACON, April 2024"; and Sheets C1.5, C6.1 and C6.2 note 1 state "REFER
TO AECOM GEOTECHNICAL REPORT "GEOTECHNICAL ENGINEERING REPORT" DATED
APRIL 14TH 2025." Neither the April 14, 2025 report nor a Terracon report is in the solicitation; Appendix A states that "Terracon Consultants, Inc. from Jacksonville, Florida drilled the borings" in April 2024. The offeror interprets the April 14, 2025 AECOM report as the geotechnical report the drawings rely on. Will the Government issue the April 14, 2025 AECOM Geotechnical Engineering Report by amendment as the report referred to in Section 01 11 00 para. 1.12?
The geotechnical field work was done by Terracon Consultant Inc and engineering report was prepared by the AECOM. The design is based on AECOM Geotechnical Engineering report dated June 14, 2024 as attached with Division 1 Specification under Appendix A.
Section 31 37 16 para. 1.5.C.1 requires the Contractor to "Secure NPS approval of source before mobilization," and para. 1.3.A requires product data including "Material source, gradation curves, test reports, quarry certification." The offeror interprets the specification as permitting the riprap source submittal under para. 1.3.A to be made after contract award and before the Notice to Proceed that starts the 259-calendar-day period. Is that interpretation correct?
The contractor shall submit material source, gradation curve, test reports, quarry certification etc. prior to procurement and site delivery of riprap stones and NOT prior to Contractor's site mobilization after NTP.
Section 31 37 16 para. 1.5.C.1 requires the Contractor to "Secure NPS approval of source before mobilization," while Section 01 31 00 para. 1.4.D, "Division 1 submittals required prior to mobilization," does not list riprap source approval, and riprap is not placed until after Phase 1 pile driving. The offeror interprets para. 1.5.C.1 as requiring source approval before riprap or bedding stone is delivered to the site, not before mobilization. May the Contractor mobilize and begin Phase 1 work before the riprap source is approved, provided no riprap or bedding stone is delivered until NPS approves the source?
Please refer response to question #85.
Section 01 57 19.12 para. 3.1.B.1 limits impact noise at 50 feet to 70 dB(A) for "More than 12 minutes in any hour" and 80 dB(A) for "More than 3 minutes in any hour," para.
3.1.B.2 lists "Pile Drivers" at 95 dB(A) at 50 feet, and Section 31 41 16.16 para. 3.6.B states "Determine appropriate noise limits in accordance with U.S. Occupation Safety and Health Administration guidelines." The offeror interprets the 95 dB(A)-at-50-feet limit in para. 3.1.B.2 as the noise limit that applies to sheet pile driving under Section 31 41 16.16 para. 3.6. Is that interpretation correct?
Yes, the maximum permissible construction equipment noise level for pile drivers shall be 95 dB(A) at 50 feet. The contractor is responsible for properly selecting the means and methods and equipment to work within the noise limits
Section 31 41 16.16 para. 3.2.E.2 states "Use cast steel shoe to prevent damage to the tip of the sheet piling," and para. 1.3.A.2.c lists "Pile Shoe" as an "A" shop drawing. The sheet piles on the drawings are SG 750 PVC and UC-95 FRP sections. The offeror interprets para. 3.2.E.2 as satisfied by the tip protection the sheet pile manufacturer recommends for those sections, submitted under para. 1.3.A.2.c. Is that interpretation correct?
Yes, the interpretation is correct.
Section 31 41 16.16 para. 3.5.B states "The vibration during the pile driving activities must be limited to a peak particle velocity American Association of State Highway and Transportation Officials (AASHTO) guidelines" without stating a value, and Amendment 0002 RFI #35 requires monitors "one at Visitor Center and other at Planter's House."
What peak particle velocity limit, in inches per second, will be enforced at each of the two monitors?
The peak particle velocity limit of 0.1 inches/second to be enforced as specified in AASHTO for Historical Site or Other Critical Location.
Section 31 41 16.16 para. 3.2.J requires an as-driven survey after each pile group and states "Do not proceed with placing other attachments until the Contracting Officer has reviewed the survey," para. 1.3.A.2.b lists the As-Driven Survey as an "A" submittal, Section 01 33 23 para. 1.3.D.1.a states "Allow 30 days for initial review of each submittal," and para. 3.2.D states "Partial submittals are not acceptable." The offeror interprets each pile-group as-driven survey as a complete submittal that the Contracting Officer will review within 5 calendar days so that wales, caps and tie rods (Sheet S3.1 step 7; Sheet S3.2 step 2) may proceed. Within how many calendar days of submittal will the Contracting Officer complete review of each as-driven survey?
Allow 5 working days for review each pile group as-driven survey by the Contracting Officer.
Appendix C §4 states "Species that require specific attention along with measures for their protection shall be listed in the Contractor's Environmental Protection Plan prior to the beginning of construction operation." No Environmental Protection Plan appears in the Division 1 submittals required prior to mobilization in Section 01 31 00 para. 1.4.D or in the action and informational submittal lists in Section 01 33 23 paras. 2.1 and 2.2.
The offeror interprets the Environmental Protection Plan as an action submittal to be approved before mobilization with the Division 1 submittals.
