About this file
This document is an Amendment of Solicitation (Standard Form 30) for a construction project located in Nevada and California on federal lands. The amendment (0002) provides detailed answers to 15 contractor questions about the DEVA Construction Project, covering past performance submission requirements, project scope, and submission guidelines.
Key details include: the project involves roadway excavation, embankment, and work in sensitive habitats; contractors must use bio-based fluids for equipment; past performance narratives have no minimum or maximum number of projects, but more recent projects (within last 12 years) will be considered more relevant; projects with significant roadway excavation, work in national parks, and limited staging areas will be viewed more favorably. The proposal due date has been extended to February 4, 2026, at 9:00am Mountain Time, with the last day for questions being January 28, 2026. Contractor licenses from any state are acceptable for this contract.

THE PURPOSE OF AMENDMENT 00002 IS TO ANSWER
QUESTIONS FOR DEVA CONSTRUCTION PROJECT.
QUESTION 1: Could you please provide clarification on the exact number needed?
ANSWER 1: There is no minimum or maximum number of past performance narratives. Past performance narratives for projects that are of similar scope and are more recent will be considered more relevant.
QUESTION 2: Firstly, could you please clarify the cut-off date for the completion of past performance? Specifically, how many years after the completion is considered acceptable?
ANSWER 2: There is no cut-off date for projects described in past performance narratives.
Projects that are more recent will be considered more relevant, however.
QUESTION 3: Secondly, concerning the similar scope and magnitude of projects, is the expected range of $5-10 million a strict requirement, or would any amount exceeding this range also be considered sufficient?
ANSWER 3: The magnitude listed is what the expected range the Government has deemed this project. It's up to the market and the contractor to provide their pricing and then the government evaluates determing fair and reasonable pricing. The government can't tell a contractor how much to propose or what is considered sufficient.
QUESTION 4: Please confirm if there is a required number of projects that must be submitted under Factor 2?
ANSWER 4: There is no minimum number of projects that must be submitted under Factor
2.
QUESTION 5: Please confirm whether contractors will be rated more favorably for submitting more projects under Factor 2.

ANSWER 5: More projects may lead to a more favorable evaluation if projects are of similar scope and are relatively recent (from the last
12 years).
QUESTION 6: Please confirm if there is a requirement regarding when projects submitted under Factor 2 must have been completed.
ANSWER 6: There is no requirement regarding time of project completion. Projects that are relatively recent (from the last 12 years) will be considered more relevant.
QUESTION 7: Please confirm whether projects that are currently underway will be considered relevant under Factor 2.
ANSWER 7: Projects that are currently underway will be considered relevant.
QUESTION 8: As projects that are more relevant to the requirements of this solicitation will be given more weight in the overall past performance rating, please provide the specific evaluation factors the Government will use to determine relevancy of projects under Factor
2.
ANSWER 8: Projects including the following elements will be considered more relevant: (a) significant amounts of roadway excavation, embankment, riprap, or rock excavation; (b) performed in sensitive habitats or in national park or similar settings; (c) project sites with limited space for staging and equipment access.
QUESTION 9: Please confirm whether Final CPARS evaluations may be submitted in lieu of obtaining new Past Performance Questionnaires.
ANSWER 9: No, final CPARS evaluations may not be submitted in lieu of obtaining new Past
Performance Questionnaires. The government pulls CPARS regardless.

QUESTION 10: Please confirm whether previously completed Past Performance Questionnaires may be submitted in lieu of obtaining new Past
Performance Questionnaires.
ANSWER 10: No, previously completed Past
Performance Questionnaires may not be submitted in lieu of obtaining new Past Performance
Questionnaires.
QUESTION 11: Is construction equipment utilized by the PRIME to complete this project need to be converted to bio-based fluids per the following contract language: 52.223-1
BIOBASED PRODUCT CERTIFICATION MAY 2024
(DEVIATION FEB 2025) AND 52.223-2 REPORTING OF
BIOBASED PRODUCTS UNDER SERVICE AND
CONSTRUCTION CONTRACTS (MAY 2024) (DEVIATION
FEB 2025)
ANSWER 11: Yes, the prime is required to utilize all fluids to be bio based for the use of government work on site.
QUESTION 12: On Volume I, Technical Ability and past performance, is there a page limit, font size, project limitation. Can we use CPARS instead of past performance questionnaire.
ANSWER 12: No, you must use the past performance questionnaire. The government already pulls CPARS aside from the questionnaire.
QUESTION 13: On Volume II, Section K, there are several boxes that are marked in BLUE
Highlight. Does that mean anything, as in do we need to address those boxes specifically, etc.?
ANSWER 13: Yes, if they are applicable to you, you must mark the boxes.
QUESTION 14: In general, Contractors are not required to have state licenses to perform work on federal property. NPS policy generally requires contractors to hold relevant state licenses to meet safety and quality standards.

This project is located in both Nevada and
California, entirely on federal lands.
Requiring Contractors to hold both Nevada and
California licenses would unnecessarily restrict the pool of bidding Contractors and would provide no benefit to the government, as holding a license in either state would demonstrate adherence to safety and quality standards. Please confirm that it is acceptable for Contractors to hold either a
California or Nevada business license of the appropriate category in order to be eligible for award of this Contract.
ANSWER 14: Contractor licenses from any state are acceptable.
QUESTION 15: Can the proposal due date be extended due to the site visit change?
ANSWER 15: Yes, the last day for questions is
Wednesday January 28, 2026, no later than 9am
Mountain Time. The proposal due date is hereby extended to Wednesday February 4, 2026, no later than 9:00am Mountain Time via email.
