About this file

This document contains responses to questions from offerors on Solicitation Number 140P2023R0011 to replace shoreline barriers at two locations within American Memorial Park on Saipan. The solicitation is to procure construction services for replacing existing shoreline barriers that are damaged. Offerors sought clarification on using alternative materials to armor rock due to lack of availability on the island. The responses indicate that while alternative materials may be considered post-award, offerors must still provide pricing for the armored stone as specified and any pricing for alternates should be in addition. Offerors also requested an extension for proposal submission due to upcoming holidays and to allow time to investigate material availability, to which an extension was granted with the new deadline stated in the latest amendment. UXO monitoring during construction is included in the contractor's scope of work, though a separate UXO contractor will need to be hired by the successful offeror to perform this task.

140P2023R0011 - Responses to Questions thru 12/18/2022

No. Question Response Amendment

Sourcing out of rock materials from various supplier in Saipan has been extremely difficult with Top layer of ,2000lbs ClassⅠ&4450 lbs Class Ⅲ, amor rock materials. There is no guaranty that both class(Ⅰ& Ⅲ) armor rocks can be supplied. Quarry operator is hesitant to provide quote nor guaranty that they can mine the armor rocks. The risk is too high for pricing and delays. On this respect we proposed artificial blocks for top layer material.

The contractor is responsible for obtaining pricing and materials to complete the project as specified.

2 For the armor rock, we would like to propose a 2 ton concrete artificial blocks Pricing for any alternates will only be accepted in addition to pricing for the solicited scope (i.e. the offeror must provide pricing for the armored stone prior to proposing any alternate armoring structures.)

Please provide the following information or clarification: Can we request to make variance for ARMOUR Rock. Saipan have no big ARMOUR Rock right now that comply the design requirement, can we request to use concrete precast in lieu with ARMOUR ROCK?

The contractor is responsible for obtaining pricing and materials to complete the project as specified.

Please provide the following information or clarification: Can we request for Bid extension of 2 week due to upcoming holidays and time check materials available in island to comply requirement in case RFI no. 01 will not granted

An extension has been granted. Please refer to the latest amendment for the current proposal submission deadline.

5 Will bids for alternative materials, other than specified, be considered?

Alternative materials may be considered post-award in accordance with specification sections 01 33 23 and 01 67 00. See previous responses in regards to alternate bids. 2

Is this solicitation under Executive Order 14026 and that wage rate for this project is $15.00/hr for all workers?

On September 30, 2022, the Department of Labor published a notice in the Federal Register announcing that, beginning January 1, 2023, the Executive Order 14026 minimum wage rate will increase to $16.20 per hour (Minimum Wage for Federal Contracts Covered by Executive Order 14026, Notice of Rate Change in Effect as of January 1, 2023).

This Executive Order minimum wage generally applies to workers performing work on or in connection with federal contracts that are entered into, renewed, or extended (pursuant to an option or otherwise) on or after January 30, 2022, in the following four categories:

* Procurement contracts for construction covered by the DBA;

* Service contracts covered by the SCA;

* Concessions contracts, including any concessions contract excluded from the SCA by the Department’s regulations at 29 CFR 4.133(b); and

* Contracts in connection with federal property or lands and related to offering services for federal employees, their dependents, or the general public.[1]

Does the contractor's SOW include UXO Monitoring? Attachment 4 describes Relyant Global to provide UXO Services, pls advise if they will be assisting the contractor during construction phase.

UXO Monitoring during excavation is part of the contractor’s scope of work as indicated in Specification Section 02 24 24. The contractor will need to hire a UXO Contractor for that work. Relyant Global was used to perform a UXO sweep of the site and UXO Monitoring during geotechnical investigation and the archaeological trenching.
